Like everything else, illegal contractors have become ‘hi-tech’ in their pursuit of unlicensed work. Consumers looking for deals online may find sorting the ‘good’ guys from among the unlicensed criminals will take more than a quick ‘search.’ While consumers may get a low price, the people they bring into their homes may not be worth the cost…

According to the CSLB, nearly 100 people may face criminal charges after being caught in 14 simultaneous statewide undercover sting operations conducted in mid-July. Among those arrested during the Contractor’s Board “Summer California Blitz” were 11 repeat offenders, four sex offenders, four suspects with active arrest warrants, four suspects on probation, two former CSLB licensees, and a woman who received widespread media attention last year as a so-called “Sweetheart Swindler.”

According to CSLB Registrar Steve Sands, “It’s particularly disturbing how many of the suspects we targeted turned out to be convicted criminals, many with a history of violent crimes and drugs”.

Investigators from Board’s Statewide Investigative Fraud Team (SWIFT) partnered with a variety of local law enforcement agencies to conduct the operations at homes in Apple Valley (San Bernardino County), Artesia (Los Angeles County), Atascadero (San Luis Obispo

County), Bakersfield (Kern County), Corona (Riverside County), Los Banos (Merced County), Rocklin (Placer County), and South Lake Tahoe (El Dorado County).

The SWIFT program is active year-round and has stopped a number of illegal operators looking to skirt the law. Properly licensed contractors are adversely impacted because these same unlicensed individuals likely do not pay employment taxes, carry no Worker’s Comp insurance and give the construction industry a bad rap.

The CSLB also stated most of those caught this week were identified through “illegal ads they posted on craigslist.org”. Blitz totals may increase as some suspects are expected to provide their bids to undercover investigators via email or fax at a later date.

Also, The CSLB recently released a consumer alert to warn homeowners about deceptive home improvement offers, particularly in relation to the HVAC industry. Recently there have been a significant number of complaints with regards to contractors using illegal tactics to up-sell unneeded equipment and services. “Many of the complaints CSLB is receiving are from older adults who are falling victim to unscrupulous operators who make promises of low-cost equipment services over the phone, only to have onsite technicians make false statements that

persuade them to increase their purchase.”

The CSLB is taking action to put a stop to these dishonest individuals by hosting conferences and educational HVAC workshops to remind contractors about California’s service and repair contract laws and requirements. They have also partnered with local District Attorneys, the Better Business Bureau, and HVAC industry leaders to identify the individuals who are damaging their reputation.

CSLB asks that homeowners be wary about low cost home improvement offers that may not be what they seem. Property owners should always ask for a license number, check the number on the CSLB’s website to make sure the license is in good standing, get a second opinion from a different licensed contractor, and talk to your utility company to verify the accuracy of the costs of the offer.

The Legislature is set to return for the final

month of their two-year session starting

Monday, August 4th. As I discussed in last

week’s update, it is the most stressful time

of the year at the Capitol because ‘gut and

amends’ of benign bills becomes a continual

fear. So for example, a measure that I wasn’t

even tracking suddenly ‘morphs’ into a ‘bad

bill’ that was killed earlier in the session, but

suddenly is moving once again as another

bill number! How can ‘they’ do that? Rule

waivers! Indeed, ‘anything’ can be done if you

receive a rule waiver.

So, based upon what is known as of today,

July 31st, following are the most important

bills I will be working over this month. All

of these bills are set for hearing in Senate

Appropriations next Monday, August 4th:

AB 52 (Gatto) – Would allow Indian Tribes to

challenge virtually any proposed construction

project contending that it is a sacred site or

other designation, even if it is not within their

current tribal boundaries. This measure, if it

were to pass, could make the current CEQA

process seem like a ‘walk in the park!’

AB 2188 (Muratsuchi) - Requires cities and

counties to adopt an ordinance

streamlining the permit process for small

rooftop solar energy systems. Unfortunately,

the streamlining would be at the expense of

virtually every other type of construction

permit which could result in lengthy delays

for other types of permits and approvals. This

measure was recently amended removing

the mandatory 5 day turnaround; however,

even with this amendment, it appears that

the League of California Cities and most

construction groups still oppose this measure.

AB 1522 (Gonzalez) - Would enact the Healthy

Workplaces, Healthy Families Act of 2014 to

provide that an employee who on or after July

1, 2015, works in California for 7 or more days

in a calendar year is entitled to paid sick days,

to be accrued at a rate of no less than one hour

for every 30 hours worked. An employee would

be entitled to use accrued sick days beginning

on the 90th calendar day of employment.

AB 1650 (Jones-Sawyer) - This bill would

require any person submitting a bid to the state

on a contract involving onsite construction-

related services to certify that the person does

not ask an applicant for onsite construction-

related employment to disclose orally or in

writing information concerning the conviction

history of the applicant on or at the time of an

initial employment application. This bill would

not apply to a position for which the person

or the state is otherwise required by state or

federal law to conduct a conviction history

background check or to any contract position

with a criminal justice agency.

AB 1723 Nazarian D Employees:

wages. – Current law authorizes the Labor

Commissioner to recover liquidated damages

for an employee who brings a complaint

alleging payment of less than the minimum

wage fixed by an order of the commission or

by statute. This bill would expand that penalty,

restitution, and liquidated damages provision

for a citation to also subject the employer to

payment of any applicable penalties for the

willful failure to timely pay wages of a resigned

or discharged employee.

AB 1897 Hernández, Roger D- Labor

contracting: client liability –

Recently amended to not affect business

entities with a workforce of less than 25

workers including those hired through a temp

agency unless they are supplying more than

5 workers at one time, it would require a

employer to share with a temp agency all civil

legal responsibility and civil liability for the

payment of wages, the obligation to provide

a safe working environment and workers

compensation coverage.

AB 2271 Calderon, Ian D - Employment:

discrimination: status as unemployed -

Would make it unlawful, unless based on

a bona fide occupational qualification or

any other provision of law, for an employer,

an employment agency, or a person who

operates an Internet Web site for posting

jobs in this state to publish an advertisement

or announcement for any job that includes

provisions pertaining to an individual’s current

employment or employment status.

AB 2416 Stone D - Liens: laborers and

employees -

This bill would allow an employee to record

and enforce a wage lien against all of his

employer’s real property for failure to pay any

wages and other compensation, penalties, and

interest owed to the employee. Amendments

were recently taken that state if a court or the

SB 315 Lieu D - Contractors’ License

Board Enforcement Capabilities – Would

allow the CSLB’s enforcement staff when

participating in a joint strike operation against

the underground economy to enter any place of

business that has labor present.

SB 785 (Wolk) - This bill repeals existing law

authorizing state and local agencies to use the

design/build procurement process, and enacts

uniform provisions authorizing this process for

specified public works projects costing more

than $1 million. This bill does not include

projects on the state highway system or school

construction projects.

SB 1077 DeSaulnier D Vehicles: mileage-

based fee pilot program – Assembly Trans

June 23

Would establish a Mileage-Based Fee (MBF)

Task Force within the California Transportation

Commission. The bill would require the task

force to study MBF alternatives to the gas

tax and to make recommendations to the

Department of Transportation and the

commission on the design of a pilot program.

SB 1159 (Lara) - This bill allows applicants

or licensees to provide an individual’s taxpayer

identification number (ITIN) in lieu of a

SSN to a licensing board. This bill resolves

inconsistencies throughout the code and

provides additional identification options to

applicants and licensees, thereby increasing

access to California professional licenses to

immigrants according to the author.

Delaying Fuel Cost Piece of Greenhouse Gases Law Pits Blue Collar vs. Progressive Elites

One of the most high profile bills in the

legislative session that resumes next week just

got pushed into the center of the spotlight. AB

69, the measure to delay applying cap-and-

trade regulations to transportation fuels, drew

the attention of hedge fund billionaire Tom

Steyer who pledged “to spend what it takes” to

see that the greenhouse gases reduction law is

implemented according to schedule.

If AB 69 does not move forward, beginning in

January, the cap-and-trade provisions of AB

32, the California Global Warming Solutions

Act, will cover motor vehicle fuels. Estimates

range from a 15-cent to 70-cent increase in

the cost of a gallon of gas if vehicle fuels are

included.

Steyer’s move puts him at odds with some

California Democrats who are concerned that

their constituents and the economy will suffer

with increased fuel costs.

AB 69 is authored by Henry Perea (D-Fresno),

one of 16 Democrats who signed a letter to the

Air Resources Board in June urging delay in

the expansion of the cap-and-trade program.

Perea’s bill would put off the implementation of

the cap-and-trade rules on fuel for three years

until January 2018 to allow time for businesses

and individuals to prepare for the new rules.

In a recent Public Policy Institute poll,

respondents were inclined to support the idea

of oil companies producing fuels with lower

emissions (76% Yes), but that support dropped

dramatically (39% Yes) when the respondents

were informed it means an increase of the gas

prices at the pump.

Steyer’s money supports environmentalists

who want no changes to the timetable and

also bucks up other Democrats who oppose

any delay to the law’s implementation. Perea’s

measure is an urgency bill, meaning it would

take effect immediately if signed by the

governor, however, urgency measures need a

two-thirds vote in the legislature to pass.

To counter the message sent to the Air

Resources Board by their colleagues, 32

Democrats signed a letter to the governor

asking that the cap-and-trade provisions on

fuels go into effect in January as scheduled.

The cap-and-trade law is already bringing in

millions in revenue, money spent in this year’s

budget on high-speed-rail, affordable housing

and mass transit. Legislators would have more

money to spend if the cap-and-trade law is

expanded to fuels.

This battle is shaping up as a classic case of

progressive elites versus blue collar workers,

both generally considered groups loyal to

the Democratic Party. It puts Democratic

legislators on the spot. Do they support the

agenda of environmentalists or the workers

who could suffer if fuel costs increases provide

a shock to the economic system and to the

workers’ wallets?

To be clear, the Democrats who advocate for

the delay, as well as many members of the

business community lead by the California

Chamber of Commerce, support the goals of

AB 32. This battle is over implementation of

the law and the costs associated with it.

But it goes deeper than that – it is schism

within the dominant, ruling party in California

and the interests they claim to represent.

Personal protective equipment check:

• Eye protection - clean safety glasses and face shield.

• Hearing protection for noisy machines and operations.

• Hand protection - leather work gloves. • Use proper respirator when using cutting

fluids.

Work area safety check:

• Sufficient lighting. • Not in traffic area. • No slip or trip hazards.

Pre-use safety check:

• Ensure that bench or floor-mounted tool is securely mounted. • Ensure electrical cords are grounded. • Check switch is not damaged. • Check to ensure there are no exposed wires. • Ensure that cords are free from work area. • Make sure all guards are in place and properly adjusted. • Check that wheels are rated for higher speed than machine RPM. • Check that equipment is securely mounted. • Ensure that grinder tool rest gap to wheel is no larger than 1/8 inch. • Conduct "ring" test for all new stones - ensure no cracks, breaks or chips.

Operation safety:

• Use tool rest - no free hand operations. • Dress wheels as needed to prevent buildup and over-heating. • Stand aside from wheel when starting grinder. • Keep hair, sleeves and jewelry out of work area. • Replace wheel when you cannot adjust tool rest gap to proper opening size.

SEEKING ESTIMATING ADMINISTRATOR

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.

Physical Presence: Regular and predictable physical presence in the corporate office is an essential qualification for this position due to the

importance of the team-related aspects of the essential duties, the aggres-sive timeframes under which the employee will operate, and the need for face-to-face interaction with employees in Estimating and Operations in order to properly perform job-related functions.

SUPERVISORY RESPONSIBILITIES: This position has no supervi-sory responsibilities.

SEEKING ESTIMATOR IN COMMERCIAL ROOFING

Wedge Roofing, Inc. is currently looking for an Estimator in the Commercial Roofing Market for the San Francisco Bay Area. Experienced Estimator who is capable of performing hard bid and conceptual estimates in both private and public

work markets. They must be able to manage multiple estimates at one time along with some minor project management.

This person will need to have the ability to work with plans & drawings, clients, consultants, subcontractors and municipali-

ties. This position will be expected to work in both a team atmosphere and function autonomously at various times. Local

SEEKING CONTRACT ADMINISTRATOR IN

ESTIMATING DEPARTMENT

Ghilotti Bros., Inc. is seeking a Contract Administrator in our Estimating Department. This position reports to the Vice

President of Estimating.

Some duties may include: processing/reviewing Owner and subcontractor contracts, insurance and bonding; maintaining

appropriate public agency business licenses; initiating and completing job folder; maintain jobs in progress log;

processing change orders; tracking owner and subcontractor final pay estimate timeline; coordinating final contract closeout documentation. Annual salary depends on experience. Become
