The Girl Guides also visit the Uitenhage SPCA on a monthly ba- sis to walk the dogs and play with the kittens. Many girls are not al- lowed to own an animal at home and thus they enjoy the interact- tion with the animals. “The collection of the food and the funds raised are just another way that we can help the animals. We will repeat this event again. Verbal agreements between familymembers often create problematicsituations with regard to livingarrangements.
A reader writes that, a few yearsago, her son and his wife suggestedthat their double garage be con-verted into a flatlet for her and herpartner. Part of this arrangementincluded that a new double garagebe constructed on the property.
The financing for these altera-tions was provided by the readerwho raised a bond on another erfshe owns.
She also agreed to pay themonthly electricity charges in re-spect of the whole property, not on-ly the flat, while her son anddaughter-in-law would take care ofthe rates and garden services.
Unfortunately, four years later,the reader’s son and his wife got di-vorced. He moved out and his ex-wife remains on the property withhis mother.
Our reader’s concerns relate towhether her son’s ex-wife can evict
her from the property without re-funding her for the improvementsmade at her own expense.
Her former daughter-in-lawrefuses to reduce the agreementbetween them to writing and thereader is concerned what the effectwill be on her rights, particularlywhen she reaches retirement age.
There are two aspects that needto be considered says Rian du Toitfrom DTS Attorneys in NelsonMandela Bay.
“Firstly, the right to live on thesaid property and, secondly, theimprovements on someone else’sproperty paid for by the reader.”
In the absence of the right to liveon the property being registeredagainst the title deed, which it doesnot appear was the case here, itsimply remains a personal right,says Du Toit.
Should the owner of the proper-ty commence with eviction pro-ceedings, Du Toit says the terms ofthe agreement may be used as adefence.
“The oral nature of the agree-ment doesn’t make it any less bind-ing, it is simply more difficult toprove its terms.”
According to Charlotte Ver-maak from Chas Everitt in the met-ro, there are a few importantaspects to highlight as far asimprovements to the property areconcerned.
“In this instance, it is clear thatthe owner of the property consent-ed to the improvements that weremade and these almost certainlyincreased the value of the proper-ty.”
In the event of the reader beingsuccessfully evicted, for whateverreason, Vermaak says she certain-ly has grounds for compensation.
“It is clear that there is a basisfor a claim against the owner, who-ever that may be, founded on theimprovements made to the proper-ty.”
