Several weeks ago we asked the question, if 50% of all licensed contractors claim they don’t employ workers and thus have filed a workers’ compensation waiver form with the CSLB (under penalty of perjury no less!), should mandatory workers’ comp for all licensed contractors be required since this number is so ‘suspect?’ We asked for input from you and have received some excellent com-ments we will share in a future update along with com-ments from some top officials both in the governor’s administration and in the legislature. In the meantime the question should also be asked, by requiring manda-tory workers’ comp would more people simply go ‘un-derground’ and thus defeat the purpose? And ‘even’ if this were the case, should the state still pursue legislation which should also include more stringent enforcement?

Let’s look at the ‘big picture.’ To no one’s surprise, the underground economy in California is rampant. Indeed, in a report entitled “Level the Playing Field: Put the Un-derground Economy Out of Business” (http://www.lhc.ca.gov/studies/226/Report226.pdf) the state’s oversight commission called the Little Hoover Commission reports:

“Using an IMF and World Bank estimate that 8.4 percent of the U.S. economy is underground, Franchise Tax Board (FTB) officials estimate that California’s $2 trillion annual economy contains $170 billion of off-the-books activ-ity. Taxes lost as a result total approximately $8.5 billion when you take out illegal activities such as human traf-ficking.”

So, roughly, $161.5 billion dollars that should be going to legitimate businesses ‘playing by the rules’ is being lost to the underground economy. Admittedly, this includes all types of underground activities, but estimates for con-

Can CSLB Find Balance In Licensing and Defeating Underground Economy?

struction alone is somewhere around $6 billion per year! One heck of a lot of lost business for legitimate contrac-tors!

This brings us to the point of this week’s article, besides the issue of whether to mandate workers’ comp, should the CSLB be finding ways to help induce the underground contractors to become licensed? The CSLB absolutely understands there is a tremendous problem. Towards this end, staff proposed at their December board meet-ing (which was postponed until the board’s April Strategic Planning meeting) a new C-1 Non-Structural Remodel and Repair Contractor Classification which would create a new sub-classification to the existing B General Contrac-tor. The thought is that allowing someone to be licensed in one craft without structural experience would create a strong incentive for many unlicensed contractors to become licensed.

Unfortunately, the contractors and union members on the board strongly expressed their opposition, meaning that the proposal will likely be rejected in April. Unless ev-eryone looks ‘out of the box’ and agrees that ‘protecting turf’ is not in anyone’s best interest, it appears that the underground economy will continue to grow and flourish. We have ‘lots’ more to discuss in future updates on this subject. Stay tuned!

January 18, 2016 LIGHT SWEET CRUDE SETTLES AT $29.42Oil closed at its lowest level in more than 12 years Friday, plummeting 11.3% for the trading week on the NYMEX. Two factors contributed greatly to the rout: the Energy Information Administration’s forecast of the global crude glut lasting well into 2017 and the imminent expiration of sanctions against Iran, which could mean greater crude exports from that country. The EIA forecast West Texas Intermediate crude prices to rise to the vicinity of $40 later this year.1,2

CONSUMER OPTIMISM REMAINS Rising to 93.3 from its final 2015 mark of 92.6, the University of Michigan’s initial January consumer sentiment index amounted to a pleasant surprise during a gloomy week. Another consumer indicator was less positive: the Commerce Department said that both headline and core retail sales dipped 0.1% in December.3

PRODUCER PRICE INDEX SLIPS 0.2% This statistic is only part of the story regarding wholesale inflation in December. Minus the volatile food and energy categories, producer prices rose 0.1% last month according to the Labor Department.3

WORRIES ABOUT OIL, CHINA IMPEDE STOCKS Another dip for Chinese equities and slumping oil prices led shares lower last week. During January 11-15, the Dow lost 2.19%, the Nasdaq 3.34%, and the S&P 500 2.17%. At the close, the Dow stood at 15,988.15, the Nasdaq at 4,488.42, the S&P at 1,880.28. Even COMEX gold futures lost 0.7% for the week, settling Friday at $1,090.70.4,5

THIS WEEK: U.S. financial markets are closed Monday in observation of Martin Luther King, Jr. Day. Bank of America, Charles Schwab, Comerica, Delta Air Lines, eBay, IBM, Morgan Stanley, Nautilus, Netflix, and UnitedHealth Group announce earnings Tuesday, and China presents its Q4 and 2015 GDP readings. On Wednesday, investors consider the December CPI, December housing starts and building permits, and earnings from Briggs & Stratton, Brinker International, Goldman Sachs, Kinder Morgan, Northern Trust, and Raymond James. Thursday, earnings from Alaska Air Group, American Express, BoNY Mellon, BB&T, E*TRADE, Fifth Third, J.B. Hunt, Schlumberger, Starbucks, Southwest Airlines, Travelers, Union Pacific, and Verizon arrive along with the latest initial claims figures. Friday, NAR’s December existing home sales numbers and the latest Conference Board leading indicator index complement earnings from GE and SunTrust Banks.

In the process of constructing the iron and steel backbone of buildings, bridges, and other major structures, structural iron and steel workers hoist, maneuever, weld, rivet, and bolt heavy, awkward girders, columns, and plates all while working at great heights. Because of the size and weight of the materials they handle, and the often dizzying heights at which they work, iron and steel workers cannot ignore workplace hazards.

Falls are a serious hazard. If you’re an iron or steel worker, get training in your company fall prevention program, which may include nets, scaffold-ing or fall protection harnesses. Ensure that you wear the appropriate fall protection gear each and every time that you work at heights. All of the components of your fall protection should be compatible, preferably from a single manufacturer. Make sure that you have the appropriate anchoring and positioning mechanisms for your job task. Inspect your gear every time you put it on and don’t use it longer than the manufacturer’s recom-mended lifetime for the materials.

Hoisting equipment is invaluable in providing the power you need to move heavy and awkward loads, but it poses a risk when you place a load and cables under stress. Get training in your hoisting equipment and proce-dures. Inspect the hoisting gear and line each time you use them. Ensure that the load is even and securely fastened. Do not operate a hoist if it’s not in safe condition; a shifting load, a sudden loss of lifting power or a snapping cable could cause a serious crush injury or death. Move the load slowly while watching for obstacles and other workers. Practice work-site communication techniques so you can get positioning and emergency shut-off information immediately.

Because it’s your job to physically maneuver the structural components into place and fasten them down, be aware of the ergonomic risks you take. Let the hoists do the heavy lifting for you; good communication with the hoist operator can save you work and back muscle. When you’re using power tools, be aware of the potential for ergonomic vibration injuries. Watch for symptoms such as finger blanching, tingling, and numbness. Use low-vibration tools and protective gloves and remember to hold the tools with a light, secure grip. Practice good body mechanics. Avoid prolonged awkward postures and take mini-breaks every 20-30 minutes to give your body a break.

Protect yourself and coworkers from falling objects. Ensure that you securely fasten the materials you’re working with to the loading equipment or to the structure before you remove supporting cables. Use tool lanyards to ensure that they will not fall if you misplace or drop them. A one-ounce bolt can feel like a bullet when coming from 10 stories up, so always wear your hard hat.

A hard hat and fall protection gear aren’t the only protection you’ll need on the job. Wear all of the personal protective equipment (PPE) necessary for your job site and the tasks you will be assigned. This may include safety shoes, safety glasses, sturdy work gloves, and/or life jackets for over-water operations. Because a construction site can be an extremely noisy environment; use hearing protection. Also, as you’re often exposed to the heat and the cold, wear layers of appropriate clothing to protect you from the elements.
