If you own land in the EU – for example a holiday home -  you will want to know about the new Regulation 650 / 2012 which came into force on the 17th August 2015. Uno� cially referred to as “Brussels IV”, it means you no longer have to comply with the inheritance rules of the state where your land is located. Jersey law will apply instead. It is worth reviewing your current arrangements, because any advice you may have received when you made them is now out of date.

 Until now, the EU’s highly mobile citizens could fi nd that upon their death their a� airs were subject to one or more sets of potentially confl icting rules, determined by various factors such as the location of their assets or their place of residence or their citizenship. The new default position is that the legal system and courts with authority over an individual’s whole estate, be it movable or immovable (i.e. including land and buildings) are those of his place of “habitual residence” or, if he so chooses, that of his nationality. Many Jersey people own land in France. Like Jersey, France is a forced heirship jurisdiction. Unlike Jersey, France’s rules of inheritance favour the children of the land owner and o� er less protection to the spouse or civil partner. Short of setting up a company to convert the asset held into shares, French law had without exception to apply because the land was located in France. A major upheavalSuch rules can now be avoided. Across 25 member states of the EU (but not in the UK, Ireland or Denmark, which opted out) the new Regulation assumes the laws and courts to regulate inheritance to EU sited assets will be those of the owner’s “habitual residence”.

Most importantly, it also allows the owner to subject his inheritance to the law of his or her place of nationality, if that is preferred. 

So if you hold a passport issued in Jersey, Jersey law can now govern the fate of your French land, and the French rules as to who must get what need no longer apply. There could one day become more land outside the Island subject to Jersey’s inheritance laws than the 45 square miles available here! This change matters to anyone who has invested in assets located in any of the 25 states (including therefore Portugal or Poland) because the law of their nationality can now be selected as one to be applied. This also means that Jersey residents holding non-Jersey passports can choose to subject their EU sited assets either to Jersey law or to the law of their nationality.

 So what do you do next?First of all you need to consider your current arrangements for your assets in the participating states. Were those arrangements what you wanted or were they imposed upon you by the rules of the applicable legal system? Conversely, since Jersey law is now assumed to apply to your assets abroad might that upset your plans or the advice you received at the time? Might the involvement of Jersey

law mean someone now stands to get a windfall or to miss out? Speak to your advisor to fi nd out these new rules could allow you to change things for the better, with the aim of:· securing what you want to achieve after your death;· assessing your need for confi dentiality in case, as in Jersey, your will may eventually be entered into a foreign register of land ownership, and;· streamlining your arrangements so as to make your a� airs as simple to sort out as possible.

Coping with the emotional and practical aspects of the loss of a loved one is inevitably difficult and stressful. Thankfully, practical guidance is available through experienced and informative funeral directors, and emotional support is there for those who need it, from a range of organisations.

One of the most important things that you can do to help those you leave behind is to make a will. A will ensures, as far as possible, that your estate goes to those who you would wish to receive it, and that its distribution is not left to the rules of intestacy. Commonplace and understandable assumptions can result in unwelcome consequences, as you will see from the following scenario:

David and Kate have lived together at Highgrove for the past 15 years. Highgrove was bought in Kate’s name because David did not have residential qualifications at the time. A joint loan was used to buy Highgrove and, after they had both worked hard to reduce it, a small lottery windfall allowed them to pay it off completely. The couple occasionally thought about putting Highgrove into their joint names once David became residentially qualified but their busy working lives and three children meant that they never got round to it. Kate died last week, following a tragic accident.

Kate left a willKate left Highgrove to David, knowing that he would make sure that the children were well cared for and that it was left to them

in the future. Her movable estate (i.e. all of her property other than Highgrove) was left to David. Kate knew that under Jersey law the children were entitled to claim 2/3 of her movable estate and that their appointed guardian may have to challenge for their share, but overall she was happy that David would have Highgrove, her most valuable asset, and at least 1/3 of her movable estate and therefore a home and financial security for himself and the children.

Kate didn’t leave a willKate and David had lived together as man and wife for many years, but Jersey law does not recognise anything other than a legal contract (i.e. civil partnership or marriage). Therefore, in succession matters, “common law” partners have no greater rights than a stranger. Without a will, Highgrove would pass to the children equally and David would have no right to any share of it or even to live in it. Highgrove might be kept as a family home whilst the children remained minors but this would depend on the wider circumstances. As and when Highgrove was sold the proceeds would be split between the children and David would not be entitled

to anything. Similarly, Kate’s movable estate would be divided equally between her children, and David would have no entitlement to receive any part of it.

If the second scenario looks bad enough, and not what Kate would have wanted, consider the outcome if Kate had married Harry in her early 20’s and, whilst they had agreed to go their separate ways, they hadn’t actually divorced. If Kate doesn’t leave a will, Harry will be entitled to a quarter share of Highgrove, alongside each of the children. He would also receive the first £30,000 plus half of the rest of Kate’s movable estate, with her children sharing the remainder.

If Kate had left a will, Harry would have been entitled to claim life-enjoyment of 1/3 of Highgrove and 1/3 of her movable estate. David would inherit Highgrove subject to Harry’s life-enjoyment of 1/3 and be entitled to 1/3 of her movable estate.

Situations like this are many and varied and can cause considerable and long-lasting damage to family relations. BASE RATE COUNTDOWNOpinion continues to change in respect of when base rate will go up, or for that matter remain where it is for the time being. Some economists are predicting February 2016, whilst others are maintaining a later date of September 2016 – the choice is yours. What must be emphasised, is the fact that when the fi rst increase happens it is unlikley to be any greater than 0.25%, so making the base rate 0.75%. JERSEY LENDING MARKET

How much further can interest rates fall? Once again we have seen noticeable reductions being made by some of the mortgage lenders in the last month which make tracker rates at certain loan to values fantastic value for money, although when you look at the fi xed rates, especially those for fi ve years , the decision can be hard to make! Arrangement fees can very expensive in some cases and it is essential to check the small print, as a higher rate of interest can sometimes be better value if the fees are lower.

JERSEY PROPERTY MARKET

This summer has seen a good recovery to the market – there is a lot more confi dence being shown by the many prospective purchasers who are fl ooding estate agents with enquiries and the conversion rate from viewings to making an o� er on a property remains high. The activity during the summer has certainly made a dent in the housing stock that is available and we are now hearing from clients that there is little choice when looking for somewhere special in the one and two bedroom fl at market. This is good news in one respect because it shows that First Time Buyers are returning to the market despite the di� culties of fi nding a deposit.

Further up the scale, the middle of the market seems to be su� ering from the same problem as is the £1m to £1.2m plus sector where once again, clients tell us that there is insu� cent choice.

The good news is that agents tell us that house prices remain static and that in some cases, there is still a chance to negotiate on the asking price.

THE BENEFITS OF SEEKING FINANCIAL ADVICE

Whether for investment and pensions advice, or for a basic life cover plan, it pays to speak to a suitably qualifi ed fi nancial adviser.In the UK, new regulations now insist that certain transactions cannot take place unless the client can prove they have sought appropriate advice, in the hope that all clients will be made fully aware of all options available to them and better understand the consequences of their choices.

Here in Jersey we have separate legislation, our own tax system and di� erent providers and products to select from.

With so many of us now accustomed to conducting our personal business online, this particular area is one where face-to-face remains the best option.

Whilst you might avoid an advice charge if you go direct, not all advice incurs a direct charge and you should weigh up any cost saving against potentially buying an unsuitable product or one which gives poor returns.

Advice can help you buy a better product than one you might choose for yourself, with independent advisers having the expertise and knowledge to fi nd better options, which could include products that are only available if you go through an adviser.

Also, being in the Channel Islands, the option to go direct to a provider are extremely limited.

Out of all the winners from the 2015 Arcitecture Awards we felt that there was one stand out development which was designed by the brilliant Dyson & Buesnel Architects team. Their fantastic Le Squez Phase 2 project scooped up TWO awards on the night, one in the Best Large Scale Development catergory and the other for Best Landscape Architecture Project In Relation To The Built Environment.

Project Description: Completed in June 2014, the Le Squez, phase 2 Housing Development, undertaken on behalf of the Housing Department / Andium Homes, provides a total of 84 one, two and three bedroom houses and fl ats. Renamed as Les Burons, Les Burons Court, Les Anquetils and Les Petit Anquetils, from the outset this social rented development aimed to provide a high density, pedestrian friendly and fully accessible environment. Paved surfaces and pedestrian only access, with private and communal gardens are an intrinsic feature of the development as is the design, scale and massing of the buildings which run from 1 to 4 storeys in height.

As the long nights draw in and we start to feel the cold snap of winter, our cockles are warmed by the idyll of curling up on the couch with a cup-a-soup, cocooned in chunky knitwear as we bask in the glow of a roaring hearth. It’s a Heinz soup and Horlix commercial wrapped up into one cosy blanket.  

Each year this scene is played out in countless TV adverts and festive fi lms, but over the past few decades, one aspect has changed for certain households – the traditional wood-burning fi re. A lot of modern homes are introducing electric or gas fi res, but is one more benefi cial than the other? 

There is no doubt that when it comes to adding character and atmosphere to your living space, a traditional hearth is a great centrepiece. However as charming and picturesque as a wood-burning fi replace might be, it is the least e� cient when it comes to heating. Although the warmth can be felt up close, most of the heat from your room will be lost through your chimney.  

Electric fi replaces are much more heat e� cient and normally have a longer lifespan than a gas fi replace. The maintenance requirement is extremely minimal, however it is recommended to have it checked once a year by a professional electrician.  The JeCC members list has professional contractors who will be able to ensure that your electric fi replace is still in good condition before the cold snap really sets in.  Keep in mind though, an electric fi replace is much less energy e� cient, especially if used throughout most of the day. If there happens to be a power cut, then o� goes your fi re.

Choosing a gas fi replace will mean very little maintenance work other than an annual check up by a professional for safety purposes. The use of a gas fi replace is as easy as fl ipping a switch and you can choose from a number of di� erent styles to compliment your home. 

Now that you know the pros and cons, the question remains which fi replace would look best in your home and which is more suitable to install? Keep in mind that when considering adding a chimney to your home you must adhere to local building regulations. A professional can advise of these regulations and ensure that they are met. NEW TENANCY DEPOSIT PROTECTION

From Monday 2nd November, by law all landlords and agents taking a deposit from their tenant will have 30 working days to lodge it with a newly appointed Company called MyDeposits Jersey.

MyDeposits Jersey has recently been selected by The States Of Jersey to receive all tenants deposits as part of the new tenancy deposit scheme.

The new legislation is designed to protect tenants deposits and ensure they get it back at the end of the tenancy, provided they have met the terms of their tenancy agreement. 

This new law will apply to all new, renewed or varied tenancy agreements from 2nd November 2015.  It does NOT apply to any existing leases which are currently in use.

MyDeposits Jersey will charge an admin fee of £20 plus GST (£21) to protect the deposit, but this is taken out of the tenant’s deposit when the deposit is returned.

The benefi t of having the deposit protected will reduce many of the disputes that arise between Landlords and Tenants and will ensure a fast and fair return.

This new introduction is in accordance with the already existing Residential Tenancy (condition Reports) (Jersey) order 2014.

The advice to Landlord’s from the JEAA is to prepare well in advance of the tenant moving in by having a high quality written tenancy agreement which is clear, concise and fair. 

In addition, you will need to provide by law a full record of the fi xtures, fi ttings and

décor (Condition Report) backed up with photo’s and video if necessary to support the inventory.The advise to tenant’s is to have a record of all exchanges of communication between Landlord and Tenant during the tenancy period by storing letters and emails between both parties which may be called upon at the end of the tenancy.

Mydeposits do o� er a free dispute resolution service if you disagree about how much deposit money should be returned at the end of a tenancy. 

Like any law, there are penalties if you choose not to lodge the deposit in the expected time frame. It’s an o� ence not to protect your tenant’s deposit and you may face paying pay a fi ne of up to £2,000.

Having said all the above, it is hoped that by following the advise from the JEAA, disputes between Landlord’s and tenant’s will be kept to an absolute minimum and you can rest assured that your deposit is fully protected and will be well looked after in the hands of Mydeposits Jersey.
