Graduation of the Marin County Construction Technology class at Redwood

High School recently was held at Camp Arequipa in Fairfax where a future

bathroom structure (in the form of a shed) was presented by 24 graduating

students and dedicated to the Girl Scouts of Marin Del Centro. Five sheds were

constructed by the class this year and presented to the Marin BSA, Wilkinson

School by Half Moon Bay and one to a private party.

The program is supported in partnership with National Association of Remodeling Industry (NARI), the Regional Occupation

Program (ROP), Marin County Office of Education (MCOE), various Contractors and suppliers (Golden State Lumber, Fairfax

Lumber, Morris Roofing, ABC Supply, CP Sheet Metal and Water Components. The class is taught by experienced tradesmen

ranging from Building Contactors, Sub Contractors, and various Craftsmen.

Along with teaching basic carpentry & safety skills, the instructors introduced other sub trades such as electrical, plumbing,

roofing and green building practices. The class consists of high school students from Marin County including Redwood, Novato,

Terra Linda, Drake, San Andreas, San Marin and Tamalpais. Adults are also welcome for a minimum fee.

A select group of graduates who have successfully completed the program have the opportunity to participate in on- the- job

training through summer internships as paid employees for local construction professionals.

ROP is integral to the foundation of the Marin Builders Association. For the last seventeen years high school students in Marin

County have had the opportunity to learn hands-on skills of the construction trade with qualified instructors Anyone who

hires these students will not be disappointed!

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

A contractor with a California license looking over the border-lines for business discovers things aren’t always as simple as rumored but having good tools makes the job easier. Another contractor walks a fine line to stay out of ‘hot water’ in Nevada, but we begin with a contractor who must make some ‘true’ or false choices…

Q: I need your help with a Nevada License to install boilers. I am currently a licensed HVAC (“C-20”) contractor in CA. From doing a little research, I have found that the equivalent classification is a “C-21” in Nevada. However, I’ve been speaking with an inspec-tor in Nevada who tells me that I cannot install boilers with the “C-21” class and that I would need to also obtain a “C-1a” (Boilers) license. Is that true?

A: Thanks for your question. If you’re installing boilers for the purpose of heating, or raising a room’s temperature, then the “C-21” will cover you. The statute reads: “The installation, repair, ser-vice and maintenance of equipment, devices, machinery, units and related ductwork which use evaporation, refrigeration, boilers or combustion for the control of air temperatures in structures where people live, work or assemble....”

Q: I work for a large company that has several sister companies. I am currently the Qualifier on my company’s “B” (General Build-ing) license in AZ. My company has requested that I become the Qualifier on our sister company’s Arizona license which is a “C-30” (Finish carpentry). Can I do that and if so, will I be able to waive the exam since I have a General Building license?

A: First of all, Arizona will only allow you to be on more than one license at the same time if one of the following is true: (a) You (the Qualifier) own at least 25% of each company that you are licensing, or (b) One licensee owns at least 25% of the other licensee. The fact that the two companies have the same parent company is not enough to satisfy the requirement. Secondly, you will be required to take the “C-30” exam, even though you currently hold a ‘B’ license.

Q: I’m an electrical contractor and I have a license here in CA. One of my customers has requested that I do some work for them in the Tahoe area. My understanding is that there’s a reciprocal agree-ment between CA and NV that allows me to work in NV if I have a license in CA. Is there anything else I need to do to start work, such as obtaining a business license?

A: While many contractors believe that the reciprocal agreement between California, Nevada, Arizona, and Utah allows them to use one license in any of those four States, it isn’t quite that simple. When doing work in another State, you’re required to obtain a license specific to that State. The agreement generally allows you to qualify for a trade waiver, if you have been licensed for 5 out of the last 7 years in one of these reciprocal States. You’re still required to take and pass the Management exam and go through their application process. Unfortunately not all classifications are reciprocal. For instance, Nevada and California do not reciprocate for Electrical, Plumbing, or Fire Protection. So as an Electrical contractor you would be required to take the trade exams and show the necessary experience qualification. Reciprocity is a great op-portunity for contractors but like all ‘tools’ does require some effort to make it work.

Well, it’s official. The primary’s over-saturation of radio, mailer and TV ads is over - now onto the general election! Wow, I can’t wait!

Despite the dismal turnout, there were some very telling results. First and foremost, the open primary - the top two tier runoff system is going to likely produce, as it was intended, more moderate elected officials in the future. In the past, one Republican and one Democrat were elected to runoff against each other. Now it will be the top two vote getters, meaning that there will be many Democrats running against Democrats and, to a lesser degree (because there are fewer Republican strongholds left), Republicans against Republicans. Since the vast majority of voters are truly moderates, they will be looking to vote for moderates in the general election. This, in-turn, will ultimately result in more moderates running the Legislature which, in-turn, should translate into a lot more positive accomplishments emanating from Sacramento (I truly believe!).

I should also add, the approval of the term limit ballot measure will mean that elected officials (henceforth for those elected for a first term this time around) will be allowed to stay in one house for 12 full years rather than the current 6 years in the Assembly and 8 years in the Senate. This means that many legislators will choose to stay in the one house and hone their skills and power base. This will result in more stability, more professional capabilities to know and perform their jobs as legislators and, coupled with the open primary, more elected officials who will work ‘nicely’ with each other for the good of the state. So too, it will mean that legislators won’t be running all the time for the next office because they are being termed-out!

Another very telling and very interesting turn of events from last Tuesday were the results from San Diego and San Jose which in both cities, a super-majority voted for city worker pension reform. Sure, the turnout was the lowest on record which means that Republicans turned out in larger numbers than Democrats and

thus voted for the reforms, but the numbers in favor of the reforms were still far too great to translate into anything except a mandate that voters are tired of over-rich pensions that are killing their local governments. To this point, the Sacramento Bee published the following editorial this morning which I believe sums up the majority’s view on the subject matter:

Sacramento Bee Editorial: San Jose, San Diego raise bar on pension reform “Looking for a trend in Tuesday’s election? Look no further than pension reform results in San Diego and San Jose. As the Legislature dithers, fed-up voters in the state’s second- and third-largest cities overwhelmingly approved ballot measures that roll back benefits for current and future city workers.

The measures go further than anything union-friendly Democrats who control the Legislature are considering. They go much further than the modest pension reform plan that Gov. Jerry Brown has advanced, a plan that’s languishing in a joint Assembly-Senate committee.

Measure B in San Jose was the most politically significant because the South Bay city is a union town and Democratic Party stronghold.

Mayor Chuck Reed, who championed Measure B, is a Democrat. Despite strong labor opposition, city voters approved it with a whopping 70 percent of the vote.The San Jose measure allows current workers to keep the retirement benefits they have already earned, but to continue accruing benefits at the same level workers would have to contribute more of their own money, as much as 16 percent of salary. Alternatively, current workers could elect to enroll in a less generous retirement plan with a higher retirement age. Future hires would receive an even lower level of guaranteed benefits plus Social Security and a 401(k)-type retirement benefit.

In San Diego, 66 percent of voters approved Proposition B. It would freeze the amount of pay used to calculate retirement benefits for current workers. It would do away with guaranteed pensions entirely for most future workers. With the exception of police, San Diego city employees hired after the effective date of Proposition B would be enrolled in a defined benefit or 401(k)-type plan.

Like many local and state governments, San Diego and San Jose are paying out more and more in pension benefits each year. Those benefits now eat up roughly 20 percent of general fund spending in both cities. Payouts for pensions in San Diego rose from $137 million in 2006 to $231 million this year. San Jose pension costs zoomed from $73 million in 2001 to $245 million this year. To help pay those higher costs, both cities have had to lay off police officers and other city employees, close firehouses, reduce library hours and cut maintenance of parks and streets.Predictably, public employee unions have filed lawsuits in both cities, arguing the reform measures violate vested retirement rights of workers and interfere with their collective bargaining rights.

In the past, courts have been highly protective of pensions, particularly for current workers. Both cities claim their measures have been carefully crafted to avoid running afoul of state law or the constitution. Struggling municipalities across the country are watching closely to see how the courts respond.

But even if unions win in court, they lose. Generous public employee pensions approved in good times are simply unsustainable, both politically and economically. Increasingly, taxpayers are unwilling to fund a retirement system that allows most public workers to retire at age 55 with generous pensions and cost-of-living increases on top of that. Voters have become even more incensed as they watch their government services shrink at the same time. Finally, as they face layoffs, furloughs and pay

cuts, even younger public employee union members are beginning to balk.

The message from voters in San Jose and San Diego could not have been more clear. They want pension reform. Gov. Brown certainly heard them, saying, the day after the vote, that reform was “imperative.” If labor unions want to head off an eventual ballot initiative that goes far beyond what Brown has proposed, they should cut a deal with him.”

You pick up your ball and bat and you take out your mitt, and you are off to the game. But what game? Baseball? Softball? Cricket??

Just so with construction contracting: are you engaged in a public works project or is it private works? Given that they are similar but not necessarily the same, it is absolutely critical that contractors, and especially subcontractors, know who the owner is for any project they are on. Do not assume that sim-ply because the project is a subdivision that there cannot be a public Owner involved in the project. There can be; and if there is, then you have a different set of rules and if you don’t comply with those rules, you will lose some very important rights. In a recent case, a subcontractor lost its rights to claim on the payment bond because they didn’t realize that the prime contract was with a local public agency despite the fact that the project itself was a subdivision being developed by a private party. In California Paving & Grading Inc v Lincoln General Insurance Co, Cal. Paving sued the General Contractor’s pay-ment bond surety for money that it was owed. The problem was that Cal Paving thought the project was a private work of improvement. It wasn’t; the City of Los Angeles was a party to the development agreement and because it was, and because the work that Cal Paving performed was required in order for the City to approve the subdivision, Cal Paving’s work on the project was a public work of improvement. A whole different set of rules applied, Cal Paving did not comply with those rules, and as a result, lost its rights in court.

What did they do wrong?

First, Cal Paving was required to provide a Public Works 20-Day Notice, not a Private Works 20-Day Notice. The Private Works Notice that was provided was served on the General and on the Bond surety, but it was not served on the Public Owner. By statute, the Public Owner must receive that Notice or it is not effective. If the 20-Day Notice is not correct for the work being done, then the rights that it seeks to preserve are not preserved at all. Cal Paving tried to argue that it substantially complied

with the Notice requirement by providing the Private Works Notice to the General and to the surety. The court rejected that argument because the statute requires that the contractor and the Public Owner both receive the Notice. There are two distinct 20-Day Notices; one for public works and another for private works. In this case, because Cal Paving sent a “Private Works” Notice, it was, by definition, not compliant. Second, Cal Paving’s fundamental misunderstanding about the public nature of the Project caused it to believe that it had a longer period of time to sue the surety. If it had been a private works project, Cal Paving could have had up to 4 years to bring its action against the payment bond. For public works projects that time period is significantly reduced. By statute, in order to make a claim on a Public Works Pay-ment Bond, a subcontractor has to give notice of its claim to the surety within 15 days of the recording of the Notice of Comple-tion or, if there was no Notice of Completion, then the notice to the surety has to be made within 75 days of completion of the work. Thereafter, the sub must file its lawsuit against the Bond within six months of the last day that it could have filed a Stop Notice. This is not the case for claims against private works payment bonds. Cal Paving waited more than a year to file its action against the Bond. Cal Paving may have been a subcontractor to the Gen-eral that was hired by the developer, but that did not convert Cal Paving’s work from public improvement to private improve-ment. Cal Paving’s assumption that the type of project and the nature of the project determined how the project would be characterized and what rules and statute of limitations would apply was simply incorrect, and it paid the price. The point to take from all of this is that it is essential to know who the Owner is and whether the project is a public or a private work of improvement. The two types of projects have many similarities but the differences are critical and must be un-derstood. Be very clear who the parties are for all of the agree-ments that are upstream or downstream of your contract. Just because a project is seemingly a private development does not mean that it cannot be a public work of improvement. It can be, and if it is, there is a whole different set of rules that come into play. You need to comply with them; be sure you do.
