Les Residences development consists of four private luxury residential villas. The development is the last of a new generation of luxury coastal homes being built in Jersey`s very own `Sandbanks` so in terms of exclusivity it has no equal.

Gorey Prices from £2,950,000

All the villas have been designed to make the most of the magnificent sea views and to allow for maximum flexibility in the layout of the interior. Spacious and stylish living areas with private terraces and balconies have been created for al fresco dining and relaxation. The interior of all three floors can be arranged to suit one’s own personal preferences. Each villa has its own large private garage and there is ample additional parking for guests.

The design, build quality and in particular the use of specialist materials is to the highest specification. The level of craftsmanship and artisans used throughout the development is World Class.

The semi-circular shaped layout of the development allows for maximum privacy. Access from the adjoining coast road is through electronically controlled security gates into secure landscaped gardens.

With the beach a stone’s throw away from the Villa`s private terraces and balconies and the harbour just a couple of minutes’ walk from the front door. The Royal Jersey Golf course, which is an 18-hole links course made famous by local boy and golfing legend Harry Vardon is literally a few minutes’ walk across the road by the beach. Close-by in Gorey village it boasts a variety of high class restaurants, chic bars, boutique shops and all the local amenities which one requires.

Buying a property can be both exciting and daunting. For most of us we are required to arrange a large mortgage to fund the purchase.

Once in place this debt remains payable and passes to our dependants in the unfortunate event of our death. A simple life assurance contract can provide the peace of mind that your loved ones have su cient money to repay the debt, at what is likely to be a very stressful time. We can help you to understand your options, from the very basic cover, for those who are budget conscious, to the more comprehensive schemes that can also provide fi nancial assistance in the event of your ill health.

Please call Hayley at Henley Financial on 789830 or email hayley@henleyfi nancial.je if you would like to fi nd out more.

The Importance of Life Cover

BASE RATE COUNTDOWN When will the Bank of England Base Rate start to rise? The Bank of England has at last admitted that they don’t expect rates to rise signifi cantly until 2020! Between now and then, however, we should expect to see several small increas-es of 0.25%, the fi rst one possibly occurring later this year, or in 2016. Do remember that infl uences outside of the UK could change these projections quickly.

BUYING IN FRANCE?With the French economy struggling the prices of property in France are even more negotiable than before. Linking this to the signifi cant improvement in Sterling exchange rates against the Euro means that the opportunity to purchase a second home in France is now far greater than it has been for many years.

WE REALLY LIKE THESE MORTGAGE INTEREST RATES!

60% discount 0.99%65% tracker 1.65%70% 5 year fi xed 2.69%85% 3 year fi xed 3.05%85% 5 year fi xed 3.99%90% 5 year fi xed 3.94%100% 5 year fi xed 5.99%

FIXED RATE OR TRACKER RATE?

During the past two years we have been recommending that borrowers should consider locking into a fi xed rate. With the increasing prospect of rates remaining low we think that a tracker or a discounted rate could be a good choice for the next two or three years.

JERSEY MARKETJanuary is always a busy month as new buyers enter the market, although this year seems to have got o to a much busier start than was expected.

The local economy, especially in the areas of fi nance and construction is surging forward with greater activity and this will increase the amount of disposable income available in the Island, which could in turn suggest that the property market will at last start to move. It is very apparent that one can still haggle over asking prices, although this opportunity might not last much longer, as more determined buyers enter the market.

SAFE ROOMS & HIDDEN SPACESThe end is nigh. It could be nuclear doomsday or deep asteroid impact. As panicked crowds rush to the streets fecklessly fl apping in mortal terror, you calmly push upon the secret entrance to a hidden safe room and step into your inner sanctum.

Constructing a hidden space is the latest popular trend in home improvement, perhaps inspired by the Batman franchise. Don’t think it’s the sole province of eccentric billionaires with secret identities. A secret room is insulated from the outside world and can be anything you want it to be: your own recording studio, private gym, study or secret cinema.

You don’t need to add an extra wing to your home. Simply convert that spare bedroom or unused living space by constructing a bookcase to attach to the front of the door. This will be an entrance on hinges that opens up into your secret area, imperceptible to even the most curious of onlookers.

To build a hidden door bookshelf, you will need to reinforce the door frame with steel to support the weight so its swings open easily. You will need a professional to calculate the right size of frame to house a bookshelf later. They can then weld bolts to act as pivot pins to fi t into a celling or fl oor mount.

After installing the mounts to act as top and base anchor you then attach the frame with the pivot bolts, and then test to see the door swings correctly. Next up, build the bookcase in the frame ensuring there is enough clearance to swing freely. A carpenter can build a bespoke bookcase for you, trimmed to fi t your frame perfectly.

Placing a wooden or magnetic door stop above the door will ensure the door doesn’t swing open of its own accord and reveal your secrets. Load up your books or vinyl and step back to admire the e ect.

Amongst the list of members of the Jersey Construction Council, you will fi nd experts who can help with the carpentry, building and electrics to create your secret lair. But remember, Mum’s the word…

Taking your first step onto the property ladder can be a daunting task. Understanding the different types of property and understanding the buying process is key. Buyers will need to consider all types of property within their budget and many first time buyers will be considering the purchase of an apartment.

In Jersey, apartments can be acquired by way of flying freehold, share transfer and, less commonly, leasehold. So what is the difference?

Flying freehold apartments are acquired through the transfer of a “lot” or share in a property that is subject to a Declaration of Co-Ownership. The Declaration sets out the rights and obligations of the share owners who together form an Association of Co-Owners. The share(s) grant an exclusive interest in a particular apartment, car parking space/s or store along with a percentage interest in the common parts. A proportion of the administration and maintenance costs of the common parts (typically comprising external and structural parts, common areas and amenities) is payable by each owner of a share. The Association of Co-Owners decides upon maintenance and other common issues by majority vote and contributions are collected by the Association Representative or Managing Agent, usually by way of a monthly or quarterly service charge.

Share transfer transactions involve buying a block of shares in a Company which owns the land and the building where the apartment is situated. As such, a buyer is not acquiring freehold property but a shareholding in

the Company. The Company’s Articles of Association will confer upon its shareholders certain rights and obligations, including rights to occupy a specific apartment, parking space/s or store as the case may be. Whilst the manner of acquisition is different, in practice, the shareholder has similar

rights to those that he would enjoy with a flying freehold apartment. In a similar way to flying freehold, the buyer will have an obligation to contribute towards the common expenditure and, again, this is usually collected by way of a regular service charge. A Company Secretary will administer of the company’s records and is responsible for convening meetings of the shareholders (who will typically also be the directors of the company) to decide upon management and maintenance issues.

Long-term residential leaseholds are quite unusual in Jersey. The original term of the lease may be for many years but as the term reduces year on year, the value

of the investment will fall. The lease will contain provisions for the maintenance of the apartment and is likely to require a contribution towards the maintenance of the common parts of the building in which it is situated. A number of older publicly owned leasehold apartments have in recent years

been converted to flying freehold ownership as they had reached the point where lenders would not grant mortgages due to the limited remaining lease term.

In addition to checking legal title to the property, your legal adviser should review all the Association, Company or Leasehold records and ensure that you are fully advised as to the rights and responsibilities, financial obligations and that you are made aware of any issues that may be evident. These can be complicated transactions with a lot of paperwork, so choose your adviser carefully so that you can be confident of completing your purchase smoothly and getting that first foot firmly on the property ladder.

In Jersey, apartments can be acquired by way of flying freehold, share transfer and, less commonly, leasehold. So what is the difference?

PROPERTY PROFILE

There’s something extra-special about homes that have managed to retain their historic integrity yet still succeed

to o er modern-day conveniences. This charming, turn-of-the-century St Ouen’s property does just that.

Lovingly restored with an eye to both historical accuracy and everyday comforts, La Maison du Portinfer has been sympathetically renovated to extremely high standards. Period details including feature fi replaces brandishing granite corbels (one of which is said to date back to the 1500’s), sash windows, exposed brick walls and stable doors, beamed ceilings and a butlers sink take center stage, while present-day fi xtures such as the chef-worthy ‘Christians’ kitchen, oil fi red triple AGA, new solid Oak fl ooring and fully insulated assets hum unassumingly in the background. The house itself is an amalgam of muted yet warm hues, traditional style, and lavish add-ons. La Maison du Portinfer is a home that truly captivates with its comforts and luxury country style. Accessed via a large driveway, this picturesque granite property, part of which dates back to 1500’s, oozes oodles of historical veracity. It’s little wonder it features in Joan Steven’s book ‘Old Jersey Houses’. From the outside, the ivy-clad stonewalls radiate a certain sense of enchantment, whilst the south-facing gardens –

comprising two equally delightful areas – boast a formal lavender-fi lled, gravel expanse with symmetrical planting, low hedging and easy access to green lane, as well as a lawned area brimming with an array of colourful trees and fragrant shrubs. It’s here you’ll also stumble upon an ample sized pond, quaint orchid (which comes alive in the summer months) and concealed pergola leading to the 2 vergees of equine fi eld – the perfect spot for those with an interest in the equestrian industry. Bordering the drive is an additional 3 vergee agricultural fi eld. Accompanying the main house is a large barn and cottage – this exciting renovation project not only brandishes an artful assemblage of rooms, it could easily be transformed into a handful of stylish holiday cottages. If refurbished sympathetically, potential owners could even use the old world country charm of these quaint outer buildings to their advantage. Across the formal garden is a delightful Bake house, another area brimming with potential that would have once, probably provided bread to the entire parish. Regardless of whether you choose to fashion this plot into the perfect lodgings for visiting guests, or multigenerational living quarters – the options are endless.

Page 19: Places Edition 118

19

Another of La Maison du Portinfer’s many allures is its location. Sited in a peaceful area of St Ouen, just a short hop from a handful of prestigious schools, the village and numerous beaches, you’re surrounded by attractions and amenities. Yet despite this, the property itself feels somewhat secluded – set back from the main road and enveloped by fi elds, it’s easy to assume you’re miles away from civilization.  Internally, the main house boasts a large family kitchen – by far the hub of this charismatic country home – with expansive French doors leading out to the garden. The entire space, even on a dull day, is awash with natural sunlight light. Further more, you’ll fi nd two principle reception rooms, both of which exude a cosy charm, fl aunting exquisite fi replaces and beamed ceilings. Upstairs, both bedrooms have been dressed in an elegant style. You’ll also fi nd a three

THE ASSOCIATIONNews from the Jersey Estate Agents’ Association

WORDS Shelagh Marett & John QuemardJoint presidents, Jersey Estate Agents’ Association

NEW YEAR… NEW CHALLENGES AHEAD

The Jersey Estate Agents’ Association is committed to raising the standards in estate agency in Jersey. For reliable information please see our list of members on this page or visit our website at www.jeaa.co.uk

With January now at a close after a busy start to the year… We have many challenges ahead.

The Residential Tenancy (Condition Report) (Jersey) Order 2014 came into e ect for all tenancy agreements prepared after 31st October 2014 and it is now compulsory for a condition report to be completed by landlords and tenants at the beginning and end of a residential tenancy with optional photos accompanying the report.

The Residential Tenancy (Deposit Scheme) (Jersey) Regulations 2014 will come into e ect on 28 February 2015 and the aim of this legislation is to avoid the risk of tenants’ rental deposits being unfairly held back at the end of a tenancy.  The regulations will also act as a framework for the management of deposits.

Under Regulation 29 it will be compulsory for a landlord in receipt of a deposit for a residential tenancy, to pay the deposit into the tenancy deposit scheme at either the beginning of the residential tenancy, the renewal of the residential tenancy or the variation of the residential tenancy.

Further details of these regulations have yet to be confirmed together with the identity of the scheme administrator and the fees payable.

The Discrimination (Jersey) Law 2013 came into e ect on 1 September 2014 and aims to cover the protected characteristic of race. It is expected that discrimination on sex, age and disability will follow in due course.

This law prohibits certain kinds of discrimination and for connected purposes,

and further amends the Employment (Jersey) Law 2003, the Jersey Advisory and Conciliation (Jersey) Law 2003 and the Employment Relations (Jersey) Law 2007.

The JEAA continues to provide valuable services to property buyers and sellers, landlords and tenants, and our member fi rms are there to assist you through the process from start to fi nish with our professional approach and our adherence to our Code of Practice.
