Senator Mark Leno Receives Award From MBA

Under current law, property owners can be held liable for injuries to uninsured workers and the Contractors’ License Board (CSLB) has no direct authority to intervene.

This bill gives the CSLB the tools they need to fight unlicensed contractors by providing the Registrar with the authority to issue administrative Stop Work Orders and an increased number of enforcement officers to ensure compliance.

This will help eliminate the unfair advantage unlicensed construction contractors have over legitimate licensees.

MBA,contractors and the State License Board reconizes and appreciates Senator, Mark Leno’s accomplishments towards the construction industry.

tYLeR DOheRtYCAL-West RentALs, inC.Cal-West Rentals, Inc. has been a family-owned North Bay business since 1958. For the last 30 years, it has been owned and managed by the Doherty family, with second generation owners and siblings Bridget and Tyler Doherty currently managing the business. Cal-West Rentals is proud to be the only rental company that is a member of the North Coast CLCA, and Tyler currently serves on theBoard of Directors.

Cal-West Rentals is located in Petaluma and frequently covers all over Marin, Sonoma, and Napa County, as well as all of Northern California. We are a full service equipment and party goods rental company that serves contractors, homeowners, ranchers, and the event industry. We pride ourselves in offering excellent customer service and quality equipment at competitive prices.

Pat Doherty started Petaluma Rental Center in 1978. He then bought Cal-West Rentals, Inc. in 1987 and subsequently consolidated both stores into our current location at 1300 Petaluma Blvd. N. in Petaluma. Pat died in a snowmobile accident in December of 2000, so his daughter Bridget decided to take over the business right after graduating from USC. She stepped into an already successful business with great management in place and huge support from the community.Tyler Doherty, Bridget’s younger brother, joined Cal-West Rentals in a full-time role in August of 2007 after graduating from UC Davis and working in sales for Ditch Witch for two years. He acts as the sales manager, as well as the many other roles that come with running your own business such as driver, yard worker, and occasional weekend manager.

Today, Bridget and Tyler work to grow and expand the family business while keeping the same strong focus on excellent customer service, quality equipment, and constant involvement in the community. Our business has been increasing each year as we expand our inventory to meet the growing demand of our expanding customer base. We are constantly upgrading our equipment and adding new models to our fleet to reach the different niche markets of both construction and party equipment rentals. We hope to continue to grow our equipment and customer base in Northern California in the upcoming years.

Meal and Rest Period Laws explained

State requirements and words like “user friendly” or “service” are NOT synonymous! Meal And Rest Requirements for Signatory Contractors - AB 569 Explained.

Let’s start off discussing AB 569 (Emmerson) - Chapter 662 of 2010 Statutes - which became law on January 1, 2011. This new law affects ONLY con-tractors who are signatory to a collective bargaining agreement (CBA). And, even if you are signatory, it still does NOT allow for your non-signatory office staff to utilize its benefits (or any other non-signato-ry employees).

Simply, the new law allows you to collectively bargain for the meal and rest period provisions in your agreement rather than having to comply with the existing meal and rest period law that applies to everyone else. The problem is, since the law is so new and most CBAs have been repeatedly extended, there’s nothing in any of them yet (regardless of the craft) that discusses this new law; however, I would urge you to carefully review each of your CBA‘s to ensure that there aren‘t some different provisions that don’t already exist . Consequently, until the re-spective CBAs are re-opened and meals and rests are addressed, the existing all encompassing meal and rest periods provisions discussed below still apply. And, once they are addressed in your CBA, if there are any gaps for some reason in terms of addressing both meal and rest periods, then the existing meal and rest period laws will apply.

Meal periods

In California, an employer may not employ an employee for a work period of more than five hours per day without providing the employee with a meal period of not less than thirty min-utes, except that if the total work period per day of the employee is no more than six hours, the meal period may be waived by mutual consent of both the employer and employee. A second meal period of not less than thirty minutes is required if an employee works more than ten hours per day, except that if the total hours worked is no more than 12 hours, the second meal period may be waived by mutual consent of the employer and employee only if the first meal period was not waived. Labor Code Section 512.

Unless the employee is relieved of all duty dur-ing his or her thirty minute meal period, the meal period shall be considered an “on duty” meal pe-riod that is counted as hours worked which must be compensated at the employee’s regular rate of pay. An “on duty” meal period shall be permit-ted only when the nature of the work prevents an employee from being relieved of all duty and when by written agreement between the employer and employee an on-the-job paid meal period is agreed to. The written agreement must state that the employee may, in writing, revoke the agree-ment at any time. IWC Orders 1 -15, Section 11, Order 16, Section 10.

The test of whether the nature of the work pre-vents an employee from being relieved of all duty is an objective one. An employer and employee may not agree to an on-duty meal period unless, based on objective criteria, any employee would be prevented from being relieved of all duty based on the necessary job duties. Some exam-ples of jobs that fit this category are a sole work-er in a coffee kiosk, a sole worker in an all-night convenience store, and a security guard stationed alone at a remote site.

If the employer requires the employee to remain at the work site or facility during the meal pe-riod, the meal period must be paid. This is true even where the employee is relieved of all work duties during the meal period. Bono Enterprises, In. v. Bradshaw (1995) 32 Cal.App.4th 968.

A key Assembly policy committee passed AB 397 (Monning/Berryhill) which is sponsored by the CSLB. AB 397 requires an active contractor licensee with an exemption for workers’ compensation insurance to recertify the exemption upon license renewal or provide proof of workers’ compensation insurance coverage. There are currently no provisions for the active maintenance of workers’ compensation exemption certifications. A license could have an exemption certification on file for years without need-ing to confirm that it is still an accurate representation of the licensee’s status. In many cas-es, when a licensee is questioned about his/her employee status by CSLB, it turns out that the licensee does have employees and has a workers’ compensation insurance policy, but has just not filed it with the CSLB. Proposed Storm Water Regulations Costly to Business

GSBE has been signed on to a coalition named WATER (Workable Approach to Environmen-tal Regulation). WATER is a coalition of business, taxpayers, and local governments that supports cost-effective water quality policies.

Thousands of California school districts, local governments, recycling facilities, truckers, manufacturers and other businesses currently comply with an Industrial General Storm Water Permit that requires them to manage storm water runoff through best management practices (BMPs). The State Water Resources Control Board has proposed a revised storm water permit that would require that these public agencies and businesses comply with several new requirements that are above and beyond what the US Environmental Protection Agency (EPA) mandates and will result in hundreds of millions of dollars in additional costs with no proven environmental benefits.

SAFETY TOPICAggressive Driving

Every year, the California Highway Patrol (CHP) reports approximately 500,000 collisions with 200,000 injuries and 4,000 fatalities as a result. Unsafe speed, improper turning, failure to yield the right of way, and obey traffic signals were the most frequent causes, which led the Department of Transportation (DOT) to estimate that two-thirds of traffic fatalities may be caused by aggressive driving.

Aggressive driving can be caused by longer commutes, traffic congestion, and other drivers’ behaviors. It can also be caused by your own mood, reactions, and ability to deal with stress on and off the road. Aggressive driving is triggered by anger – yours or another driver’s. Aggressive drivers are more likely to speed, make unsafe lane changes, ignore the right of way, and violate traffic signals. Aggressive driving behavior includes tailgating, unsafe passing, honking your horn, making rude gestures, or swearing at other drivers.

Don’t confuse aggressive driving with road rage. Blaring your horn in traffic or making rude gestures are not illegal, but they can escalate and lead to road rage. Road rage is a criminal act where a driver tries to intentionally injure or kill another driver, passenger, or pedestrian.

Help prevent aggressive driving (and road rage) by first adjusting your attitude. Forget the idea of “winning” on the road. Driving is not a race; it should not be a contest to see who finishes first. Leave plenty of time for a trip so that if traffic or another delay occurs, you can keep your cool.

Whether on Wall Street, in a casino, or on the highway, there will always be bad actors that want to break the rules. Ignore rude and bad drivers on the road. Unless you are a traffic safety officer, it is not your job to enforce the rules of the road or punish the bad behavior of others behind the wheel. Do not try to teach other drivers “a lesson.”

If you encounter an angry or aggressive driver on the road, don’t engage them. Avoid eye contact and do not make (or return) rude gestures or comments. Give an angry driver a lot of room by putting distance between you. Slow down or exit the roadway if necessary, but do not pull off to the side of the road or try to “reason” with an angry driver. Get help by using your cell phone or driving to a public area such as a police station or shopping center.

If you think you have a problem with anger on the road or aggressive driving, get help. Anger management classes or counseling can help you deal with the stress in your life and in your car that may be contributing to your behavior.

Keep your cool on the road and live to work and play another day.

Put yourself in the other driver’s shoes. Have you ever made a mistake on the road, been lost, or unsure of your turn-off point? Instead of being angry at another driver making the same mistakes, give them the benefit of the doubt. When you make mistakes, acknowledge them and give the drivers around you a friendly nod or wave. Polite behavior makes driving safer.

Conducir a una velocidad peligrosa, hacer giros inapropiados, no ceder el paso, y desobedecer las señales de tráfico fueron las causas más frecuentes, que llevaron al Departamento de Transporte (Department of Transportation, o DOT) a estimar que dos tercios de las muertes vehiculares fueron causadas por la conducción agresiva.

La conducción agresiva puede ser causada por los viajes cada vez más largos, la congestión del tráfico y el comportamiento de otros conductores. Si usted piensa que tiene un problema de furia al conducir o con la conducción agresiva, obtenga ayuda. Las clases o consejeros para controlar la furia pueden ayudarle a lidiar con el estrés en su vida y en su auto que puede estar contribuyendo a su comportamiento.

GILEAD HOUSE IN NOVATO IS ASKING FOR HELP!

Gilead House, a transitional house for homeless women and their children, would appreciate your help! We are building

a new home in downtown Novato that will provide shelter and a home for six (6) women and their children.

During their stay at Gilead House, we help the women get jobs, learn how to budget, save, complete their education and

offer other life skills leading to independent living and greater stability.

The new house is over 5,000 square feet and is expected to cost $2.6M. As a non-profit organization we are working to

reduce the overall costs with donations of materials and skilled labor. So far we have received several hundred thousand

dollars. We are privileged to have had McLeran Roofing, Inc. (a Marin Builders Association member)

provide the roof of the house as a donation. According to Brian McLeran, McLeran, Inc. President “this project

touched me and I am pleased to have had the opportunity to support a project that helps the homeless children who so

often fall through the cracks”.

At this time we are looking for a carpet installer, and someone who can volunteer a maximum of one day to assist the

volunteer contractor with finish electrical and/or finish plumbing. We would also appreciate a donation (or provide at

cost) the following: plumbing fixtures, hardscape materials (pavers or concrete), electrical trim (canned light trim, wall

receptacles, wall switches). Gilead House is truly a community project and a labor of love. You can be a part of this

and make a difference in the lives of mothers and their children.
