Governor Sworn-In for Record Fourth and Final TermAs he was sworn in for a record fourth term,

Gov. Jerry Brown charted an ambitious

new goal on Monday for California in its

fight against climate change, challenging

the nation’s most populous state to increase

renewable energy use to 50 percent in the

next 15 years.

Brown, a Democrat, specifically called for

the state to increase renewable electricity

sources, reduce petroleum use in vehicles,

double the energy efficiency of existing

buildings and make heating fuels cleaner by

2030.

California already is known as a leader in far-

reaching environmental laws, but Brown said

existing efforts were not enough.

The current state goal calls for 33 percent of

energy use to come from renewable sources

by 2020. As of last year, nearly 25 percent

of California’s retail electricity came from

renewable energy, not including large dams,

the state energy commission said.

Brown called for state employees to help

start prefunding retiree health obligations.

He also urged Republicans and Democrats

to tackle the state’s infrastructure needs and

implement education, health care and public

safety reforms.

Governor Releases $164.7 Billion Budget Proposal

Four days after taking the oath of office for

the fourth time, Gov. Jerry Brown released

his $164.7-billion budget proposal this

morning in the Capitol.

The proposal includes $113.3 billion in

general fund spending, plus $45.5 billion

from dedicated funds and $5.9 billion from

bonds.

There’s good news for public education, and

Brown’s proposal includes a $2.5-billion

funding increase for schools and community

colleges, the result of higher-than-expected

tax revenue.

However, the spending blueprint is likely

to continue a standoff over tuition at the

University of California. The proposal

does not include an extra $100 million that

university leaders say is necessary to avoid a

tuition hike.

Instead, Brown includes his original offer of a

$120-million bump, and only if student prices

don’t increase.

Although revenue has been stronger than

expected, California is wrestling with the

increased cost of providing healthcare to the

poor. Medi-Cal enrollment has jumped 50%

in recent years, and the program is expected

to cover one-third of the state’s population.

California is also facing higher costs for

providing healthcare to retired state workers,

one of the state’s long-festering financial

problems. Officials estimated the bill at $71.8

billion last year.

Brown previously said he would ask state

workers to chip in more for the benefit, but he

hasn’t provided more specifics yet.

Three Former California Governors Write - Too few jobs, too much poverty

CALIFORNIA’S WOUNDED economy

needs serious intervention from

policymakers, businesses and educators

equally committed to restoring jobs and

ending poverty.

During the last year, we’ve been reminded

how unsettling the prognosis is if we don’t act

swiftly and with purpose.

Even the more promising headlines — such

as employment levels returning to and

approaching pre-recession levels — are

tempered with a harsher subtext. Good-

quality jobs are being replaced by those

that don’t pay well and require only limited

education or experience.

Recent reports from Southern California’s top

economists indicate just how formidable our

challenges are, especially in this part of the

state.

In Los Angeles County, two-thirds of

projected job openings over the next five

years will come from occupations that require

a high school diploma or less and little to

no work experience. Although needed to

accommodate low-skilled workers, these

jobs do not offer a path to the middle class.

For instance, the three fastest-growing job

categories in the county — cashiers, retail

salespeople and waiters/waitresses — pay

an average of about $20,000 annually. This

continues a disturbing trend that has seen

inflation-adjusted median household income

in L.A. County drop to $54,529 in 2013 from

an equivalent of $61,544 in1990.

In Orange County, despite a 90% chance of

employment totals returning to pre-recession

levels sometime in 2015, the growth is

concentrated in low-wage jobs.

A similar story is playing out in the Inland

Empire, where the manufacturing sector has

added just 267 net manufacturing jobs during

the last two “recovery” years, according to

economist John Husing. Since1990, inflation-

adjusted median income has dropped more

than 9% there.

Not surprisingly, the number of people below

the poverty line in Southern California

jumped to 3.2 million in 2012 from fewer

than 1.9 million in 1990, with 1 in 4 children

now living in poverty — an unacceptable

statistic under any circumstances.

This summer, the Southern California Assn.

of Governments, in partnership with the

Southern California Leadership Council,

gathered stakeholders from throughout the

region to address economic challenges and

the poverty crisis, and to discuss possible

solutions.

Those discussions led to a multi-layered

Regional Action Plan on Poverty that was

unveiled at the Economic Recovery and

Job Creation Summit, hosted in December

by SCAG and the leadership council.

The plan includes a heavy emphasis on

workforce development and teaching

students marketable skills, such as those

required to build needed transportation and

infrastructure projects. In coming years, tens

of thousands of such jobs could be created

as a result of hundreds of billions of dollars

in infrastructure investment identified by

SCAG. This investment can produce a

bonanza of good-paying jobs.

But the plan will have only limited success

without desperately needed regulatory

reform. California takes longer than 45 other

states, on average, to get a construction

project approved. According to Caltrans, for

example, it now takes an average of 17 years

to complete a major transportation project.

California must undertake serious regulatory

reform, starting with the job-killing delays

caused by the California Environmental

Quality Act, if we are to deliver important



building and infrastructure projects — and

the jobs they could produce — as quickly as

needed to accelerate our economic recovery.

To prevent the Legislature from producing

even more delay, there should be a five-year

moratorium in Sacramento on the enactment

of any laws that are more likely to reduce

jobs than create jobs. By punching the pause

button and rethinking what must be done

to generate the jobs needed to stoke the

economy, the Legislature can best help move

Californians out of poverty and into jobs.

And we must fix the skills gap that also

encourages employers to look outside the

region. Time after time, we hear of good-

paying jobs going unfilled because of a

lack of qualified candidates. This would

include jobs in technology, manufacturing

and healthcare. We need to redouble

efforts to develop effective pathways

from schools to workforce training to

meaningful employment opportunities,

through partnerships, apprenticeships and

real coordination between the education

community and businesses.

More broadly, schools and employers need

to get on the same page so that young people

have the best chance to succeed when they

leave high school. Community colleges and

universities can play a significant role in this

as well — again, by aligning what they teach

with the changing real-world needs and job

opportunities that exist. The Regional Action

Plan includes specific steps for doing this.

As former governors, we believe in

California, but California must help itself.

Business, education and government each

needs to do its share to restore economic

vitality and reduce the high poverty that costs

everyone.

This isn’t someone else’s problem. It’s ours

to fix.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Happy New Year readers! We begin the new

calendar of weekly Q&A with important

news from the CSLB. The Contractors

State License Board has appointed Cindi

Christenson as its new Registrar of

Contractors.

Although the CSLB conducted a nationwide

executive search, they did not have to look

far for the most qualified candidate. Ms.

Christenson had served as the Board’s Chief

Deputy Registrar for 5 years and, before

joining CSLB, was the Executive Officer for

the California Board of Professional Engineers

and Land Surveyors from 1996 to 2009. She

also was that organization’s Senior Engineering

Registrar for 8 years and worked with the state

Department of Water Resources as an Associate

Mechanical Engineer from 1981 to 1988.

According to CSLB Chairman, David Dias,

“We are pleased and confident with our decision

to promote Cindi Christenson who, as a 33-

year career state executive, has successfully

demonstrated her fiscal, policy, regulation,

legislative, and operational management

abilities.” Dias went on to say, “She also will

have the distinction of serving as CSLB’s first

female Registrar of Contractors, among the

known 15 executives who have served in this

position since 1929.”

Ms. Christenson will take over for Steve

Sands who retired after serving as Registrar

for well over a decade. “My knowledge

and appreciation for our state’s construction

industry has grown under Steve Sands’

leadership,” said Christenson. “We will

continue to meet our consumer protection

mission, and serve as a strong industry partner

in our efforts to curb the underground economy

and establish more streamlined processes for

state licensure.”

According to industry expert David Kalb, now

an industry expert witness and the prior owner

of Capitol Services, “I’ve worked with six

Registrar of Contractors during the previous

35 years, and believe Cindi will do an excellent

job as the Board’s new Executive Officer.” He

added, “This is the first time in memory, that

the Board has selected someone from within to

serve as Registrar and this continuity will serve

the Board and construction industry well.”

Michael Brown, a former CSLB employee

and current licensing expert consultant, who

worked under several Registrars as Chief of the

Licensing and Legislative Divisions, had the

highest of praise for outgoing Registrar Steve

Sands and firmly believes that, in his words:

“Cindi Christenson is exceedingly qualified to

assume the role of Registrar. Her consummate

intellect and the breadth of her management

experience will continue to provide the CSLB

with solid guidance in the coming years.”

Ms. Christenson earned her Bachelor of

Science degree in Mechanical Engineering

from California Polytechnic State University,

San Luis Obispo and is a licensed Mechanical

Engineer. She began serving as Registrar of the

Board on New Year’s Day.

New California Employment Laws for 2015

Below are summaries of some of the most important new employ-

ment laws that Governor Brown signed into law this year. Each of

the summaries is brief, focusing on the gist of the bill, while some

of the bills have additional provisions that are not mentioned. Links

are provided to the full text of each of the bills for those wanting to

know in detail the provisions of the new law.

Employers are encouraged to review these laws with manage-

ment and supervisors to ensure that existing policies and em-

ployee handbooks are updated to comply with the new laws. As

always, we are available answer any questions on how these new

laws may impact your businesses individually.

Sick Leave

Mandatory Paid Sick Leave (AB 1522)

Beginning on July 1, 2015, the Healthy Workplaces, Healthy Fami-

lies Act will require that all California employers allow employees

who work 30 or more days within a calendar year to accrue paid

sick leave. Employees must be allowed to use paid sick leave

after 90 days following the first day of work. There is no exemp-

tion for small employers. Further, this statute applies to all

employees, including exempt, non-exempt, temporary, sea-

sonal, and part-time employees. There are very limited excep-

tions for employees covered by collective bargaining agreements

that meet certain conditions, employees that provide in-home

support care, and certain employees of air carriers.

Sick pay must be accrued at the rate of no less than 1 hour of sick

leave for every 30 hours worked. Alternatively, to avoid the burden

of tracking hours, employers may choose to offer paid sick leave

in a lump sum (e.g., providing three days of sick leave up front at

the beginning of each year). For purposes of this statute, exempt

employees are deemed to work 40 hours per week, unless their

normal workweek is less than 40 hours.

Employers may choose to limit the use of paid sick leave to 3 days

(or 24 hours) per year. Employers may also choose to limit the

accrual of paid sick leave to 6 days (or 48 hours) per year. Unused

sick pay may be carried over into another year up to the permissi-

ble cap of 6 days (or 48 hours) per year. If employment terminates

and employee is rehired within one year, any accrued unused sick

leave must be reinstated.

Sick leave may be used for the diagnosis, care, or treatment of an

existing health condition of, or preventive care for, an employee or

an employee’s family member. The definition of “family member”

is broad and includes, parents-in-law, grandparents, grandchil-

dren, and siblings, among other persons. Sick leave may also be

used for victims of domestic violence, sexual assault, or stalking.

Employers are required to provide written notice on designated

pay dates that sets forth the amount of paid sick leave benefits

available to the employee. This notice may be given to the em-

ployee on either the itemized wage statement or in a separate

document.

Employers must keep for at least three years records document-

ing the hours worked and paid sick days accrued and used by

New Construction Laws for 2015

Over 4200 bills were introduced by the California Legislature in the 2013-2014 session. Below are summaries of some of the more important bills affecting contractors in their roles as contractors, effective January 1, 2015 unless otherwise noted. Many other bills will impact them in other roles, such as being businesses, taxpayers, and employers. Links are provided to the full text of each of the bills for those wanting to know in detail the provisions of the new law. Lastly, reference is made to failed bills that are likely to be revisited next session.

Retention Cap Protection 5% retention cap loophole closed. AB 1705 (Williams D) SB 293 last year capped, through the end of 2015, public works retention at 5% with certain exceptions including a finding by the public entity that the project is “substantially complex”. Entities started immediately abusing this law by finding essentially every project to be “substantially complex”. This law extends the operation of these provisions to January 1, 2018 and requires that the bid documents include details explaining the basis for any “substantially complex” finding. This transparency will allow contractors to challenge unfounded findings and enforce the 5% retention cap.

Design-Build Design-build projects continue to gain ground in California. New health care district authorized to use design-build. SB 268 (Gaines R) Each health care district has specific duties and powers respecting the creation, administration, and maintenance of the districts, including to purchase, receive, take, hold, lease, use, and enjoy property of every kind and description within and without the limits of the district. This law authorizes the Last Frontier Health Care District to use this design-build process when contracting for the construction of a building and improvements directly related to a hospital or health facility building at the Modoc Medical Center. Transit design-build authority extended. SB 1433 (Hill D) The Local Agency Public Construction Act until January 1, 2015, authorizes a transit operator, as defined, to enter into a design-build contract, as specified. Current law requires certain information submitted in this regard to be provided under penalty of perjury. This law extends the authorization for a transit operator to enter into a design-build contract until January 1, 2017.

each employee, and make such records available for employee

inspection, if requested.

Employers may not deny an employee the right to use accrued

sick days, discharge, threaten to discharge, demote, suspend,

or in any manner discriminate against an employee for using or

attempting to use accrued sick days. The law creates a rebut-

table presumption of unlawful retaliation if an employer takes an

adverse employment action within 30 days of an employee’s: (1)

filing a complaint with the Labor Commissioner or in court alleging

violations of the new law; (2) cooperating with an investigation or

prosecution of an alleged violation of the new law; or (3) opposing

a policy, practice, or act that is prohibited by the new law.

Notice Requirements

Beginning on January, 1, 2015 – even though the law does not

take effect until July 1, 2015 – employers are required to post a

sick leave rules poster. Click here for a poster template. Employ-

ers are required to display this poster in a conspicuous place in

each workplace of the employer. Employers who willfully violate

the posting requirements will be subject to a civil penalty of not

more than $100 per offense.

Accordingly, employers who do not currently provide their employ-

ees with sick leave must do so by July 1, 2015. Employers with

existing PTO or sick leave policies should review those policies

to ensure they are in compliance with the new law, including the

notice, posting, and record-keeping requirements. Failure to follow

the new law will subject employers to significant penalties.

This law establishes minimum requirements and does not pre-

empt or limit other applicable laws that provide greater sick leave

benefits (such as San Francisco’s paid sick leave ordinance).

Employers that have employees work within the city limits of San

Francisco must ensure that their paid sick leave policies also com-

ply with San Francisco’s paid sick leave ordinance.

Work-Related Injury

Employers May Report Serious Injuries to OSHA by E-mail (AB

326)

Existing law requires all employers to file a complete report for

every work-related injury or illness with the Department of Indus-

trial Relations. Existing law also requires all employers to make an

immediate report by telephone to the Department or Cal-OSHA of

any serious injury, illness or death of an employee. This bill autho-

rizes employers to report all serious work-related injuries, illnesses

and deaths to CAL-OSHA by email in addition to telephone.

Employer Vicarious Liability

Client Employers Utilizing A Labor Contractor May Be Held Jointly

Liable for Agency’s Violations of Labor Laws (AB 1897)

Effective January 1, 2015, client employers will share civil respon-

sibility and civil liability with a labor contractor’s violations of labor

law such as failure to pay wages or failure to provide workers

compensation benefits. A “client employer” is a business entity

that obtains workers through a labor contractor to perform labor

within the employer’s usual course of business. Exempted from

this law are employers with a workforce of less than 25 workers or

businesses with five or fewer workers supplied by a labor con-

tractor at any given time. This law also does not apply to exempt

employees.

Client employers are allowed to enter into indemnification agree-

ments with its labor contractor to shift liability to the labor con-

tractor for liability created by acts of the labor contractor. Labor

contractors may also enter into indemnification agreements with

client employers shifting liability to the employer for liability created

by acts of the employer. Employers cannot, however, shift liability

to labor contractors for the employer’s responsibilities and obliga-

tions under Cal-OSHA.

The implications of this statute are significant in that employees of

labor contractors with wage claims will now have two pockets from

which they can recover damages, penalties, and attorney’s fees.

Anti-Discrimination

Public Contract Bidder Must Certify that It Will Not Ask Employ-

ment Applicants About Conviction History (AB 1650)

This bill enacts the Fair Chance Employment Act, which requires

any person submitting a bid for a state contract involving onsite

construction-related services to certify that the person will not

ask an applicant for onsite construction-related employment to

disclose information concerning his or her conviction history on or

at the time of an initial employment application. The act does not

apply to a position for which a person or state agency is otherwise

required by state or federal law to conduct a conviction or crimi-

nal history background check or to any contract position with a

criminal justice agency. This act does not apply to a person to the

extent that he or she obtains workers from a hiring hall pursuant to

a bona fide collective bargaining agreement.

City of San Francisco Enacts Fair Chance Ordinance Which

Regulates Employers’ Ability to Ask Applicants and Current Em-

ployees About Criminal Background (Ordinance 17-14)

San Francisco’s Fair Chance Ordinance (SFFCO) which became

effective on August 13, 2014 regulates certain employers’ ability

to inquire about an applicant’s arrest and conviction records. The

SFFCO applies to employers who are located in or doing busi-

ness in the City of San Francisco and have 20 or more employees

regardless of the employees’ locations. Additionally, the SFFCO

applies to “City Contractors” or entities or businesses, regard-

less of size, that contract with the City of San Francisco for public

works projects. Therefore, this Ordinance would apply to contrac-

tors and subcontractors that work on public works projects within

San Francisco City limits.

Specifically, the SFFCO prohibits the following:

Prohibits employers from issuing job ads or solicitations stating

that persons with arrests or convictions may not apply or will not

be considered for employment.

Prohibits questions about, seeking records of, or consideration

of, the following six categories of information at any time in the

interview or hiring process: (1) an arrest not leading to a convic-

tion, except for unresolved arrests, (2) participation in a diversion

or deferral of judgment program, (3) a conviction that has been

dismissed, expunged otherwise invalidated or otherwise inopera-

tive, (4) a conviction, determination or adjudication in the juvenile

justice system, (5) a conviction that is more than 7 years old, and

(6) an offense other than a felony or misdemeanor, such as an

infraction.

Prohibits questions about conviction history or unresolved ar-

rests until after an employer has either conducted a live interview

with the applicant, or made a conditional offer of employment to

the applicant.

Requires the employer to provide the applicant with a copy

of OLSE’s FCO Notice before inquiring about conviction history

or unresolved arrests. Employers are also required to post the

OLSE’s FCO Notice in conspicuous locations where employees

can easily review it.

Requires the employer to conduct an individualized assessment

if he/she intends to make an employment decision based on an

unresolved arrest or conviction history.

Requires that the employer give the applicant an opportunity

to explain or correct an unresolved arrest or conviction history,

as well as to provide any evidence of rehabilitation or mitigating

factors.

Requires the employer to delay any adverse action and recon-

sider the action if the applicant provides evidence of rehabilitation,

mitigating circumstances factors or inaccuracies in the report.

Requires the employer to inform the applicant if he/she decides

to take an adverse action based on the applicant’s unresolved ar-

rest or conviction history.

The Ordinance also requires employers to maintain records re-

garding all job postings, hiring notes, and background checks.

Nondiscrimination for Undocumented Persons With Driver’s

Licenses (AB 1660)

Beginning on January 1, 2015, the California DMV will begin issu-

ing driver’s licenses under AB 60, which was passed last year, to

undocumented immigrants. AB 1660 clarifies issues and provides

rights to immigrants who obtain a driver’s license without estab-

lishing citizenship. These immigrants are now afforded protec-

tions under existing anti-discrimination statutes. These driver’s

licenses will be marked with “federal limits apply” on the front of

the license. These licenses cannot be used to establish eligibility

to work when completing the I-9 form.

This bill makes it illegal under the California Fair Employment and

Housing Act (FEHA) to discriminate against employees who pres-

ent these licenses for employment purposes. Employers should

also be aware that this bill requires the employer to keep the

driver’s license information private and confidential.

The bill also provides that it is a violation of FEHA for an employer

to require a person to present a driver’s license, unless possess-

ing a driver’s license is (1) required by law; or (2) required by the

employer and the employer’s requirement is otherwise permitted

by law.

Employers With Greater Than 50 Employees Must Now Include

“Abusive Conduct” Training in Mandatory Sexual Harassment

Prevention Training Program (AB 2053)

Since 2005, employers with 50 or more employees have been

required to provide 2 hours mandatory sexual harassment

prevention training to all supervisors and managers once every

two years, and to new supervisors within 6 months of their newly

acquired supervisory status. AB 2053 requires these same

employers to include a component on the prevention of “abusive

conduct” in this same training, beginning January 1, 2015. “Abu-

sive conduct” is defined as conduct of an employer or employee

in the workplace, with malice, that a reasonable person would find

hostile, offensive, and unrelated to an employer’s legitimate busi-

ness interests. The statute further provides that abusive conduct

may include repeated infliction of verbal abuse, such as the use

of derogatory remarks, insults, and epithets, verbal or physical

conduct that a reasonable person would find threatening, intimi-

dating, or humiliating, or the gratuitous sabotage or undermining

of a person’s work performance. However, “a single act shall not

constitute abusive conduct, unless especially severe and egre-

gious.”

This new law does not mean that an employee can sue for

abusive conduct in the workplace unless, of course, the conduct

becomes discrimination or harassment against a protected class.

The law merely requires training on prevention of abusive con-

duct.

Minimum Wage

New Minimum Wage for San Francisco, Oakland and San

Jose

All employers need to be aware of the following new local mini-

mum wages that will go into effect in 2015:

San Francisco – On November 4, 2014, the voters of San

Francisco passed Proposition J raising the local minimum wage

in San Francisco to $15.00/hour by 2018. Thereafter, annual

minimum wage increase will follow the consumer price index. The

minimum wage will increase according to the following schedule:

5/1/2015 $12.25

7/1/2016 $13.00

7/1/2017 $14.00

7/1/2018 $15.00

July 1st Each Following Year CPI Increase

Oakland – On November 4, 2014, the voters of Oakland

passed Measure FF which shall increase the local minimum wage

in Oakland to $12.25/hour effective March 2, 2015. The minimum

wage shall increase yearly depending on inflation.

San Jose – On November 6, 2012, the voters of San Jose

passed Measure D which will raise the local minimum wage in

San Jose to $10.30/hour effective January 1, 2015. The minimum

wage will increase yearly depending on cost of living.

Labor Commissioner May Cite Employers Who Fail to

Pay Minimum Wage Waiting Time Penalties (AB 1723)

Existing law authorizes the Labor Commissioner to award liqui-

dated damages and other penalties against employers who fail

to pay minimum wages. AB 1723 expands the existing law to

authorize the Labor Commissioner to award waiting time penalties

for an employer’s willful failure to timely pay wages of a resigned

or discharged employee.

Employees Have Three Years In Which to Seek Liquidated

Damages Against Employers Who Fail to Pay Minimum Wage

(AB 2074)

Last year, the legislature passed AB 442 which authorized em-

ployees to recover liquidated damages from employers who fail

to pay minimum wage. Liquidated damages are defined as the

amount equal to the wages unlawfully unpaid and interest there-

on. One Court of Appeal found that while employees’ wage claims

would be subject to a three-year statute of limitations, the employ-

ees’ claims for liquidated damages based on those claims would

only have a one-year statute of limitation. (Bain v. Tax Reducers,

Inc., 219 Cal. App. 4th 110 (2013).

AB 2074 supersedes the Bain decision and clarifies that employ-

ees seeking liquidated damages for minimum wage violations

would now be subject to the same three-year statute of limitations

that the underlying wage claim would have. To illustrate, employ-

ees suffering minimum wage violations

occurring now would have until 2017 to file suit for the unpaid

wages and penalties as well as liquidated damages.

Recovery Periods

Recovery Periods Taken By Employees Must Be Compensated

(SB 1360)

Last year, the Legislature passed a bill was passed that requires

employers to provide non-exempt employees a “recovery period,”

or cool down period, of no less than 5 minutes to prevent heat

related illnesses. Failure to provide employees with a recovery

period subjects employers to a one hour wage penalty for each

day a recovery period is refused upon request.

This bill clarifies that the time taken by employees for recovery

periods should be counted as hours worked and paid. The time

should also be taken into account when calculating overtime.

Prevailing Wage Law Update

Post-Construction Work At Public Works Project Must Be Paid At

Prevailing Wage (AB 26)

This statute clarifies that post-construction phases of a public

works project, including cleanup work, is considered part of the

project and must be compensated at the prevailing wage.

Contractors May Sue Hiring Parties For Increased Labor Costs,

Penalties, and Legal Fees if Project Is Later Determined To Be a

Public Works Project (AB 1939)

Contractors may now sue hiring parties for any increased costs

for labor, penalties, and legal fees incurred as a result of any

decision by the Department of Industrial Relations, the Labor and

Workforce Development Agency, or a court that classifies the

work as a public work after the contractor has entered into a con-

tract for the work or begun the work. If the hiring party provided

notice to the contractor before entering the contract that the work

would be classified as a public work, this section does not apply.

Period that Labor Commissioner May Assess Wage Penalties

Against Contractors of Public Works For Prevailing Wage Vio-

lations Is Tolled If Awarding Bodies Do Not Provide Notice of

Completion (SB 266)

Under Labor Code 1741, the Labor Commissioner may, within

18 months following the Notice of Completion, assess civil wage

penalties against contractors or subcontractors who violate the

prevailing wage laws. This bill requires the body awarding the

contract for a public work to furnish, within 10 days after receipt

of a written request from the Labor Commissioner, a copy of the

valid Notice of Completion for the public work or a document

evidencing the awarding body’s acceptance of the public work

on a particular date, whichever occurs later. If the awarding body

fails timely to furnish the Labor Commissioner with the applicable

document, the period within which the Labor Commissioner may

assess penalties against contractors is tolled until the Labor Com-

missioner’s actual receipt of the applicable document.

Grants Received From Council Must Be Divided Between Multi-

employer Apprenticeship Programs (AB 1870)

This bill requires that if there are two or more approved multiem-

ployer apprenticeship programs serving the same craft or trade

in the geographical area for which the training contributions were

made to the council, the grant is required to be divided among all

those programs based on the number of apprentices registered in

each program.

Job Hazard Analyses- An Important Part of Behavior Based Safety

"Behavior Based Safety" (BBS) can have positive results when done correctly. In a successful BBS approach, everyone must be on the same page with respect to what the safe behaviors are for all hazards present.

To assure everyone is truly aware of the hazards and respective controls for each task, a simple process can be employed… Job Hazard Analyses (JHAs).

JHAs provide a simple outline of the CRITICAL BEHAVIORS which need to be followed to assure safe performance. They outline for the tasks of a job, the respective hazards, and for those hazards, the respective critical behaviors required to prevent an incident. Developing JHAs is the first step in an effective BBS approach. Coupled with excellent training and observations, a true safety culture can be developed.

JHA development begins by performing hazard assessments. The JHA must identify both the hazards of the tasks, and the needed critical behaviors to prevent an unwanted outcome.

Following is a Hazard Assessment Form which can assist in evaluating tasks, hazards and needed controls. When using the form, look for any unsafe conditions, talk to and observe staff to see what critical behaviors are needed to prevent a mishap, as well as any situations that cause employees to make unsafe choices (e.g., locking out a piece of equipment is required but necessary supplies are not available in the area).

Análisis en Peligros del Trabajo – Parte Importante de Seguridad Basada en Comportamientos

"Seguridad Basada en Comportamientos" (BBS) pueden tener resultados positives cuando se hacen correctamente. En un método BBS exitoso, todos deben estar de acuerdo con respecto a cuales son los comportamientos seguros.

Para asegurar que todos en verdad estén al tanto de los peligros y respectivos controles para cada asignación, un proceso simple debe ser empleado… Análisis en Peligros del Trabajo (JHAs).

Los JHAs proveen una simple pauta de COMPORTAMIENTOS CRITICOS los cuales necesitan seguirse para asegurar un desempeño seguro. Delinean las asignaciones de un trabajo, los peligros respectivos, los comportamientos críticos requeridos para prevenir un incidente. Desarrollar un JHA es el primer paso en un método efectivo de BBS. Junto con un entrenamiento excelente y observaciones, una cultura de seguridad puede ser desarrollada.

Community Emergency Response Team (CERT)

For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
