GRAND 'RAPIDS—A suit seeking court determinat ion and ruling on validity of an option clause in a lease concerning S p a r t a business prop-er ty was taken under advisement Tuesday by Judge Dale Souter In Cir-cui t Court, who set July 7 as t h e date for filing f inal briefs ay at torneys.

T h e suit was brought toy Joseph rf. Gass and Erastus W Smi th , pro-pr ie tors or the Spar ta Variety Store, agaiiist Mrs. Margaret Garl inger , •who* operates the Twin Sister Dress S h o p in Spa r t a , and who Is the p resen t owner of property occupied by tt»e Variety Store.

S m i t h and Gass In 1941 leased the properly f rom Mrs. Ber tha M. Bloomer and the Fred F. Shaw estate for seven years, f rom Sept. 15, 1941 to Sep t . 15. 1948. the p la in t i f f s said In court. Smi th explained t h a t h e added, wieh approval of tooth par t ies to the lease, a clause giving h im a n d his partner an option to buy should t.ie property be for sale, a n d also a clause for extension of the lease. %

H e said the clause read In p a r t : "A first option af te r expiration of the lease for a fu r ther extension of five years. I t Is agreed that the par t ies of the first p a r t < owners > have the privilege of selling property covered by tne lease a t any t ime while same is in effect af ter f irst giv-ing part ies of ffbe second par t such privilege to exercise their purchase option "

They said Mrs. Gai l lnger refused to accept the notice.

I n her crossbill of complaint Mrs. Garl inger said <she had purchased the Variety Store property in 19*7 and planned u> move her Twin Sister Dress S h o p into I t f rom property now leased on a mon th - to -mon th IDAS Is. She said she sought a "more secure occupancy."

Attorneys for Smith and Gass are Philip Hogan of Spar ta and J o i n W. Cunumisky of G r a n d Rapid* and Mrs. Garl inger Is represented by J o h n Smolensky of G r a n d tRaplds. Judge So liter is expected to hand down his roiling In tha case sometime late in July.
