“Dirty Dozen” List of Tax Scams for the 2015 Filing Season

Construction Bills Being Introduced This SessionEvery year about this time, the construction lobbyists who make up the ‘Construction Caucus’ get together for an afternoon to discuss bills that each member of the caucus plans to have introduced in the Legislature for the session. While invariably others may well be introduced, or the ones that were discussed become amended at some point, following are the remarkable few (this is the lowest amount in memory) that were reported on the other day.

I). Storm Water Plan Preparation – Public and private owners of construction projects in California disturbing one or more acres of land are required to comply with National Pollutant Discharge Elimination Systems permit requirements. The permit regulates the discharge of stormwater and non-stormwater from certain construction activities and is enforced by Regional Water Quality Control Boards. The permit requires, among other things, the development of a site-specific Stormwater Pollution Prevention Plan (SWPPP) that demonstrates compliance with the permit.

Although the permit allocates SWPPP design responsibility to project owners – including the corresponding risk of penalties for design defects – many owners attempt to transfer design responsibility/risk to their contractors. This is done through broad contractual indemnity provisions and design-risk shifting requirements contrary to California Public Contract Code Section 1104. As a result, contractors:1). Are forced to hire a design firm to design the SWPPP/act as QSD; and2). Often attempt to transfer the risk of penalties down to their subcontractors through similarly broad subcontract indemnity provisions.

Proposed Legislation – This bill will require the owner of a site to retain responsibility for discharge from their own property. This bill does NOT relieve contractors of their duty to prevent stormwater pollution. Where a contractor is negligent in constructing the SWPPP, the owner retains the right to hold the contractor responsible for the resulting penalties. Additionally, the Regional Water Quality Boards retain their rights to fine any person directly for violations of the permit.

II). Use of Bonds In Prevailing Wage Claims – Under current law, if you as a contractor have received a wage and penalty

assessment under public works law, as an alternative to becoming automatically liable for liquidated damages in specified circumstances, you may deposit the full amount of the fine in cash with the Department of Industrial Relations. Besides being stuck ‘shelling out’ a large amount of money, EVEN if you are exonerated, the Department can and does hold the full amount of your money for an ungodly amount of time.

Proposed Legislation – This bill will allow for a contractor to post a surety bond in lieu of cash.

III). Prompt Pay On Change Orders – How many times have you performed a public works project where the agency orders you to do change orders, only to be ‘stuck’ trying to get paid for the extra work? Often times the extra work goes into a dispute, many agencies threaten false claims and ultimately you ‘eat’ part or all of the extra work!

Proposed Legislation – This bill will require that the non-disputed extra work be paid promptly and that any disputed work be taken to mediation as quickly as possible. This bill is still a work in progress at this time.

The lobbyists for the building trades are also members of the Construction Caucus. They too have several bills they are introducing:

I). Prevailing Wages For Ready Mix Drivers on Public Works Projects – It appears that there is no requirement for drivers of ready mix trucks to be paid the prevailing wage for deliveries to a public works project.

Proposed Legislation – This measure will require that prevailing wages be paid to all ready mix drivers traveling to and from a public works project

II). Prequalification of All Contractors on Lease/Lease Back Projects – There has been considerable consternation by the building trades and others about lease/lease back projects, most of which are built as schools.

Proposed Legislation - There is concern that many of the contractors performing these projects have bad safety records or have had other issues which could be resolved if there was a pre-qualification requirement for any contractor wishing to participate on one of these projects.

III). Require Competitive Bidding on all Water Projects Funded by the Recent Water Bond, Proposition 1 – Proposition 1 that was approved by the voters this past November authorizes the expenditure of $6.4 billion on myriad water projects including improvements, storage and other measures.

Proposed Legislation – This measure would require that all construction-related

work created and paid for by the approved bonds would have to go out to competitive bid. Currently, there is no provision in the law created by the proposition to require competitive bidding!

School Bond Measure For Future Ballot – There was an in-depth discussion about the growing need for funds to upgrade, replace or build additional schools around the state. Unfortunately, the ‘pot of money’ has run dry and the California Building Industries Association, along with the school districts and myriad other interest groups are ‘floating’ the idea about a possible bond measure either sometime in 2015 or 2016. There was consensus agreement that now is NOT the time to be pushing for a new bond measure for schools, particularly in 2015! ‘Word’ has it, that the governor has also weighed –in to the organizers cautioning them to ‘back-off’ because it will lose badly!

WASHINGTON — The Internal Revenue Service today warned taxpayers to watch out for fake emails or websites looking to steal personal information. These “phishing” schemes continue to be on the annual IRS list of “Dirty Dozen” tax scams for the 2015 filing season.“The IRS won’t send you an email about a bill or refund out of the blue. Don’t click on one claiming to be from the IRS that takes you by surprise,” said IRS Commissioner John Koskinen. “I urge taxpayers to be wary of clicking on strange emails and websites.

They may be scams to steal your personal information.”Compiled annually, the “Dirty Dozen” lists a variety of common scams that taxpayers may encounter anytime but many of these schemes peak during filing season as people prepare their returns or find people to help with their taxes.

Illegal scams can lead to significant penalties and interest and possible criminal prosecution. IRS Criminal Investigation works closely with the Department of Justice (DOJ) to shutdown scams and prosecute the criminals behind them.

Stop and Think before Clicking

Phishing is a scam typically carried out with the help of unsolicited email or a fake website that poses as a legitimate site to lure in potential victims and prompt them to provide valuable personal and financial information. Armed with this information, a criminal can commit identity theft or financial theft.If you receive an unsolicited email that appears to be from either the IRS or an organization closely linked to the IRS, such as the Electronic Federal Tax Payment System (EFTPS), report it by sending it to [email protected].

It is important to keep in mind the IRS generally does not initiate contact with taxpayers by email to request personal or financial information. This includes any type of electronic communication, such as text messages and social media channels. The IRS has information online that can help you protect yourself from email scams.

Q: We have been licensed for many years

in California as a corporation. Now that

California is licensing Limited Liability

Companies (LLC) we recently applied for a

license for our LLC, which is how we conduct

business in many other States. We are General

Engineering contractors and our business name

is our owner’s name, followed by “Construction

LLC”. Our application was rejected because

the CSLB is stating that we cannot use the

word “Construction” in our name. They are

requiring that we adopt a ‘doing business as’

name (dba). For obvious reasons we don’t want

a different name in California than we have in

other States and the President is arguing that

there must be some way around this. Is there a

law that you can point me to that I can provide

to our President with regards to contracting

company companies using “Construction” in

their business name?

A: There is no code section that specifically

addresses the use of the word “Construction”.

B & P Code Section 7059.1 states that a

business name needs to be compatible with

the classification that is being performed. The

CSLB has determined that General Building

(“B”) contractors are the ONLY license

holders that can use “Construction” in a

business name without giving descriptive or

limiting words. Therefore, you can still use

the word “Construction” in your name, but it

needs to be prefaced with a descriptive word.

As an example, “John Smith Engineering

Construction LLC” would likely be acceptable.

Q: I am a General Building contractor and I

want to add the “C-8” Concrete classification

to my license. Is there any way that I can get a

Waiver of the exam based on the fact that I’ve

been doing concrete work with my General

license for many years?

A: There are certain circumstances where

you can ask for a Waiver of a Specialty

Classification based on the current classification

that you hold. The CSLB may consider a

waiver if you meet the following requirements:

a) The Qualifier has been listed as a member

of the personnel for five of the last seven

years immediately preceding the application;

b) The Qualifier has at least four years of

experience within the last 10 (Journeyman level

or above) in the classification being applied

for; and c) The classification being applied

for, as determined by the Registrar, is closely

related and is a significant component of the

classification currently on the license.

Be aware that when requesting a Waiver of

an additional classification you will likely be

required to provide additional documentation,

such as detailed project forms showing that your

additional classification has been a significant

part of your work.

Q: I have a Sole Owner license and I recently

incorporated. Do I just need to submit a name

change application to the CSLB?

A: No, since you formed a new corporate

entity you are required to submit a new license

(waiver) application. As long as you own at

least 51% of the corporation you can transfer

your Sole Owner license number to the

corporation, however be aware that if you do

that you can never get it back as a Sole Owner

in the future.

When a Motor Vehicle Accident Happens

As drivers, we must do all we can to prevent accidents: If you are in an accident, you should know what to do so the situation is not made worse. Your actions should be almost automatic. • Make sure to report the accident: No matter who is responsible, every vehicular

accident must be reported at once. It is a criminal offense to leave the scene of any accident before identifying yourself.

• Turn the vehicle off: If you are in an accident, turn off the ignition and try your best to stay off the road. Commercial drivers must comply with Motor Carrier Safety Regulations and set up reflective triangles and flags or flares.

• Stay at the scene of the

accident: Stay until someone relieves you, unless you need medical attention or go to call for help.

• Call the appropriate people: Call the police and your home and or office

immediately.

• Collect information: Get the license numbers of all vehicles involved and the names and addresses of all drivers and passengers. If there has been any property damage, get the name and address of the owner or owners. List the companies that insure the property and vehicles. Try to get the names and addresses of anyone at the scene, whether they actually saw the accident or not.

• Do not argue or discuss fault: People are usually emotionally upset at an accident and will argue without making much sense. Arguing only prevents you from getting the facts down on paper. A good driver sets a good example by his or her behavior at the accident scene. One should be calm and businesslike.

• Search for the owner: If the accident involves an unattended vehicle, do a reasonable search for the owner. If the owner cannot be found, leave a note in a conspicuous place, so they can contact you. Inform the police and ask if they want you to remain at the scene.

When a Motor Vehicle Accident Happens

• Don’t move injured victims: Never move injured victims unless it is absolutely

necessary to get them away from fire or passing traffic. Moving them can easily make their condition worse, especially if they have internal injuries. If there are injuries, call 911 immediately. Give first aid, but only if you are certified and confident in what you are doing.

• Keep other people away: If people gather around, help keep them away from the victims and accident scene so as not to destroy any of the evidence e.g., skid marks and parts of vehicles. Keep everyone away from spilled fuel or other materials – a careless cigarette toss can turn a minor accident into a major one.

• Take pictures: If you have a camera, take several pictures from different angles including the directions from which the vehicles approached the accident location.

• Make a record: As soon as time is available, write an account of the accident as it looked to you. Fill out all required incident investigation forms and insurance reports. Such reports may seem like a burden at the time, but your description can be the basis for preventing such accidents in the future.

Above all, be prepared and be thoroughly familiar with your organization's policies and procedures regarding accidents.

Cuando ocurre un accidente de vehículos automotores

Como conductores, debemos hacer todo lo posible para prevenir accidentes: Si sufres o te ves involucrado en un accidente, debes saber qué hacer para no empeorar la situación. Tus acciones deben ser casi automáticas. • Asegúrate de reportar el accidente: Sin importar quién sea responsable, todos

los accidentes vehiculares debe ser reportados de inmediato. Es un delito retirarte del lugar de un accidente antes de identificarte.

• Apaga el vehículo: Si te ves involucrado en un accidente, apaga el motor y haz tu mejor esfuerzo por salir del camino. Los conductores comerciales deben observar Reglamento de Seguridad de Autotransportes y colocar triángulos reflejantes y banderas o luces de emergencia.

• Permanece en el lugar del

accidente: Quédate hasta que alguien te sustituya, a menos que requieras atención médica o que vayas a pedir ayuda.

• Llama a las personas correctas: Llama a la policía, a tu casa y/o oficina de

inmediato.

• Recaba información: Obtén la matrícula de todos los vehículos involucrados y los nombres y direcciones de todos los conductores y pasajeros. Si ha habido daños a propiedades, anota el nombre y dirección de el o los propietarios. Toma nota de las empresas aseguradoras de las propiedades y vehículos. Trata de obtener los nombres y direcciones de todos en el lugar, ya sea que hayan visto el accidente o no.

• No pelees ni discutas responsabilidades: Normalmente las personas están emocionalmente alteradas y discuten sin lógica. Discutir sólo impide que puedas tomar nota de los hechos. Un buen conductor pone el buen ejemplo con su conducta en la escena de un accidente. Siempre hay que mantener la calma y seriedad.

• Busca al propietario: Si el accidente involucra a un vehículo desocupado, haz un

esfuerzo razonable para localizar al dueño. Si no logras localizar al dueño, deja una nota en un lugar visible para que pueda contactarte. Informa a la policía y pregunta si quieren que permanezcas en el lugar.

• No muevas a víctimas lesionados: Nunca muevas a una víctima lesionada, a

menos que sea absolutamente necesario para alejarle del fuego o del tráfico que circula. Moverlo puede fácilmente empeorar su condición, especialmente si existen lesiones internas. Si hay lesiones, llama al 911 de inmediato. Aplica primeros auxilios, pero únicamente si estás certificado y tienes la certeza de saber lo que estás haciendo.

• Mantén alejadas a las demás personas: Si se acerca gente, ayuda a mantenerles alejados de las víctimas y del lugar del accidente, para evitar destruir evidencia, por ejemplo marcas de derrape y partes de vehículos. Aleja a todos de cualquier derrame de combustible o de otros materiales - un cigarrillo aventado por descuido puede convertir un accidente menor en uno mayor.

• Toma fotos: Si tienes una cámara, toma varias fotos desde ángulos diferentes, incluyendo las direcciones desde donde los vehículos se aproximaron al lugar del accidente.

• Haz un reporte: Tan pronto como tengas tiempo disponible, escribe un recuento del accidente como tú lo viste. Llena todos los formularios requeridos de investigación de incidentes y de reporte de seguros. Estos formularios pueden parecer una molestia de momento, pero tu descripción puede ser la base para prevenir accidentes similares en el futuro.

Sobre todo, siempre está preparado y familiarizado por completo con las políticas y procedimientos de tu empresa en cuanto a accidentes.

For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.
