722 MOTIONS ON NOTICE 722.1 Motion on Notice Cr Laubsch – Seventh Street Traffic Flow I, Councillor Barry Laubsch, having complied with the requirements of Regulation 13 of the Local Government (Procedures at Meetings) Regulations 2000, hereby give Notice of the following motion to be submitted at the meeting of the Council of the Rural City of Murray Bridge to be held on 24 July, 2006 at 7 pm. I will move: That the Manager Infrastructure & Technical Services prepare a report to Council, with recommendations, on the implications of changing traffic flow on Seventh Street by repositioning the Give Ways signs on Seventh and Second Street, Murray Bridge. 722.2 Motion on Notice Cr Laubsch – Pedestrian Safety Sturt Reserve I, Councillor Barry Laubsch, having complied with the requirements of Regulation 13 of the Local Government (Procedures at Meetings) Regulations 2000, hereby give Notice of the following motion to be submitted at the meeting of the Council of the Rural City of Murray Bridge to be held on 24 July, 2006 at 7 pm. I will move: That the Manager Infrastructure & Technical Services prepare a report to Council with the aim of providing a safer environment for children playing in the area and improving pedestrian safety at Sturt Reserve with the possible introduction of 1. 25 kph or other appropriate speed restriction on Murray Cods Drive 2. A marked pedestrian crossing between the Children’s playground and Bunyip

area on Murray Cods Drive 3. 40 kph or other appropriate speed restriction on Charles Sturt Drive. 722.3 Motion on Notice Cr Laubsch – Bridge Street & Swanport Road I, Councillor Barry Laubsch, having complied with the requirements of Regulation 13 of the Local Government (Procedures at Meetings) Regulations 2000, hereby give Notice of the following motion to be submitted at the meeting of the Council of the Rural City of Murray Bridge to be held on 24 July, 2006 at 7 pm. 722.5 Motion on Notice Cr Schubert – Kangaroo Island Council I, Councillor Schubert, having complied with the requirements of Regulation 13 of the Local Government (Procedures at Meetings) Regulations 2000, hereby give Notice of the following motion to be submitted at the meeting of the Council of the Rural City of Murray Bridge to be held on 24 July, 2006 at 7 pm. I will move:

That the Rural City of Murray Bridge supports Kangaroo Island Council’s efforts to stop further forest planting, restricting long term development and financial rewards for Kangaroo Island Residents.

733 OFFICER’S REPORTS 733.1 CHIEF EXECUTIVE OFFICER 733.1.1 GOVERNANCE UPDATE Purpose To update Members’ on the status of various Governance matters. Introduction Council has several reporting requirements in the area of Governance. Much work has been done to ensure all records are up to date and processes are streamlined, it should be noted that there are still many records to be updated and the proposed reporting flow will assist in this. Documentation: This report will address the following documentation and provide Members with an update and the proposed future reporting flow to Council.

• Strategic Management Plan • Council adopted Policies • Council adopted Bylaws • Council adopted Delegations • Confidential Items considered by Council • Committee Membership approved by Council. • Annual Report and audited financial statements.

It is recognized that there is other documentation required to be presented to Council, eg financial reports, including Budgets, Freedom of Information update, Representation Reviews and these reports will continue as required. Strategic Management Plan Adopted by Council in September 2005 (item no 485.1.4). Legislative Requirements: Section 122(4) of the Local Government Act, 1999 states that Council must have a Strategic Management Plan and financial plan covering 10 years and be reviewed at least every 3 years. Council was provided with a report in January 2006 (item no 565.1.2) providing a status report on how the SMP was operating. It is proposed to provide Members with an updated annual status report on the Strategic Management plan in February. It should be noted that the 10 year financial plan should also be considered in conjunction with the Strategic Management Plan and an update on this will be included in a separate report.

Council Adopted Policies Council adopted policies are required to be endorsed regularly. Please refer to report numbers 733.1.2; 733.1.3; 733.1.4; 733.1.5; 733.1.6 for existing policies requiring endorsement and new policies requiring adoption. Several other policies are due for review and these will be listed at future meetings for endorsement. From time to time Council passes resolutions that relate to policy/delegation but do not require a dedicated policy. These will be captured in a separate schedule but will managed with the Council adopted policies. It is proposed to list all Council adopted policies for annual endorsement in May of each year and at the first meeting of Council in November. Council Adopted Delegations Council recently adopted a suite of delegations and these are now up to date and legally compliant. Delegations under the Aged Care Act are included in the agenda for this meeting (refer report 733.1.7). Legislative requirements: All delegation instruments made pursuant to Section 44 should be reviewed at least once in very financial year. It is proposed to list delegations for annual endorsement in July of each year. Confidential Items This area needs some work and it is proposed to provide a report to Council in August to update the status of these items. Legislative requirement: Section 91(9)(a) requires that items kept confidential be reviewed annually. It is proposed that they be annually reviewed in August of each year, recognizing the Chief Executive Officer has delegated authority to release reports as appropriate. Committee Membership Council’s Committee membership is considered by Council at its first meeting following a periodic election and as required. A draft Council Committees policy has been prepared and will be presented to Council for adoption in November. A draft copy has been circulated to Members separate to the agenda for information only. It is proposed that Committee Membership be reviewed annually in September of each year and of course, following a Council election.

Bylaws Bylaws are generally monitored and policed by the Development and Environmental Services department. Legislative requirement: Chapter 12 of the Local Government Act relates to bylaws and states that unless it has expired or been revoked expire on the 1 January of the year following the year in which the 7th anniversary of the day on which the by-law was made falls. It is proposed that bylaws be annually reviewed in March of each year. Annual Report Legislative requirement Section 131(1) of the Local Government Act states the last day for adoption of the annual report for the preceding financial year is 30 November. It is proposed that the Annual Report will be presented to Council in October of each year. Appendix 733.1.1 a provides Members with an index of current policies, delegations, bylaws and committee membership. Further work will be done on this document to include all registers required under the Local Government Act and will be presented to Council in November. 1. Policy objectives The Rural City of Murray Bridge will ensure that the payment of Elected

Member allowances and the reimbursement of expenses is accountable and transparent, and in accordance with the Local Government Act 1999 and the Local Government (Members’ Allowances and Benefits) Regulations 1999.

2. Principles 2.1 This policy is underpinned by the following principles: 2.1.1 Elected Members should not be out of pocket as a result of

performing and discharging their Council functions and duties. 2.1.2 Any reimbursements claimed by Elected Members must be for

expenses actually and necessarily incurred in performing and discharging their official Council functions and duties.

2.1.3 Elected Members are entitled to receive: 2.1.3.1 an annual allowance as provided in Section 76 of the

Act and Regulation 4;

2.1.3.2 reimbursement of prescribed travelling and

child/dependant care expenses associated with attendance at Council/Committee meetings, pursuant to Section 77(1)(a) of the Act and Regulation 5, subject to any necessary resolution as required by Local Super and where the amount of the allowance payable enables payment options, e.g. deeming to superannuation that the method of payment be as determined by the member.

2.1.4 Council has agreed to: 2.1.4.1 reimburse certain prescribed expenses pursuant to

Section 77(1)(b) of the Act and Regulation 6; 2.1.4.2 provide Elected Members with facilities and support

to assist them in performing and discharging their functions and duties pursuant to Section 78 of the Act.

3. Introduction 3.1 This policy summarises the provisions of the Act and Regulations in

respect to Elected Members’ allowances, expenses and support and sets out the type of expenses and the circumstances in which those expenses will be reimbursed.

3.2 In setting this policy, Council took into consideration the overall

support provided to Elected Members, i.e. annual allowances paid, expenses reimbursed and facilities/services provided pursuant to Sections 76, 77 and 78 of the Act.

4. The Local Government Act 1999 (“the Act”) 4.1 Section 77(1)(b) of the Act provides that Council may approve the

reimbursement of certain prescribed expenses incurred by elected members, either on an individual basis or under a policy adopted by Council. Regulation 6 sets out the types of expenses that may be reimbursed under Section 77(1)(b).

4.2 This policy has been developed and adopted in accordance with

Section 77(1)(b) of the Act to specify the types of expenses that will be reimbursed without the specific approval of Council, and the process for elected members to obtain reimbursement of those expenses.

5.2.1 implementing expense reimbursement procedures in

accordance with this policy; 5.2.2 maintaining a Register of Allowances and Benefits as

prescribed in Section 79 of the Act and Regulation 7; 5.2.3 implementing a review of allowances paid to Elected Members

annually, pursuant to Section 76(5) of the Act; 5.2.4 ensuring a copy of this policy is available for inspection and

purchase by the public. 6. Entitled allowances and reimbursements 6.1 Allowances 6.1.1 Elected Members are entitled to receive the following annual

allowances pursuant to Section 76 of the Act to help cover the cost of performing and discharging their official functions and duties:

Mayor $26,980 Deputy Mayor/Chairperson $8,425 Other Elected Members $6,740 6.1.2 Allowances will be paid on a monthly basis in advance

pursuant to Regulation 4(2). 6.1.3 In setting these allowances, Council took the following factors

into consideration: 6.1.3.1 the allowance is intended to help cover the general

expenses of office incurred by Elected Members 6.1.3.2 there is no requirement to provide evidence to

Council of actual expenses incurred in respect to the allowance.

6.1.4 Allowances will reviewed on an annual basis in the month of

May and also listed for consideration at the first ordinary meeting after being newly constituted following a periodic election.

6.2 Travel and dependant care 6.2.1 In addition to any allowance paid under Section 76 of the Act,

Elected Members are entitled to receive reimbursement for travelling within the area of Council and dependant care

expenses associated with attendance at Council and Committee meetings pursuant to Section 77(1)(a) of the Act as detailed below:

6.2.1.1 reimbursement is restricted to ‘eligible journeys’ (as

defined in Regulation 3) by the shortest and most practical route and to the part of the journey within the Council area, i.e. any travelling outside the Council area in order to attend Council or Committee meetings is provided by this policy under “Additional Reimbursement and Support”.

6.2.1.2 where an Elected Member travels by private motor

vehicle, the rate of reimbursement is as prescribed in Section 82KX(1)(a) of the Income Tax Assessment Act 1936. Travel by taxi, bus or other means of public transport is reimbursed on the basis of expenses ‘actually and necessarily incurred’, but Is still limited to ‘eligible journeys’ by the shortest or most practical route and to the part of the journey that is within the Council area.

6.2.1.3 child/dependent care expenses are not reimbursed if

the care is provided by a relative of the Member who ordinarily resides with the Member. A definition of “relative” is contained in Section 4 of the Act.

6.2.1.4 Elected Members to utilise the Mayor’s vehicle where

practical (as pooled by booking arrangement with the Executive Assistance & Governance Officer) as first preference for business use only.

6.3 Additional reimbursement and support 6.3.1 Pursuant to Section 77(1)(b) of the Act, Council also approves

the reimbursement of expenses and support to Elected Members as described below:

6.3.1.1 In addition to eligible journeys (as defined in

Regulation 3), Elected Members are entitled to receive reimbursement for expenses actually and necessarily incurred in travelling to a function or activity on the business of Council. The following conditions apply to these expenses:

6.3.1.1.1 Travel both within and outside the

Council area must be incurred by the Elected Members as a consequence of attendance at a function or activity on the business of Council. A ‘function or activity of Council’ means official Council functions including Mayoral receptions, opening ceremonies, dinners, citizenship

ceremonies and official visits etc; inspection of sites within the Council area which relate to Council or Committee agenda items; attendance at meetings of community groups or organisations as a Council appointed delegate (but not to attend meetings of community groups or organisations when fulfilling the role of local representative, as the Elected Members’ allowance provides for this).

6.3.1.1.2 Council will not reimburse the member

for travel related to attendance at a Council or Committee meeting (eligible journey) as it relates to that component outside the Council area.

6.3.1.1.3 Reimbursement is restricted to the

shortest or most practicable route. 6.3.1.1.4 Where an Elected Member travels by

private motor vehicle, the rate of reimbursement is as prescribed in Section 82KX(1)(a) of the Income Tax Assessment Act 1936.

6.3.1.1.5 Training sessions which have been

approved by Council or under delegated authority.

6.4 Other Expenses Pursuant to Section 77(1)(b) of the Act Council approves

reimbursement of: 6.4.1 Expenses incurred for the care of a child of the Elected

Member or a dependent of the Member requiring full time care as a consequence of the Member’s attendance at a function or activity on the business of Council.

6.4.2 Expenses incurred by the member as a consequence of the

Elected Member’s attendance at a conference, seminar, training course or other similar activity that is directly or closely related to the performance or discharge of the roles or duties of the Member. Expenses will only be reimbursed for attendance at conferences, seminars etc which have been approved by Council or under delegation. The following types of expenses will be reimbursed – airfares, registration fees, accommodation, meals, taxi fares and car parking. (also refer Elected Members Training & Development Policy)

7. Facilities and support 7.1 Pursuant to Section 78 of the Act, Council resolved to make available

to Elected Members the following facilities and support to assist them in performing or discharging their official functions and duties:

7.1.1 Access to a meeting room and designated office facilities; 7.1.2 The provision of facsimile machines and business cards to

those members who request them. 7.1.3 Provision of administrative support via the Executive

Assistance & Governance Officer. 7.1.4 The use of Council vehicles (when available) by Elected

Members for business use only via booking arrangements. This also includes the vehicle allocated to the Mayor, with the bookings to be undertaken via the Executive Assistance & Governance Officer.

7.1.5 During business use, the Elected Member has flexibility to

authorise another person to drive the vehicle in his/her presence.

7.2 In addition to the above, Council has resolved to make available to

the Mayor the following facilities and support to assist in performing and discharging of official functions and duties:

7.2.1 The provision of a mobile phone and office accommodation. 7.2.2 A suitable fully maintained vehicle is also available for

unlimited/unencumbered use (except during time of leave). 7.3 These facilities and services are made available on the following

basis: 7.3.1 They are necessary or expedient for the Member to perform or

discharge his/her official functions or duties; 7.3.2 The facilities remain the property of Council and will not be

used for a purpose unrelated to official functions and duties unless the use has been approved by Council and the member has agreed to reimburse Council for any cost associated with that use.

8. Local Government Elections & Use of Council Facilities In order to address openness, fairness and transparency issues at the time of

Council elections, Council supports and that any actual or perceived advantage that sitting Members may have over other candidates will be minimised. In order to achieve this, the following actions will be implemented.

Council website The Elected Member profiles will be deactivated as

from the commencement of the nominations period until the declaration of each relevant appointment.

The photographs and contact details of Members will remain accessible to the general public.

Letterheads etc Elected Members will not use Council letterheads,

logo or business cards or similar for campaign purposes either personally or in support or otherwise of candidates.

Council Facilities Elected Members will not use any of the Council

offices, meeting rooms or equipment or other Council provided services for the elections campaign purposes.

9. Expenses and support requiring Council approval All other expenses, reimbursements and support not detailed above will

require approval by Council on a case by case basis. 10 Claims for reimbursement 10.1 Elected Members are required to provide details of kilometres

travelled and/or evidence of expenses incurred to support all reimbursement claimed. Procedures have been established which require evidence of expenses incurred to support reimbursements claimed. Details are not required of expenses paid out of the Elected Member’s allowance.

10.2 All claims for reimbursement must be submitted to the Chief

Executive Officer on the forms provided for this purpose. 11. Register of allowances and benefits Pursuant to Section 79 of the Act, the Chief Executive Officer will maintain a

record of the annual allowances paid to Elected Members under Section 76 of the Act, any expenses reimbursed to a Member under Section 77(1)(b) of the Act and any other benefits paid or provided to a Member, with the exception of reimbursements paid under Section 77(1)(a) of the Act.

12. Review and Evaluation 12.1 Elected Member allowances will be reviewed annually. The

effectiveness of the Policy will be reviewed and evaluated in May of each year.

13. Post Implementation Action

13.1 Following approval by the Council the original signed version of this policy will be kept within the Council adopted policy filing cabinet by the Executive Assistance and Governance Officer for referral by any staff member who wishes to do so.

733.1.3 POLICY – COUNCIL ELECTIONS Purpose To provide Council and Staff with a clear direction on the conduct of Council Elections. Business The Council Elections Policy has been developed in consideration of Section 12(b) of the Local Government (Elections) Act, 1999 which states, ‘A Council is responsible for the provision of information, education and publicity designed to promote public participation in the electoral processes for its area, to inform potential voters about the candidates who are standing for election in its area, and to advise its local community about the outcome of elections and polls conducted in its area. Attached as appendix 733.1.3 is the proposed policy – Council Elections. Recommendation: That item number 733.1.3 on Council agenda of 24 July, 2006 be received and the Council Elections Policy attached as appendix 733.1.3 be endorsed, with this policy and other Council adopted policies being listed on the first agenda of the new Council in November 2006 with a further review in May of each year. 1. Policy objectives The Rural City of Murray Bridge will ensure that the convening of Local

Government Elections, (General or Supplementary), are conducted in an accountable and transparent manner, in accordance with the Local Government Act 1999 and the Local Government (General) Regulations 1999 and the Local Government (Elections) Act 1999 and the Local Government (Elections) Regulations 1999.

2. Principles 2.1 This policy is underpinned by the following principles: 2.1.1 As Council Members make a range of important decisions and

contribute to the shaping the sort of place the Council area will be in the future, Council will ensure the running of elections are conducted in an accountable and transparent manner through promotion and publicity of Elections.

2.1.2 The Chief Executive Officer will engage the State Electoral

Office, as required under the Act, to assist in the conduct of Council elections.

2.1.3 The Executive Assistance and Governance Officer will be the

Council Contact Officer for Election enquiries.

2.1.4 Council will join with the Local Government Association of South Australian in promoting and publicising Elections.

3. Introduction

3.1 This policy summarises the provisions of the Act and Regulations in respect to the conduct of Local Government General or Supplementary Elections.

This policy will also apply to the conduct of Council Referendums

and/or Polls required by Council resolution. 4. The Local Government (Elections) Act 1999 (“the Act”) 4.2 This policy relates to Section of 12(b) of the Act to promote Council

elections. 5. Policy Statement

5.1 This policy will apply to the conduct of all Council Elections – General or Supplementary.

5.2 This policy will also apply to the conduct of Council Referendums

and/or Polls. 5.2 The Chief Executive Officer is responsible for ensuring the

transparent and accountable conduct of all Elections.

6. State Electoral Commission The Chief Executive Officer will engage the services of the State Electoral

Commission, as appropriate as required under the Act, in the conducting of General or Supplementary Elections

7. Council Voters’ Roll The Council Voters’ Roll will be compiled in accordance with prescribed roll

closure dates and in conduction with the requirements of the State Electoral Commission as set out in the Acts and Regulations.

Council’s Voters’ Roll may be viewed at the Local Government Centre without

cost. Copies of the Council’s Voters’ Roll may be purchased in paper form (hard copy) only, Fees are set out in Council’s Fees & Charges Schedule.

Under no circumstances will Council’s Voters’ Roll be distributed electronically

to sitting Elected Members and/or candidates or any other party, with the exception of the State Electoral Commission, at any time.

8. Council’s Web Site Council’s Web Site will have an entry for Local Government Elections. This

will assist in promotion and publicity and will be kept up to date by Council’s Executive Assistance & Governance Officer.

The site will include information on; How to Enrol to Vote Key dates How to nominate as an Elected Member Becoming an Elected Member Links to relevant sites Other information deemed relevant by the Chief Executive Officer Sitting Elected Members and/or Candidates will not have access to Council’s

web site to market and/or promote themselves or others in any Council election.

9. Elected Members – use of Local Government Elections & Use of Council

Facilities (also refer to Elected Members’ Allowances and Benefits) In order to address openness, fairness and transparency issues at the time of

Council elections, Council supports that any actual or perceived advantage that sitting Members may have over other candidates will be minimised.

This will incorporate, but not be limited to – use of Council’s logo; facsimile

machine for circulating information as part of their campaign; photocopying; free use of meeting rooms; telephones; Council stationery.

10. Publicity & Promotion Council is responsible for the provision of information, education and publicity

designed to promote public participation in the electoral processes for its area. It is also responsible to inform potential voters about the candidates who are standing for election in its area, and to advise its local community about the outcome of elections and polls conducted in its area.

To achieve this responsibility Council will undertake publicity and promotion

through its website, articles in the Rural City Review and press releases and articles in the Murray Valley Standard and segments on Radio 5MU. Council will join the Local Government Association of South Australia in publicity promotions as appropriate.

Education programs will also be conducted in liaison with the Local

Government Association of South Australia and the State Electoral Office. 11. Election Signs Council will refer to the Control of Elections Signs – for Federal, State and

Local Government Elections, Referenda and Polls LGA Model Guidelines, attached as appendix 1 to this document.

OBJECTIVES The objectives of these guidelines are to: 1. achieve clarity of the policy position and approach of Council, and to incorporate

issues of ETSA Utilities and Transport Services Division of the Department for Transport, Energy and Infrastructure (DTEI) as they relate to their respective interests, thereby enabling a single approval (from Council) covering the interests of all three parties;

2. establish a policy which is to be applied consistently and equitably to all political parties and candidates;

3. achieve consistency of approach within a Council area, whilst recognising that some variation will occur from one Council area to another;

4. provide a summary of the legal position; 5. provide information on whom to contact within Council; 6. provide information on how to make application to Council; and 7. minimise any threat to public safety from the placement of signs. A) INTERPRETATION References in this document to: “Elections” is to be interpreted to include Periodic and General Elections, By-elections and Supplementary Elections, Referenda and Polls. “Road” is to be interpreted within the definition of road under the Local Government Act 1999 and for the purposes of clarification extends from property boundary to property boundary. “Signs” includes moveable signs where appropriate and also includes posters that comprise an advertisement for a candidate or party in the election, or for a referendum or poll whether held for Federal, State or local government purposes. B) SUMMARY OF LEGAL POSITION RELATING TO

ELECTION SIGNS LOCAL GOVERNMENT ACT 1999 It is an offence to interfere with any structure on a public road or to erect or install a structure (“structure” includes pipes, poles, fixtures, fitting or other objects) in, on, across, over or under a public road without authorisation from Council (Sect. 221 (2)(b) & (2) (d)). A maximum penalty of $5,000 applies.

A Council may remove and dispose of any structure or object (which includes an election sign) which has been erected, placed or deposited on a public road without authorisation, and recover the cost of doing so from the person who erected, placed or deposited the structure or object (Sect. 234).

A Council can make a by-law to regulate moveable signs (defined in the Act as a moveable advertisement or sign and is sufficiently broad to include an election sign). A person may place and maintain a moveable sign on a road without authorisation provided:

• the sign is related to a State or Commonwealth election and is displayed during the period commencing with the issuing of the writ(s) for the election and ending at the close of polls on polling day, or

• the sign is related to a local government election and is displayed during the period commencing 4 weeks before the date set for polling day and ending at the close of voting on polling day, or

• the design and structure, the positioning of the sign and any other relevant requirements of the by-law are complied with.

A moveable sign must not unreasonably restrict the use of the road or endanger the safety of the public (Sect. 226). Where a moveable sign fails to satisfy these requirements, a person authorised by Council may order the owner to remove the sign, or if the owner is unknown or fails to comply immediately with the order, may remove and dispose of the sign (Sect. 227). Council has the power to make by-laws prohibiting the posting of bills, advertisements or other papers or items on a building or structure on a road, other local government land or other public place, without the permission of the Council (Sect. 240). By-laws which implement controls for signs other than moveable signs on roads ordinarily provide exemptions for election signs authorised by a candidate during a Commonwealth, State or Local Government election and when a referendum is being held. A person who deposits rubbish (which includes litter) on a public road without authorisation or permit commits an offence. An expiation fee of $315 applies, with a maximum fine of $5,000 (Sect. 235).

LOCAL GOVERNMENT (ELECTIONS) ACT, 1999 (Applicable to Council elections only) A person who publishes electoral material must include the name and address of the person who authorises the publication and in the case of printed material, the name and address of the printer or other person responsible for its production. A maximum fine of $2,500 applies (Sect. 27). It is an offence to publish electoral material that purports to be a statement of fact and yet is inaccurate and misleading to a material extent. A maximum fine of $5,000 applies (Sect. 28). DEVELOPMENT ACT The Development Regulations provide that an advertisement in relation to an election/referendum is excluded from the definition of “development” (and hence does not require authorisation under the Development Act) if the total area on one

building or site is not more than two square metres and the display does not move, flash, reflect light so as to cause undue distraction to motorists nor is internally illuminated. If an advertisement or hoarding disfigures the natural beauty of a locality, detracts from the amenity of a locality or is contrary to the character desired from the locality under the Development Plan, the Council may serve notice on the owner or occupier of the land (on which it is located) to remove or obliterate it unless it is authorised under the Local Government Act 1999, the Electoral Act 1985 or the Local Government (Elections) Act 1999 (Sect. 74 of the Development Act 1993). ELECTORAL ACT (STATE) Councils do not have the power to regulate the content of electoral signs. Queries in relation to the provisions of the Electoral Act 1985 should be directed to the State Electoral Office, telephone (08) 8401 4300. COMMONWEALTH ELECTORAL ACT Queries in relation to the provisions of the Commonwealth Electoral Act should be directed to the Australian Electoral Commission, telephone (08) 8237 6555. CRIMINAL LAW CONSOLIDATION ACT It is an offence under this Act to steal or deface an electoral sign or poster. Any alleged offence will be referred to the SA Police for their attention. C) COUNCIL POLICY ELECTION SIGNS IN PUBLIC PLACES Subject to the limited exemptions (as set out above) for moveable election signs placed on a road, the Council Policy is that prior to any signs being posted, affixed or erected on property under the care and control of Council, ETSA Utilities or DTEI for the purposes of candidate promotion in Federal, State or Local Government Elections, Council consent must be obtained. Where Council consent is given, the following terms and conditions for signs must be complied with: 1 Signs must:

1.1 not be more than 1 square metre in area and be limited to one sign per site/pole. A back to back sign facing two directions is considered to be one sign for this purpose. (For private fences a larger area is permissible – please refer to point 4 below).

1.6 contain clear and legible writing or symbols; 1.7 contain the name and address of both the person authorising the

promotional material and the printer of it, along with a phone contact number of the authorising person or party, and

1.8 be fastened securely so that they cannot become detached in high winds and endanger Council, ETSA Utilities or DTEI property or equipment or pose a danger to the public.

2 Signs must not:

2.1 be illuminated (internally or indirectly), move, flash, rotate, or reflect so as to be an undue distraction to drivers;

2.2 be self adhesive. All individual promotional material affixed under the terms of this consent may only be affixed by non-invasive means that do not cause damage of any type to the structure to which the material is affixed. If a paste is to be used, it must be of a water based/wallpaper type (or similar);

2.3 be affixed under any circumstances to trees, shrubs, or other plants or at any location that may cause damage to Council, ETSA or DTEI property;

2.4 be placed on a carriageway, dividing strip, traffic island, roundabout, or within 50 metres of a signalised intersection or pedestrian activated crossing, or on the South-Eastern Freeway, the Southern Expressway or the Port River Expressway;

2.5 be placed within 6 metres of an intersection or junction, or in any other location that may pose a hazard to pedestrians or road users;

2.6 be attached to any street name, traffic direction or parking sign or to the associated pole;

2.7 be erected on poles or towers carrying electricity transmission lines (these can generally be identified as all poles, which are taller than 11 metres);

2.8 be attached to ETSA Utilities padmounted transformers or switching cubicles;

2.9 be attached to the fence or other enclosure of any sub-station of ETSA Utilities;

2.10 be placed so as to cover any Council, ETSA or DTEI signs or markings;

2.11 be placed on DTEI structures with the exception of “gooseneck” light poles belonging to DTEI. Structures which belong to DTEI, include road bridges on arterial roads, traffic control boxes, traffic signal poles, signal boxes, traffic signs and other traffic control devices, guide posts and pedestrian fences located within the road reserve.

2.12 be placed in a location on a pole or fence so as to aid the climbing of the pole or fence.

2.13 be placed so as to restrict the sight distance for road users and pedestrians crossing the road;

2.14 compete with or reduce the effectiveness of other signs and traffic control devices;

2.15 resemble a traffic control device, or reasonably be capable of being mistaken as a traffic control device;

2.16 advertise any organisation other than a registered political party or candidate.

3. Where signs are fixed or posted on poles adjacent to footpaths or roadways

such signs shall only be between a height of 2 to 3 metres from the ground with nothing above the sign to affix it or anything else to the pole. There is a total prohibition on any part of the sign being higher than 3 metres from the ground.

4. Signs on private fences, including those adjoining Council land, shall have a

total advertisement area of not more than 2 square metres and be limited to one sign per candidate/party per site/location.

5. The person or party responsible for the sign must maintain the sign. The

person or party is also responsible for ensuring that safety is maintained (and the Australian Road Rules complied with) whilst the sign is being installed, maintained or removed and no traffic disruption is to occur during the installation, maintenance or removal process.

6. This authority does not cover railway or tramline structures such as level or

pedestrian crossings, bridges, stations, signalling equipment or fences adjacent to railway and tram lines. In this regard, information on the various rules and if appropriate, permission to enter or erect signs in these areas must be obtained form the relevant rail authority. In metropolitan Adelaide, this is (in most instances) either TransAdelaide or the Australian Rail Track Corporation.

7. Where properties of Council are managed by others, Council may delegate to

the Management Committee of that body the right to determine its own policy for election advertising, subject to relevant legislation. In such cases, written consent of that body is to be obtained. Upon request by the Council, the applicant must produce such written consent.

8. The person(s) to whom consent is granted and any persons acting on their

behalf, accept full responsibility for any personal injury, damage or loss in any way arising out of or consequent upon the display of election material and acknowledge(s) that the Council, ETSA Utilities or DTEI have no liability or responsibility in relation to such matters whatsoever.

9. It is a condition precedent to the granting of consent that if any breach occurs

which results in action by or on behalf of the Council to enforce the conditions of this policy and thereby results in costs and expenses for the Council, then such costs and expenses will be recovered by the Council from the person(s) responsible. These costs will include removal and/or destruction of the offending material by an officer or agent of the Council.

10. Should the applicant propose to use property belonging to any party - other than Council, ETSA Utilities or DTEI - they must firstly obtain the written consent of that third party. Upon request by the Council, the applicant must produce such written consent. In cases where there is property involved belonging to any other party, Council approval will be subject to all of the relevant matters contained in this policy.

11. The person or party responsible for the sign must remove all parts of the sign

and fixtures from the site in complying with 1.2 or 1.3 of this Part D. 12. Installing, maintaining and removing signs must not be carried out between

7.00am and 9.00am or between 4.00pm and 6.00pm Monday to Friday on a peak flow traffic lane.

A breach of, or non-compliance with, any of the conditions of the policy will invalidate the consent and may result in a report being prepared for consideration by Council with a view to prosecuting the offender. D) ILLEGAL SIGNS Council is totally opposed to illegal signs as a form of advertising. If advice is received that signs have been affixed that restrict the use of a road, or endanger the safety of the public, or without Council consent or remain in place after the deadline for removal, the following procedure will be followed by Council staff: 1. The relevant officer will notify the organisation/persons by phone/facsimile,

requesting removal of the signs within 24 hours. 2. If the signs are not removed within 24 hours, instructions will be given to

immediately remove or paint over the offending signs and Council will charge the resultant cost to the parties responsible.

3. If evidence can be obtained of persons affixing the offending sign, this information

will be referred to the relevant officer for possible legal proceedings.

A proposed policy is attached as appendix 733.1.4 Business The Leave of Absence (Elected Member) Policy has been developed as a guideline that will be followed when Elected Members of Council require leave of absence from three or more consecutive formal meetings. 1. Objective The purpose of this policy is to develop guidelines that will be followed when

Elected Members of Council require leave of absence from three or more consecutive formal meetings. Compliance with this policy will minimise the potential removal from office of a member due to period of absenteeism and ensure compliance with the delivery of Council notices, agendas, minutes and documentation.

2. Legislative Framework There is no legislative requirement for Council to have a policy relating to

this area. However Section 54(1)(d) of the Local Government Act 1999 states that the office of a member of a council becomes vacant if the member has been absent, without leave of the council from three or more consecutive meetings (the first of which having been held three months or more before the last).

(NB: Rural City of Murray Bridge convenes 2 Council meetings a month, therefore this clause only applies for leave of absence of 3 months or more))

3. Policy If an Elected Member of Council requires leave of absence from three or

more consecutive meetings , the following guidelines should be followed:

• Advise the Chief Executive Officer of absence and complete the Elected Member Leave of Absence Advice form

• An apology shall be listed on the agenda and minutes for each Council meeting the Leave of Absence relates to.

The Rural City of Murray Bridge is committed to transparent decision making processes and to providing access to a fair and objective procedure for the hearing of review of decisions. Grievances may arise as a result of dissatisfaction with a decision about a policy, procedure, service or fee. All attempts will be made to resolve grievances quickly and efficiently, without the need for formal applications for review to be lodged. Sometimes this cannot be achieved. The procedures provides guidance for dealing with formal requests for review of decisions of Council, its employees and other people acting on behalf of Council. Dealing with grievances at the local level is the most effective way of resolving matters quickly. Applicants for review of decisions will be encouraged to participate in the review handling process co-operatively. However this will not negate citizens’ rights to seek external review through the State Ombudsman, other legal appeal processes, or the Courts at any time during the complaint handling process. Local Government Act 1999 The Rural City of Murray Bridge’s procedure for Review of Decisions has been adopted in accordance with Section 270 of the Local Government Act. This procedure is one of Council’s customer focused approach to service delivery. It provides a further opportunity to review the way Council provides services to the community, and to identify areas for improvement.

Principles Some key principles of the Policy include:

• A publicised, accessible, fair and objective process, in which complainants are treated with respect and dignity;

• Observing the principles of natural justice – ensuring all parties have access to all relevant information and the opportunity to respond;

• Matters being dealt with by suitably experienced and trained review officers with sufficient decision making authority;

• A process which is objective and independent of the original decision making process wherever possible;

• Resolving complaints quickly and effectively, and ensuring complainants are kept informed about the progress of the matter.

Instances where the Procedure will Apply Issues arise about a range of matters during the course of Council’s day to day activities. Most grievances are initially made verbally by telephone, face to face to a Council officer, or some may be in writing in the first instance. Sometimes Elected Members also receive grievances. Grievances will be referred to the relevant Council staff members in the first instance and prompt action generally results in the matter being resolved satisfactorily. The procedure will apply to matters that are not resolved satisfactorily. A formal application or request for review of a decision will therefore initiate the procedure process. The person who lodges a formal grievance is referred to as the “applicant”. The procedure will apply to all formal requests for review of decisions, except, for example, Development Act, Freedom of Information Act matter ie in instances where specific procedures are prescribed in relevant legislation. The procedure, for example, could apply to unresolved grievances about:

• Fees and charges levied by Council • Parking infringement notices and fines • Dog Control matters • Rubbish collection • Road and footpath conditions • Environmental nuisances • Street trees

Persons Eligible to Lodge a Grievance Any person who is affected by the decisions made by Council, may lodge a grievance. For example, residents, ratepayers, members of a community group, users of Council’s facilities, and visitors to the area all have the right to lodge an application for review. Lodging a Grievance Formal grievances are to be in writing to the Chief Executive, providing full details about the grievance. Assistance will be provided to applicants where necessary, including the use of an interpreter, providing assistance for people with a disability, or

referring applicants to an advocate to help prepare a written application. Confidentiality will be maintained by Council, and only parties to the grievance will be involved. Applicants will be encouraged to observe confidentiality also, as this is likely to achieve the fairest result for all concerned. Attached as appendix 1 is an application form that is to be used when lodging formal grievances. The Chief Executive (or delegate) will act as Contact Officer to provide advice to the public on the review process. Resolving a Grievance Principles of natural justice will be observed in dealing with grievances. All parties will have the opportunity to express their point of view, provide relevant information, and respond to issues raised. Council has nominated the Chief Executive (or delegate) who is responsible for dealing with grievances. The Chief Executive (or delegate) will assess grievances, determine the appropriate action, and arrange for independent investigation if necessary. Some matters will be referred directly to Council for consideration or re-consideration. The types of grievances that will be referred to Council are those regarding;

• A request for review of a decision formally made by Council (ie a Council resolution)

• A request for an alteration to a formal Council Policy • A request for the review of a decision made by the Chief Executive which

is not supported by Council Policy or clear procedural guidelines • Any other matters at the discretion of the Chief Executive

Council requires the Chief Executive (or delegate) to make a judgement about the severity of complaints regarding the above mattes, so as not to hold up Council meeting time on matters which whilst falling into the above categories, are of a relatively minor nature. However, where such matter is likely to be of interest to the wider community, the Chief Executive (or delegate) shall consult with the Mayor. The Council will not review or reconsider an application:

• Which appears frivolous or vexatious; • Where the applicant is not seen as having a sufficient interest in the matter; or • Where alternative statutory review processes exist (e.g. Development Act

matters where well developed review mechanisms exist). It is considered inappropriate to use this review procedure when alternative statutory processes exist. Examples are:

• Electoral issues – Local Government (Elections) Act. • Development Act matters (ERD Court). • Freedom of Information requests. • Expiation of Offences – Dog and Parking Controls • By-Laws and Orders • Rates • Valuation of property – Valuer-General • Land use • Code of Conduct issues

Mediation and Evaluation Matters may also be dealt with through independent mediation or neutral evaluation. This will only happy if both parties agree. In all cases, the associated costs will be shared equally between Council and the applicant. The Chief Executive will discuss this option with applicants where relevant. Records of evidence of the provisions of Section 271(8) of the Local Government Act 1999, a mediator or evaluator, acting in good faith will incur no civil liability. Timeframes Grievances will be formally acknowledged within 5 days of receipt, including advice to applicants about the expected timeframe for dealing with the matter. In most cases applications for review will be considered 28 days, although in some circumstances it may take longer. However, in all cases, applicants will be kept informed about the progress of the review, and advised in writing of the outcome of the review procedure and process. If applications for review are not resolved satisfactorily, applicants will be advised of other options for review, such as the State Ombudsman, legal advice, and/or the courts. Ombudsman Nothing in this procedure prevents an applicant from making a complaint to the Ombudsman under the Ombudsman Act 1972 at any time during or after any of the steps of the process. 733.1.7 DELEGATIONS – AGED CARE ACT 1997 Purpose To complete the purpose of undertaking Council’s annual review of its delegations as required by Section 44(6) of the Local Government Act 1999. Background Members will recall at the meeting on the 26 June, 2006 the Aged Care Act 1997 delegations were to listed for Council consideration at a further meeting. Business: They have now been reviewed and listed for adoption, as part of the suite of delegations prepared by the Local Government Association and Norman Waterhouse. Recommendation 1 That item number 733.1.7 on Council agenda of 24 July, 2006 be received

and that Council resolves to revoke its previous delegations to the Chief Executive Officer of those powers and functions under the Aged Care Act 1997.

2 That Council In exercise of the power contained in Section 44 of the Local

APPENDIX 733.1.7

In exercise of the powers contained in Section 44 of the Local Government Act 1999 and in accordance with the resolution made by the Rural City of Murray Bridge (the “Council”) on the 23 July 2006 the following powers and functions under the Aged Care Act 1997 (“the Act”) are delegated by the Council to the person occupying the office of the Chief Executive Officer of the Council (“the Delegate”), subject to the conditions or limitations (if any) specified in this instrument. The Delegate is authorised to further delegate these powers and functions in accordance with Section 44 and Section 101 of the Local Government Act 1999 as the Delegate sees fit, unless otherwise indicated below, provided that any such sub-delegation shall be subject to the same conditions and limitations as are specified in this instrument. Part 2.1 Division 9 1 9-1 OBLIGATION TO NOTIFY CERTAIN CHANGES

The duty pursuant to Section 9-1(1) of the Act to notify the Secretary of any of the following changes within 28 days after the change occurs;

(i) A change of circumstances that materially affects the approved provider’s suitability to be a provider of aged care (see section 8-3)

(ii) A change to any of the approved provider’s key personnel (as defined in section 9-1 (2)).

2. 9-2 OBLIGATION TO GIVE INFORMATION RELEVANT TO AN APPROVED PROVIDER’S STATUS WHEN REQUESTED

3. 9-3 OBLIGATION TO GIVE INFORMATION RELEVENT TO PAYMENTS UNDER THIS ACT

The duty pursuant to Section 9-3(1) of the Act to give to the Secretary such information relating to payments made under this Act as is specified in the request provided the request is in writing.

The Delegate must comply with the request within 28 days after the request was made, or within such shorter period as is specified in the notice.

4 43-4 CLAIMS FOR RESIDENTIAL CARE SUBSIDY The duty, pursuant to section 43-4(1) to, for the purpose of obtaining payment of residential care subsidy in respect of a residential care service through which the Council provides residential care, to, as soon as practicable after the end of each payment period, give to the Secretary:

(i) a claim in the form approved by the Secretary for residential care subsidy that is payable in respect of the residential care service for that payment period; and

(ii) any information relating to the claim that is stated in the form to be required, or that the Secretary requests; and

(iii) copies of any documents relating to the claim, or to the payment of residential care subsidy, that are stated in the form to be required, or that the Secretary requests.

Division 54 5 QUALITY OF CARE

54-1 Responsibilities of approved providers

The duty pursuant to Section 54-1(1) in relation to the quality of the aged care that the council provides to:

(i) Provide such are and services as are specified in the Quality of Care Principles in respect of aged care of the type in question.

(ii) Maintain an adequate number of appropriately skilled staff to ensure that the care needs of care recipients are met;

(iii) Provide care and services of a quality that is consistent with any rights and responsibilities of care recipients that are specified in the User

Rights Principles for the purposes of paragraph 56-1(1); 56-2(i) or 56-3(j).

(iv) If the care is provided through a residential care service after the accreditation day to comply with the Accreditation Standards made under section 54-2.

v) If the care is provided through a residential care service after the accreditation day – to comply with the Residential Care Standards made under Section 54-3.

(vi) If the care is provided through a community care service – to comply with the Community Care Standards made under Section 54-4.

(vii) If the care is provided through a flexible care service – to comply with the Flexible Care standards (if any), made under Section 54-5, that apply to a flexible care service of that kind;

(viii) Such other responsibilities as are specified in the Quality of Care principles.

6. 56-4 Complaints Resolution Mechanisms The duty pursuant to Section 56-4(1) of the Act to:

(i) establish a complaints resolution mechanism for the aged care service, and

(ii) use the complaints resolution mechanism to address any complaints made by or on behalf of a person to whom care is provided through the service; and

(iii) advise the person of any other mechanisms that are available to address complaints, and provide such assistance as the person requires to those mechanisms; and

(iv) allow people authorised by the Secretary to investigate and assist in the resolution of complaints such access to the service as is specified in the User Rights Principles; and

(v) comply with any determination made, in respect of the approved provider, by a committee of the kind referred to in subsection 96-3(2).

The duty pursuant to Section 56-4(2) of the Act if the aged care service is a residential care service, to ensure that the complaints resolution mechanism must be the complaints resolution mechanism provided in the resident agreements entered into between the care recipients provided with care through the service and the Council.

7 BASIC RULES ABOUT ACCOMMODATION BONDS

The duty, pursuant to Section 57-2 of the Act to follow the rules relating to charging an accommodation bond for the entry of a person to a residential care service as a care recipient, as set out in Sections 57(2)(1) and 57-2(2).

8 57-19 AMOUNTS TO BE DEDUCTED FROM ACCOMMODATION BOND BALANCE

The power pursuant to section 57-19 of the Act to deduct from an accommodation bond paid by a care recipient to the Council:

(i) retention amounts in respect of the accommodation bond (see section 57-20); and

(ii) amounts owed to the approved provider by the care recipient under an accommodation bond agreement, a resident agreement or an extra service agreement; and

(iii) amounts, worked out in accordance with the User Rights Principles, representing interest on the amounts referred to in paragraph (b).

The duty pursuant to Section 57-19(2) of the Act to not deduct any other amounts from the accommodation bond balance.

9 57-21 REFUNDING OF ACCOMMODATION BOND BALANCE The duty pursuant to section 57-21 of the Act to refund the accommodation bond balance in respect of an accommodation bond paid by a care recipient for entry to the residential care service if:

(i) the care recipient dies; or

(ii) the care recipient ceases to be provided with residential care by the Council (other than because the care recipient is on leave); or

(iii) the residential care service ceases to be certified.

The duty pursuant to Section 57-21(2) of the Act to refund the accommodation bond balance to the care recipient in the way specified in the User Rights Principles.

The duty pursuant to Section 57-21(3) of the Act to refund the accommodation bond balance if the care recipient is to enter another residential care service:

(i) if the care recipient has notified the Delegate of the move more than 7 days before the day on which the Council ceased providing care to the care recipient—on the day on which the Council ceased providing that care; or

(ii) if the care recipient so notified the Delegate within 7 days before the day on which the Council ceased providing that care—within 7 days after the day on which the notice was given; or

(iii) if the care recipient did not notify the approved provider before the day on which the approved provider ceased providing that care—within 7 days after the day on which the approved provider ceased providing that care; or

(iv) in any other case—within 2 months after the day on which the event referred to in paragraph (1)(a), (b) or (c) (whichever is applicable) happened.

10 57-22 DELAYING REFUNDS TO SECURE RE-ENTRY The power pursuant to Section 57-22 of the Act, if a care recipient ceases to be provided with residential care by a residential care service (other than because the care recipient is on leave), the care recipient may agree with the Delegate to delay refunding the accommodation bond balance on condition that, if the care recipient requests re-entry to the service:

(i) the Delegate must allow entry to the care recipient, if:

(ii) there are any places vacant in the service; and

(iii) the care recipient has been approved under Part 2.3 as a recipient of residential care; and

(iv) an accommodation bond is not payable in respect of that re-entry.

11 57-23 CHARGING AN ACCOMMODATION BOND INSTEAD OF AN ACCOMMODATION CHARGE The power pursuant to section 57-23 of the Act to charge an accommodation bond, instead of an accommodation charge, when:

(i) a care recipient has entered into an accommodation bond agreement (the original agreement) for entry to a residential care service (the original service); and

(ii) the care recipient ceases being provided with residential care through the original service (other than because the care recipient is on leave); and

(iii) within 28 days after the cessation, the care recipient enters another residential care service (the later service) for which entry and accommodation charge would become payable (disregarding subparagraph 57A-2(1)(a)(iv) of the Act); and

(iv) the Delegate and the care recipient agreed, before the care recipient entered the later service, that an accommodation bond, instead of an accommodation charge, can be charged for the entry of the person to the later service.

Division 57A 12 57A-2 BASIC RULES ABOUT ACCOMMODATION CHARGES The duty pursuant to Section 57A-2 of the Act to follow the rules relating to charging

an accommodation charge for the entry of a person to a residential care service as a care recipient, as follows:

(i) at the time of entry, all of the following must be true:

(a) the person requires a high level of residential care;

(b) the person’s approval as a care recipient of residential care is not limited under Section 22-2 of the Act to a low level of residential care;

(c) the service, or the distinct part of the service through which the care recipient is to receive care, does not have extra service status;

(d) Section 57-23 of the Act does not allow the approved provider to charge an accommodation bond for the entry;

Note: A concessional resident cannot be required to pay an accommodation charge—see section 57A-6 of the Act.

(e) the person is not a charge exempt resident;

(f) the entry must not be for the purpose of the provision of respite care;

(g) the Delegate must, before the care recipient enters the service, provide the care recipient with such information about the accommodation charge as is specified in the User Rights Principles;

(h) the Delegate must have entered into an accommodation charge agreement (see section 57A-3) with the care recipient before, or within 21 days after, the care recipient entered the service;

Note: This time limit is extended in some cases if certain legal processes relating to the care recipient’s mental impairment are in progress—see subsection 57A-2(2) of the Act.

(i) another person must not be required to pay the accommodation charge as a condition of the care recipient entering the residential care service;

(j) the daily amount at which the accommodation charge accrues must not exceed the maximum provided for by Section 57A-6 of the Act and the care recipient must not be charged more than one accommodation charge in respect of entering the service;

(k) the accommodation charge must not accrue for any day in contravention of the requirements of Section 57A-7 of the Act (which deals with cessation of the provision of care) or 57A-8 of the Act (which deals with certification of the residential care service);

(l) the accommodation charge must not be charged if a determination is in force under Section 57A-9 that paying an accommodation charge would cause the care recipient financial hardship;

(m) the Delegate must comply with the requirements of Section 57A-11 relating to payment of the accommodation charge;

(n) the care recipient may be required in accordance with Section 57A-12 to pay interest to the approved provider if some or all of the accommodation charge is not paid within the time that section permits;

(o) the Delegate must use any payment of the accommodation charge it receives in the following ways:

A. to meet capital works costs relating to residential care;

B. to retire debt relating to residential care;

C. where no capital expenditure is reasonably necessary to comply with matters specified in the Certification Principles for the purposes of Section 38-3(3) of the Act and meeting accreditation requirements—to improve the quality and range of aged care services;

(p) the Delegate must not charge an accommodation charge if prohibited under Part 4.4 from doing so (see Section 66-1(j) of the Act);

(q) any other rules specified in the User Rights Principles.

(ii) If, at the end of the 21 days mentioned in paragraph (1)(e):

(a) the Delegate and the care recipient have not entered into an accommodation charge agreement; and

(b) a process under a law of the Commonwealth, a State or a Territory has begun for a person (other than an approved provider) to be appointed, by reason that the care recipient has a mental impairment, as the care recipient’s legal representative;

the time limit in that paragraph is extended until the end of 7 days after:

A. the appointment is made; or

B. a decision is made not to make the appointment; or

C. the process ends for some other reason;

or for such further period as the Secretary allows, having regard to any matters specified in the User Rights Principles

13 57A-12 APPROVED PROVIDER MAY CHARGE INTEREST The power pursuant to section 57A-12 of the Act to require the care recipient to pay the Delegate interest on the balance outstanding for the period beginning at the end of the one month and continuing while the balance remains unpaid, if:

(i) a care recipient is required, under an accommodation charge agreement, to pay an amount of accommodation charge to an approved provider; and

(ii) the care recipient does not pay the required amount before the end of one month after the day for which the charge accrues; and

(iii) the agreement provides for interest to be charged on the balance outstanding at a specified rate.

Division 58 14 58-1 RESPONSIBILITIES RELATING TO RESIDENT FEES

The duty pursuant to Section 58-1 of the Act where there are any fees paid in advance in respect of a period occurring after the care recipient dies or leaves, to refund those fees in accordance with the User Rights Principles.

15 62-1 RESPONSIBILITIES RELATING TO PROTECTION OF PERSONAL

INFORMATION The duty pursuant to Section 62-1 not to use personal information, relating to a person to whom the approved provider provides except:

(i) for a purpose connected with the provision of aged care to the person by the approved provider; or

(ii) for a purpose for which the personal information was given by or on behalf of the person to the approved provider;

except with the written consent of the person, the personal information must not be disclosed to any other person other than:

(iii) for a purpose connected with the provision of aged care to the person by the approved provider; or

733.1.8 COUNCIL MEETING - MONARTO Purpose To organise Council’s second ‘out of town’ meeting for 2006. Business Members will recall a previous resolution – 326.2 from the meeting of the 29 March 2005; That at least two meeting of Council of the Rural City of Murray Bridge be convened at locations within the minor townships – for example Mypolonga, Monarto, etc. Council has met at the following locations.

• 24 October, 2005 – Wellington Hall • 14 March, 2006 – Mypolonga Hall

Cr Weinert had verbally suggested that we hold our October 2006 meeting at Monarto. No objections are raised to this location. However upon looking at dates it is suggested that the next ‘out of town’ meeting be held on the 11 September, 2006. QED are providing an updated at the Council briefing on the 9th October and the last meeting of this Council term will be 23rd October and it is felt that this meeting should be held in the Council Chamber. Contact has been made with the Monarto Hall Committee and the Hall is available for our use on the 11 September, 2006. It is planned to leave the Local Government Centre at approximately 4 pm to have a tour of the area before commencing a briefing with the Monarto residents at 5.30 pm. REGIONAL AUSTRALIA 2006 – 28-30 August 2006 Purpose Cr Nutt has provided me with information on the Sustainable Economic Growth for Regional Australia 2006 Tenth National Conference to be held in Launceston, Tasmania on 28-30 August. Information is attached as appendix 733.1.9. Business; The conference is about how regions need to be increasingly adaptable, have open minds to new opportunities, and be able to respond and seize these opportunities with appropriately and timely actions that can be effectively implemented. Action Agendas for SEGRA 2006 include

SERVICES Discussion The Corporate & Community Services Department has continued to be busy through the fourth quarter of the year. Major activities for Q4 are as follows: Community Services Cultural & Community Development • The Fraser/Johnstone Avenue Park Upgrade is continuing after receiving a

Community Grant from Council • Over 500 people attended the Mayoral Welcome Reception for New Arrivals • Report being prepared for Council on the Migrant Housing project • Audit review of CCDAC Cultural Plan is underway with a status report expected

end August/early September Accessibility • Opening of Liberty Swing to be held on 25th July • Sensory Equipment has been installed in Library and staff training has been

provided • Quotes for Adaptive Rowing signage are currently being sought • An application has been submitted to the Heart Foundation Kellogg Local

Government Awards for last year’s International Day of People with a DisAbility – Physical Activity Showcase

• Council has approved additional disabled parking within the CBD • A representative from the Depot is to be appointed to the AAC • Council supported the Tri State Games with funding for the purchase of new

• Residents continue to have immobilisers installed. 50 more immobilizers have been ordered and therefore there is now no waiting list.

• Graffiti Removal Team has been kept busy around the town • Data Dot Program has taken longer than anticipated to become popular but

interest is now increasing. Data Dot Program and Immobiliser Program are regularly advertised during Council’s weekly 5MU radio spot

• Linda Martin continues to provide counseling and support through the Domestic Violence Intervention Program

• Successful Platesafe/Biggest Morning Team was held in partnership with the RAA and local Neighbourhood Watch groups. More than 300 residents took advantage of the offer.

• Community Safety Officer has attended several local Neighbourhood Watch meetings, represented Council at the Food Co-Op meetings and attended the monthly Murraylands Domestic and Family Violence Action Group

Youth & Indigenous • Council played a significant role in the organisation of Reconciliation Day. Over

100 people attended a barbecue and were entertained by leading indigenous and non-indigenous entertainers

• Planning for NAIDOC week in early July • Plans for the Skate Park are progressing well with a leading Skate Park design

and construction company (Convic) being engaged to review the design and prepare the documentation drawings. Tenders will be called for the construction of the facility

• Frustration continues regarding gaining access to the Railway Refreshment Rooms to undertake renovations for the Youth Centre

• The Beach Volleyball facility continues to get casual usage during the cooler months. The Youth Advisory Committee is planning events to promote the facility and the pool

733.3.2 BRIDGE TO OPPORTUNITY AFFORDABLE HOUSING PROJECT

Purpose To provide Council information regarding an opportunity which exists to create a collaborative partnership with the Inter Church Housing Unit and Lutheran Community Housing. An affordable housing innovations program which is a new initiative of the State Government to facilitate the delivery of innovative, affordable housing solutions for low to moderate income residents & migrants by working with the private sector, government agencies and community partners. Appendix 733.3.2a provides details from the Inter Church Housing Unit and their Affordable Housing Innovations Program. Background As Elected Members are acutely aware, Murray Bridge has seen a significant increase in new arrivals, whether it be through skilled migration, asylum seekers or refugees. To enable the long term sustainability of economic growth Murray Bridge must implement strategies to ensure that the township retains the residency of migrants and other community members. Migrants are more likely to move on if the local conditions do not fit their expectations. While high levels of immigration may quickly increase the potential wealth and skill base of the economic environment, people need reasons to settle permanently. The Affordable Housing Innovation Program (AHIP) is seeking to develop projects which will contribute to a diverse portfolio of responses across a number of target groups and locations – with a particular focus on areas with a demonstrated undersupply of lower priced rental housing like Murray Bridge. The Housing Plan for South Australia identified that provision of affordable rental housing and private purchase through private/non-government housing providers could be cost effective when evaluated against conventional fully grant funded supply arrangements through the State’s housing agencies. The objective of the (AHIP) is to identify potential partners that are able to CONTRIBUTE to the development of projects which:-

• Demonstrate cost effective, replicable models for development affordable rental and private purchase housing

• Are financially sustainable over a long term and ensure an ongoing supply of affordable housing

• Maximise housing outcomes from available Government resources (grants and assets)

Discussion Council has been approached by an agency known as Lutheran Community Housing which specialises in creating opportunities for affordable rental housing projects for

The full proposal of Lutheran Community Housing (LCH) is detailed in Appendix 733.3.2b and is summarised for the convenience of Elected Members as follows:- Lutheran Community Housing plan to seek capital funding through the Affordable Housing Innovations Program (AHIP) in partnership with Council to develop a portion of land (possibly contributed by Council) to build rental or purchase properties targeted at refugees (new arrivals), workers, families, young singles, retirees, elderly and disabled people. About Lutheran Community Housing

• LCH manages 540 houses in South Australia, of which they have either constructed (project managed) or played a key role in their design.

• Marshalled Lutheran Church owned land for over 170 dwellings, which represents 25% of all joint ventures entered into by the South Australian Community Housing Authority (SACHA).

• Taken over and amalgamated with and provided management support services for numerous SACHA funded housing association and cooperatives that were either insolvent or in extreme financial difficulties.

• Plays a significant role in developing CommunityStart loans, provided demonstration projects for CommunityStart, developed IT solutions for efficient management of houses, developed pilot programs with Centrelink & provides IT licences for community housing groups.

• Proposal

• LCH would build 2, 3 & 4 bedroom dwellings on a portion of land possibly contributed by Council

• Council consider transferring title of the contributed portion of land to LCH for some properties in exchange for developing the land. An opportunity exists for Council to retain some blocks developed by LHC and re-coupe costs by on selling (project could possibly be cost neutral).

• Once built the dwellings will be rented at affordable housing rents (75% of market rent)

• All dwellings will be available for purchase by tenants or other buyers, housing associations upon completion.

• Off the plan purchasers could have input into selections. • LCH would carry out tenant, property and financial management while it

retains ownership. • LCH reinforces its ‘social development with economic development’ policy

though local tenant support groups. These groups offer tenants information and support to settle into both the house and the community. They also provide social activities for tenants.

Land Council consider the contribution of a portion of McQuarrie Street Reserve refer Appendix 733.3.2c for exact location. McQuarrie Street Reserve is approximately 20 acres in size. It is not expected at this time that the entire amount of land will be required. It has been suggested to develop the land slowly, creating and developing a mix of blocks available also to the mainstream market, thus alleviating issues surrounding perceived intensive housing for a specific target group. LCH could purchase a portion of the land from Council and fully own the development subject to funding/grants and debt servicing viability. Additional Information

• Why this location? Only available suitable residential land owned by Council. • Is the location conveniently situated? Some argument exists that the location

is logistically inconvenient to some new arrivals who do not hold a current drivers licence, however we believe the location is easily accessible via bike, taxi or community bus. A much more suitable location than some areas previously discussed for settlement.

• The Planning Department has been consulted. Initial discussions were favourable.

• Several areas and locations of land have been investigated by the Asset Department i.e previous dump site (not suitable to build) & Dorset Reserve (now sold).

• Open space and appropriate neighbourhood facilities would be features of this project subject to Council consents.

• Nayano Taylor-Neumann of Murray Bridge Lutheran Community Care has advised me that she currently has names and contacts of 64 Afghan families who have indicated strong interest in this project, 50 of which are not currently living in Murray Bridge and all of whom said that they would re-locate to Murray Bridge if such housing was to become available.

• An opportunity exists for no-equity home loans to be made available to those who fit with the criteria, which is also an attractant to potential home buyers.

Policy implications 1. Financial/budget

Council’s contribution consists of both in-kind, largely via the allocation of a portion of the McQuarrie Street Reserve and the resource of the Team Leader – Community services.

2. Staffing/Work Plans

The Affordable Housing Project fits within the portfolio of the Community/Services Department of Council and is a key component of the cultural development role who will play a significant part in the implementation of this project.

3. Social

The Affordable Housing Project will have a positive impact socially for a broad range of the community in Murray Bridge and the surrounding areas. LCH has already developed support groups & networks which will provide tenants with information and assist them in settling into both the house and the community.

4. Strategic Plans

The Strategic Plan currently states that Council’s purpose is “to meet peoples’ needs in local communities by providing services and facilities that they value”. The plan also aims to “develop opportunities for people” under the heading of ‘Social Cohesion’. The affordable housing project is a critical component in delivering on the outcomes of these aspects of the Strategic

Plan. Importantly a project as this is closely linked to the Housing Plan for South Australia.

5. Community Consultation

A significant need exists for this type of project which has been demonstrated through commentary from leading Murray Bridge organisations, community members & groups, State and Federal Government statistics and the media all of whom have publicised their opinions and beliefs to both Council and to the public.

Summary Currently an opportunity exists with the Affordable Housing Innovations Program, Council and Lutheran Community Housing as partners to provide affordable housing for workers, families, young singles, retirees, elderly people, refugees, new arrivals and disabled people in Murray Bridge. The Affordable Housing Innovations Program is a new initiative of the State Government to facilitate the delivery of innovative, affordable housing solutions for low to moderate income residents by working with the private sector, government agencies and community partners. Through assessment it has been determined that such a housing project especially targeting new arrivals certainly meets with criteria of the AHIP and would attract a significant amount of attention while meeting the substantial need for additional rental/purchase properties in Murray Bridge. The lead organisation with proven project management skills will be Lutheran Community Housing, who can develop the land & housing and continue managing the rental properties through its support services and networks. Council’s only contribution is the land. This project may prove to be cost neutral if Council retain some developed housing blocks and on sell them to the mainstream market, thus alleviating issues surrounding perceived intensive housing for a specific target group. The project will be a development of a mix of rental and purchase homes. There is demonstrated widespread community support and need for affordable housing within Murray Bridge with far reaching outcomes for the community. The Affordable Housing Innovations Program is a project that provides a holistic, community driven response to the needs of residents & migrants of low to moderate income in the community. Council, should it agree to support the project will be integral to its success with its ability to engage the other partners and stakeholders. Where to from here? The project is in its embryonic stage and will need extensive research and investigation to progress further to the next step. Lutheran Community Housing will require commitment from Council to enable them to proceed with funding through the Affordable Housing Innovations Program. Recommendation: That Council:

733.3.3 COMMUNITY SAFETY OFFICER (228/3/18 Pt 6) Officer: Kym Miller

Purpose To advise Council that as yet confirmation has not been received from the Attorney General’s Department on the funding of Council’s Community Safety Officer. Background Historically the Attorney General’s Department has provided a $35,000 grant to fund a 0.6 FTE position. This grant plus the Council’s contribution has funded our community based Crime Prevention Programs. The Community Safety Officer’s contract expired on 30 June 2006. In prior years, we have had advice of our success in gaining funding prior to the end of the financial year but as yet this confirmation has not yet been received because of the general impasse with the State budget. When the writer met with Mr James Armytage, Manager of the Crime Prevention Unit within the Attorney General’s Department he indicated that he was expecting the current programs to continue. Council has budgeted accordingly for 2006/2007. Discussion Whilst we are hopeful that this grant will be renewed for 2006/2007 we are concerned that advice has not been received. We believe that the Crime Prevention Program is a key part of our community responsibility and are reluctant to make a decision on its future at this point in time. Budget implications The Corporate & Community Services budget has the capacity to carry the salary as the Records Management Officer position will not be considered until the end of Q1. Recommendation That item number 733.3.3 on Council agenda of 24 July 2006 be received and that the Community Safety Officer role and the associated programs be maintained until 31 December 2006 when they will be reviewed as part of the Q2 budget review. 733.3.4 SCHEDULE OF FEES & CHARGES Officer: B Gale

Purpose To seek approval of the Schedule of Fees and Charges for the 2006/2007 financial year, effective from the date of adoption . Background The Council may impose Fees and Charges for various information, activities, and services as described within Chapter 10, Part 2 of the Local Government Act 1999. A Council may provide specific, maximum, and annual fees and charges in accordance with the Act. These fees and charges maybe fixed, varied or revoked by a decision of Council. The Schedule of Fees and Charges seeks to provide an effective list of fees and charges for services regularly accessed by members of the public. Discussion Council officers have reviewed the Schedule of Fees and Charges and provided the Financial Controller with the proposed fees for 2006/2007. Worksheets are attached as Appendix 733.3.4 outlining the reasons for any change. As the CPI increase for the twelve months to 30 June 2006 has not yet been advised, a figure of 3% has been applied in most cases. Policy implications 1. Financial/budget

733.5 MANAGER, LERWIN

733.5.1 LERWIN AND COMMUNITY CARE UPDATE REPORT APRIL - JUNE 06

Purpose Quarterly update report for Lerwin Nursing Home and Community Care programs. For information. Background Under the current organizational structure, Council has an oversight responsibility for Lerwin. Although it has been common practice in the past to update Council on significant issues in relation to Lerwin as they occurred, a regular quarterly report is now presented to give Council a more complete and ongoing view of the Lerwin operation. Issues of interest in relation to the operation of the Community Care programs have also been included for Council’s information. Discussion LERWIN Issues of interest for the April to June quarter are as follows:

Operational • Full occupancy was achieved during February 2006 however there have in

the last period, there has been several patches with up to 5 vacancies. • The Aged Care Standards and Accreditation Agency carried out a follow up

support visit on 21st June 2006. The audit found Lerwin to now be compliant with 44 of 44 standards. It is expected that the Agency will carry out another support visit in September 2006.

• Lerwin staff have recently been involved in team building sessions and as part of the work in these sessions have developed new draft Mission, Vision and Values. These items will be finalized after consultation and a final draft will be circulated to members along with planned usage of the new document.

Statistics In the quarter April to June, Lerwin admitted 11 new permanent residents and 6 respite residents. Residents diagnoses were:

Occupancy 98.2% 97.6% 94.3% COMMUNITY CARE Issues of interest for the April to June quarter are as follows:

• A number of local care givers were able to take part in a retreat organised by our Community Care coordinators recently and which was funded by the Carers Association. These carers were able to take a 2 night break in Adelaide and share fellowship with others in like situation whilst enjoying recreational activities that are normally beyond them due to their caring role. The retreat was highly successful with a number of participants giving very positive feedback.

• A tender has been lodged for the continuation of the Veterans Home Care program. Notification about the success of tenders should be given in September with contracts to be signed in December to allow service delivery to continue without interruption after 31st December when current contracts expire.

• Home and Community Care, Funding and Service Agreements have been extended for a further 3 months (they were due for renewal on 1st July 06) due to changes in the contracting departments within State Government.

Statistics In the quarter April to June, the Home and Community Care program provided services to 215 clients (of whom 10 were of a CALD and 1 was of an ATSI background). The most significant of these services included 1229 transport trips (one way), 562 hours of domestic assistance, 101 hours of home maintenance and 42 hours of social support. MURRAY MALLEE AGEING TASKFORCE The local falls prevention initiative “Best Foot Forward” current being coordinated by Hills Mallee Southern Regional Health Service has now commenced work on initiatives outlined in its 5 year strategic plan for the Murraylands recently launched by Mayor Arbon. As funding for the planning project will end in September of this year, the MMAT Project Officer has been working with the Best Foot Forward Project Officer and steering committee to effectively pass over the project to the Taskforce. The Taskforce will endeavour to move forward with the implementation of the plan post September. The Taskforce will be looking for sources of grant funding for specific projects within the plan over time. 1. Financial Lerwin A full year income and expenditure report is not yet available. Murray Mallee Ageing Taskforce The Murray Mallee Ageing Taskforce project was re-funded in July 2005 for a period of eighteen months and any surplus will be carried over for use in the first half of next financial year as per the Funding and Service agreement for this project. Recommendation 3. That pursuant to Section 91 (7) & (9) of the Local Government Act, 1999, and on the grounds that Item No.737.1 listed on the Agenda for the meeting of Council of the Rural City of Murray Bridge held on 24 July 2006 was received, discussed and considered in confidence pursuant to Section 90 (3) (b) of the Local Government Act, 1999, this meeting of Council do order that the: (i) Resolution, report, appendices, discussion and any other associated

Cr Schubert moved That pursuant to Section 91 (7) & (9) of the Local Government Act, 1999, and on the grounds that Item No.737.1 listed on the Agenda for the meeting of Council of the Rural City of Murray Bridge held on 24 July 2006 was received, discussed and considered in confidence pursuant to Section 90 (3) (b) of the Local Government Act, 1999, this meeting of Council do order that the: (i) Resolution, report, appendices, discussion and any other associated

information submitted to this meeting and the minutes of this meeting in relation to the matter remain confidential and not be available to the public for the period of 6 months;

(ii) the exception to (i) of this resolution being those required to have knowledge

of the resolution in order to execute said resolution;

(iii) the confidentiality of the matter be reviewed annually in accordance with Section 91 Clause (9) (a) of the Local Government Act 1999 ; and

(iv) Chief Executive Officer be delegated the authority to review and revoke all or

part of the order herein and directed to present a report containing the Item for which the confidentiality order has been revoked.
