Dear Dr. Lewin,
Our organization strongly urges you to not issue the permit to Puu Lani Ranch to operate the drywells until it is clear that all mitigating measures dealing with previous violations (Department of Health, DLNR, and County of Hawai'i) by Puu Lani Ranch and it's owner, Newell Bohnett, have been finalized. All required remedial actions need to be confirmed to be complete in an acceptable manner, and all requirements and conditions for 'past applications met .. Please do not issue any more permits until Mr. Bohnett has a "clean slate".
This "cleaning of the slate" will include:
1. Completion of the current Department of Health investigation, determination of fines, and receipt' of fines levied for (A) the construction of drywells with out permit (the wells that he is currently applying for permit to operate), (B) construction of drywells on the Old Government road with out a permit in violation of right of entry issued by the DLNR, (C) misrepresentation on original application that Puu Lani Ranch owned all the land that the wells were to be constructed on, and (D) misrepresenting in the published notice of application that dry wells were not yet constructed when fact, the construction was complete.
2. Verified completion of required mitigating measures concerning Department of Health order to submit dump closure plans, as well as clean up and close the illegal dump sites.
3. Verification of removal of the recreational facility ("party house n
) as required by the DLNR.
• • 4. Verification that proper insurance is in place for
the State owned lease lands.
5. Completion of an investigation and mitigating measures of the destruction of the reservoir on State owned lands.
6. Verified completion of mitigating measures as a result of the county citation for operating an unauthorized landfill.
7. Verified completion,of mitigating measures or fines resulting from the violations of the county's building, grading, and zoning codes for the construction of an airstrip, hangers, houses, and sheds -- all constructed without permits.
8. Verification of payment of back county taxes on the improvements built without permits.
9. And any other measures that deal with Mr. Bohnett's apparent reluctance to adhere to state and county regulations.
It is time that the DeparL~ent of Health join other agencies of the State of Hawai'iin sending a clear message to all developers that the rules, regulations, and requirements are to be followed, and violations are a serious matter (especially with repeat offenders) that will be dealt with strongly and with meaningful consequences. The present policy of toothless enforcement and punishment does not s~rve the best interests of the citizens of the State of Hawai'i.

DRILLING AND TESTING
This report is compiled using known infonnation from the owner and State of Hawaii records. Some records are
incomplete or contain different measurements. This report has tried to review the data and provide a summary.
The Puu Anahulu Well was constructed near the Puu Huluhulu area (see Figure 1) as shown on the well location
map, above Puu Anahulu in the Puu Anahulu Homesteads. The well was designed as a geothennal well. Based
on the data collected it was detennined that geothennal use could not be achieved. It was detennined that potable
quality water was available at this site. This well is intended to pump at a rate of up to 89,280 gallons per day
(gpd) for purposes of potable water use.
A well Pump Installation Pennit for a new pump with a pumping capacity of 62 gpm was issued effective
November 21, 1991. The well is cased with a 9.625" ID diameter casing. The As-Built dimensions of the well are
shown in Figure 2.
A pumping test was J:/on 4 Mar 93. The results of this test is contained in Figure 3. Both the yield and quality
are satisfactory. The well can readily be pumped at a continuous rate of 62 gpm for extended periods as
designed.
Pump data is provided in Appendix 1. REDA Pump Company provided the new pump. The attached data is
from their records.
Water quality analysis are listed in Appendix 1. This well has been supplying a water system for potable use and
under the review of the State Dept. of Health since April 1987.
The contracted drillers Well Completion Report is attached as Figure 4. This report was sent to the State as
required.

I would like to discuss three items concerning the Total Coliform Rule.
First, if your review of your sample siting plan requires any changes or adjustments, please present your proposed changes to my office for discussion and approval. Be sure the current plan accurately reflects what is beinq executed in the field.
Second, please send me your 1993 sample rotation schedule for all of your water systems by January 15, 1993. Be sure your sampling program accurately reflects the 1993 sample rotation schedule. Several of the West Hawaii water systems did not implement the 1992 sample rotation schedules.
Third, please keep the Safe Drink.in9"·~ater Branch informed about your corrective actions on the recommendations and deficiencies noted on the water system surveys and follo~P:ViSit inspection reports.

1. . The Division of Water Resource Management (DWRM), P.O. Box 373, Honolulu, HI 96809. shall be notified. in writing, before any work covered by this pennit commences.
2. The proposed pump installation shall not adversely affect existing or future legal uses of water in the area. including any surface water or established instream flow standards. This pennit or the authorization to pump water from a well shall not constitute a detennination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.
3. The permit shall be for installation of a H-5 gpm capacity pump in the well. , 62
4. The applicant shall provide and ,maintain an approved meter for measuring and reporting total water usage on a monthly basis.

RESERVOIR CAPACITY
The reservoir water capacity is sized to meet two criteria; . A. Deliver maximum day consumption. The reservoir should be considered
full at the beginning of the 24 hour period with no source input to the reservoir.
B. Deliver maximum day rate plus fire - flow for a duration of 0.5 hour. The reservoir should be 3/4 full at the start, with credit for incoming flow from pumps, one maximum size pump out of service. :
The domestic consumption is 58,800 GPD or 40.83 GPM.
Criteria "A" is satisfied: Maximwn dally demand: 1.5 x 58,800 = 88,200 gallons
88,200 < 100,000 ,
Criteria "B" is satisfied: Maximum daily demand plus fire flow: (40.83 gpm x 1.5 + 500 iPm) x 60 min/hr x 0.5 hr is approximately 16,900 .
16,900 < (100,000 x 3/4) Note: credit for incoming flow was neglected.
Based on the above analysis, the existing 0.1 MG reservoir is adequate to serve both the existing and proposed developments.
PUMP/WBU CAPACITY
The number of pumps/wells must meet the average daily demand with the operating time of 16 hours or meet maximum daily demand with an operating time of 24 hours with the larger pump unit on standby and not contributing to the flow requirements. Pump capacity is outline below:

The existing pump capacity is 40 to SO GPM at the Puu Waawaa well and 3S GPM at the Puu Anahulu well. To satisfy DWS standards, both pumps must be replaced with a minimum 62 GPM pump.
Water Resources International estimated the potential yield at the well sites to be 144,000 GPD (100 GPM) for the Puu Waawaa well and·28B,OOO GPD (200 GPD) for the Puu Anahulu well (see Appendix 5); therefore, both of the existing wells may be equipped to yield adequate capacity for the proposed project requirements.

The Puukapu Deep Well will directly benefit the Waimea Irrigation System serving Hawaiian home lands, by providing backup supply in periods of low stream flow, and we favor its approval.
The Silversword wells are downslope from Hawaiian home lands at Waiohuli and Keokea (Kula), and will draw from the same groundwater source. The distance between these wells and those that DHHL would drill to explore for domestic water is great enough to suggest that any potential relationship between them would be tenuous. Of course, the characteristics of this aquifer are not well known, and the impacts of these wells is therefore also unknown. This is one area we will eventually need to monitor carefully.

The Lualualei-PVT well may have adverse effects on groundwater needed for Hawaiian home lands. The Department anticipates the sUbstantial development in Nanakuli, and will need to produce additional domestic supply. A reserve of 0.5 Mgd will be required to serve this development.
The other proposed wells are not expected to impact Hawaiian home lands, and we have no comment at this time.

Thank you for the opportunity to review and comment on the subject document. We have examined the application and have the following comments to offer:
1. In accordance with Hawaii Administrative Rules, Title 11, Chapter 20, Rules Relating to Potable Water Systems, section 29, the Department of Health granted conditional approval for both the Puu Waawaa and Puu Anahulu Wells, as sources of potable water (February 21, 1984 letter to Newell Bohnett, Puu Waawaa Ranch). Thus, we have no objections to these pump installation applications. Please note that both our public water system files and the August 1991 pump installation permit application show a different well name (Puu Anahulu instead of Puu Lani) for state well no. 4850-01.
2. Since these wells are also used for livestock watering, adequate measures must be taken to eliminate cross-connections and backflow conditions. The potable and agricultural water systems should be clearly labeled and physically separated by an air gap or an approved backflow preventer to avoid contaminating the potable water supply.

In accordance with the Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", your application to install a 115 gallons per minute pump in Puu Anahulu Well (Well No. 4850-01), at Tax Map Key: 7-1-06:19, for private/municipal use, is approved subject to the following conditions:
1. The Division of Water Resource Management (DWRM), P.O. Box 373, Honolulu, HI 96809, shall be notified, in writing, before any work covered by this permit commences.
2. The proposed pump installation shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.
3. The permit shall be for installation of a 115 gpm capacity pump in the well.
4. The applicant shall provide and maintain an approved meter for measuring and reporting total water usage on a monthly basis.
5. The following shall be submitted to DWRM within 30 days after 'completion of the work:

6. The applicant shall comply with all applicable laws, rules, and ordinances.
7. The permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work proposed in the permit application shall be completed witl1ir@ months from the date of permit issuance.

Thus, we have no objections to these pump installation applications.

The above well drilled in 1978-1979 by Water Resources International, Inc., for the STEAMCO partnership, did not provide evidence of a geothermal heat source, after drilling to a depth of 6800 feet.
The owner, therefore, elected to try to convert this well to possible water well use by plugging the well at 2500 feet depth by means of a packer, and perforating the 9-5/8" casing and grouted annulus with 200 holes, P diameter, from 2298 feet to 2398 feet depth as shown on the attached cement bond log.
The well was then bailed, and evidenced fresh water standing at +18 feet elevation.
The owner, Mr. F. Newell Bohnett, plans to purchase a submersible turbine pump capable of approximately 45 GPM, probably in 1981, and to install this and run a pumping test. If the test is satisfactory the well would then be utilized at approximately 45 GPM, and feed into the present ranch water system.
The only logs taken were the cement bond logs, one copy of which is enclosed.
