1 Pursuant to sections 43, 44, and 51 of The Cities Act, the Council of the City of Martensville has submitted an application to to annex land to the Minister of Government Relations in the form prescribed by the Minister together with:
(a) a map showing the proposed alteration of boundaries which involves withdrawing territory from the Rural Municipality of Corman Park No. 344 and adding it to the City of Martensville;

The Municipalities Act [section 53]

RESTRUCTURING OF THE VILLAGE OF WELWYN Pursuant to section 53 of The Municipalities Act, the Village of Welwyn has applied to restructure to become
included in the Rural Municipality of Moosomin No. 121 as a designated Special Service Area.
IT IS HEREBY ORDERED THAT:
1 The Village of Welwyn is restructured through the inclusion of the Village of Welwyn within the Rural Municipality of Moosomin No. 121.
2 The former Village of Welwyn is designated as a Special Service Area for the purpose of assigning different tax rates, applying different tax tools and providing different service levels within the Rural Municipality of Moosomin No. 121.
3 The boundary of the designated Special Service Area is consistent with the former Village of Welwyn boundaries and is described as:
Township 15, Range 30, the north-west quarter of Section 35, West of the First Meridian, in the Province of Saskatchewan.
4 The Rural Municipality of Moosomin No. 121 shall allocate all revenues collected from and on behalf of the Special Service Area to special service area ledger accounts; and all expenses of the Special Service Area shall be allocated to and paid from special service area ledger accounts.
5 A statement of revenues and expenditures of the Special Service Area shall be presented to council annually and any additional time(s) requested by council.
6 The terms and conditions of the restructuring agreement entered into by the Village of Welwyn and the Rural Municipality of Moosomin No. 121 are confirmed as follows:
Opening Statement
(1) This agreement has been entered into by Rural Municipality of Moosomin No. 121 (“The RM”), and the Village of Welwyn (“The Village”) for the purpose of the inclusion of the Village in the RM.
Restructuring Principles
(2) All parties agree to work respectfully together to negotiate sustainable long-range governance, administration, and service delivery practices that mutually benefit the citizens of the Village and the RM now and in the future.
Governance
(3) A municipal council consisting of a reeve and seven (7) councillors will govern the RM.
(4) Upon inclusion, the former Village shall be considered a separate division within the boundaries of the RM and as such a councillor shall be elected to represent that division.
(5) The municipal costs of the election for the division are a charge on the RM as a whole.
(6) All bylaws and resolutions in force in the Village at the time of restructuring continue in force for one year unless they are repealed sooner with others made in their place.
Municipal Boundaries
(7) The RM consists of the land described in Schedule A.
(8) Reference to any land described in Schedule A in any order, regulation, bylaw, resolution, certificate of title, agreement or other instrument is deemed to be a reference to the RM.
Establishment of Special Service Area (“The SSA”)
(9) The former Village shall be designated a Special Services Area for the purposes of assigning different tax rates with the application of tax tools, and for providing different forms and levels of service. It will be known as the Welwyn SSA.
(10) The designated Special Service Area shall be within the boundaries of the former Village.
Disposition of Assets
(11) The assets and liabilities of the Village shall become assets and liabilities of the RM upon inclusion of the Village.
(12) Cash assets remaining after settlement of the Village’s assets and liabilities will be set aside for the provision of services and benefits within the former Village.
(13) All grants received by the RM in recognition of the Village will be set aside for provision of services and benefits within the former Village.
Integration of Administration
(14) The administrator for the Village will continue as an employee of the RM.
Service Delivery
(15) Much as former Welwyn (now the Welwyn SSA) residents may rightfully expect that types and level of service delivery they have enjoyed and financed until now should be carried over into their future in the RM, they must remember that it will remain the tax and utility rates they will pay – now in the Welwyn SSA – that will predominantly determine the quantity and quality of the services received from hereon.
(16) All expenditures associated with service delivery within the Special Service Area (Welwyn SSA) as set out below shall be allocated to the special service area accounts.
Wastewater: Sewer, Lift Station, and Lagoon Operations
(17) The RM will continue to employ Carl Bowey for waste water, lift station and lagoon operation services.

(18) The RM will continue to contract the services of the certified waste water operator from the Town of Rocanville to oversee the waste water lift station and lagoon until Carl Bowey obtains his certification.
Water Treatment Plant (WTP) And Water Delivery Operations
(19) The RM will continue to retain the services of Amber Hamilton as the WTP operator.
(20) The RM will continue to employ Carl Bowey and relief services for the water treatment plant.
Street Maintenance
(21) The RM will continue to retain the services of Kenneth (Kenny) Taylor to provide street maintenance services, as needed according to current arrangements and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
Snow Removal
(22) The RM will continue to retain the services Kenneth Taylor and Dale Baily, to provide snow removal services on Welwyn streets and service sites as per current arrangements which expire on May 31, 2018 and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
(23) The RM will continue to retain the services of Alexander Hamilton to provide snow removal services on the Legion Hall site and assigned sidewalks according to current arrangements which expires on May 31, 2018 and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
(24) The RM will continue to retain the services of Jean Halliday to provide snow removal services on assigned sidewalks and sites as per current arrangements which expires on May 31, 2018 and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
Grass-Cutting and Non-Winter Maintenance
(25) The RM will continue to retain the services of Alexander Hamilton to provide grass-cutting services consistent with current arrangements, and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
(26) The RM will continue to retain the services of Kenneth Taylor as per current arrangements to provide grass-cutting services with a large mower for instance the sports grounds, open areas on the lagoon site, and at the cemetery, and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
(27) The RM will continue to retain the services of Carl Bowey to provide grass-cutting services as per current arrangements at the lagoon in the areas where it is not appropriate for large machinery to operate, and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
(28) The RM will continue to employ Amber Hamilton to provide grass-cutting services at the cemetery consistent with current arrangements, and may be re-negotiated as necessary to meet policy and practices of the RM and applicable legislation.
Cemetery
(29) The RM will continue to provide administrative services for the record keeping and management of cemetery files, income, expenses and continuation of maintenance and care of the Welwyn cemetery.
(30) The RM will continue to utilize the cemetery trustees in regards to the Millennium Fund that provides financial assistance for the maintenance, perpetual care, general repair and improvements of the Welwyn cemetery.
Fire Protection and First Responders
(31) The RM will continue to provide the annual grant at the time of the restructuring for a ten-year period to the Welwyn Fire Department. After the ten-year period, it will be the RM discretion to continue with the grant.
(32) The RM will continue financial support of the rejuvenation of the Welwyn Fire Department with funds provided by the Welwyn SSA. The funds are supported by donations received and grants received from RM of Moosomin No. 121 and RM of Rocanville No. 151.

(33) The RM will support the creation of mutual aid services of the Welwyn Fire Department to provide fire protection services to the Welwyn SSA, Division 5 and areas located in the RM of Rocanville No. 151.
(34) The RM will support the continued service of the Welwyn First Responders, with continued financial support by Welwyn SSA. The funds are supported by donations received.
Moosomin and District Health Care Foundation and Corporation
(35) The RM will examine what role the Division 7 councillor might be able to have with the Moosomin and District Health Care Foundation/Corporation, and the status of the funding commitments the Village has made towards them.
Transfer Station
(36) The RM will continue to provide transfer station services under the current license to operate for waste disposal at the Welwyn site according to current arrangements (seasons of operation and hours).
(37) The RM will continue to employ Carl Bowey to supervise access to the transfer station according to current arrangements.
(38) The RM will continue to employ Amber Hamilton as relief services for supervision of access to the transfer station.
(39) The RM will continue the agreement with the Town of Rocanville for the Welwyn SSA residents to access the Loraas Waste Disposal bins at the Rocanville site. If equivalent alternative services can be obtained for the Welwyn SSA, the RM may arrange different waste management services.
Recreation and Cultural Facilities
(40) The RM will continue to provide insurance coverage through the RM provider and invoice the premium cost for the building, contents and boiler to the volunteer group known as Community Recreation Organization of Welwyn (“C.R.O.W.” or “CROW”). The “CROW” organization will continue the management and maintenance of the Welwyn rink as consistent with the current practices. The management could be amended/assisted should CROW require further support of the RM in the future.
(41) The RM will continue the lease with the Belles & Beaus coffee shop and providing insurance coverage through the RM provider and invoice the premium cost for building and contents to the Belles & Beaus. The Belles & Beaus are also charged $150.00 for the use of the Loraas Waste Disposal bins provided by the Welwyn SSA.
(42) The RM will continue the operations of the Legion Hall, covering the costs and collecting rental fees and revenue, while delegating access and simple upkeep responsibilities to the Welwyn Legion Hall.
Welwyn Housing Authority
(43) The RM will continue the relationship with the Saskatchewan Housing Authority (SHA) in regards to the units known as “Harmony Place”. The SHA provincial guidelines indicate obligations, benefits and representation to the board.
Amendments
(44) This agreement may be amended:
(a) by the agreement of the councils which are signatories to the agreement prior to the application being forwarded to the Minister for approval, provided that these amendments are included timely in the submission; and
(b) by the RM after the Minister’s Order when, because of aspects honestly overlooked or misunderstood after best efforts, or developments that could not reasonably be anticipated, an amendment is in the best interests of the ratepayers of the former Village and the RM.
Effective Date
(45) This agreement will come into effect on the date of restructuring as set out in the Minister’s Order.

SCHEDULE ATOWNSHIPS 13, 14 AND 15 IN RANGES 30 AND 31;
ALL WEST OF THE FIRST MERIDIAN IN THE PROVINCE OF SASKATCHEWAN.7 The restructuring will take effect on May 1, 2018.
8 The imposition of special levies is authorized on affected properties for a period not greater than ten years or in the case of retiring a debt of the municipality not greater than the term of the debt, for the following purposes: renewing municipal infrastructure; remedying and reclaiming contaminated sites; and settling any liabilities.
9 Cheryl Barrett of Wapella, Saskatchewan, is appointed to adjust and settle the assets and liabilities of the Village of Welwyn including:
(a) the allocation of any grants, surplus funds and reserves; and
(b) the manner of dealing with liabilities through:
(i) the sale of, the disposition of and conversion into money of sufficient assets to satisfy the liabilities of the Village and pay the remuneration of the person appointed by this Order; and
(ii) the ability to assess, levy, collect and enforce payment of any amount that may be required to satisfy the liabilities of the municipality, including all associated expenses and the remuneration of the person appointed by this Order, when the realizable assets do not satisfy the liabilities pursuant to 63(4) of The Municipalities Act.
10 Remuneration for settling the assets and liabilities is paid to Cheryl Barrett at a rate of $40.00 per hour of work, in addition to 44.83 cents/travelled kilometre and reimbursement of related miscellaneous expenses.
IT IS FURTHER ORDERED THAT:
11 A new division, namely Division 7, is created in the Rural Municipality of Moosomin No. 121 effective June 27, 2018. The area formerly known as the Village of Welwyn is deemed to be within Division 5 in the Rural Municipality of Moosomin No. 121 from the date of restructuring until an election for the new division is held.
12 The boundaries of Division 7, being consistent with the boundaries of the former Village of Welwyn, shall be described as follows:
Division 7:
Township 15, Range 30, the north-west quarter of Section 35; West of the First Meridian in the Province of Saskatchewan.
IT IS FURTHER ORDERED THAT:
13 An election is held on June 27, 2018, for a councillor to represent Division 7, as described herein to coincide with the effective date of the creation of the division.
14 Kendra Lawrence is appointed as Returning Officer, to conduct the election in accordance with The Local Government Elections Act.
15 The term of office for the councillor representing Division 7 shall begin June 27, 2018, and shall expire at the time of the general election October, 2020, and every four years thereafter.
