He was very abu- sive towards me, both verbally and emo- tionally. It is such a relief to hear that he has been removed.” This was the emotional reaction from San- dra Orji (nee Hudd), the only child of the late Norman and Doris Hudd, when she heard that Norman Anthony Walton, chairperson of the Hudd Trust since its inception in the early 1980s, was removed from office by order of the Cape High Court. After a lengthy court battle between the Kid- brooke Place Management Association and the trustees of the Hudd Trust, judgement was handed down by the Honourable Justice Ash- ley Binns-Ward on Wednesday 25 March. Walton was found to be in breach of his fidu- ciary duty as a trustee and the following order was made: “The first respondent (Norman Walton) is hereby removed from office as a trustee of the Hudd Trust (Master’s Office reference T618/87). “The fifth respondent (Master of the High Court) is directed to take the appropriate steps to give effect to the provisions of paragraph 1 of this order. “The first respondent (Norman Walton) shall be liable for the applicants’ (Kidbrooke Management Association’s) costs of suit, in- cluding the costs incurred as a result of the postponements of the application on the scale as between party and party.” The judge declared that Walton was to pay the costs in his personal capacity. In a notice to the Life Right holders (cottage owners) of Kidbrooke Place dated 20 March 2015, the elected members of the Kidbrooke Place management committee, led by Linda Harris, summarised the case: “At a special general meeting held on 23 March 2012, the Kidbrooke Place Manage- ment Association mandated legal action against the trustees for not having acted in the best interests of the Life Right holders, as set out in the agenda papers and minutes of the aforementioned meeting. “The special general meeting and resultant legal action followed only after unsuccessful attempts by the elected representatives at the time in persuading the trustees to rectify cer- tain matters. “On 2 October 2012 the Kidbrooke Manage- ment Association’s motion was lodged with the Master of the Supreme Court for the re- moval of Norman Walton as trustee of the Hudd Trust. “Papers were served on trustee Norman Walton as First Respondent together with Messrs John Martin and Allan Powell. “Mr Robert van Zyl was also named as a respondent as Mr Walton had announced his intention to appoint Mr Van Zyl as a trustee. “ To date the Master has not confirmed this appointment. “The hearing took place in the Cape Town High Court on 4, 5 and 6 November 2014 before Judge Ashley Binns-Ward.” Looking back into the history of Kid- brooke, The Times of Hermanus of 19 October 1989 reported that an R18 million contract had been awarded to Murray and Roberts to build a retirement village called Kidbrooke Place, and the clearing of the 74 acre site had begun. Traders at the Market Square stallsabove the Old Harbour are up in armsafter being informed that their leasesare not automatically being renewedthis year.

Anew tender processwill be followed andcurrent traders may have to vacate by theend of June. Before, rental leases were re-newed on a yearly basis.“Why toss out successful businesses that

are sought out year after year by returningtourists who love the market,” exclaimedone of the traders.Stephen Müller, director: infrastructure

andplanningat theOverstrandMunicipali-ty, says the tender process has not yet beenadvertised, but he confirmed that the ten-ants’ contracts will not be renewed.“The specific requirements in the tender

document can not yet be revealed until thetender is advertised in the local newspaperand on our website. The tenants have beeninformed.”He says in terms of the council’s policy,

themunicipalitymust follow a competitiveprocess. “This process is being followed,specifically to ensure that the renting outof municipal ground is based on fairness,is reasonable, and in line with legislation.“The policy stipulates that if more than

one person or entity is interested in therenting of municipal ground, the renting ofthe grounds must be through a competitiveprocess.”The current market stall holders at Mar-

ket Square say the market is a viable andsuccessful tourist attraction, thanks to thebusinesses that have built the market.“What is to become of the traders whose

tenders are not successful?” a stall holderasked. The stall holders whom the Herma-nus Times spoke to, wish to remain anony-mous.“We are the people who have been there

for the past 10 to 35 years, struggling to setup outdoors in thewind and rain, year afteryear. After years of waiting and begging,the Overstrand Municipality finally builtcovered stalls for this tourist market.

“We have earned our places throughsheerdetermination, butnow it seems“oth-er people also want a chance,” says a stallholder, who has been part of the marketsince the beginning.Market Square tenants moved into the

under cover stalls in December 2009.The rent per stall was about R1 300 per

month, plus two months’ deposit and elec-tricity. At present the rental rate is R2 145plus R170 for basic services.Stall tenants have a solution for the OM:

Stall holders at the Market Square couldbe evicted depending on a new tenderprocess by the Overstrand Municipality,who owns the grounds.

HuddswithWaltonaschairpersonandprima-ry developer of the retirement estate.

In the 1989 Times article, Walton was quotedas saying: “Kidbrooke Place will be run as anon-profit making organisation and a total of150 Georgian style cottages will be built

around a clubhouse. The homes will be soldunder life tenure terms. Any profit on theresale of cottages will be ploughed back intothe Trust and used in the maintenance andrunning of the village, to keep levies down.”But it seemsthatWaltonandhisco-trustee

JC (Koos) Badenhorst who served withWal-ton from 1992 to 2008, profited through theestablishment of a company called HuddManagement Services (HMS).Theyasthetrustees, sold13 freeholderven

adjacent to the retirement village, and 32 haof farmland (owned by the trust) to them-selves (in their personal capacity) as ownersof HMS, and sold them for a profit, in order,they claimed, to pay off a R1,74 M overdraftsettlement amount to FNB.Inhisverdictdeliveredlastweek, theCape

High Court judge said: “It follows that therespondent andBadenhorstwere effectivelycontracting with themselves in concludingthe sale of the properties by the Trust, totheir company.”Judge Binns-Ward pointed out that if a

trustee wants to purchase immovable prop-erty from a trust, it must be sanctioned bya court. This was not done, and accordingto the judge, their fiduciary duty as trusteesbehoved them to have made full disclosureto themanagement committee of the precisenature of thepersonal interest andgain theystood to realise before embarking on the un-dertaking.According to the judge, they should not

have proceeded with these transactions inthenameof HMS,without the informedcon-sent of the beneficiaries.The othermain complaint againstWalton

was the commission earned on the sale oflife rights in the development by a close cor-poration, Codé Design CC. Walton and hiswife are the onlymembers of this CC. It wasalleged that this company was paid overR5,8 million in commission and administra-tion fees by the Trust between 2001 and 2011.

Thejudgesaidthat inthismatter,“Walton’sconduct points to an inadequate appreciationof the nature of his fiduciary duties with theresult that he failed to properly distinguishthe proprietary affairs of the Trust from hisown.”The judgement further states: “The re-

spondent gives no indication of being astuteto howhis conduct deviated from that expect-edofa trustee. Iamof theviewthat the incomegenerated through Codé Design CCwas prob-ably seen by him as affording reasonable rec-ompense for his exertions on behalf of theTrust and the Kidbrooke Place development.“Walton’s ‘profound misappreciation’ of

his duties and obligations signifies a risk thathe may act in breach of his fiduciary duty inother respects should he remain in office.”Harris said she is very satisfied with the

judgement.Fernando Smith De Sousa, a resident since

1991,whoinhispersonalcapacitycontributedR120 000 towards the court case, said. “I neverbelieved inWalton andBadenhorst. They act-ed in bad faith towards theLife Right holders.I have no faith in the trustees who have nowbeen appointed by Walton. They used Trustmoney to pay for his defence.”As of 26 March 2015, residents were in-

formed thatAllan Powell had succeeded Wal-ton as chairman of the Hudd Trust (see p 5).Sandra Orji (nee Hudd) said: “I, as the

daughter of the late Mr and Mrs Hudd, wantto congratulate the Kidbrooke ManagementCommittee and am delighted at the news. Iwas behind the committee who set up thecourt case.”She said that when her parents signed over

In response to the verdicthanded down in the Cape HighCourt in the case between theKidbrooke Place ManagementAssociation and the trustees ofthe Hudd Trust, Powell said:“The ruling by the High Court toremove Norman Walton as atrustee of the Hudd Trust hasended his work as chairman ofthe trust after over 20 years. As

the founder trustee, he had beeninstrumental in building up Kid-brooke Place after a donation ofa farm and R100. During thattime he had to improvise waysof getting things done, since thistype of retirement village was anew concept in South Africa.

“The trustees are studying thejudgement and have alreadystartedtakingstepstoensuretheeffective functioning of a secure,independent trust. As part ofthat process we have appointedAlan Marshall, Frances May-tham and Mike van Eyk as newtrustees. They come with a

wealth of experience in theworld of business and trusts.

“The divisions and tensionscreated by this court action hashad a debilitating effect on theatmosphere of Kidbrooke vil-lage, and one of the jobs of thenew trustees will be to continuea process of healing with like-minded people of good will.

“We have therefore beenpleased by the expressions ofsupport we have received fromresidents, and have pledged our-selves to carry on working forthe benefit of the beneficiaries,as defined by the Trust Deed.”

A group of 13 students from the HermanusYouth Art Centre are participating in thepinhole photographic project which is un-der the mentorship of Lawrance Brennonand Jeandre Marinier.

Lawrance, a printmaker and professionalphotographer, has been actively involved inpinhole photography for many years and hasbuilt a number of pinhole cameras. He saysthepinholecamerascombinesimpletechnolo-gy–asimplewoodenbox–withalotofscientif-ic elements. Artist Jeandre is an art teacherat the Hermanus Youth Art Centre.She has recruited the learners who will be

part of this initiative. The learnerswill attenda three day workshop at the centre from 8 to10 April where theywill be taught how to con-struct the cameras, how to use them and howthe images are processed.Eachcamerawillbedecoratedandindividu-

alisedbyeachparticipant.Theywillalso learnhow to write an artist’s statement.Lawrancesays theaimis tohave thepartici-

pants and the cameras ready to take photosonwhat is know as International Pinhole Dayon Sunday 26 April.Anyone, anywhere in theworld,whomakes

a pinhole photograph on the last Sunday inApril, can scan and upload it, where it will be-come part of the annual Worldwide PinholePhotography Day’s online gallery.The group’s pinhole photos and cameras

will be framed and featured at an exhibitionat theHermanusArt Circle gallery during theFynArts Festival.

ARTISTIC COMPANY: Jeandre Marinier’s first solo exhibition was held at the Windsor Ho­tel on Saturday evening, where she introduced a series of new canvasses exploring inks andoils. Graphic artist, Alexander Mitchley – one of Jeandre’s students, also exhibited his pencilsketches, Sensual Taste. Examples of work produced by the Hermanus Youth Art Centre werealso on display. By navraag aan die Veilige Skole Projek,geloods deur die Wes-Kaapse onderwysde-partement, het hulle twee weke gelede dieskool besoek en bevestig dat daar wel “ele-mente van buite op die skoolgronde aange-tref is”.

Volgens Jessica Shelver van die VeiligeSkole Projek verkry hulle toegang tot dieskoolterreinwantdiehoofhekwordaanhou-dend beskadig.

“Die departement het al by verskeie ge-leenthede die hek laat herstel, maar tans isdie hek se elektriese toestel ook gesteel.”

Shelver sê die skool het veiligheidsmaat-reëls in plek gestel. “Die skool het ’n veilig-heidsrooster opgestelwaarop enige insiden-te geïdentifiseer en aangeteken moet word.Skooluniforms word ook gemonitor sodatdiegenewat nie op die skoolgrond hoort nie,uitgeken kan word.

“Die skoolhoof maak ook gebruik van ’nmetaalverklikker om te verhoed dat enigewapens die skool binnegebring word.”

VolgensShelver is verskeiemaatreëls ookdeurdie skoolhoof ingestel. “Metbehulpvan

die departement word die elektroniese toe-stel van die hek tans vervang. Die skoolhoofhet ook bevestig om meer sigbaar op dieskoolgronde te wees. Verder het die skoolonderneem om ’n vergadering te belê metdie beheerraad aangaande die aanstel vansekerheidswagte.

“Saam met die skool is ons ook besig met’n risiko-analise waarna ons sal kyk om ’nverdere veiligheidsplan op te trek om so-doende leerders se veiligheid te verseker.”

Volgens IdyAdams, skoolhoofbyHawstonSekondêr, vergader hulle binnekort met diebeheerraad.

“Ons het ’n vergadering belê vir 9 Aprilwaartydens al die veiligheidsaspekte be-spreek sal word. Op die vergadering sal diemoontlike aanstel van sekerheidswagte ookonder die soeklig wees.

“Ons is in die proses om die hek te laatherstel, met die hulp van die departement.Wat die opgradering van die heining omdie skool betref, moet ons dit eers op dievergadering bespreek aangesien dit netweer beskadig gaan word as ons dit noudadelik doen.”

Shelver voeg by dat die departement nieaanspreeklik gehou kan word vir die leer-ders se veiligheid nie, veral nie as hulle hulbuite die skoolterrein bevind nie.

Unpaid rent, tenants fleeDid you perhaps rent accommodation, to-wards the middle of March, to a well spokenmiddle-aged couple, both employed, with twosmall animals?

Did you phone the reference given, and re-ceive a glowing report?

That same couple has been renting from us.After following eviction procedures, once

the lease process had been followed, they tookoff in the middle of the night, just before thesheriff arrived to attach their assets.

We have been left with a legal bill, unpaidrent, a huge water bill, and a house so disgust-ingly dirty, the cleaning service said theyhave, in 20 years, never seen anything like it.

No one has phoned us for a reference.When the couple moved into our house it

was also after midnight apparently, accord-ing to a neighbour.

Seems likewewerenot the first tobecaughtthis way by them, and possibly not the lasteither.

More to subsistence fishing than meets the eyeIn response to the Hermanus resident whocomplained about the goings on during themackerel run recently, I would like to makeit clear that I agree with you whole hearted-ly with the regard to the littering, abusivelanguage, urinating and consuming alcoholin public and general bad behaviour.

Having said that, I find the writer to havea romanticised notion as to how a subsist-ence fishing community supports them-selves and their families.

Granted that the amount of people whorely solely on fishing to support their fami-lies these days is nowhere near what it usedto be. Despite that being a fact, many peoplewho share this community have their fami-ly roots originating in subsistence fishing.

It’s what their families did for generationafter generation. That is how they madetheir living.

The images you witnessed would havebeen no different 30, 50, 80 years ago.

The same could be said for any fishingcommunity, whether it be in Simons Town,Hout Bay or Kalk Bay.

When people aren’t simply fishing for“fun” but are doing so to provide for theirfamilies, it can be quite a cut throat and“barbaric” scene to witness, as is any fish-ing on a semi or commercial fishing boat.

It all comes down to getting as much aspossible while the going is good.

It definitely doesn’t please me to see fishbeing ill-treated but I am a “sports angler”

and I’m not fishing to provide for my family.People born in a subsistence fishing com-

munity are not simply going to catch threedays’ worth of food for their families andpack up for the day and go home.

For generations, families were fed by thecatch and the rest were sold to those whoare unable to catch or bartered for goods ortraded for services.

That is how fishermen provide for theirfamilies.

The suggestion of taking only a few fora meal, is far removed from the realities ofthe real world and a struggling communitywhose livelihood has been withered awayfor far too many reasons to try and putacross in this letter.

Would the writer rather have a largetrawlerscoopuptheentireshoalandbenefitjust a few people because that is normallywhat happens or the latter, where hundredsof people benefit from the resource?

I know where my sentiments lie.By the way, once caught, a snoek cannot

be released. Once its scales and protectiveslime comes off during handling, they aredoomed to die from infection.

I’m not supporting those targeting them,not at all, but there were plenty caught asa by-catch.

The maasbankers you mentioned weren’twasted, they were in turn reused as bait.

Fire hazard on plotFollowing the recent, serious fires in theOverstrandandapoweroutageasaresultof runaway fires, is it not time for the mu-nicipality to take action to prevent fires,ratherthanjustfollowingtheregulations?

Numerous complaints and visits to themunicipality about the accumulation ofinflammable brushwood on a neighbour-ing vacant plot, resulted in the same feed-back:“Aletterwillbewrittentotheoffend-er and they will have 28 days to comply.”

This was ignored by the offender, orworse, more cut wood was added to thepile.

We were led to believe that the munici-pality was ultimately responsible forclearing plots and billing the owners.

When pressed on this matter, the mu-nicipality replied that funds were notavailable.

We then asked for the owner’s addressfor assuming responsibility in case ofdamages. This was refused however, aswasourrequesttohaveourletterforward-edtotheowner,onthegroundsofabreachof privacy.

The proposed 2015-’16 budgetfor the Overstrand was tabled incouncil on 25 March and is nowopen for public inspection untilthe end of April.

The total budget is R1,072 billionofwhichR85,5 million is forcapitalexpenditure, (notwithstandingthat an estimated R100 million isrequired annually to sustain capi-tal infrastructure), and R977 mil-lion is foroperational expenditure.The total revenue is R908 mil-

lion, of which R745 million isgainedfrompropertyratesandser-vices. The third largest revenuesource is operational grants fromnational and provincial govern-ment.This translates into a budgeted

deficit of R69,2 million (comparedto R121,6 m for 2014-’15) which, ac-cording to the report, does not re-

flect the actual cash position.Theassetvalueofproperty,plant

and equipment (PPE), before de-preciation is in excess of R6,1 bil-lion,which relates to substantiallyhigh depreciation charges.Although accurately reflecting

assetvalue, thecostofasubstantialportionof theseassetshadbeenful-ly redeemed previously, but theuseful life of assets were extendedas well as ever-increasing assetsfundedbygrants. The replacementthereof can thus not be recoupedvia current tariffs as this wouldlead to taxation in advance of needandnoreservesmaybeestablishedfor these purposes.

Anticipated borrowings to bemanaged downThe capital budget of R85,5 mil-

lion for 2015-’16 is 27,3% lesscompared to the 2014-’15 Adjust-ments Budget. The reduction isdue to the available resources tofund the capital budget.

The capital programme increas-es to R94,6 million (and R103,6 mil-lionintheouteryears),withantici-pated borrowings being R90 mil-lion over the three-year period.The balance will be funded from

internally-generated funds (3%)and capital grants (65%).The municipality had reached

its prudential borrowing limit of60% of operational revenue in 2012and has embarked on a strategy tomanage this rate down by at least10%.At thecurrentborrowingpro-gramme this rate will be manageddown to 44% by 2017-’18.National Treasury has recom-

mended an upper limit of 45%.Challenges include develop-

ment backlogs and electricityincreasesSome of the challenges the Over-

strand Municipality faces are anever-increasing population (7thhighest growth nationally as perthe 2011 census), development

backlogs, increasingpovertylevelsand ever-aging water, roads, sew-age and electricity infrastructure.Added to this is the increased

cost of bulk electricity due to tariffincreases byEskom in excess of in-flation.DirectEskomusers arenowpay-

ing (as from 1 April) 12,69% more.The price at which themunicipali-ty buys bulk electricity from Es-kom,goesupon1Julywith14,24%.Council has budgetedR193,6mil-

lion for the bulk purchase of elec-tricity. The report states that con-tinuous high bulk tariff increasesarenot sustainable, as therewill bea point where services will nolonger be affordable.Other main challenges experi-

enced during the compilation ofthis budget include:• Sustainable refuse disposal;• The need to reprioritise pro-

jects and expenditure within theexisting resource envelope;

• Revenue recovery from cost-re-flective core municipal services;• Wage increases for municipal

staff that have exceeded headlineconsumer inflation in the past, aswell as the need to restructure cer-taincomponents foroperationalef-ficiencies;• Affordability of capital pro-

jects.Cost-saving measures appliedThe budgeted allocation for em-

ployee-related costs totalsR291,6 million,whichequals29,8%of the total operating expenditureand within the NT norm of 25-40%.Cost-saving measures applied

include:- Restructuring of the OM per-

sonnel corps in protection servicesand introduction of a shift system;- Abolishment of 23 posts;- Principle of 0% increase innon-

core general expenses unless validmotivations dictate.

that the capital budget is utilised

to the hilt, even if the resources atits disposal are rather limitedmostof the time. It goes without sayingthat productivity, service deliveryand good governance will be ad-dressed in earnest, while councilpromisesnot tobudgefromitszero-tolerance attitude towards waste-ful and fraudulent practices.“We also need to put in place

measures to generate a more sub-stantial surplus. To some extent,this has been achievedwith the ad-justments budget, and the alloca-tion of aMunicipalDisasterRecov-ery Grant of R1,27 million as an-nouncedon31December2014, afteran application was lodged follow-ing substantial damage due to theheavy rainfall and floods in No-vember 2013.“We are mindful of the afforda-

bility of services for consumers. Itis also a fact that municipal reve-nues and cash flows are expectedto remain under pressure in2015-’16.“To continue proper service de-

livery toourcommunities,wehow-ever once again had to budget forunfunded mandates to the amountof approximately R28,8 million,which include:

A group of people took it upon themselves towalk a gruelling 50 km from Bettysbay toHermanus early on Monday morning as partofWalk foraDreamfundraiser for local singerEdian Barnard who was chosen to perform atthis year’s KKNK in Oudtshoorn.

Hermanus Staan Saam (HSS) decided to supportthe dreams of Barnard by initiating this fundrais-er, says Tronel Meintjies, founder of HSS.

The 50 kmwalkwas the first step towards reach-ing Barnard’s goal and more events will follow. Apercentage of funds raisedwill go toHSS to contin-ue its support of local families and those in need.

On Monday, members of HSS walked with Bar-nardandMissTfromWhaleCoastFMastheystart-ed their journey at 05:00. By 12:00 they reachedHermanus, tired but satisfied with what they hadaccomplished.

During their walk, they handed out Easter eggsto the homeless and people passing by.

Police arrest six suspectswith stolen vehicleSix suspects, four males and femalesaged between 25 and 35 were arrestedin Kleinmond on Saturday 28 Marchwhile in possession of a stolen greyBMW.

The vehicle was stolen during ahousebreaking in Sharpie Street, Fish-erhaven on 26 March.

This arrest came after Hermanus Po-lice shared the information to allneighbouring stations and vigilance ofthe Kleinmond Police who spotted thevehicle in their area.

They requested backup from Herma-nus Police to pull the vehicle off.

Meanwhile, the suspects are linkedwith several cases, including a robberywhich tookplace inHighStreet,Herma-nuswhere a personwas attacked, a rob-bery case at Prawn Flats, Hermanuswhere the suspects used the BMW, andat a housebreaking in Long Street,Hawston where the same vehicle wasspotted on the scene.

The vehiclewas also spotted at a theftcase in Sharpie Street, Fisherhaven.

Police also recovered the driver’s li-cence, bankcardsandclothing fromthesuspects.

All the suspects appeared in Caledoncourt on Monday 30 March and thecase was postponed for a formal bailapplication.

These suspects will be furthercharged for the cases that are linked toHermanus.
