The UK started a Mortgage Market Review (MMR) in 2009. It’s well known that a catalyst for the recent worldwide recession was the sub-prime market in the USA –where high-risk mortgage loans were approved for people without proof of income. When people couldn’t a� ord their loan repayments, this built up to be a large bad debt problem which had repercussions not just for the individuals who lost their homes, but for the banks and other institutions involved.

In the UK, whilst the situation wasn’t as severe as the USA, some bad practice still took place and so it was decided that a regulatory framework should be brought in to constrain high-risk lending.

The review took four years but the new regulations came into e� ect on 26th April of this year. One of the main changes is that lenders must now take more responsibility for assessing if a customer can a� ord the loan. Also, interest-only loans are much harder to obtain. Pre 2009, there was evidence of mis-selling going on in the mortgage industry and interest-only mortgages were approved purely from an a� ordability anglewith very few questions asked about how the capital was going to be repaid. It was like a car crash waiting to happen.

There is no doubt that a tightening of rules is a good thing if it encourages responsible lending. At Skipton International we have always emphasised the importance of lending responsibly and that has been proven in our incredibly low default rate.

There is no point in giving a mortgage to somebody who will run the risk of losing their home a few years down the line.

A� ordability also means facing up to the fact that interest rates are at a record low and the only way is up, increasing mortgage customers’ monthly payments. The debate over when the interest rates are going to start rising is hotting up with increasing signs of an economic recovery, and a reduction in unemployment putting pressure on the Bank of England Governor, Mark Carney.

So how is this a� ecting Jersey? Some lenders will follow their UK parents and so their mortgage application processes have changed. Whilst it’s a positive that more safeguards will be brought in, it is slowing down the application process, particularly for the next few months as the system settles.

Because we are local we understand the local situation and have always been adaptable and responsive.

More responsible lending is a good thing for all of us as whilst we all want to own our own home, taking on a mortgage which isn’t sustainable will make it an unpleasant and

expensive experience. It will also hopefully help protect our fi nancial system from the sort of bad debts which built up in 2008 and tipped us all into a recession.

However, it can also be a worryingly expensive time.

There is something of a temptation to accept the lowest quote for legal fees when you are looking to buy or sell a property. However, what seems to be the cheapest quote may not always be the best (or even the cheapest in the end!).

It is important to ensure that your legal quote covers everything that might be involved to ensure you don’t get any nasty surprises in your final statement.

Advice for sellersWhen you are selling, your lawyer is likely to agree to a fixed fee upfront. Sale fees are generally less than purchase fees and you may get the best deal from the lawyer who acted when you bought.

If you are selling by share transfer there may be other costs to consider, for example there may be a small cost for obtaining up to date company documentation from the JFSC and the company secretary may charge for assisting you.

In the unfortunate event that a neighbour needs to be party to your sale they will usually obtain advice from their own lawyer who will charge a fee.  It is normal for the seller to bear these costs unless the lawyers who acted previously made an error in not addressing a defect and are therefore responsible to pay these fees. 

Given that freehold and flying freehold properties in Jersey are bought and sold on a Friday in front of the Royal Court, some clients are not able to be present when their sale completes, however you can appoint your lawyer as your attorney. Preparing a power of attorney should not be expensive and is often not subject to a fee charge. You will however have to pay stamp duty of £60 for registering a power of attorney.

Advice for buyersThere is generally more legal work involved when acting for a buyer than for a seller. A purchase fee will therefore be higher than for a sale.

Again, your lawyer is likely to agree to a fixed fee upfront, based on various things including the value and complexity of the transaction and whether additional work such as equity agreements or wills are required.

There will need to be enquiry letters and you should allow approximately £350 for this. Essentially, if the buyer is financing the transaction with the assistance of a loan, then the enquiry letters usually have to be done in order to enable the buyer’s lawyer to satisfy various questions asked of him by the lender. In any event it makes good sense to make these enquiries.

Assuming that there is to be a mortgage on the property, the buyer must also pay their lender’s legal fees. Remember that you will also need to obtain your Registration Card for the transaction from Social Security of the Population Office.

If you are buying a property with another person it is sensible to protect each other. There may be an additional fee for an equity agreement as these can be complex documents.  You should check whether the cost of preparation is included in the fixed fee quote.

Stamp duty is a significant cost that you will need to factor into your calculations. Your lawyer will advise how much you need to allow but it is worth noting that stamp duty is charged on both the purchase price of the property and at a rate of ½% on the mortgage.

The mortgage lender for the property will also require a minimum of a basic valuation survey which it is your responsibility to pay for.

SummaryAlways try to obtain an “all inclusive” fee quote.

Whilst price is important there are other factors to consider. You should choose a lawyer who will take the time to update you, take your calls, return your e-mails and make sure that you fully understand everything.

Seek recommendations from others and never make the choice based solely on price.

THE PERILS OF A POORLY MAINTAINED ROOFWhat early signs of roof damage should homeowners look for?It is a good idea to start with the obvious; can you see water entering the home unannounced? Before we lay blame on the roof, though consider if there are obvious signs of plumbing issues but if not, then it is possible that the roof is the culprit.

What can the homeowner do themselves?That fi rst inspection can be done by the homeowner without the need for ladders or scrambling up onto the roof itself, something never to be recommended. Externally, pitched roofs can be viewed from the ground and damage or wear and tear will likely be obvious. Flat roofs can be a little more problematic but in most cases there will be a window overlooking the roof from which to inspect the condition.

Is now a good time to call in the experts?If you cannot see the cause or you can, and work clearly needs to be done, then yes, a JeCC member with the right tools, equipment, insurance and skills. To reiterate, it is never a good idea to be climbing over your own roofs. It is a job for a professional or a character in a bad sitcom! In addition, the DIY approach will see work taking take twice as long and end up looking less than excellent. Not ideal when considering one of our most valuable assets.

What roofi ng problems will we mostly face?Older fl at roofs tend to be covered in felt and fi breglass which has a shorter life than the materials used now so the work could well just be a process of updating and general maintenance. Seams have often failed, the cause of the water ingress, and standing water can accelerate any problems. Both fl at roofs and pitched roofs are prone to the build-up of leaves in the gutters and outlets which can lead to blockage and pitched roofs can, again over time, su� er the excesses of high winds or falling branches.

Are those pretty, wild fl owers an issue?Put simply, yes. Weeds have roots that grow and will open up tears or small spaces and gaps to increase their capacity to grow. Pretty but ultimately quite destructive. Moss will attract dirt build-up which also can create an issue if left to its own devices.

The professionals are in, then but what preventative measures should I have taken?Each spring, homeowners who can access hoppers and gutters safely should carry out cleaning to prevent blockages.

It’s also advisable to check after storms. Regular visual inspections allow the homeowner to take note of issues that need expert attention when they are small problems rather than waiting until the outdoors suddenly becomes the indoors.

SHARE TRANSFER PROPERTY

Buying share transfer property differs from buying flying freehold or freehold property in that the transaction does not have to be registered in the Royal Court of Jersey, by way of a Deed of Conveyance.

With share transfer you are effectively buying shares in the company that owns the property and acquiring the specific shares that relate to the part of the property that you are purchasing, by way of a Share Vending Agreement. Ownership of the shares gives you exclusive occupation and use of that property.

A share transfer transaction is more involved because it involves not only checks on the property by way of title checks and survey, but also checks on the company to ensure that the books and records are in order and that the company is of good standing. This could hold up any potential sale if the books and records have not been kept up to date. Not only can this result in a delayed sale, but in some cases, additional costs to get the books and records updated, or worst case scenario cause the purchaser to pull out of a sale.

By law, every company has to keep records detailing the names of shareholders, directors, company secretary and any decisions made by its shareholders and directors by way of minutes. Thus, the minute book, share register, share certificate book, registers of directors and secretaries and the financial statements should be kept up to date so that any relevant issues can be identified and if necessary updated and/or rectified.

HELPFUL HINTS FOR VENDORS OF SHARE TRANSFER PROPERTY

If one of the shareholders is acting as Company Secretary, ensure that all books and records are kept up to date and that any minutes or special resolutions have been recorded correctly;

If the property is managed, ensure it is a reputable company who will carry out the work in a timely manner;

If there is a service charge on the property, ensure that all shareholders pay the relevant amount in a timely manner and that this is recorded accurately in the company books;

Highlight the items covered by the service charge such as buildings insurance, electricity in the communal areas, garden maintenance, car park maintenance, managing agent’s fees and/or company secretary fees, lift maintenance, possibly window cleaning and possibly water rates;

Ensure that any future works to be carried out are minuted and confirm whether they are covered by a sinking fund, which is a fund paid into as part of the service charge to cover such future maintenance.
