I expect that the one major change you will likely see is more focus on immigrant issues, which he has already publicly stated will become a priority if it doesn’t have an impact on California’s budget. Besides this difference, Steinberg is much more staid while de Leon is more flamboyant. How this will affect his leadership style will be interesting to watch. Certainly his party the other evening gives us a ‘flavor’ of what to expect. Stay tuned!
Use Third-Party Contractors? The Signing of AB 1897 (Hernandez) Could Impact Your BusinessCompanies that rely on labor provided by third-party contractors may be held jointly liable for wages owed to the contractor’s workers under a new California law that goes into effect on January 1, 2015. The legislation appears to target the construction, agricultural,
and security guard industries, but applies more broadly to almost any business that contracts with another person or company to supply five or more workers on a regular basis.
New Provision to Labor Code, Section 2810.3AB 1897, recently signed into law by Gov. Jerry Brown, targets companies (referred to as “client employers” in the new statute) that use outside firms (called “labor contractors” in the statute) to provide them with workers. The law adds a new provision to the California Labor Code, Section 2810.3, which states that a company using a third party to supply its workers “shall share … all civil legal responsibility and civil liability” for any unlawful failure to pay “wages” and for failure to secure workers’ compensation insurance for the third party’s workers.
As an example, if a company’s third-party staffing agency violates California’s wage or workers’ compensation laws, the company itself may be liable under the new law. In addition, both the company and staffing agency would be prohibited from taking any “adverse action” against a worker who complains of wage violations or who files a claim or civil action. Limits of LiabilityPotential liability under Section 2810.3 is not
unlimited. It only applies to companies that use third parties as a source of workers in the “usual course of business” at their premises or worksites. It does not apply to businesses with fewer than 25 workers, businesses that use five or fewer subcontracted workers, or to employees who are exempt from overtime under the administrative, executive and professional exemptions. Certain motor carriers, telecom service technicians and employee-leasing arrangements are also excluded.
Workers may only rely on Section 2810.3 to recover “wages”—such as overtime pay, commissions, bonuses, incentive pay and premium pay for missed meal and rest breaks—but not unreimbursed business expenses or statutory penalties. On its face, the law does not alter common law vicarious liability or joint employer theories for tort or fair employment claims, nor does it expand the scope of potential liability for the use of bona fide independent contractors outside of the labor contractor context.
Impact of Section 2810.3Section 2810.3 is a significant change in the law to companies that rely on workers provided by other entities or people to operate their businesses on a day-to-day basis. Service recipients are likely to be joined in wage-and-hour lawsuits brought by their subcontractors’ workers and could be held jointly liable for their

subcontractors’ alleged wage violations. To mitigate risks, companies should update the indemnity, insurance and termination provisions in their service agreements, and they should consider whether and how to verify their subcontractors’ compliance with labor laws. New California Paid Sick Leave Law is Nothing to Sneeze At – Another Look At the New LawAs I reported several weeks ago, starting July 1, 2015, virtually all employers in California will be required to provide three days of paid sick leave each year under a new law signed by Gov. Jerry Brown last week. A.B. 1522, the “Healthy Workplaces, Healthy Families Act of 2014,” will affect small and large employers alike, with only unionized workers, home health care providers and airline flight crews exempted from the mandate. It is anticipated that 6.5 million workers in the state, or 40 percent of California’s workforce, previously without paid sick time, will benefit from the new law.
Under A.B. 1522, all employees, full and part time, will earn paid sick leave at a rate of one hour for every 30 hours worked and can begin using the accrued time after 90 days of employment. Employers are permitted to cap accrual of paid sick leave at six days and limit the employee’s use of paid sick days to three days per year, with the remaining time carrying over from year to year. However, employers are not required to pay out accrued sick time at termination. A small nuance that should not
be overlooked is that the law applies to out-of-state employees that work in California 30 or more days within a calendar year. For example, an out-of-state employee who travels to the home office of his or her California employer one week every month will be covered by A.B. 1522.
Employees may use the paid sick time for their own health condition, caring for a family member, or if they are a victim of domestic violence. Existing law already requires employers that provide paid sick time to allow employees to use half of their yearly allotment for “kin care” (care of their sick child, parent, spouse or registered domestic partner). Under A.B. 1522, the definition of family member is expanded to include grandparents, grandchildren and siblings. Employers should revise sick time policies to reflect these broad rights of use.
In addition to accounting for and providing the accrued leave, employers are required to display posters telling employees of their right to paid sick days and informing them that retaliation for requesting or using paid sick days is illegal. Employers are also required to include the amount of paid sick leave accrued on employees’ itemized wage statements. Employers could face fines of up to $4,000 per day for withholding paid sick leave or violating the bill’s requirements.
Although many California employers already provide at least three days of paid sick time, A.B. 1522 will impose additional administrative burdens on those employers, including:• The employee’s sick leave balance must
now be included on itemized wage statements, or in another writing, on each
pay day.• Accrued sick leave must carry over into
the new year, subject to the cap of six days. Employers are permitted to avoid the administrative burdens of tracking accrual and carry over if three or more days of paid sick time are granted at the start of the year.
• Records documenting the hours worked, and paid sick days accrued and used by an employee, must be retained for three years. Employees will have the right to inspect these records.
• Former employees that are re-hired within one year are entitled to have previously accrued and unused paid sick days be reinstated.
The passage of the law makes California the second state in the nation, after Connecticut, to subject employers to paid sick leave mandates. However, Connecticut’s law, which took effect in 2012, applies only to larger employers with 50 or more workers and covers only “service workers.”
The new California requirement follows the lead set by San Francisco when, in 2006, it became the first locality in the nation to require employers to provide paid sick leave for all employees working within the county. Other cities, including New York City, the District of Columbia, Seattle, Portland, San Diego and five cities in New Jersey have followed suit. Q: I recently received a citation from the CSLB for doing work over $500.00 without a license. I would like to get a license in CA, NV, and AZ but what’s stopping me is that I heard that they all run background checks now and I have a felony on my record. It’s from many years back, but will that prevent me from getting my license in those three States?
A: Again, we are happy to provide you with our opinion, however this in no way should be construed as legal advice.
In discussing this issue, here in California, the Contractors Board (CSLB) requires each applicant to respond to a question that concerns any criminal history and provide a detailed description of each arrest/conviction. In addition, the CSLB requires a fingerprint background check, which is evaluated by the State Department Of Justice (DOJ) and the Federal Bureau of Investigation (FBI). They do not have any specific criteria concerning what type of past criminal offense would disqualify an applicant from obtaining a contractor’s license or being a license Qualifier. While it
is very unlikely an applicant will be issued a license if still on parole or probation, there actually is no regulation disallowing someone from filing an application.
While a felony charge would likely be evaluated carefully, it would depend on how long ago this took place; whether this was an isolated incident or one of several convictions; and how the applicant has documented their rehabilitation. Each application is evaluated on a case-by-case basis, but statistically only a small percentage of applications are ultimately denied. In some cases, the CSLB may issue a Probationary License, again depending on the severity of the crime and information provided by the applicant and obtained from the Department Of Justice.
Nevada has a policy of requiring all applicants to complete a “Criminal Disclosure Statement Regarding Criminal Plea/Conviction” form and provide fingerprints. Like CA, the applicant will be required to list the arresting agency, conviction date, court location, sentence, explanation of the crime and efforts towards rehabilitation.
The FBI and the Nevada Criminal History Repository will then evaluate your records and fingerprints. Any felony will cause the application to be denied at staff level and it will then be assigned to go before the Board for final determination.
When reviewing convictions, the Nevada Board considers factors such as the seriousness of the crime, the time that has passed since the conviction and any evidence of rehabilitation.
Arizona requires that you complete a background check online and the information is automatically transferred to the Arizona Registrar of Contractors (ROC). The ROC reviews criminal convictions to determine if the crime is substantially related to the duties, qualifications and functions of a contractor. They also review rehabilitation efforts. Arizona has a list, which is available on their website, of convictions that may result in the denial of a license so you may want to review that before you apply for a license.

The menace of motion Almost 200,000 workers are injured every year by machinery. This is third highest cause of occupational injury in the United States. The most common source of those injuries is workers being struck by or caught in moving parts. There are essentially two kinds of motion in machinery… rotating and sliding:
• Rotating: Shafts rotate. Drill presses, rollers, pulleys, and gears spin. Rotating machinery and moving parts can grab loose hair, jewelry, and clothing.
• Sliding (or reciprocating): Power presses, shears, and other machine parts slide up and down or sideways with great force. These motions can pinch, crush, and chop misplaced fingers, hands, and arms.
Machines are everywhere, and are used by smaller facilities as well as the big and busy production facilities. Recognize and avoid the hazards of machinery wherever you are working.

Important points to remember when working with machinery:
• Never operate a machine unless you are fully trained and authorized to use it. • Only use a machine the way it is designed to be used and according to all the
manufacturer’s safety requirements. • Always ensure that all safeguards are in place and that everyone is clear of moving
parts prior to use. • Never reach into any hazard area or moving portion of a machine for any reason,
such as removing a blockage, without first implementing proper Lockout/Tagout procedures.
• Always perform Lockout/Tagout when doing machine maintenance and repair. Always disconnect the main power, release all stored energy, and prevent re-energizing (lockout).
• Only use machines that are properly maintained and in safe working condition. • Only operate machines when you are dressed properly (make sure there is no loose
hair or clothing, or jewelry to catch in a machine). • Always turn off the machines when you have finished using them.

• Rotación – Hay un eje que rota. Hace girar taladros, rodillos, poleas, engranajes. La maquinaria rotatoria y sus partes móviles pueden atrapar cabello, bijouterie y vestimenta.
• Desplazamiento (o alternador) - Prensas mecánicas, tijeras de corte y otras partes de la maquinaria se deslizan hacia arriba y hacia abajo o de lado con mucha fuerza. Estos movimientos pueden pellizcar, aplastar y cortar dedos, manos y brazos fuera de lugar.
Las máquinas están en todas partes, y son utilizadas tanto por las instalaciones más pequeñas como por grandes establecimientos de producción con mucho trabajo. Identifique y evite los peligros de la maquinaria donde está trabajando.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.
ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
