A C-27 Landscaping license will be required and the Engineer’s estimated cost for the accom-plishment of this work is $95,000.

A prebid conference will be held at 1:30 PM on Wednes-day, October 3, 2012 at Paradise Beach County Park lo-cated at 3450 Paradise Drive, Tiburon, CA 94920. The governor has only until this Sunday night, September 30th at

Midnight to act on the remaining hundreds of bills that were sent

to him by the Legislature. As you may recall from past years,

I will be sending out my annual Year End Legislative Report in

the latter part of October. This informative report provides you

with an in-depth recap of the year’s events in the Capitol and then

provides you with everything you need to know about the new

laws that will be affecting you and your business.

CalChamber Reminds Employers of Guidelines for Political

Communications to Employees

With just six weeks remaining until the november 2 general

election, the California Chamber of Commerce is reminding

employers about guidelines to follow for political communications

to employees.

The dos and don’ts are summarized in the CalChamber

“Guidelines for Political Communications to Employees”

brochure. The brochure can be downloaded at:

Informing employees and stockholders about the impact of

proposed ballot measures, legislation and regulations is within

an employer’s rights as a business owner, the brochure points

out. Employers should remember, however, not to use paycheck

stuffers to communicate the message, the CalChamber warns.

As outlined in the brochure, an employer can communicate with

its stockholders, employees and their families about the company’s

support of or opposition to state legislation, regulations or ballot

measures. Encouraging those groups to support or oppose state

legislation, regulations or ballot measures also is permitted.

Employers cannot coerce, reward or punish employees (or threaten

to do so) for their political activities or beliefs.

Spending for internal communications to employees, stockholders

and their families need not be reported when expenses are below

a certain level, the brochure notes. Communications to external

audiences—such as non-stockholder retirees, outside vendors,

customers and passersby—must be reported.

California has changed from a state people seek to live in to one

that people move from and attempts to analyze the reasons for the

change. Below is the Executive Summary of the report. The full

For decades after World War II, California was a destination for

Americans in search of a better life. In many people’s minds,

it was the state with more jobs, more space, more sunlight, and

more opportunity. They voted with their feet, and California grew

spectacularly (its population increased by 137 percent between

1960 and 2010). However, this golden age of migration into the

state is over. For the past two decades, California has been sending

more people to other American states than it receives from them.

Since 1990, the state has lost nearly 3.4 million residents through

this migration.

This study describes the great ongoing California exodus, using

data from the Census, the Internal Revenue Service, the state’s

Department of Finance, the Bureau of Labor Statistics, the Federal

Housing Finance Agency, and other sources. We map in detail

where in California the migrants come from, and where they go

when they leave the state. We then analyze the data to determine

the likely causes of California’s decline and the lessons that its

decline holds for other states.

The data show a pattern of movement over the past decade from

California mainly to states in the western and southern U.S.:

Texas, nevada, and Arizona, in that order, are the top magnet

states. Oregon, Washington, Colorado, Idaho, and Utah follow.

Rounding out the top ten are two southern states: Georgia and

South Carolina.

A finer-grained regional analysis reveals that the main current of

migration out of California in the past decade has flowed eastward

across the Colorado River, reversing the storied passages of the

Dust Bowl era. Southern California had about 55 percent of the

state’s population in 2000 but accounted for about 65 percent

of the net out-migration in the decade that followed. More than

70 percent of the state’s net migration to Texas came from

California’s south.

What has caused California’s transformation from a “pull in”

to a “push out” state? The data have revealed several crucial

drivers. One is chronic economic adversity (in most years,

California unemployment is above the national average). Another

is density: the Los Angeles and Orange County region now has

a population density of 6,999.3 per square mile—well ahead of

new York or Chicago. Dense coastal areas are a source of internal

migration, as people seek more space in California’s interior, as

well as migration to other states. A third factor is state and local

governments’ constant fiscal instability, which sends at least two

discouraging messages to businesses and individuals. One is

that they cannot count on state and local governments to provide

essential services—much less, tax breaks or other incentives.

Second, chronically out-of-balance budgets can be seen as tax

hikes waiting to happen.

The data also reveal the motives that drive individuals and

businesses to leave California. One of these, of course, is work.

States with low unemployment rates, such as Texas, are drawing

people from California, whose rate is above the national average.

Taxation also appears to be a factor, especially as it contributes

to the business climate and, in turn, jobs. Most of the destination

states favored by Californians have lower taxes. States that have

gained the most at California’s expense are rated as having better

business climates. The data suggest that many cost drivers—

taxes, regulations, the high price of housing and commercial real

estate, costly electricity, union power, and high labor costs—are

prompting businesses to locate outside California, thus helping to

drive the exodus.

Population change, along with the migration patterns that shape

it, are important indicators of fiscal and political health. Migration

choices reveal an important truth: some states understand how to

get richer, while others seem to have lost the touch. California is a

state in the latter group, but it can be put back on track. All it takes

is the political will.

Q: Do I have to own any shares in a Corporation as RMO in order to qualify for a license?

A: There is no requirement that a RMO own any shares of the corporation. This being said, an existing contractor should notify the CSLB regarding any change in ownership. Owning less than 10% of corporate stock will require the company to post a $12,500 Bond of Qualifying Individual. If applying for a new license, this ‘ownership’ question is asked on the application. Please contact us if you have further questions.

Q: Can you provide me with a list of plumbers in my area? A: While we don’t have that information readily available, the CSLB will provide you with a list of specific contractors based on certain criteria. The form allows you to pick parameters such as classification, business type, county, etc. There is a $245 fee for this service. The form can be found on the CSLB web site.

Q: It’s been a long time... hope you are doing well. We are surviv-ing...actually more than surviving. Our landscape business, which had been very slow the past two years, is picking up now. In fact we are thinking of re-tooling for a final push to sell it before I retire... that is the nature of my inquiry.

Can I change the name of a corporate license? I think having my name as the business name may limit our possibilities to expand and ultimately sell the whole business to a non-family member. My boys are in completely different fields and really don’t want to carry on with this business. Or perhaps we do a DBA with a different name? Got any ideas? Thanks.

A: nice to hear that things are going well. Have you decided how you’re going to sell the business -- asset or stock sale? If an asset sale, the buyer will likely set up their own corporation; purchase the assets, and continue operating as you have been doing for years. The buyer may want to keep your existing name or change it. Ei-

ther way, it should not matter what official name you’re using at the time of sale.

With a stock sale, again, the buyer can continue using your existing business name or amend it. You certainly could add a dba, howev-er, I’m not sure it would make a big difference since the buyer will be looking at your profitability and other financial considerations. They may even want to maintain the existing name because it is known in the community.

We recommend that you contact a professional business broker or your legal council. Discuss these questions with him or her, includ-ing the issue of the business name. Are You Practicing Scaffolding Safety?The majority of scaffold accidents on the construction site are caused by falls, slipping or being struck by an object from above. All of these accidents can be prevented by taking the proper precautions. Here’s how. General Safety Tips

• To prevent slipping hazards, conduct a daily routine inspection to ensure all walking and working surfaces are free from potential hazards. If you spot a hazard, remove it.

• Never move, dismantle or alter a scaffold unless under the supervision of a qualified person while doing such activities.

• Never move a scaffold with workers still on it.

• Keep scaffold loads below maximum capacity and remove your equipment when the scaffold is not in use.

• Be alert for bad weather. High winds and driving rain and snow can be dangerous when working at high levels.

Protection for Those Below

Always hoist up heavy tools, equipment and supplies, rather than carry them up by hand.

There must be a 3½"-high toe board to prevent things falling off a scaffold. If things on the scaffold are taller than 3½" (above the toeboard) other

systems, like debris nets, must be used to catch falling tools or materials.

Always wear a hard hat when working on and around a scaffold.

Never walk under or near the scaffold if roped off when work is being performed above.

Fall Protection Basics To help protect you against potentially deadly falls, fall protection is needed when working 6 feet or more above a lower level, and consists of either a personal fall-arrest system or guardrail systems, depending on the job. If using a fall arrest system, keep the following in mind:

• Always attach your lanyard to a vertical lifeline, horizontal lifeline or scaffold structural member.

• If you are using a vertical lifeline, make sure that you are fastened to a fixed safe point of anchorage, independent of the scaffold. This includes structural members of buildings, but not standpipes, vents, electrical conduit, etc. They may give way under the force of a fall.

• Clean and test your gear regularly, and never tamper with your fall protection system.

When working on scaffolding, your safety is our top priority. Make it yours, too!

When working on or around scaffolding, following some simple safety tips goes a long way in preventing injuries from slips, falls and being struck by falling objects.

¿Pone en práctica la seguridad en andamios?La mayoría de los accidentes en andamios en los lugares de construcción son causados por caídas, resbalones u objetos que caen provocando heridas. Todos estos accidentes se pueden evitar tomando las precauciones adecuadas. Descubra cómo hacerlo. Consejos generales de seguridad

• Para evitar peligros de resbalones, realice una inspección diaria de rutina para verificar que en todas las superficies de trabajo y por donde se camina no haya posibles riesgos. Si divisa un riesgo, elimínelo.

• Nunca mueva, desmonte o altere un andamio a menos que se encuentre bajo la supervisión de una persona capacitada mientras realiza tales actividades.

• Nunca mueva un andamio con trabajadores que todavía se encuentren sobre él.

• Mantenga las cargas de andamio por debajo de la capacidad máxima y quite su equipo cuando el andamio no esté en uso.

• Esté atento al mal clima. Los vientos fuertes y la nieve y lluvia intensa pueden ser peligrosos cuando trabaja en niveles altos.

Protección para los de abajo

Siempre eleve las herramientas pesadas, el equipo y los suministros en lugar de llevarlos en la mano.

Debe haber un tablón de pie de 3½" de alto para evitar que las cosas caigan del andamio. Si las cosas sobre el andamio son más altas que 3½" (sobre el tablón de pie), otros sistemas, como redes de desechos, se deben utilizar para atrapar las

herramientas o materiales que puedan caer.

Siempre use un casco cuando trabaje sobre y alrededor de un andamio.

Nunca camine debajo o cerca del andamio si está cercado cuando se está realizando trabajo arriba.

Puntos básicos para la protección de caídas Para ayudarlo a protegerse de caídas posiblemente fatales, es necesaria la protección contra caídas cuando trabaja a más de 6 pies sobre un nivel inferior. Esta protección consiste en un sistema personal para detención de caídas o en un sistema de baranda de seguridad, según el trabajo. Si utiliza un sistema para detención de caídas tenga en cuenta lo siguiente:

• Siempre ate su acollador a una cuerda de salvamento vertical, a una cuerda de salvamento horizontal o a una extremidad estructural del andamio.

• Si utiliza una cuerda de salvamento vertical verifique que esté sujeta a un punto fijo de seguridad, independiente del andamio. Esto incluye extremidades estructurales de edificios pero no incluye columnas reguladoras, ventilaciones, conductos eléctricos, etc. Pueden sucumbir ante la fuerza de una caída.

• Limpie y pruebe su equipo regularmente y nunca altere el sistema de protección contra caídas.
