The Disaster Recovery Center at the Westchester County Center in White Plains will close Dec. 21, County Executive Robert Astorino said at a press conference Dec. 5 at the center.

Astorino urged residents whose proper-ties sustained damage from Hurricane Sandy to file an application with FEMA before the Dec. 31 deadline. Sandy caused $42 million in damage to county-owned land, including $12 million at Rye Playland.

“The Ice Casino was trashed,” Astorino said. “The north boardwalk was obliterated. But the park will be open in May, no matter what.”

The rest of the county parks totaled $12.5 million in damage. Thirty municipali-ties have reported a combined $15 million in damage, though the number is expected to rise. Astorino said that 300,000 people lost power, criticizing Con Edison.

“Too many people were left in the dark for too long,” Astorino said. “Con Ed needs to do a better job. Their liaisons need better training skills to get the job done.”

Compared with other parts of the New York metropolitan area, Astorino said that Westchester County was fairly lucky.

“We came through Hurricane Sandy together,” Astorino said.

With the storm over, Astorino has teamed

with other area elected officials to lobby Washington to ensure that the county gets adequate federal funding. At a minimum, the county is entitled to be reimbursed for 75 per-cent of the cost, with the remaining 25 percent to be split between the county and the state.

Small businesses are also starting to recover from the storm damage. Richard Daigle, public affairs specialist for the Small Business Administration, announced the approval of seven loans for homeowners, totaling $198,500, with 730 applications out-standing. According to Daigle, no small busi-nesses have been approved yet.

loans and until July 31 to apply for economic injury loans.

“Our message to the people of Westchester is to get those applications in,” Daigle said. “Don’t wait on insurance settle-ments. The sooner you apply, the sooner you can be approved.”

Businesses can borrow up to $2 million with interest rates as low as 4 percent. Daigle and Astorino said that while Westchester fared better than its neighbors, businesses still suffered.

“If you miss a week or lose your custom-ers, it’s very difficult,” Astorino said. “A lot of these businesses are barely hanging on and this could be the death knell.”

Rarely does a catastrophic weather event have a positive impact, but a month after Hurricane Sandy hit, the

car industry managed to close November on a high note.

Auto sales had their strongest month since the first quarter of 2008, according to Autodata. Domestic automakers had a slight increase in sales. Ford recorded a 6.5 percent increase and General Motors rose 3.4 percent over November 2011. Chrysler sales jumped 14 percent in November. It was still overshadowed by Toyota, which saw a 17.2 percent increase.

“We have seen it climb to a five year high which is pretty good,” said Mark Schienberg, president of the Greater New York Automobile Dealers Association. “In 2008, 17 million cars were sold across the country. During the recession, that went down to 9.5 million. We’re going to reach 15.5 million this year at this pace.”

That number is being helped in part by

Hurricane Sandy. Schienberg revealed the storm was responsible for the destruction of 200,000 to 250,000 vehicles. It also helped deplete vehicle inventory in this region.

For many, replacing their cars has become a high priority. Car manufacturers have responded to the demand by adding Sandy-related incentives to their seasonal marketing package.

The holiday season is the time of year people are typically wooed by area deal-erships through their promotion of year-end sales events. One seasonal commercial theme, the Happy Honda Days program, launched Nov. 19 and will run through Jan. 2. So far, it’s helped car sales increase. White Plains Honda saw a 15 percent increase in showroom traffic over the previous month, according to Finian D’Cunha, general sales manager for the store.

“There’s always a steal in the car business. It doesn’t matter the car or the month. We do whatever it takes to make a deal,” said D’Cunha, who has been in the car business since 1989. He said dealerships appeal to the need of the

potential customer, which is why he believes the Sandy-related incentives are not just about helping people, but they’re good for business.

D’Cunha also noted the store’s Sandy vehicle replacement program has translated into 10 cars sold so far. “Most of the Hondas are not highly marked up, so if we have to save the customer an extra $500 to $800 then that’s what we do,” he said.

Like Honda, Toyota has also trimmed the cost of its vehicles to help put them with-in reach of those devastated by the storm. In addition to its year-end sales event, DCH Toyota City in Mamaroneck sold 10 cars connected to their post-hurricane program. Many of the people who took advantage of the program came from Long Island where inventory has been scarce.

Through the program, the dealership is offering customers no payments until 2013, no down payment, and zero percent financ-ing. “We’ve had some great deals,” said Tom Muradian, new car sales manager. He also noted the dealership has seen a 10 percent boost overall which translated into 10 addi-

tional cars sold in the month of November. Muradian claims the sales increase is

partially due to Hurricane Sandy, but the economy also played a strong role. “There’s been a pent-up demand for new cars,” he said. “Because of the recession, people were keeping their cars longer – six, seven, eight years. Now they can buy.”

Muradian said, however, the looming fiscal cliff could also have a dramatic impact of those looking to buy a new car, so things could change.

Schienberg agrees the economy has played a significant role in customer spend-ing habits. He said economists believe spend-ing is tied to the perception of property val-ues. It essentially “piques a consumer’s inter-est” when they feel that their home values have not gone down. Schienberg added that this year has been unusually strong for the car industry. Even before the storm or any announcement of year-end sales events, the greater New York area saw car sales exceed 37 percent in October compared with October 2011. The rest of the country only increased 18 percent in car sales that same month.

The federal government wants busi-nesses to think globally, not just in terms of products, but in terms of

customers. The reason for this initiative is that the

market for exporting goods and services is expanding. Congress last year passed free trade agreements (FTA) with Korea, Panama and Colombia. The agreements make it eas-ier for exporters and international service provides to do business within those coun-tries.

“We’re hoping that U.S. businesses will take advantage of those opportunities, and in turn that would create jobs,” Bennett Harman, deputy assistant U.S. trade rep-resentative for Latin America, told area business leaders at an event sponsored by the Westchester County Association at Westchester Community College’s Gateway Center.

“If we don’t have our companies speak-ing in global terms, they are not only missing out, but they’re not realizing the U.S. is part of a global society. If they want to compete

they have to do so not just here but else-where,” Harman said.

Those who have already started thinking globally have benefitted from the substan-tial pool of money tied to the international market. According to the International Trade Administration (ITA), New York’s metropol-itan area exported shipments of merchandise in 2011 totaling $84.9 billion. The state’s big-gest international client is Canada. The ITA revealed merchandise exports of more than $16 billion to Canada last year. Hong Kong was the second-biggest importer of New York goods and services with sales totaling $8.1 billion.

The ITA also revealed 28,930 companies within New York state export goods around the world. Within the county, Bedemco Worldwide Inc. in White Plains has embraced the exporting industry. The company started as an importer of dried fruits, seeds and nuts. The business now exports its product under the North American Free Trade Agreement (NAFTA) to Canada and Mexico. It also exports to Colombia and Israel and hopes to expand under the new agreements.

in Poughkeepsie, said her company manu-factures equipment for wastewater treatment plants and foreign markets are ideal for the company.

“In developing countries, the regula-tions are becoming stricter in terms of water use, reuse and pollution,” she said. “That’s a large market for us.” Chiaverini explained that Stamford Scientific exports to more than 75 countries including South America, Mexico and Argentina, “so obviously the free trade agreements that are now in place with Panama and Colombia are very important for us to tap in to.”

Chiaverini said her company com-petes with European brands for the South American market; but they are comfortable with the competition because they believe these new agreements will provide the right opportunity to expand.

In order to help other companies tap into the international marketplace, the Westchester U.S. Export Assistance Center remains committed to helping small to medium-size businesses do just that, said Michael Grossman, senior international trade specialist.

Grossman said most companies already

have an international presence if they have a website, and some even get inquiries from customers worldwide. But many companies “don’t know how to come up with an export strategy,” he said. “That’s where we come in.”

The organization plays “matchmaker” between local companies and international agents and distributors and help them unlock their potential, Grossman said. “Because if a company is successful here then there’s no reason they couldn’t have success on a global scale.”

If Elm Street Sports Group’s CEO Donald Scherer has his way, his lawsuit against Game On 365’s project in Greenburgh

will force the project to be delayed for more than five years.

Scherer, who filed a lawsuit Oct. 1 on behalf of Elm Street Sports Group L.L.C., which runs Ardsley’s House of Sports, says that Game On 365 L.L.C.’s lease of the former Frank’s Nursery property is illegal and a vio-lation of Westchester County law.

County law states that a town must sell any property acquired via tax lien, though Greenburgh Town Supervisor Paul Feiner has said that state law, which allows the town to lease the property, supersedes county law.

Game On 365 plans to build the Westchester Fieldhouse at Dobbs Ferry Road, replacing Frank’s Nursery, which foreclosed and the town took over the property.

Though Game On 365’s proposals have generated opposition in the town, a referen-dum to allow the town to lease the property to Game On 365 passed 66 percent to 34 percent, 7,734 votes to 3,863.

Supporters have said that it would cre-ate revenue, help lower taxes and allow for much-needed field space. Opponents have

questioned the speed in which the town is entering into the deal and how much traffic it would create.

While the lawsuit is in the early stages with only motions being filed, Scherer said it will be a seven-year process, and that as long as the project is being litigated, the Westchester Fieldhouse will not go forward.

“Seven years is a long time to keep the property open especially in a lawsuit that they will lose,” Scherer said. “It’s time for the town of Greenburgh to go in a different direction.”

Feiner has disputed Scherer’s claims and said that the Westchester Fieldhouse will not begin construction for a while due to neces-sary land use reviews, traffic studies and site plan approvals that must be granted.

“He keeps tying this up in frivolous legal minutia,” Feiner said. “He’s trying to postpone competition. I think it’s unfair; it’s capitalism at its worst. The voters decided they wanted a sports facility.”

If House of Sports offers a good product, then they shouldn’t be afraid of competition, Feiner believes. The supervisor also said he doesn’t foresee the lawsuit dragging as long as Scherer claims.

“I could see delays because of the lawsuit but we are taking steps to expedite the pro-cess,” Feiner said.

Scherer’s comments follow the discovery

of massive amounts of carcinogens at the Frank’s Nursery site, further delaying the project. Woodward & Curran, an environ-mental agency the town hired to look into the property, plan to meet with the New York Department of Environmental Conservation (DEC) in February, after they collect more samples.

Once they meet with DEC, it could take the department four months to decide on how to proceed with the site.

Under the terms of the lease between Game On 365 and the town, Game On 365 will pay up to $125,000 for cleanup. Money spent on cleanup will be reduced from Game On 365’s lease. If cleanup costs exceed $400,000, Game On 365 can back out of the lease.

Feiner said he feels the cleanup is man-ageable and doesn’t think this jeopardizes the property.

“The results were expected,” Feiner said. “We expect Woodward & Curran to do an honest assessment.”

Feiner said he plans on seeing if the town can receive state funding for the cleanup.

“It would be nice if they could start building tomorrow, but we’re doing what we have to do,” Feiner said. “Frank’s Nursery walked away because of contamination at the site. It was never a secret.”

said he also wasn’t surprised by the news, and that he knew the property had a history of contaminants.

“We understand our options,” Hewitt said. “We want Game On to build at that site. We’ve had a resounding level of support. We’ve worked very hard.”

Scherer said he thinks it is improper for kids to be playing on fields that were full of carcinogens.

“It’s probably not a good idea,” Scherer said. “It’s why established operators did not look at this land. Everyone has known that this was used for a landfill when White Plains had fac-tories. It’s the Three Mile Island of Westchester.”

Scherer has also filed a tax certiorari against the town, hoping to get his property taxes reduced.

The Dodd-Frank Wall Street Reform and Consumer Protection Act was signed into law by President Obama

on July 21, 2010. In the ensuing two and a half years, the leg-

islation has produced 129 rules that have been finalized. They cover more than a dozen different areas, are implemented by seven major regula-tory organizations, including the new Consumer Financial Protection Bureau (CFPB), affect the operations in another half dozen agencies and assign powerful oversight to a new Financial Stability Oversight Council (FSOC).

The major responsibility of the council, along with the Federal Reserve Bank, is to oversee the strategies and operations of “sys-temically important” banks and nonbanks. The impact on financial institutions, large and small, and in every sector of the economy has been an onslaught of thousands of pages of complex and detailed regulatory language and “allowing” affected organizations up to 60 days to comment on the proposed regulation.

Financially strong organizations have been forced to expand internal staffs, create new recruitment and training programs and take on new compliance and regulatory costs in the millions of dollars. Less affluent orga-nizations, especially community banks and

small foreign bank operations in the U.S., have faced tough decisions on how to cope with the regulations and harder yet to find the funds to support these new non-income-producing requirements.

As we approach the third year with Dodd-Frank we are aware that an additional 137 rules, many of the legislative core reforms are yet to be completed. The level of uncertainty, currently high, can only increase as these new rules come into being, one by one, or in bunches. Combined with the lack of certainty as to the final requirements for stress tests and the level of assets needed to back loans and investment it is little wonder that the reluctance to make loans remains significant.

Of perhaps greater importance is the indeci-sion on resolving major issues such as the Volcker Rule, the “living will” and defining standards, definitions and rules governing derivatives.

Paired in the Congressional decision-making process with the debates on how to “avoid going over the cliff,” it is likely that the level of uncertainty will increase.

The remaining 137 rules will have to deal with legislative goals relating to “reforms” in key areas such as: financial stability, resolution plan-ning, agency oversight, securitization, deriva-tives, investor protection, credit rating agencies, executive compensation, corporate governance, disclosure, capital requirements, regulation of

foreign banks, consumer protection, mortgage origination and servicing and more.

Obtaining Congressional agreements on any of these remaining areas will be even more difficult. Even with the 129 rules that have been finalized, House committees have called agency chiefs to task over the effective-ness of their cost-benefit analyses. These are more than stalling tactics as the courts have also complained about the inadequacies in this area so critical to businesses.

One area of recent discussion that trou-bles me is the broadening of the oversight of systemic risk. Banks have made efforts to meet securitization goals, provided scenarios on major and potentially disastrous risks, and have paid huge fines for violations of what are ill-defined regulations. Top bank officials have regular meetings with regulatory officials at all levels. They have found the expansion of systemic risks to include both counter-party risk and the stability of business customers to be an unrealistic overreach. I agree.

No one believes more in the need for effec-tive and efficient regulation than I. However, I wonder if the lack of understanding of what business management entails, or possibly a deeper distrust than their off-the-cuff deroga-tory remarks convey, may be leading our regu-lators to install a regulatory system so complex and costly that the important function of

financial institutions – to raise and provide capital for the other two economic sectors (manufacturing and public) – is encumbered. The nation’s economy would suffer from an overburdening regulatory system inhibiting both investment and new jobs creation.

Do you think this is only about banks? Think again. If you have a charge account with a customer or run a tab at your café or bar, the CFPB will be in your life, and, soon.

There is no question that the subjects of compliance, internal controls and regula-tory strategy are among the most important issues that any business, bank or nonbank, is facing and will continue to face as we finish the rollout of Dodd-Frank.

Whether a financial institution facing the regulatory tsunami today or another organi-zation line of business or sector – including public sector finance – each board and execu-tive management needs to take a new look at their own strategic planning, risk manage-ment and compliance organizations.

The car dealership had an underground parking garage to store its fleet and it will be used for parking at the site. Corey Rabin, man-aging partner of Chauncey Station Partners, said he hopes to file with the city in the next six months and the project would be completed by mid to late 2014.

The property “is begging for redevelop-ment,” Rabin said. “It’s a very good place for people to park onsite without burdening the neighborhood.”

The hotel or senior living complex would have from 90 to 140 beds. Rabin said the senior living complex would be a place for

people who don’t need nursing care, but said it would not be an assisted living facility.

While Rabin and Martin Berger, manag-ing partner of Saber, would not disclose any potential retail outlets, an artist’s rendering of the project shows a Niketown store. The duo would also not disclose who would run the hotel or senior living complex, but Rabin said they have a letter of intent with a third party.

“It should be a nice deal that enhances the area quite a bit,” Rabin said. “That strip of land is really a gateway to White Plains from I-287. There are a lot of beautiful things that have come into that area over the last few years. We hope this will be the centerpiece of redevelopment.”

Protein Sciences Corp., a vaccine and bio-pharmaceutical company, announced that it will be establishing manufactur-

ing and developing operations in Pearl River.The company’s multimillion dollar

investment, announced by Gov. Andrew Cuomo, will create 50 full-time jobs that could grow to 150 over the next 10 years.

“We are thrilled to be expanding our operations into New York and laying roots in Rockland County,” said Protein Sciences CEO Manon Cox in a statement. The com-pany is based in Meriden, Conn. “The state

and local government have provided invalu-able assistance, without which this transac-tion would not have been viable.”

Protein Sciences will make a multimil-lion dollar investment in their operations at the Pearl River site to establish a production line for Flublok, its seasonal flu vaccine can-didate, including machinery and equipment, engineering and process validation. The com-pany will initially lease two buildings covering 83,000 square feet on the Pearl River campus.

The company has developed a cell-based platform technology for producing high-qual-ity vaccines and biologics with speed and pre-cision. Flublok will be Protein Sciences’ first product manufactured at the Pearl River facility.

Flublok is under final review by the U.S. Food and Drug Administration; approval is expected in mid-2013.

The 550-acre Pearl River campus is a site for vaccine research, as well as key aspects of biologics research. It is owned and operated by Pfizer, the state’s largest biopharmaceuti-cal company, which has global headquarters in New York City.

The buildings being leased by Protein Sciences had previously been part of Pfizer’s Pearl River manufacturing operations, which the company began exiting in 2010.

The deal was put together by Empire State Development (ESD), the state’s eco-nomic development agency. The agency will

provide Protein Sciences with $2 million in tax credits through the Excelsior Jobs Program that is designed to incentivize the company to create 100 jobs by 2018 and sus-tain employment levels through 2023.

“We are making smart investments to attract new businesses like Protein Sciences that strengthen key industries, create new jobs and grow our economy,” said Empire State Development President, CEO and Commissioner Kenneth Adams in a statement. “The Hudson Valley is home to some of the fastest-growing biopharmaceutical industry clusters in the nation. We are proud to welcome Protein Sciences to the Empire State and look forward to a long and successful partnership.”

stands to recover about 21 percent of the $114 million in Madoff payments to the defendants that he sought. The Bankruptcy Court settlement was approved five days after another federal judge gave her prelimi-nary approval of a $219 million payment to duped investors to settle claims against the same feeder-fund defendants. Those law-suits were brought by upstate union pen-sion and health funds on behalf of plaintiffs in a class action.

For another downtown White Plains law firm, Lowey Dannenberg Cohen & Hart P.C., the U.S. District Court settlement, expected to be paid out in 2013, marks a tentative victory and eventual payday after four years of litigation on behalf of their

union clients. (See this week’s “Players” col-umn on page 27.) The plumbers and steam-fitters union locals were represented in court and in complex multiparty negotiations by Barbara Hart, chief operating officer of the Lowey Dannenberg firm at 1 N. Broadway, and firm partner Thomas Skelton.

In the related federal cases, plain-tiffs’ attorneys said the White Plains and Syracuse defendants were steered to invest with Madoff by owners and managers of Ivy Asset Management, a Jericho, Long Island company that kept its business ties with Madoff after its acquisition in 2000 by Bank of New York – now Bank of New York Mellon Corp. By then, Ivy Asset had more than $2.4 billion under management; Bank of New York paid $200 million for the company.

The Beacon/Andover funds and the Syracuse investment adviser, J.P. Jeanneret Associates Inc., were among Ivy’s main clients, according to court documents.

Picard in his complaint claimed Danziger, Markhoff, their Andover management com-pany and some of their family members and trusts paid 50 percent of all fees they earned to Ivy Asset as compensation for consulting and administrative services and for connecting them to Madoff Investment Securities, though the fee percentage was slightly lowered in 2006.

Picard in his complaint said the White Plains attorneys and the other defendants “received enormous fees from the Madoff investments and their businesses grew wild-ly successful.”

Years before his Ponzi scheme was exposed, Picard claimed, the defendants “already had and expressed grave concerns about whether Madoff ’s operation was legitimate. But the benefits of investing with Madoff were so critical to their business success and personal wealth that they delib-erately ignored all the red flags of fraudu-lent activity … For almost two decades,

the defendants individually and collectively engaged in a pattern of willfully ignoring these red flags, rather than lose potentially tens of millions of dollars in fees and jeopar-dize the success of their Madoff-dependent investment management businesses.”

The defendants denied both Picard’s allegations in the complaint and any liability to the Madoff estate in connection with the court proceeding. They decided to settle to avoid “expensive and time-consuming liti-gation” and legal risk, the agreement states.

The settlement also recognizes near-ly $140.9 million in allowed loss claims by the White Plains companies as victims of Madoff ’s fraud. With the settlement payments added on, the loss claims for Danziger’s and Markhoff ’s investment busi-nesses in the Madoff affair total nearly $165 million.

In October, the village of Port Chester welcomed its first new housing devel-opment in decades when The Mariner,

a first of its kind housing complex, opened in the downtown area.

The luxury apartment building at 21 Willet Ave. along the Byram River fits 100 units in its five-story frame 12 of which have been rented so far. The land where The Mariner was built used to be a brownfield. Developer Frank Boccanfuso, principal at Phoenix Capital Partners L.L.C. reportedly bought it for just more than $5 million. It cost more than $35 million to build, he said.

“We were going to build condos, but the market changed.” That was back in 2010. The luxury rental complex, which is three blocks from the Metro-North Railroad station, is now being touted as ideal for young professionals and empty nesters in the area.

“This represents a change in Port Chester,” said Jeff Heifetz, managing director for The Mariner’s management company, Rose Associates of New York City. “It’s a lynchpin architecturally.” The exterior represents the old version of the community sandwiched between Rye and Greenwich, Conn., while the inte-rior design reflects the personality of the young professionals The Mariner hopes to attract to the area, he said.

Making Port Chester more attractive to both residents and visitors was part of a plan that Mayor Dennis Pilla initiated in 2007 when he was first elected.

“I introduced a downtown revital-ization project,” he said. Development had slowed since the waterfront complex, home of Costco and AMC Loews opened in 1999, in part because of the economy, he said.

After the mayor took office he said the village gradually started “rebuilding infra-structure primarily through grants for side-walks and street lights. Then we changed sidewalk café and entertainment ordinanc-es to enhance restaurant identities.”

Port Chester’s reputation as the self-proclaimed “Restaurant Capital of Westchester” grew. In September, the Capitol Theatre, at 149 Westchester Ave., reopened as a concert venue. It has brought concert-goers to the village. It also promotes the fact that is just across the street from the Metro-North train.

The Mariner was not a part of the original plan for revitalizing Port Chester, but the mayor calls it a “litmus test.” Other residential development projects might follow if it fares well.

Partners has already started working on another luxury housing project, The Castle. The site for the proposed complex is on the corner of Willett Avenue and Abendroth Place. Boccanfuso said, like The Mariner, The Castle will be near a train station making it ideal for commut-ers. “Transportation is very important for these projects,” Boccanfuso said.

Starwood Capital Group, a private investment firm in Greenwich, Conn., is proposing a complete transformation of the former New York United Hospital Medical

Center property, Pilla said. The mixed-use development would include residential, retail, and commercial office space.

The village board will be watching The Mariner as a pioneer project for down-town residential development in a village where 80 percent of housing was built before 1969. More than one-third of its housing was built before 1939, Pilla said.

“This could be a good antidote,” Pilla said.

Heifetz also said The Mariner has been a much-needed answer for some people who were displaced by Hurricane Sandy.

Apartments can be leased on a short-term basis for those who aren’t looking to permanently settle. It lures others with amenities such as Wi-Fi, boat slips and an accessible rooftop for lounging. Rents range from $2,095 for a one-bedroom to $3,850 for a three-bedroom apartment with den.

But one of the most attractive things about the building is it’s a fully taxable property, Pilla said. According to the town of Rye records The Mariner is valued at $5,937,500. “Having a multimillion-dollar addition to the tax roll is great,” he said.

Yonkers Industrial Development Agency directors approved about $1.5 million in tax incentives for a roughly $26 mil-

lion hotel project at Cross County Shopping Center and an $8 million demolition and cleanup at the future downtown site of a $173 million high-rise apartment building.

The board approved a $266,220 mortgage tax exemption and an estimated $775,023 in sales tax exemptions on construction materi-als that will be used to convert an office tower

at Cross County Shopping Center into a 155-room Hyatt Place Hotel.

The Manhattan developer, Friend Development Group L.L.C., plans to add 17,000 square feet of first-floor and base-ment space to the 55,000-square-foot office tower. It will be the first hotel at the reno-vated, nearly 60-year-old outdoor mall.

The 18-month Cross County project will create 80 construction jobs with an estimated payroll of $6.6 million. The hotel will hire for 28 full-time equivalent jobs.

Regeneron named biotech’s best

The state’s largest biotechnology employer, Greenburgh-based Regeneron Pharmaceuticals Inc., was named Biotechnology Company of the Year in the same week that its drug treatment for eye disease was approved for use in Europe.

The award from Scrip Intelligence, a bio-pharmaceutical industry publication, recog-nizes the biotech firm that has achieved the most in the 12 months between June 1, 2011 and May 31, 2012. A panel of judges noted that Regeneron has been transformed over the past year by the U.S. approval and launch of its first major product, Eylea, and this year expects to become profitable for the first time.

“This has indeed been a transforming time for Regeneron,” Dr. Leonard S. Schleifer, company president and CEO, said in a pre-pared statement, “as we went from having one approved drug to three, advanced investiga-tional drugs into Phase 3 trials, and created shareholder value that moved Regeneron into the top ranks of the biotechnology industry.”

The Scrip award shortly followed Regeneron’s announcement that its injectable drug Eylea has been approved in the European Union for the treatment of patients with neovascular age-relat-ed macular degeneration, or wet AMD.

Eylea was approved for the treatment of wet AMD in the U.S. in November 2011 and in Japan, Australia, Switzerland and other countries this year. Bayer HealthCare,

Regeneron’s collaborator in the global devel-opment of Eylea, plans to launch Eylea in those countries this month in 2012 and into 2013. In September, Eylea also was approved in the U.S. for the treatment of macular edema following central retinal vein occlusion.

Regeneron maintains exclusive rights to Eylea in the U.S. Bayer HealthCare has licensed the exclusive marketing rights for foreign markets, where the companies will share equally the profits from sales of the eye drug, except for Japan, where Regeneron will receive a royalty on net sales.

Pleasantville investment firm forms

Former Wall Street senior executive Larry Yavner has formed LBY Partners L.L.C. in Pleasantville, an investment firm that will lend to and invest in established small-to-medium-sized businesses. The firm will also make other private investments.

LBY Partners will also partner with com-munities in which its investments are made. One such nonprofit partner, Hudson Valley Economic Development Corp. in New Windsor, will help the firm find worthy businesses in the Hudson Valley for loan opportunities.

Yavner, the investment firm’s managing partner, in a press release said it establishes strategic partnerships and provides its lim-ited partners with the ability to deploy capital on an “idea-by-idea” basis.

“LBY Partners will have the ability to lend to or invest in companies that typically fall under the radar screen of larger investment firms and banks, and we look forward to help-ing companies execute on their strategic plans and fulfill their growth potential,” he said.

In a nearly 25-year career on Wall Street, Yavner focused on as mergers and acquisi-tions, capital structure arbitrage and distressed investment opportunities. He has held senior positions at JPMorgan Chase & Co., Bear Stearns & Co. and UBS Investment Bank.

How do I compensate my employees when

either Mother Nature or I decide to close

our office because of inclement weather? During the recent

hurricane we were closed for a day and a half. Most employees

were out for two days because of a lack of power at home. Should employees be using

personal or vacation time or do I simply pay them and chalk it up

to an act of God?

THougHTS of THe dAY: There is no one right answer to your question. Each business owner has to first assess the health of the business and then decide how much, if anything, can be allocated to helping out employees. Make sure your company is pre-pared for Black Swans – events that you can-not predict or control.

The first job for every business owner is to preserve the company. If you’re positioned to survive, then employees will have jobs to come back to. Ability to respond and be there for employees may be driven by the health of the company post-storm.

Evaluate the storm’s impact on the busi-ness. Is cash flow A-OK? Are reserves sufficient? Are clients still buying? If yes, then go on to consider what else can be done for employees.

If the company was open then it’s up to employees to use personal days to cover outages. If the company was closed it’s up to you to decide what to do. Check your policy manual for direction.

Do salaried employees have paychecks docked because the company was closed or they couldn’t get to work? Certainly hourly workers will lose out because they can’t report hours worked. Keep in mind that hourly workers are generally at the lower end of the wage scale where they can least afford gaps in income.

Do employees have enough personal days to deal with the emergency? What about employees who need to take care of post-storm issues. When an emergency event hap-pens late in the year there’s a greater possibility that personal days have already been used for other activities. That’s the luck of the draw, but it still has a real impact on personal well-being.

If the company can afford it, consider a one-time increase of a few personal days, available the month after the emergency, to help close post-event needs.

compensating workers when disaster strikesIf you planned to pay year-end bonuses,

consider distributing them early. That may reduce profit sharing, if you have a plan, but the need may be greater for cash now versus putting the money into qualified plans that can’t be accessed.

What if the company has loads of reserves and is positioned to help employees in any way possible? Think about offering low inter-est loans to help employees rebuild homes or replace cars, clothing and other possessions. Offer overtime to employees who want extra pay and are willing to work for it. Rent an apart-ment for people to use to take showers, get a hot meal or take a break from the devastation.

Reach out to federal, state and local emergency contacts. Have talks before and

after work with employees and their families about what resources are available to help people recover. Bring in counselors to talk about managing in stressful times. Put some-one in charge of helping employees figure out and fill out paperwork for disaster relief.

Lastly, get ready for the next Black Swan. The only thing you can do is be prepared. Set a plan in motion to build reserves, have lists of how to contact employees in emergency, policies on what is and is not the company’s responsibility.

Hold internal workshops on what people can do to recover from this event and get ready for the next one. Education is the first line of defense. Right now, while people are thinking about the topic, get them involved

in building their own personal emergency preparedness plan.

When Rae Szymanski decided to go to nursing school, she thought about working at a hos-

pital. But her college experience changed her direction.

“I went to NYU nursing school, and there, you really got exposure to the commu-nity and it clicked with me,” said Szymanski, who attended the school almost forty years ago and fell in love with caregiving. She also learned even then that the health care industry was destined to change.

At the time, she anticipated it. “The hospital was going to shrink. It would be a place where people go to get cut up, sewn up and sent home, and that’s what’s happening. That resonated with me.” Her foresight and desire to work with people in the communi-ty lead her to the home health care industry.

Szymanski, now executive vice president and COO of the Visiting Nurses Association (VNA) of Hudson Valley, said while the transition for hospitals took four decades, there are changes in the home health care industry that are happening at “light year speed.” That’s at least partially due to some changes related to the Affordable Care Act (ACA), which according to the Obama administration will make health care acces-sible to everyone and keep Medicare and Medicaid “more secure.”

Security in the home health care indus-try, however, has been fleeting. One issue facing the VNA and other organizations in that industry is the cuts associated with the ACA. The American Health Lawyers Association published a report which points to a potentially grim future for many in home health care: the ACA is slated to reduce Medicare spending on home health care services by $4.2 billion between 2010 and 2014. That figure is expected to exceed more than $39.5 billion by 2019.

The VNA of Hudson Valley has already been “clobbered with cuts” according to VNA President and CEO Michele Quirolo. There was a “retroactive take back” for Medicaid services provided in 2009, said Quirolo, and in 2011 the governor enact-ed a retroactive recovery of funds for services rendered in 2009 and beyond for

some organizations. “So how do you budget when you com-

plete a budget for ’12?” Quirolo asked rhe-torically. “All of a sudden you’re going to have money taken away? It has put my licensed agency in the red.” Adding to the financial burden of spending cuts and retro-active billing is the anticipated mandate that insurance should be offered to all employ-ees. “In home health care, particularly in New York, there are a lot of hourly workers, particularly home health aides,” Quirolo said. “They currently don’t enjoy full ben-efits by virtue of the work they do. So do you take the chance and cut hours down to 29 hours so that you don’t have to pay it? It could bankrupt the organization.”

Szymanski added that if it’s a strug-gle for larger organizations, it must be an enormous burden for independently owned

and operated home health care companies. She believes smaller service providers will soon have no choice but to partner with a hospital or Accountable Care Organization (ACO).

Rosa Barksdale, owner and CEO of Barksdale Home Care Services Corp., understands that concern. Barksdale has run her independently owned home health care service for roughly 30 years. “The smaller organizations have to be cognizant,” she said. “The patients are the home care business; the home care agency now has to contract with managed care programs to get the business.”

Although she recognizes the challenges, Barksdale sees the benefits of the ACA. “We have to manage with less and minimize the waste in order to keep costs down to keep up with modern technology in the ways we

bill and operate.” But, she added, “Clients will have better access to home care.” In the end, it’s about the patient.

The VNA of Hudson Valley champions that mission of providing quality health care to all people in their communities. Despite financial challenges, the VNA of Hudson Valley was able to remain committed to that idea by expanding their telehealth services, which allows a virtual nurse to offer care to up to 60 patients a day through technology similar to Skype.

Szymanski believes you have to stay on the cutting edge of technology even as more changes and challenges occur. She also noted those changes affiliated with the ACA could end up being good. “It’s still a great opportunity bringing great change, and who knows, maybe home health won’t be an afterthought anymore.”

Brian Foy, the executive director of the Westchester County Medical Society, said Memorial Sloan-Kettering’s cancer center will be disruptive to the cancer care that exists in Westchester.

“This has nothing to do with Memorial Sloan-Kettering,” Foy said. “We just didn’t feel there was a need. The oncology com-munity is very concerned. I’m sure they’ll see a loss of patients. We felt the whole thing was rushed through.”

The groups do support Lawrence Hospital’s proposed cancer center in Bronxville. The $39 million center, set to receive site plan approval from the plan-ning board this month, would open at the end of 2014. Money for the project will come from fundraising and capital reserves.

The 40,000-square-foot addition to the hospital would provide cancer ser-vices, surgery and radiation therapy. The addition is part of a combined project that includes replacing operating rooms to allow expanded space and higher ceilings.

The cancer center will also offer ser-vices such as support groups, patient education and a resource center.

“Our goal is to develop a comprehen-sive center,” said Tim Hughes, vice presi-dent of business development at Lawrence Hospital. “All of the disciplines are located in a single location. It’s a team approach to making patients well.”

Hughes said Lawrence Hospital offi-cials are not focused on Memorial Sloan-Kettering, noting that many patients already have the means to travel to New York.

“We believe in developing this center for people for whom transportation is an issue,” Hughes said. “This meets all needs; it’s what is really attractive for our patient population.

Westchester is becoming a mag-net for cancer centers, though not everyone is happy about it.

Construction continues on Memorial Sloan-Kettering’s Cancer Center at 500 Westchester Ave., a former Verizon facil-ity, in Harrison. The 114,000-square-foot treatment facility is expected to open in the first quarter of 2015.

“Frequently, cancer patients from this area who choose to receive care from Memorial Sloan-Kettering must trav-el into Manhattan for treatments and services,” Dr. Maureen Killackey, deputy physician-in-chief and medical director of Memorial Sloan-Kettering’s Regional

Care Network, said in a statement. “The new Harrison facility would allow our patients to receive Memorial Sloan-Kettering’s expertise in this outpatient setting, closer to home.”

The facility would have 140 full-time employees.

Manhattan-based Memorial Sloan-Kettering already has a facility in Sleepy Hollow, though its plans to open in Harrison sparked opposition last year. Its application to the state Department of Health was opposed by the Northern Metropolitan Hospital Association (NorMet) and the Westchester County Medical Society.

The two organizations claimed Memorial Sloan-Kettering could not show sufficient need for a new facility, though

the Department of Health approved the application late last year.

“This will be disruptive to the market,” said Kevin Dahill, president and CEO of NorMet. “This will further fragment services, create more competition and marginalize existing sites. It’s not neces-sary. It’s not in any way in short supply in Westchester.”

Dahill said that Memorial Sloan-Kettering offers great service, but the organization only goes to demographics that suit them and not places that need oncology like Brooklyn and the Bronx.

“They feel they need to create a pres-ence for themselves in highly desired parts of suburban areas,” Dahill said. “It’s pretty clear what’s occurring here. We think it could have a cascading effect.”

Westchester is home to two of the top spine surgeons and prolific inventors in the country.

Dr. Seth Neubardt and Dr. John A. Abrahams, both based out of Westchester Avenue in Harrison, were recently recog-nized as two of 61 “Spine Surgeon Inventors to Know” by Becker’s Orthopedic and Spine Review due to their innovative inventions.

Neubardt, an orthopedic spine surgeon, holds 22 patients, while Abrahams holds 16.

“Surgical inventors follow a simple set of patient focused rules,” Abrahams said in a statement. “How can I make this safer? How can I reduce pain? How can I get the patient out of the hospital more quickly?”

Abrahams invented a medical hydro-gel that reduces bleeding during surgery, eliminating post-surgery complications. He is chief of neurosurgery and co-director of the Orthopedic Institute’s Spine Section at Northern Westchester Hospital and associ-ate professor of neurosurgery at New York Medical College.

Abrahams’ inventions have led to him

forming several small companies designed to make spinal surgery easier and also improve communication in health care.

Growing up, Abrahams said he was always a tinkerer, and even while he was

at medical school at the University of Pennsylvania he wanted to be an inventor. He also has a master’s in biomedical engi-neering from RPI.

“I take what I learned and I pick up

these ideas,” Abrahams said. “I’m always tak-ing stuff apart and putting it back together. I’ve always been a technophile, which makes me really different. I’ve been able to use my background as a computer engineer.”

Abrahams said he was excited to be named to the list, and that he wants to work with Neubardt in the future.

“It makes you feel good about what you’re doing,” he said. “It makes you want to do more. Me and Seth think we should work together, but we haven’t teamed up on any inventions.”

Abrahams said his long-term goal is to continue to have smaller surgeries that pro-duce better outcomes.

Neubardt has branched out of the medi-cal field, inventing a device that improves the mechanisms of umbrellas, though in medicine, he only invents to enhance the quality of a patient’s life.

“Through our inventions we are able to help more patients than we could ever personally see in our practice,” Neubardt said.

A procedure Neubardt patented to safely insert screws during spinal surgery is used in 250 hospitals and 15 countries.

To White Plains attorney Thomas Skelton, a fed-eral judge might have granted a sound night’s sleep when on the last day of November she

approved a settlement that will give back to his firm’s union clients much of what Bernard Madoff stole from their pension and health funds over 15 years.

The middle-of-the-night emails that Skelton sent to his next-day self from bed – where inspiration awakens a legal mind without regard for billable hours – might not be as urgent or as frequent as an end seems near to the highly complex litigation in which he and another partner at Lowey Dannenberg Cohen & Hart have played leading roles.

“When you do a major litigation,” says Barbara Hart, “you do it in such a way that you’re preoccupied by it day and night.”

Hart, the firm’s chief operating officer and a litigator with an impressive record of multimillion-dollar securities fraud settlements, teamed with Skelton, her fellow Fordham Law School graduate, to recover $219 million for class-action plaintiffs from so-called “feeder funds” that invested their customers’ money in Madoff’s bogus investment securities company. The settlement agreement is expected to get final approval from U.S. District Court Judge Colleen McMahon following a fairness hearing in March.

If investors file no objections to a deal that required Hart and Skelton to forge what Hart calls “a global peace” among about two dozen law firms, the U.S. Department of Labor, New York’s attorney general and state court judges in California and Minnesota, “We can write checks by April or May for real,” she says.

The Madoff fraud has preoccupied Hart and Skelton for nearly four years. They and their 16-attorney firm at 1 N. Broadway represented two upstate plumbers and steamfitters union locals that became lead plaintiffs in class-action litiga-tion against Madoff-feeding investment managers in White Plains, Long Island and Syracuse. Their firm’s fifth-floor office is a short walk up Main Street from the law office of two defendants in the suit, Joel Danziger and Harris Markhoff. (See related story, page 1.)

“This was the largest settlement the firm has ever achieved,” says Hart, a Chappaqua native whose father, Edward Hart, was principal at Horace Greeley High School for nearly 30 years. “What’s remarkable about the litigation, this will represent about 70 percent recovery of net dollars” invested by the plaintiffs in Madoff’s company. “I would put money on it that it’s unprecedented in terms of rate of recovery.”

To compare, the Madoff bankruptcy trustee’s approxi-mately $1 billion settlement in 2011 with the felon’s second largest feeder, Rye-based Tremont Group Holdings Inc., rep-resented about 50 percent of Tremont customers’ net invest-ments with the Ponzi schemer.

In Syracuse, the 1,000-member Plumbers & Steamfitters Local 267 began investing their pension fund monies in Madoff’s business, either directly or through feeder funds, in the mid-1990s, says Gregory Lancette, Local 267’s business manager. “He stole it from day one.”

“was very traumatic,” says Lancette. It “came at the worst time possible,” as union pension funds nationwide already had taken severe hits to their invested balances in the financial collapse and recession.

Lancette’s father is a retiree of the plumbers and steam-fitters union that his son now leads. “That was the hardest phone call I will have to make in my life,” Lancette says. “I told him, ‘Something happened. I don’t know if I can give you a pension at this point.”

From Buffalo to Binghamton, labor unions had heeded their investment advisers at Ivy Asset Management on Long Island. “What they were peddling was Madoff,” says Hart. “Because he had all the prestige surrounding his name, he was the cachet marketed by Ivy.”

With Madoff’s arrest, “They were shattered,” she says of her clients. “Not only were their plans or their future shat-tered, their illusions were shattered. Not only were they shat-tered financially, they were shattered in their views of people and what you think about people, what was right and what was wrong. These are salt-of-the-earth guys.”

Lancette’s union local did work out a 30-year restructur-ing plan that continues pension benefits to its 300 retirees at the same level as before they learned that the one-man, invest-ment miracles-working Wall Street brand they’d bought into was a fraud. “But we added five years to everybody’s career that’s still working,” raising the union’s retirement age from 55 to 60 in an occupation where degenerative disease and hip and knee replacements are common among older workers, he says. And those workers’ pension contribution rates were nearly doubled to make up for their pension fund shortfall.

Lancette says his local expects to recover about $14 million from the settlement and the separate liquidation of Madoff assets, money that should shorten the union’s 30-year pension rehabilitation payment plan. The recovered sum amounts to “just about all of our initial pension fund investment.”

The union’s investment with Madoff had grown to a book value of about $33 million, he says. Unfortunately for his hard-laboring victims, Madoff’s book was a work of fiction.

Lancette thinks his union would have recovered less money if they had not been represented by Hart and Skelton and had not taken an active role as plaintiffs. “They were just so diligent about it,” he says, “They’re very organized.”

The consensus reached by law firms and government reg-ulators involved in a case of extraordinary magnitude “came under the leadership of Barbara Hart and Tom Skelton,” says Lancette. “They were the point of the arrow.”

Law firms in the class action stand to collectively receive about $40 million in contingency fees after payments to the federal Labor Department and state attorney general’s office, Hart says. In negotiations with federal officials, attorneys agreed to lower their initial contingency fees to 20 percent of the recovered amount from either 22 percent or payment capped at four times their billable hours in the case.

With the negotiated payment, “The lawyers at those rates are going to get less than one times their hours” on the case, says Hart. Her firm’s high risk in taking on the unions’ case will not return a high reward.

“We have a long way to go,” Skelton cautions. The arrow has not yet reached its target.
