Hospital president makes Westchester history

Former state Business Council CEO Kenneth Adams will remain at the helm of a restructured Empire State Development (ESD) agency this year, when Gov. Andrew M. Cuomo plans to “gut the place” to have it function “like a business” to attract and keep companies in New York, accord-

ing to a recent published report from Albany.Officials at ESD and the governor’s office, though, have

kept mum on the substance of the Dec. 31 report by longtime Albany political reporter Frederic U. Dicker in the New York Post. Neither office would comment on the reported shake-up when contacted by the Business Journal.

Dicker quoted an anonymous senior Cuomo adminis-tration official who described Empire State Development as “disjointed, dysfunctional – and nobody really is sure on the inside who is responsible for what.”

“ESDC has not even branded itself properly,” the Cuomo official was further quoted. “For many people, ESDC means nothing.”

For others, it could mean a number of things, given its confusion of names and corporate and operating entities.

CEO hands off day-to-day duties in his gradual transition to retirement.

Susan Fox on Jan. 1 became the first woman to serve as president of an acute care hospital in Westchester County. She assumed one of the job titles held for 31 years by White Plains

Hospital CEO Jon B. Schandler, who has worked closely with Fox since her arrival in 2010 as senior vice president of administration.

“Susan is a seasoned executive,” Schandler said. “She has great experience. She relates well with people and she’s done an exceptional job” at the East Post Road hospital. With Fox, the hospital’s future is in good hands, he added.

The White Plains Hospital board of directors in December approved her precedent-setting appointment as president of the approximately 2,600-employee institution with an annual budget of roughly $350 million.

“Our hospital is at a critical point in its 120-year history,” hospital board chairman J. Michael Divney said in a prepared statement. “We are building for the future and bringing exceptional doctors onboard to offer our patients the most advanced techniques and technologies available. Susan’s innovation, coupled with Jon Schandler’s three decades of experience as a health care leader in this market, is the best of both worlds, and will ensure White Plains Hospital will continue to be a health care leader now and into the future.”

Happy hour, the after-work tradi-tion, may be on the decline nation-wide, but it has become a booming

business in downtown White Plains.The city of White Plains has trans-

formed itself into a destination for those looking to relax and blow off some steam after work, with numerous bars, especially on downtown Mamaroneck Avenue, cater-ing to the happy-hour crowd.

Bars across the country have seen the tradition disintegrating, with an economic recession that has made people more cau-tious with their dollar. The loss of manufac-turing jobs, concerns about healthy living and stiffer drunken-driving penalties are also to blame for happy hour’s decline.

Smoking in bars, illegal in Westchester and elsewhere, has also caused the decline. Bar owners have said that smokers simply choose to drink at home, rather than go to a place where they can’t light up.

Since the economic recession, beer drinking has declined by 5 percent, accord-ing to the Beer Institute, a Washington-based trade group.

“Contrary to the myth that people go out and drown their sorrows, the truth is that beer drinkers are pretty responsible people and when they have to cut back, they’re cutting back on their pleasures,” said Chris Thorne, vice president of communi-cations at the Beer Institute.

A place like White Plains, with more white-collar than blue-collar workers, has not been subject to the same happy hour malaise plaguing the rest of the country.

The Brazen Fox has become one of the city’s most popular happy-hour destina-tions since it opened in 2008. Manager Neal Alpuche said the bar’s prominent location at 175 Mamaroneck Ave. makes it a perfect meeting place.

“Happy hour is a starting point for us,” Alpuche said. “People like to come and see other people, they like to see what we have going on.”

Brazen Fox offers wine by the glass,

discount martinis and appetizer samplers during happy hour. Alpuche said their bar is a place for people to be social, with its horseshoe- shaped bar allowing for better interaction.

“We market a reasonable price,” Alpuche said. “The prices aren’t sky high for food or drink; we appeal to a regular middle-class demographic.”

Ron Blacks Beer Hall is next to Brazen Fox at 181 Mamaroneck Ave. Both bars are owned by Declan Rainsford, who also runs Rory Dolan’s in Yonkers. Ron Blacks appeals to a similar demographic as Brazen and patrons frequently go back and forth between the two during happy hour.

Ron Blacks happy hour runs from 4 p.m. to 8 p.m. with lunch specials Thursday through Friday from 11 a.m. to 4 p.m. Happy hour deals include $4 drafts and $5 wine by the glass, with sliders, tacos and waffle fries going for $2.50. The bar also attracts a late night crowd with a DJ.

“We are busy at all different times of the day,” manager Peter Quinn said.

While Ron Blacks still does well during happy hour, Quinn said he has seen some

impact from the recession. Quinn remem-bers working in lower Manhattan where people would cash their checks at the bar on payday and then spend all their money that night.

Ron Blacks features a mix of students and white- and blue-collar workers. “We are a destination for people from all over Westchester,” Quinn said. “We have 40 beers on draft and we’re constantly changing.”

Quinn said that having so many bars on Mamaroneck Avenue is good for business since it brings in more people to the area and more people into Ron Blacks.

“We welcome all competition,” he said. “Whatever gets people here. We see people rotate from one place to the next.”

Butterfield 8 is the new kid on the Mamaroneck Avenue block. John Gazzola, a partner in the restaurant, also runs Mulberry Street Italian Kitchen at 189 E. Post Road and Lola’s Mexican Kitchen at 147 Mamaroneck Ave. Butterfield 8, locat-ed at 147 Mamaroneck Ave., opened in October.

Gazzola said the restaurant has done good happy hour business since it opened,

with $3 beer, $4 wine and $5 mixed drinks served from 5 p.m. to 8 p.m.

“The happy hour concept is conducive to the crowd that we draw,” Gazzola said. “There’s a lot of corporate business in the area. White Plains is the hub of Westchester for a lot of different segments of business.”

While other restaurants and bars focus on atmosphere or drinks, Gazzola said that Butterfield 8’s food is its main draw.

“We have a big open kitchen that you see when you walk in. We have customers that come in just for dining and we have an overflow of people that come in for happy hour and then stay for dinner.”

On the 42nd floor of the Ritz-Carlton Westchester on Renaissance Square, the res-taurant 42 offers a different experience than the bars on Mamaroneck.

42’s happy hour runs from 5 p.m. to 8 p.m., with drink specials and food specials, including its popular $1 oysters.

“White Plains is becoming a destina-tion,” said Christine Goncalves-Bedder, chief of staff at 42. “We are so unique, being 42 floors up. We offer a really great ambi-ence with great views. We strive to create the best guest experience through services and cuisine.”

Like Butterfield 8, 42 is focused on its cuisine, offering a mix of New American with Portuguese dishes, with an extensive wine and beer list.

Among the workforce, happy hour is still popular. In a recession, patrons said they seek out places with good drink specials. Debbie Muscara and Stephanie Gonzalez, who work at Citrin Cooperman in White Plains, said they both love The Brazen Fox.

“They offer good food and atmosphere,” Muscara said. “They also have $4 drafts. We tried others, but we always come here. It’s the one and only.”

Not everyone is into happy hour. Robert Signore, a banker at Bank of America, said when his coworkers go to happy hour, he hits the gym.

“I’ve never been a happy hour guy,” he said. “When I go out to drink, I drink. It’s just a marketing ploy to entice people to come in.”

At Pace University’s Lubin School of Business, professor and tax attor-ney Philip Cohen gave a mixed

review of the Taxpayer Relief Act passed by Congress that staved off the economy’s plunge over a fiscal cliff shaped by a sched-uled end to tax cuts and sharply reduced across-the-board government spending at the start of the new year.

At the Jerome Levy Forecasting Center in Mount Kisco, economist and company chairman David Levy in a post-New Year’s Day bulletin was calling the widely forecast cliff – or the mini-cliff he had anticipated as a possible outcome in December – a “fiscal pothole” instead in the wake of the tax legislation.

“We dodged a bullet,” said Cohen, a retired vice president and general tax coun-sel for Unilever United States Inc. “It’s not as bad as it could be. But I don’t like it as tax policy.”

“I’m glad sequestration was postponed, “he said. “Now we pushed off everything to March, so we have to go through it again” in the battle over spending reductions that pits Republicans in Congress against Democrats and the Obama administration.

“I’m disappointed that so-called ‘grand bargain’ wasn’t concluded with some spending cuts and the lifting of the debt ceiling,” he added.

Cohen, a tax professor in the Pace busi-ness school’s legal studies and taxation department, said the enacted tax changes have “both positive and negative aspects. I’m glad both that the lower tax rates for most Americans were extended and that a higher tax rate was reinstituted for higher income taxpayers.”

But he said the income level triggering the higher 39.6 percent tax rate – up from 35 percent in 2012 – perhaps should have been set higher than the $400,000 thresh-old for individuals and $450,000 for mar-ried couples approved by Congress. A bet-ter level would have been in the $700,000 to $1 million range, he said.

He said the tax rate hike for high-income Americans could have been kept at less than 39.6 percent “at least for 2013 when we’re still battling a recession.”

Cohen was pleased that the bill set a rate distinction between capital gains and dividend income and ordinary income. The bill raised tax rates from 15 percent to 20 percent for capital gains and dividend income exceeding $400,000 for individuals and $450,000 for couples.

“As a matter of tax policy I question the inclusion of a limit on itemized deduc-tions, especially one kicking in for upper middle-class taxpayers,” he said. The bill limits itemized deductions and phases out the personal exemption for individuals making more than $250,000 and couples earning more than $300,000.

Still, “It could have been a lot worse,” he said. “They could have capped deduc-tions at $50,000.” In a November op-ed piece, Cohen claimed such an arbitrary cap would unfairly affect upper middle-class taxpayers in states with high tax rates such as New York and California.

Both Cohen and Levy pointed to the potential negative impact on the economy of the expired payroll tax reduction for employees. Congress allowed a 2 percent rise in the payroll tax on income, from 4.2 percent to its previous 6.2 percent level.

“If I had been in Congress, I think that I would have pushed to extend that,” said Cohen. “There seemed to be no real push to extend it. I think one more year (of reduced payroll deductions) would have made sense to spur growth and aid recovery.”

In Mount Kisco, Levy called the expi-ration of the two-year partial payroll tax holiday the most significant reduction in

fiscal stimulus in the cliff-averting legisla-tion. He said the increased tax burden is regressive because the payroll tax rates are capped “and will mostly affect workers who have a high propensity to spend each marginal dollar of income.”

Levy in his Jan. 2 bulletin said the one-year renewal of extended unemployment benefits was “one big surprise” in the bill. Though it amounts to only about $30 bil-lion, it will have a high impact on spending in the economy, he said, as persons unem-ployed for long periods “tend to lack the financial cushions to cut into saving” when their extended benefits end.

Levy called the lack of spending cuts in the legislation “a smaller surprise.” Government spending cuts tend to have a high negative impact on profits, he said. “If there is a sizable impact on spending in 2013, it will hurt the economy, but unless and until that possibility rears its head, we assume there will be no further 2013 spending cuts.”

Levy said the bill’s fiscal tightening totals nearly $200 billion. But the negative effect on profits is likely to be more in the $100 billion to $125 billion range.

“This represents a blow to the econo-my, but not one that will by itself end the expansion.”

Whether it was because of the down economy, Hurricane Sandy or the shooting in Newtown, Conn.,

there is plenty of blame to go around for the sluggish retail sales this holiday season.

Retailers like Target Corp. and Macy’s Inc. reported flat growth, while Barnes & Noble Inc. saw a sales decrease. Many retail-ers only saw a 2.5 percent increase over last year.

The International Council of Shopping Centers reported an increase of 3 percent for November and December, but the number is expected to rise when post-holiday sales are factored in.

Many retailers noted heavy shopping the weekend of Black Friday and the week-end before Christmas, but soft sales the rest of December. A Thanksgiving that was earlier than usual led to less of a holiday urgency. RetailNext reported traffic from Thanksgiving to Dec. 23 was down 16.5 per-cent, with sales down 5.8 percent.

In Westchester, chambers of commerce reported their communities did well, while retailers reported sluggish sales.

“Things seemed to be bustling,” said Eli Gordon, president of the New Rochelle

Chamber of Commerce.While Gordon did not have any actu-

al numbers, he said that in New Rochelle people were opening up their purses and that businesses saw traffic. A Thanksgiving parade and a holiday lighting ceremony also helped get people into the holiday spirit.

Mount Kisco retailers have been strug-gling since Borders, a major anchor store, closed in September 2011, with the vacant space not filled.

Leslie Bijoux and Eric Sussman run Yogi’s Paw, a boutique store with locations in Mount Kisco and Mamaroneck. The duo said that sales were slower than in previ-ous years, and that they didn’t have big days on Black Friday or the weekend before Christmas.

“It was steady but there was a lack of enthusiasm,” Bijoux said. “I felt like people’s moods were a little down. After Hurricane Sandy hit the region, it changed people’s attitudes a bit.”

Bijoux said that Mount Kisco is suffering without an anchor store and that Borders gave people a reason to come to the town. She said that Mamaroneck is holding its own. Bijoux would like to see municipalities relax parking restrictions and keep towns looking good as a way to attract more foot traffic, but she said it’s up to businesses to generate customers.

“They have to get them and keep com-ing back with good merchandise and good prices,” Bijoux said. “That’s what we focus on. We get good new merchandise in our store at a price that people can afford them.”

Retailers in Mount Kisco said the holiday season was sluggish and flat versus last year.

“Hurricane Sandy and (the shooting in) Newtown took a lot out of the momentum of the holiday season,” said Cathy Deutsch, who runs Tiger Lily Boutique. “It was a very soft season in Mount Kisco.”

Deutsch said that events like Small Business Saturday did not help business, call-ing it a marketing campaign for American Express, which created the event.

Lori Land, who co-owns Churchills of Mount Kisco, an upscale clothing, shoes, jewelry and accessories store, also saw a slow holiday season until a last-minute rush helped boost sales.

“People were in a giving mood,” Land said. “Family members were looking for special gifts without any limits. We were extremely busy, busier than last year. We started off weak, but ended with a bang.”

put people in a somber mood, hurting sales. She said that businesses in Mount Kisco need to collaborate more and that the town needs to do more to promote itself.

“We need more town events, more Mount Kisco night outs,” Land said. “Business own-ers need to work together to bring in traffic as a unit.”

State health department deems fracking safe

An analysis by the New York State Department of Health said that hydro-fracking, a method used to obtain natural gas, could be done safely.

The analysis was leaked to The New York Times, which published the report this morning. Fracking has yet to be approved in New York, with environ-mental groups and energy corporations

fiercely debating the merits and safety of the practice.

The eight-page report looked into fracking’s impact on water, the ground and on the air, and said that fracking can be done safely with proper regulations.

“By implementing the proposed miti-gation measures, the Department expects that human chemical exposures (during fracking) will be prevented or reduced below levels of significant health con-cern,” the analysis says.

Environmentalists have criticized Gov. Andrew Cuomo for failing to release any information the state has found about the potential risks of fracking.

When we started the Citrin Cooperman Corner column in the beginning of 2012, the purpose of the articles was to go be-yond tips and tactics for

creating tax returns and financial state-ments by addressing key operational and financial areas to help executives with their businesses. We wanted to make sure that the columns were not theoretical but based on the real-world experiences of our CPAs, who work with companies of all sizes in Westchester and Fairfield coun-ties. Some of the topics we covered this past year in our columns included:

The seminar series looked at a busi-ness from inception to succession. The first seminar, “Start Your Engine,” cov-ered such items as structuring a busi-ness to afford the best tax opportuni-ties, budgeting a business, and working capital options. “Put It In Gear,” the second seminar in the series, examined critical areas including making a busi-ness more competitive by trimming expenses, expanding a business across state borders, and how to protect the company balance sheet in dealing with the new healthcare law. “Driving Off Into The Sunset,” the final seminar in the series, focused on concerns includ-ing employee stock ownership plans, valuing a business for sale, and succes-sion planning.

Many business owners reached out to us after the seminar series. They asked us for more information on a number of the issues that were addressed. In addition, we heard from them about the ongoing challenges they face on a daily basis in order to make their company successful and profitable.

Business owners and executives are understandably concerned about a whole range of issues, from the ever-changing tax landscape, to maximizing the value of their business, as well as em-ployee management.

We have listened. The columns that will appear every month on this page in 2013 will focus on methods business owners can use to make their compa-nies thrive in this very challenging en-vironment.

Upcoming articles will provide infor-mation on business concerns such as:

By 2010, Judy Goss knew a career change was inevitable. She’d been laid off twice and was seeking not

only job security but fulfillment in her career.

“I was 41 years old, I had two kids at home and a husband whose business was really crashing and burning,” Goss said. She worked as an editor at More magazine and her focus was on women and reinven-tion. Goss took that experience, combined it with her own commitment to jumpstart her career change, and launched Over 40 Females, a networking organization for women.

“I think some of us are forced to rein-vent ourselves,” Goss said of founding the company. “I think women are looking to meet each other in person and looking to help each other so we can all raise each other up to a higher level.”

Goss set out to do just that. She hosted her first networking party in April 2010. At that first event, 70 women came to New York City, a place known for its competitive networking parties. She knew she was on to something.

“I started in New York City and I tested the waters in Florida, Arizona and Connecticut, and I realized that there was this inherent need all across the country,” said Goss.

Just last year, she settled on Westchester County as the perfect chapter site for her growing networking organization. Recently, the newly minted chapter celebrated its first year in operation and already claims 100 members. All told, there are 500 members

in Over 40 Females.Within the Westchester County chapter,

members expressed a genuine need for networking as opportunities to grow and prosper have proven difficult to come by for many reasons. Over 40 Females chapter member Teresa Goetz, a transformational coach, believes women in business are chal-lenged by dual responsibilities at home and at work. “They are responsible for the family and their business and they always feel pulled in so many directions,” Goetz claimed.

Chapter director Phyllis Hirschauer began her journey with Over 40 Females a year ago when the Westchester branch launched. She helped spearhead the group’s debut and recruitment. Like most of the members, Hirschauer reinvented herself after spending 45 years in her career, as a nurse. “The older women in the group – we can mentor and educate (these women). You know we’ve walked that walk already,” she said.

Hirschauer has been networking for 10 years and believes women network dif-ferently than men and that’s why it’s so important for women to connect with one another, she said. “Men, when they net-work, they do it on the golf course, tennis court, playing racquetball. Hirschauer confirmed this method of social gathering, bonding and networking has translated into opportunity. One Over 40 Females member, a gluten-free baker, brought her product to a chapter event in New Haven, Conn., and expressed an inter-est in seeking out a commercial kitchen to expand her brand. A fellow member who happened to a restaurateur offered her an opportunity on the spot. Goss explained, “So making connections through nontra-ditional methods is what we try to find for our members.”

This new method of networking is spreading as part of Goss’s effort to build Over 40 Females into a recognized national organization. Beyond Westchester and New York City, Over 40 Females has chapters in Putnam County, N.Y., New Haven, Fairfield County, Hartford, Conn., Bergen County, N.J., and Los Angeles.

As for the coming year, the group hopes to increase membership and help other women reinvent themselves through tried-and-true networking methods, which as Hirschauer puts it, is “more than just a business card exchange.”

ESD also is parent corporation for nine subsidiary economic development corporations across the state.

The multiple titles apply as well to ESD’s head, Adams, the former president and CEO of The Business Council of New York State, whom Cuomo recruited to public service when taking office two years ago. Adams is president and CEO of ESD and com-missioner of the Department of Economic Development.

Adams reportedly helped develop the reorganization plan that Cuomo on Jan. 22 will present to the state Legislature in his executive budget.

into five units, each of which will be over-seen by an executive vice president. They are: business attraction; public policy and strategic planning; tourism; overseas exports and international trade; and small businesses.

That organizational structure would not be entirely new. ESD currently operates a small business division and an international division, with foreign offices in London, Israel and South Africa, that provides export counseling and education to New York state manufacturers and services firms looking to tap global markets. Its division of market-ing, branding and tourism is responsible for the long-running “I Love New York” cam-paign and includes the Governor’s Office for Motion Picture and Television Development.

ESD also includes a minority- and women-owned business development division.

Cuomo apparently plans to bring a mea-sure of diplomatic star power to the effort to develop export markets for the state’s businesses. The Post reported that James P. “Jamie” Rubin, former chief spokesman at the State Department in the Clinton admin-istration and that administration’s telegenic public face in international crises and articu-lator of foreign policy, will be named execu-tive vice president for exports and interna-tional trade at ESD.

In an administrative restructuring, each of the agency’s five units reportedly would be headed by an executive vice president.

Cuomo in November 2011 appointed Rubin as counselor for competiveness and international affairs at ESD and nominated him to the board of commissioners of the Port Authority of New York and New Jersey, a post he has held since last June.

“The idea is to get ESDC to function like a business, to look like a business and to think like a business with its general purpose being to bring companies to the state of New

York and retain the companies we have now,” the anonymous Cuomo administration offi-cial was quoted in the Post.

Another anonymous administration offi-cial described Cuomo’s planned renovations to the unwieldy Empire State Development edifice in real estate terms: “What the gover-nor wants to do with ESDC is gut the place.”

That experience has been transferred to her work in White Plains, where she has led the hospi-tal’s strategic plan to respond to the changes in the health care industry being wrought by the federal Affordable Care Act and to continue to grow as a leading community hospital in Westchester.

Among the strategic innovations, Fox led the creation in 2011 of White Plains Hospital Physician Associates, the hospital’s alternative for area doctors looking to join

large health care organizations. The hospital practice group is an alternative to the large multispecialty practices that have become formidable competitors with established

hospitals for patients and services. It has quickly grown to include nearly three dozen physicians whose specialties include thorac-ic medicine, orthopedics, oncology, general

surgery, obstetrics and gynecology and internal medicine.

Fox said the hos-pital has turned its focus to more com-plex medical ser-vices, such as cardiac catheterization and cancer treatment,

that have been moving out of hospitals into other health care settings.

Dr. Roger Cappucci, president of the White Plains Hospital medical staff, in a statement noted Fox’s “remarkable leader-ship skills” and said she has “inspired con-fidence in the physician community” about the hospital’s future growth.

Schandler, a certified public accountant who joined White Plains Hospital as comp-troller in 1976 and was named CEO in 1981,

said Fox will take a larger day-to-day role in running the hospital. Schandler himself “will take more of an outside role, more of a fundraising role, more of a community role,” he said, as he prepares to retire in three years.

As fundraiser, Schandler will be busy. The hospital has raised about $20 million in a five-year capital campaign, called The Time Is Now, which is the largest such effort in the hospital’s history. “We have to raise $100 million, so there’s a long way to go,” he said. Having focused privately on major donors since 2011, the hospital this year will launch a more broad-based campaign to reach its goal, he said.

For Fox, a Westchester resident for 20 years, the shop talk sometimes continues at home. Her husband is Jeffrey Menkes, president and CEO of New York Downtown Hospital in the Manhattan financial district.

New rochelle restaurant to pay back wages

Golden Rod Restaurant Corp. in New Rochelle was part of a chain of three suburban Chinese restaurants that will pay approximately $1.09 million in back wages, interest and liquidated damages to 255 employees following legal action by the U.S. Department of Labor.

The Golden Rod eatery, at 55 E. Main St., and two Asian Moon restaurants in Nassau County, along with the chain’s president, Vickie Su Li, also agreed to pay $98,231 in civil penalties and interest for violations of the federal Fair Labor Standard Act’s minimum wage, overtime and recordkeeping provisions, federal officials said.

The lawsuits and consent judgment followed investigations of the restaurant chain by the Labor Department’s Wage and Hour Division offices in White Plains and on Long Island.

FdiC reveals new study on community banking industryThe Federal Deposit Insurance Corporation (FDIC) has released a data-driven study devoted to the community banking industry.

A key part of the study was forming and using a universal definition of a com-munity bank. According to the accepted definition, there were 7,658 FDIC-insured community banks in operation within 6,914 separate banking organizations (or 94 percent of all banking organizations) as of 2010. Most significantly, the new defini-tion captures 330 larger banking organiza-tions that might have been excluded if the only criterion used was asset size.

The study also revealed that commu-nity banks hold the majority of banking deposits in U.S. rural and micropolitan counties, the latter of which have a popula-tion of 10,000 to 50,000. As it stands, there are more than 600 counties that have no other physical banking institution other than those operated by community banks.

The FDIC study was part of an ini-tiative launched in February 2012 at a national conference for community bank-ing. It was part of the FDIC’s effort to better understand the evolution of community banks over the last 25 years through the assessment of comprehensive

research and analysis on current challeng-es, opportunities for community banks, and implications for the future of com-munity banking.

Bee-line bus riders invited to comment

on proposed rate hikeWestchester County is offering those who use public transportation an opportunity to voice their opinion about a proposed rate hike.

The county’s Department of Public Works and Transportation will hold a public hearing Wednesday, Jan. 23 at the Westchester County Center in White Plains.

The county is inviting riders to com-ment on the formal adoption of a fare increase for the Bee-Line Bus system. The plan to raise rates corresponds with the regional rate hikes approved by the Metropolitan Transit Authority (MTA). Although the county transportation sys-tem falls under the MTA MetroCard sys-tem, final approval for a Bee-Line rate hike requires a county department vote.

The changes include an increase of single-ride bus fares from $2.25 to $2.50 – the same increase New York City bus and subway riders face – and the 30-day unlim-ited MetroCard, which can be used on the Bee-Line, will increase from $104 to $112.

For those who cannot attend the pub-lic hearing, letters may be submitted to the Westchester County Department of Public Works and Transportation, 100 E. First St., Mount Vernon, N.Y. 10550. They must be received by Jan. 24.

verizon Wireless to add 135 jobs

Verizon Wireless is adding 135 jobs throughout the New York metro area.

The company announced in a press release it will hire 10 full-time inside sales representatives in Orangeburg and 100 part-time retail sales and customer sup-port reps in the area, including Rockland and Westchester counties. An additional 25 positions will be based in Long Island.

“We’re proud to be able to expand our local investment further by creating new job opportunities within the New York metro region,” said Pat Devlin, president of the New York metro region for Verizon Wireless in a statement.

Verizon is looking for candidates who speak English and Spanish to meet the needs of the growing Hispanic population.

Job requirements for inside sales rep-resentatives include one year of sales expe-rience in a commission environment. Job requirements for the retail sales representa-tive position, a 30-hour per week job, include one to two years of sales experience in a com-mission environment, while customer sup-port requires one year of related experience.

When Lisa Pizzurro, co-own-er of Treat Frozen Yogurt in Cross River, visited her sister in

Southern California a few years ago, she made a life-changing discovery. “We would go and get frozen yogurt and one brand was so good! We actually went through with-drawal when we got back home.”

The withdrawal symptoms begged for a cure, but when Pizzurro and her husband searched for a local alternative, the nearest frozen dessert shops were at least 15 minutes from their area.

In the past, the couple had discussed opening their own business. After a few trips to visit her sister, Pizzurro and her husband began seriously talking about opening up a frozen yogurt shop of their own.

“The talks went a bit further than usual with my sister-in-law, Amy Civetta,” Pizzurro said. “She mentioned her kids wanted ice cream and she said she didn’t want to drive 15 minutes in any direction to get it.” So

the women began plotting their business strategy. Pizzurro admits that she had no business background: “I never had a career. I was a stay-at-home mom. I had jobs here and there but never a career.” Civetta also had little business knowledge, so they did their due diligence.

“We just did a lot of research online and reached out to those who had business expe-rience – those who had frozen yogurt shops in California, Illinois and Florida,” Pizzurro said. “We also found a community of people who shared with us the ins and outs of the business.” She added it was important for the business venture not to move forward unless they found a product they could dis-tribute that was like the frozen yogurt they discovered on the West Coast. The owner of the frozen yogurt shop there was skeptical and didn’t want to help them, but through product sampling, Pizzurro and Civetta dis-covered the same distributor who was willing to broker a deal.

After a year of planning, the sisters-in-law launched the store in April 2010. They found investors and pooled their own resources to come up with the roughly $200,000 start-up cost and settled into the store’s current home at Orchard Square, formerly Cross River Plaza.

Since the store opened more than two years ago, a lot has changed in Cross River. “It’s interesting – when we opened, we were the only place in a 15-mile radius,” said Pizzurro. “Part of the reason we felt confident was because there wasn’t any place local. Now there are a ton of places. We have competi-tors all over.” Pizzurro added that business increased by 10 percent in the two years since they opened, but recently competitors have played their part in deflating that financial cushion.

Pizzurro still insists her business remains strong. In fact, she said Treat Frozen Yogurt is still highly sought after and the brand is expanding into area markets, selling their peanut butter-flavored frozen yogurt. “I’m so proud of the shop and branching out,” said Pizzurro. “I’m extra proud to be a successful and female-driven enterprise.”

do what they have to do. What advice can I give her?

ThouGhTS of The DAy: Delegation is essential. Entrepreneurs struggle to over-come their basic instincts of pitching in. Generally, people are most highly engaged when they are challenged. Giving up control yields significant rewards for the owner.

Think of the business owner as a juggler. Each day she goes around keeping balls in the air. Building a team of jugglers is key. The group can handle a workload substantially greater than what the owner can juggle alone.

Most business owners are characterized by the entrepreneurial mentality of “I’m on it, I’ll make it happen.” They step into situations to get things done, to help out, to rescue people who are in trouble and to

make things come out right. Unfortunately, that behavior can get in the way of allowing other people to learn how to take on their own juggling load.

It’s better if the owner steps back, lets people try and teaches them how to recover when they make mistakes. When people ask for help, instead of providing direct answers, this owner needs to ask:

• What do you think you should do next?• What are your options?• If you try that, what do you think will

happen? Is that what you want to have happen?• How did you get here and what did you

learn that you can apply the next time?Think of decisions and actions as the

balls being juggled. When someone tries to throw a decision the owner’s way, throw it back. Let the original juggler decide, take action and learn.

People down the line in the organization can be disruptive. They see the owner as the person in charge and want contact with the source of power – the ultimate juggler. They throw balls into play, to the owner, past the juggler it should go to, who may lose momen-

tum and focus watching the ball go by. Redirect down-line players to the people

they report to. Follow through to be sure they learn how to work with their direct manag-ers. Check that managers are doing a good job working with their direct reports.

The owner has to practice distance – being aware without being involved. Watch how all jugglers perform without pitching in to pick up the load. Educate, train and coach players so they build their skills.

Some owners shy away from delegating, fearing that their staff will get overwhelmed or resist the additional workload. In fact, most employees today say they don’t have enough decision-making authority. They are not allowed to contribute as much as they could. And they are looking for greater opportunity to participate and take on addi-tional responsibility.

High levels of engagement happen when people are working to solve meaningful prob-lems. Show people how their tasks fit into the whole. Give people purpose by helping them see the importance of what they are doing.

When new tasks are in play, plan additional

time to complete. Allow for errors. Focus on train-ing people to try, recover, learn and build capacity.

When people get overwhelmed, reduce the number of balls they’re juggling. Help them to get their stability back. Offload assign-ments to an interim player. Build confidence by letting people master the load they’re jug-gling before throwing new tasks into the mix.

Through delegation, the organization builds momentum and capacity to perform. The owner is freed to work more on the business, not so much in it. There’s time to observe how everyone is performing. There’s time to get away from the business to recharge. There’s time to plan what’s next.

County law states that a town must sell any property acquired via tax lien, though Feiner has said that state law, which allows the town to lease the property, supersedes county law.

While Feiner said he does not believe the lawsuit has merit, he said he felt selling the property will save residents and Game On 365 from years of legal wrangling.

“The sale would eliminate the grounds for the existing lawsuit while simultaneously allowing for the project to proceed,” Feiner said. “Years of time-consuming and expen-sive litigation can be avoided.”

Martin Hewitt, project manager of Game On 365, said that with the competition vow-ing to do anything to stop the lease, it was smart to just buy the property outright.

“They have vowed to do anything they can,” Hewitt said. “Avoiding this lawsuit gives us a better chance to complete this facility at a faster pace.”

If Game On 365 purchases the property, it will be responsible for all the cleanup costs, which could be expensive. Carcinogens have been found at the site. The town and Game On 365 are still negotiating a price and would not disclose a dollar figure. They hope to have it resolved quickly.

“I see this as a way to try and avoid years of litigation,” Hewitt said. “Nobody wants to

But if Greenburgh thinks this move will end all litigation, not so fast, says Scherer, who said he will sue the town again if they sell the property to Game On 365 without issuing a request for proposal (RFP).

“We would like to bid on it. Why not?” Scherer said. “This is a shady backroom deal. They can’t lease it, because the lease is illegal, so they’ll just sell it. You don’t take the first person that comes to your door and say, ‘Hi, I want to sell it to you.’”

Scherer said it is the town’s fiduciary duty to get as much as they can for the property.

“Selling the town-owned property with-out an RFP is insane,” Scherer said. “If they want a sports complex, we’ll build a sports complex. I operate in this region; we know how to do it. We would love to expand House

of Sports.”The town did an issue an RFP for the

property in 2011, receiving two offers, with the highest offer at $1.5 million. The town board preferred to lease the site, so it could keep its options open, but now feels it has no choice with Scherer’s lawsuit.

“The land (would) stay vacant for years,” Feiner said. “The property will stay contami-nated while the litigation proceeds. The town won’t generate the tax revenue from the property and will continue to pay taxes to other levels of government (losing money).”

The town said that Game On 365’s offer is substantially higher than $1.5 million. Feiner said if the town sells the property to Game On 365, any lawsuit from House of Sports would not delay construction or cleanup.

Hewitt said he would like to open in 2013. If the sale is completed, he would still need approvals from the zoning board, plan-

ning board and building department. On Nov. 6, Greenburgh voters over-

whelmingly approved a referendum to allow

the town to lease the foreclosed property to Game On 365.

owning a second edition of “The North Pole” by Richard E. Peary, bound in the original pictorial blue binding. “It is not a valuable book, but has a pleasing provenance,” David remarks.

David recalls a pleasant surprise when summoned to a Westchester home by a woman seeking to sell a large book collection. By accident, he found the woman had a large collection of old maps. Her father had used small portions for decorative lamp shades and screens. She was left with the remains, which turned out to be of some value.

The Lilburnes find that about a third of new inventory moves quickly; another third moves over a 15-year period, “and the rest stays with you forever.”

Currently, the couple is coping with the water damage done by Hurricane Sandy to books stored in their lower level and have installed additional display areas in their ground-level space, offering the books at $5 each. “We’re not going to use that space again,” David declares. “If it flooded once, it could again.”

The Lilburnes met at Victoria Station in London when David was representing the Youth Hostel and Cathy was vacationing with two female friends from studies at The Sorbonne in France. They married in 1976 and gravitated into business when David’s Australian father, a medical doctor and book collector, asked his son to buy books for him in London.

Despite demands of their business, the couple is active in local community and pro-fessional endeavors. David is president of the Cold Spring Lions Club, vice president of the Garrison Ambulance Corps and is winding down a term as president of the Old Book Table at the Grolier Club on 60th Street in Manhattan. Cathy is vice president of the Putnam Northern Westchester BOCES. They have three sons in their 20s.

Garrison shop owners offer rare waresTucked into a row of buildings at

Garrison Landing, Antipodean, a shop featuring old and rare books,

maps, prints, ephemera and photographs on myriad subjects, is operated by David and Cathy Lilburne of Garrison.

“Some people think we just deal in expensive books,” David says. “Actually, we have offerings in a wide range.”

The name Antipodean comes from “anti”

and “pode,” meaning “opposite pole.” Born in England and raised in Australia, David gravitates toward articles featuring Antarctica and the South Pacific. He has not lost his dis-tinctive Australian accent since coming to the United States in 1982. His wife is a Cortlandt Manor native.

The Lilburnes stock their wares by visit-ing book fairs and from private collections. A typical year might mean attending book fairs

in Hartford, Conn., Boston, San Francisco, New York City, London, Australia and Hong Kong.

The couple belongs to the 450-plus-member Antiquarian Booksellers Association of America, which David served as president of from 2006 to 2008. The organization prides itself on its slogan, “The Buyer Need Not Beware.”

With a deal in place to stave off the fiscal cliff, the nation has shifted its focus to debt. For

months, Washington lawmakers danced around financial issues that have lingered years after the start of the Great Recession. Debt has been a worrisome part of the nation’s financial health and likewise has had a significant impact on Americans who suffered under its crushing weight during the financial crisis.

The result has been a discernible change in consumer behavior. MasterCard, head-quartered in Purchase, has been monitor-ing the change. The past year in consumer behavior has looked a lot like it did in 2011, according to Theodore Iacobuzio, vice president of global insights at MasterCard. Consumers are optimizing spending, and not just by cutting back and becoming more deliberate with payment methods regarding credit, debit use and prepaid cards.

Iacobuzio said U.S. credit card usage took a big hit in 2009. MasterCard did research measuring this from both a quantitative perspective, looking purely at numbers and a qualitative market research point of view, and determined that consumers have become more confident as they’ve focused on saving and decreasing debt.

“The U.S. consumer had the living day-lights scared out of him,” Iacobuzio said. “People were engaged in reducing the level of consumer spending in the hopes of taking whatever was left over to reducing consumer debt.” That effort proved successful, after credit card usage dipped into what Iacobuzio called “a spending crater.” More recently, consumers have slowly started to climb out. In 2011, MasterCard estimated $152 billion in U.S. credit card volume growth, which is a direct reflection of increased consumer spending.

The spending has also reflected a more calculating consumer: one who buys what they can actually manage to pay for. Over the past decade, the emergence of debit cards also changed the way people have wielded their buying power. From 2010 to 2011, debit and prepaid card growth increased by 45 percent, according to MasterCard analysis.

“We engaged in this research because there was wild talk going around the industry four years ago when we were really in a crisis that people were only using debit cards,” Iacobuzio said. But that wasn’t the whole story. Through MasterCard’s research, the company has identified a new credit card user.

“Consumers have figured this one out,” Iacobuzio said. “People have educated themselves; they’ve realized that the kinds of behaviors that they’ve engaged in real-ly for 20 years from the late ’80s to the crash weren’t going to cut it anymore.” Expectations of retirement and saving for a child’s college forced people to shift their thinking about the big purchases and using credit cards as a “wish-granting apparatus,” he continued.

Moving forward, Iacobuzio said MasterCard hesitates to forecast what’s to come, but he thinks consumer behavior will continue to evolve as it relates to balancing debt and managing spending. Because in the end, Iacobuzio said, “I think consumers have learned their lesson.”

Home builders are hopeful 2013 will be the year of the comeback in their industry, and so far they have reason to be: The U.S. Department of

Commerce revealed a 3.6 percent jump in building per-mits, the biggest increase since 2008 and the start of the Great Recession.

Following that trend, single-family new home build-ing permits were up 15 percent over 2011 in both the New York-Northern New Jersey area and the Hudson Valley metro area, according to the Builders Association of Hudson Valley (BAHV).

New York home builders are still cautiously optimis-tic about their prospects in the new year. The road for many builders has recently been tripped up with obsta-cles. Despite seeing gains in 2012, the uptick in building stalled in the latter part of the year, as Hurricane Sandy proved to be an unexpected hurdle.

In the aftermath of the storm, some home building companies are seizing the opportunity as homeowners look to rebuild. Westchester Modular Homes Inc., an employee-owned construction company in Wingdale, advertises services to help homeowners rebuild after Sandy on its website. The company is offering a Hurricane Sandy Informational Seminar Jan. 19.

John Colucci, vice president of sales and marketing for Westchester Modular Homes, said the company has already had a strong response. “Since Sandy we have received some very firm contracts on rebuilding homes,” he said. “And the hits on my website have gone up dra-matically. We used to get 3,000 hits per week; we’re now getting 5,000.”

Before the recent rise in interest, Westchester Modular suffered a 50 percent drop in home teardowns and rebuilds, a significant part of their business. In 2011, Colucci said they rebuilt 40 homes in the New York metro and Boston areas. In 2012, that number rose to about 50.

In the Hudson Valley, home builders have been wait-ing for signs of life, according to Scott Wohl, executive officer of BAHV. Wohl said Hurricane Sandy was “a bit of a snafu” for the home-building industry. And, he noted, coming out of the storm, there’s going to be an impact to the industry that’s not all positive. “It’s probably going to drive up the cost of materials somewhat,” he said. “And make it difficult to keep the costs low on construction,

but it also is going to reinvigorate the need for construc-tion.”

The need for construction has been growing for a while, Wohl admitted, long before Hurricane Sandy. Wohl said even during the Great Recession, there were people in Dutchess, Putnam and Westchester counties who wanted to buy homes, but had limited options given the aging housing stock. According to BAHV, the median age of a home is 60 years old and is not up to the latest building codes and energy efficiency standards.

Rebuilding and replacing homes in New York has been challenging in recent years, in part because of the red tape that’s specific to the state. It’s enough to make Lewis Dubuque, executive vice president of the New York State Builders Association (NYSBA), a little wary of the slight increase in numbers related to home building.

“I think we still need to ease up on regulations,” Dubuque said. “We’re growing towards a more green infrastructure and I mean it sounds nice, but it’s not entirely practical with people moving toward smaller lot sizes.” He added that the NYSBA is concerned about the New York state code council considering a mandate for fire sprinklers in one- and two-family homes. The organization projects the cost of compliance would add $7,000 to $10,000 to the price tag of a home, and that could spark another decline in the housing market state-wide.

But Dubuque said Gov. Andrew Cuomo’s lean toward lower taxes and regulations could translate into a health-ier building industry in the coming year. “We have a governor who’s going in the right direction so, there are signs of hope.”

mer St. Agnes Hospital at 305 North St. in White Plains. “This was an abandoned build-ing, essentially, for so long.”

Designed by architect David Mammina for its Long Island-based developer, The Engel Burman Group, the four-story, 150,000-square-foot main hospital building has been transformed into The Bristal at White Plains, a luxury assisted living resi-dence for up to 190 area residents over the age of 65. The redeveloped facility, estimated to cost $34.4 million when Engel Burman took over the project in a joint venture in 2009, includes 148 apartments, most of them studio and one-bedroom units, richly and color-fully designed by Amy Woodman and her W Design Group in Massachusetts. Thirty-two residences are on a secure memory care wing, named “Reflections,” reserved for persons with dementia or Alzheimer’s disease.

“It’s a combination of living in an apart-ment building and living in a boutique hotel,” said Yubas, director of business devel-opment for Engel Burman at The Bristal at

White Plains. The building’s many amenities include a 40-seat cinema, fitness center, hair salon, arts and crafts studio, Las Vegas-style bingo room, card and game room, library, business center for still-working residents, reserved private dining room for family get-togethers, wellness center and a heated out-door pool to be built this year.

The Bristal at White Plains marks the entry of the privately owned Engel Burman into the Westchester market, a potentially lucrative one in an affluent and aging county whose over-60 population is expected to rise 34 percent by 2030. Headquartered in Garden City, Engel Burman owns and operates seven

Bristal assisted living communities on Long Island since launching the brand in 1999.

Yubas said the developer could break ground in the first quarter this year on its planned $38 million, 115,000-square-foot Bristal facility on Business Park Drive in Armonk. With several more facilities in con-tract or in development in the tristate area, the company plans to double the size of its Bristal portfolio by 2014.

The Long Island developer first ventured into the Westchester market in 2009 in a partnership with North Street Community L.L.C., which five years earlier paid $21.4 million for the 23-acre hospital campus.

North Street Community’s plans to build a condominium community on the campus for seniors able to live independently were approved in 2007 by White Plains city offi-cials but stalled in the recession and credit crisis. The developer, though, did complete a $4 million renovation of a former hospi-tal building next door to the Bristal site as the Westchester Medical Pavilion, a medical office complex said to be about 90 percent leased.

At the Bristal, monthly rates range from $4,600 for a studio to $5,900 for one-bed-room apartments. Rates include three res-taurant-style meals a day, utilities and staff services directed by a registered nurse. In the memory care wing, monthly rates range from $6,900 to $7,900.

Yubas said about 30 residents have moved into the facility since its opening in late November and more are due to arrive this winter. Residents bring their own furni-ture. All are required to have medical assess-ments before moving in. The community, said Yubas, is not designed for persons need-ing medical services from skilled profession-als seven days a week.

The Bristal will employ about 100 work-ers, Yubas said. “We staff based upon the needs of the population,” she said.

The Club at Briarcliff Manor, a planned retirement community, is expected to break ground later this year.

The Club is on 59 acres, on the former site of The King’s College and has been planned for years, waiting for commitments from tenants before it began building. The property is being developed by Integrated Development Group.

But not here at The Club.”

A sales price was not disclosed, but the deal was off-market. The complex will be managed by HarborView Properties based in Larchmont, with upgrades and improve-ments planned.

cussion between the developer and borough officials and there’s a chance the property may not be sold. In 2009, local government officials rejected a proposal that would have changed the golf course’s zoning laws to make way for retail and housing develop-ment.
