For the last nineteen years students all over Marin County have had the opportunity to learn hands-on skills of the construction trade. The class is eighteen weeks and is offered every Spring Semester on Wednesday evenings at Redwood High School, Larkspur. Our Assistant Instructors take groups of five students each and build a shed from the ground up. It is a memorable experience and the students and instructors look forward to every Wednesday. Students also have the opportunity to be hired for a six week Summer Internship with local contractors. They will be completely qualified to use power tools during the internship. Please support us by hiring a student for an internship. Students who interview are recommended by all Instructors to insure they are ready to work for you! You will not be disap-pointed. It’s a WIN, WIN, WIN for you and the students!

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Times are improving for contractors large and small, and almost everyone in-between! The North State Building Industry Association held its first Trades Job Fair in seven years in Sacramento this month. Among the skilled trades being sought were licensed plumbing, HVAC, landscaping, roofing, energy and electrical contractors. Unlike the last few years, now you can get licensed and likely go right to work..

Q: I have a “B” license and plan on taking a project that involves many trades. This will be the biggest job I have taken since becoming licensed 5 years ago. Is there certain work that I cannot do with this class? I was told that for some trades a General Building contractor is required to hire subcontractors. Is this correct?

A: First, it depends on the type of project you’re going to work on. As a “B” the first question you should ask yourself is: Does the project involve a structure that houses people, animals, chattels or moveable property. If so, then Section 7057 allows you to self-perform most all work except for “C-16” (Fire Protection) and “C-57” (Well Drilling). These are the two classifications that would require the hiring of a licensed sub-contractor.

Of course, as a General “B” you’re allowed to sub-contract some or all the work to properly licensed subs regardless of the trades involved.

Q: I have an active contractor’s license for my corporation. My wife and I recently formed a new corporation together and we have started running the business through the new corporation. I submitted a name change request to change my current license’s business name to the new company name. The CSLB rejected the form stating that the name doesn’t match what’s on file with the Secretary of State. But the new company is registered with the Secretary of State with the correct name! I’ve tried to reach my technician but haven’t had any luck. I thought you might be able to assist me.

A: Absolutely we can help you. Any time you form a new entity you are required to obtain a new contractor’s license. A name change form will not suffice because it’s a new entity you are licensing, not simply a name change. License numbers are not transferrable so you will receive a new license number.

Q: I am listed as the RME on my company’s license. I recently was promoted to Vice President so I need to update my status on the contractor’s license. In looking at the list of forms on the CSLB’s website, I’m not sure if I need to complete an application to add an Officer or an Application to Report Change of Corporate title. Which would you recommend?

A: Actually, neither! In order to change your status on the license from RME (Responsible Managing Employee) to RMO (Responsible

Managing Officer), you will need to submit an application to replace the Qualifying individual. As silly as it sounds, you are replacing yourself!

Here in the Sacramento area new construction is planned, underway or near completion on a new Soccer Stadium at Cal Expo, the new Sacramento Kings NBA Arena, plans for a street trolley system, Lite Rail expansion and new construction breaking ground on developments with hundreds of houses to be built, the opportunity for licensed contractors is growing here and across the state.

deadlines. As you may recall, the deadline for

all bills to pass out of their house of origin’s

policy committees was May 7th. If they didn’t,

they died. The next deadline fast approaching

is May 23rd, which is the deadline for bills to be

approved in their respective house’s appropriation

committee (if they have a cost to government,

they must pass through the appropriations

committee). The next deadline thereafter is May

30th, which is the deadline for all bills to pass out

of their house of origin. The process then starts

anew in the opposite house; i.e. Senate bills must

pass move through the Assembly and vice versa.

This process then moves throughout the summer

and concludes at midnight on August 31. All

bills must be on the governor’s desk by then or

die.

As we fast approach the May 23rd

Appropriations Committee deadline, myriad

bills are ‘piling up’ in the Suspense file. All bills

that cost more than $100,000 to government are

placed on Suspense. Then, prior to the May 23rd

committee deadline, a list of bills that ‘passed

off of Suspense’ is announced by the committee.

In essence, the list consists of bills that

POLITICALLY are deemed important enough to

pass muster out of the committee.

Fortunately for us, Suspense is, thankfully, where

many of the ‘bad’ bills we oppose end their

journey through the Legislature (at least for this

year!). It is a way for the Legislature to ‘rid’ itself

of bills that cannot be killed in policy committee

(politically) and need an excuse to be stopped in

their tracks.

Since so many of the bills I have reported on

this year are now on Suspense, I will hold off

discussing them any further until we know

if they are make it out of Appropriations

Committee next week.

Final Public Works Fee Language – Fee Starts

July 1, 2014

Never say ‘final’ until it officially becomes law

(which in this case means the governor signs

the budget bills that will likely happen by mid-

June), but let me say that the major opposition

appears to be ‘off’ the proposed public works fee

language that we’ve been battling on since early

January. This means the $300 annual fee will

be due by July 1st. I will keep you posted as we

get closer, but take heed IF you plan on bidding

on ANY public works starting on July 1, 2014

or thereafter. Starting on page 18 is the entire

language which I would urge you to read!

SEC. 4. Section 1725.5 is added to the Labor

Code to read:

1725.5. A contractor must be

registered pursuant to this section in order

to be qualified to bid on, be listed in a bid

proposal pursuant to Section 4104 of the Public

Contract Code, or engage in the performance

of any contract for public work that is subject to

requirements of this chapter.

Proposition 41 redirects $600 million of

previously approved, unspent bond funds to

construct and rehabilitate housing for California’s

large population of homeless veterans. The

act will construct affordable, supportive and

transitional housing for homeless and near

homeless veterans without raising taxes.

Ballot Arguments Against

Proposition 41 authorizes the state to borrow

(by selling bonds) $600 million of $900 million

in bonds voters previously approved for use by

the CalVet Home and Farm Loan Program. The

issue is whether such a diversion of funds is wise.

Proposition 42

Public Records. Open Meetings. State

Reimbursement to Local Agencies. Legislative

Constitutional Amendment.

Requires local government compliance with laws

providing for public access to local government

body meetings and records of government

officials. Eliminates reimbursement for costs of

compliance.

Ballot Arguments For

Proposition 42 will cement in the Constitution

the public’s right to know what the government

is doing and how it is doing it. Local agencies

shouldn’t be allowed to deny a request for public

information or slam a meeting door shut based

on cost.

Ballot Arguments Against

Proposition 42 amends the California

Constitution to impose the cost of complying

with the California Public

Records Act and local open meeting laws upon

the local governments involved. An alternative,

not offered by the proposition, would be to

require state government to pay.

Public Works Contractor Registration Fee Budget Trailer Bill Language

Requested Revisions to Labor Code sections 1725.5, 1771.1, and 1771.3 SEC. 4. Section 1725.5 is added to the Labor Code to read: 1725.5. A contractor must be registered pursuant to this section in order to be qualified to bid on, be listed in a bid proposal pursuant to Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work that is subject to requirements of this chapter.

(a) To qualify for registration under this section, the applicant or a contractor must do all of the following:

(a) (1) Beginning July 1, 2014, register with the Department of Industrial Relations in the manner prescribed by the department and pay an initial non-refundable registration application fee of $300 to qualify for registration under this section and an annual renewal fee on or before July 1st each year thereafter. The annual renewal fee shall be in a uniform amount set by the Director of Industrial Relations, and the initial registration and renewal fees may be adjusted no more than annually by the director to support the costs specified in Section 1771.3.

(b) (2) Provide such evidence, disclosures, or releases as are necessary to establish all of the following:

(1) (A) Workers’ Compensation coverage that meets the requirements of Division 4 (commencing with Section 3200) and includes sufficient coverage for any worker who the contractor will employ to perform work that is subject to prevailing wage requirements other than a contractor who , whether or not that person may otherwise be exempt from workers’ compensation coverage requirements, unless that person is separately licensed registered under this section. Coverage may be evidenced by a current and valid Certificate of Workers’ Compensation Insurance or Certification of Self-Insurance required under Section 7125 of the Business and Professions Code.

(B) Where applicable, the contractor is licensed in accordance with Chapter 9 (commencing with Section 7000) of the Business and Professions Code.

(2) (C) The applicant or contractor does not have any outstanding delinquent liability to an employee or the state for any assessment of back wages, or related damages, interest, fines, or penalties due to an employee or the state pursuant to

any final judgment, order, or determination by a court or any federal, state, or local administrative agency, including a confirmed arbitration award. However, for purposes of this paragraph, the applicant or contractor will not be disqualified for any judgment, order, or determination that is not yet final or is under appeal, provided that the applicant or contractor has secured the payment of any amount eventually found due through a bond or other appropriate means.

(3) (D) The applicant or contractor is not currently debarred under Section 1777.1 or under any other federal, or state, or local law providing for the debarment of contractors from public works.

(4) (E) The applicant or contractor has not bid on a public works contract, been listed in a bid proposal, or engaged in the performance of a contract for public works without being lawfully registered and licensed in accordance with this section, and licensed in accordance with Chapter 9 (commencing with Section 7000) of the Business and Professions Code, within the preceding 24 12 months, or since the effective date of the requirements set forth in subdivision (d)(f), whichever is shorter. For a contractor found to be in violation of the requirements of this paragraph only, the period of disqualification shall be waived if: (i) the contractor has not previously been found to be in violation of the requirements of this paragraph within the preceding 12 months; and (ii) the contractor pays an additional non-refundable penalty registration fee of $2,000.

(b) Fees received pursuant to this section shall be deposited in the State Public Works Enforcement Fund established pursuant to Section 1771.3 and shall be used only for the purposes specified in subdivision (b) of Section 1771.3.

(c) The term “contractor,” as used in this section, shall include any subcontractor, as defined in Section 1722.1.

(d) A contractor who fails to pay the renewal fee required under paragraph (1) of subdivision (a) on or before the expiration of any prior period of registration shall be prohibited from bidding on or engaging in the performance of any contract for public work until once again registered pursuant to this section. A contractor who inadvertently fails to pay the renewal fee may retroactively renew its registration by paying an additional non-refundable penalty renewal fee equal to the amount of the renewal fee within 90 days of the due date of the renewal fee.

(e) The requirements of this section shall not apply with respect to any contract, which as a result of a determination by the Director of Industrial Relations pursuant to Section 1773.5 or decision by a court that classifies, after the time at

which the body awarding the contract accepts the contractor's bid or awards the contractor a contract, the work covered by the bid or contract as a "public work," as defined in this chapter, to which Section 1771 applies, provided that:

(1) The body awarding the contract failed to identify as a public work, in the bid specification or in the contract documents, that portion of the work that the determination or decision classifies as a “public work.”

(2) Within twenty (20) days following service of notice on the awarding body of a determination by the Director of Industrial Relations pursuant to Section 1773.5 or a decision by a court that the contract was for public work as defined in this chapter, the contractor and any subcontractors are registered under this section or are replaced by a contractor or subcontractors who are registered under this section.

(3) The requirements of this section shall apply prospectively only to any bid, bid proposal, contract, or work performed after the awarding body is served with notice of the determination or decision referred to in paragraph (2) of this subdivision.

(d) (f) The requirements of this section shall apply to any bid proposal submitted on or after March 1, 2015, and any contract for public work, as defined in this chapter, entered into on or after April 1, 2015. SEC. 5. Section 1771.1 is added to the Labor Code, to read: 1771.1. (a) No contractor or subcontractor shall be qualified to bid on, be listed in a bid proposal pursuant to Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered to perform public work pursuant to Section 1725.5. It shall not be a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Sections 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded.

(b) Notice of this requirement shall be included in all bid invitations and public works contracts, and no bid shall be accepted nor any contract or

subcontract entered into without proof of the contractor or subcontractor’s current eligibility registration to perform public work pursuant to Section 1725.5.

(c) An inadvertent error in listing a subcontractor who is not registered pursuant to Section 1725.5 in a bid proposal shall not be grounds for filing a bid protest or grounds for considering the bid nonresponsive, provided that any of the following requirements are met: (1) the subcontractor is registered prior to the bid opening; (2) within 24 hours after the bid opening the subcontractor is registered and has paid the penalty registration fee specified in paragraph (E) of subdivision (2) of Section 1725.5; or (3) the subcontractor is replaced by another registered subcontractor pursuant to Section 4107 of the Public Contract Code.

(d) Failure by a subcontractor to be registered to perform public work as required by subdivision (a) of this Section shall be grounds under Section 4107 of the Public Contract Code for the contractor, with the consent of the awarding authority, to substitute a subcontractor who is registered to perform public work pursuant to Section 1725.5 in place of the unregistered subcontractor.

(e) The department shall maintain on its website a list of contractors who are currently registered to perform public work pursuant to Section 1725.5.

(f) A contract entered into with any contractor or subcontractor in violation of subdivision (a) shall be subject to cancellation. However, no contract for public work shall be unlawful, void, or voidable solely due to the failure of the awarding body, contractor, or any subcontractor to comply with the requirements of Section 1725.5 or this section.

(c) (g) This section shall apply to any bid proposal submitted on or after March 1, 2015, and any contract for public work entered into on or after April 1, 2015. * * * SEC. 7. Section 1771.3 is added to the Labor Code to read. 1771.3. (a) The State Public Works Enforcement Fund is hereby created as a special fund in the State Treasury. All registration fees collected pursuant to Section 1725.5 and such other moneys as are designated by statute or order shall be deposited in the fund and used for the purposes specified in subdivision (b) of this section.

(b) Moneys in the State Public Works Enforcement Fund shall be used only for the following purposes:

(1) The reasonable costs of administering the registration and qualification of contractors and subcontractors to perform public work pursuant to Section 1725.5.

(2) The costs and obligations associated with the administration and enforcement of the requirements of this chapter by the Department of Industrial Relations.

(3) The monitoring and enforcement of any requirement of the Labor Code by the Labor Commissioner on a public works project or in connection with the performance of public work as defined pursuant to this chapter.

(c) The annual contractor registration renewal fee specified in paragraph (1) of subdivision (a) of Section 1725.5, and any adjusted application or renewal fee, shall be set in amounts that are sufficient to support the annual appropriation approved by the Legislature for the State Public Works Enforcement Fund and not result in a fund balance greater than 25% of the appropriation. Any year-end balance in the fund greater than 25% of the appropriation shall be applied as a credit when determining any fee adjustments for the subsequent fiscal year.

(c) (d) To provide adequate cash flow for the purposes specified in subdivision (b), the Director of Finance, with the concurrence of the Secretary of the Labor and Workforce Development Agency, may approve a short-term loan each fiscal year from the Labor and Workforce Development Fund to the State Public Works Enforcement Fund.

(1) The maximum amount of the annual loan allowable may be up to, but shall not exceed 50% of the appropriation authority of the State Public Works Enforcement Fund in the same year in which the loan was made.

(2) For the purposes of this section, a “short-term loan” is a transfer that is made subject to the following conditions:

(A) Any amount loaned is to be repaid in full during the same fiscal year in which the loan was made, except that repayment may be delayed until a date not more than 30 days after the date of enactment of the annual Budget Act for the subsequent fiscal year.

(B) Loans shall be repaid whenever the funds are needed to meet cash expenditure needs in the loaning fund or account.

Hand Tool Safety—Screwdrivers

Hand tools help us with many tasks and have become a part of our everyday lives. As a result, the hazards associated with hand tool use are often ignored. Most hand tool accidents are preventable if best safety practices are followed. Protect yourself with the following basic safety practices when using hand tools, including screwdrivers. The screwdriver is one of the most commonly used and abused hand tools. Use the right tool for the job:

• Each tool is designed to perform a specific function. It is dangerous to substitute or use an inappropriate tool.

• Use tools properly, including the proper positioning to avoid strains and sprains.

• Never use damaged tools: discard, fix or replace them immediately.

Housekeeping:

• Do not leave tools lying around where they can become a tripping hazard.

• Ensure that your tools are secured when they are not in use, so that they cannot fall off work surfaces and injure you or others.

• Do not carry chisels, screwdrivers and other pointed tools in your pockets. Use a tool belt.

• Carry all pointed tools with the tools’ pointed ends aiming downward.

• Do not throw tools, pass them handle-first.

• Keep your tools in good repair, and inspect them before each use.

• Always wear the appropriate personal protective equipment (PPE) when working with hand tools.

Ergonomic factors:

• Minimize sprains and strains by keeping your wrists straight and elbows close to the body.

• Use the comfort grips or properly fitted gloves to reduce the stress on your hands and wrists.

Hand Tool Safety—Screwdrivers

• Take breaks to rest your muscles.

• Consider tool design when choosing a tool: − Look for lightweight tools with handles that allow for a relaxed grip and enable

you to keep your wrists straight. − Choose tools that can be used with either hand. − Select a tool that is the proper size for your hands. Tool handles should be

shaped so that they contact the largest possible surface of the hand and fingers. − Avoid handles with sharp edges and corners.

• Consider using power tools to reduce repetitive movements. Safety when using screwdrivers:

• Do not use screwdrivers as punches, wedges, pinch bars or pries.

• Keep screwdrivers in good condition: − A broken handle, bent blade or a dull or twisted tip

may cause a screwdriver to slip and result in a hand injury. A sharp, square-edged bit will not slip as easily as a dull, rounded one.

• Place the stock being worked on in a vise or on a flat surface and not in your hand; then, if the tool slips, there will be less chance of a hand injury.

• Match the screwdriver to the screw head.

• When using a screwdriver for electrical work, ensure that the handle is insulated and that the shaft does not extend into the handle.

Always use caution when working with tools. Do not take the safety of hand tools for granted.
