plan judged one of the top three in the state.Competing with nine other regional councils appointed

in 2011 by Gov. Andrew Cuomo, the mid-Hudson Valley council was awarded $25 million in capital funds for its winning plan for jobs creation and economic development in its sprawling seven-county region. In all, businesses, nonprofits and municipalities, from Westchester County to Ulster County, stand to receive a total of $92.8 million for 84 projects awarded through the state’s 2-year-old consoli-dated funding application process.

The regional award total is a nearly 39 percent increase from the valley’s share of competitive funding in 2011, when state agencies awarded $67 million for 61 projects.

The 2 percent tax cap, signed into office by Gov. Andrew Cuomo in spring 2011, was supposed to bring property

tax relief to beleaguered New Yorkers who pay some of the highest taxes in the nation.

But without mandate relief, critics charge that the cap is unsustainable and 25 percent of municipalities have passed resolutions to override the cap as they prepare 2013 budgets.

The tax cap prohibits taxing entities from increasing the tax levy by more than 2 percent year to year. Municipalities can override the tax cap if 60 percent of the board approves a resolution, while school districts need 60 percent of voters to approve an override.

In Westchester, municipalities including Mount Pleasant, Ossining, Lewisboro and New Rochelle have been forced to override the cap or make deep cuts to essential ser-vices. Mayors and city managers said that rising pension and health care costs, which are imposed by the state, make meeting a cap impossible.

“It’s very difficult for local governments to sustain the course without structural changes to state law,” Port Chester Mayor and President of the Westchester Municipal Association Dennis Pilla said. “With the cost of living increasing, you can seldom keep giv-ing employees zero percent raises.”

Pilla said that while the tax cap is a great concept, the cap causes municipali-ties to take too much from the fund bal-ance. The Westchester Municipal Officials Association has been working with the New York Conference of Mayors to lobby Albany for more mandate and pension relief.

“How can we find ways to generate sup-plemental revenue without asking the state for more money and asking the taxpayers for more money?” Pilla asked. “We need to make structural changes.”

Despite no mandate relief on the table, Pilla is encouraged that mandate relief will eventually come.

“I am encouraged by state government, but we need to see more,” Pilla said. We need

to look to Albany to make structural changes, pension relief and health care reform.”

The city of New Rochelle has been strug-gling to live within the tax cap since it was enacted. This year, City Manager Charles Strome proposed a budget with a 5.7 percent tax levy increase, blaming the state for sending a bill for pension and health costs double the cap.

“We are starting our budget in an impos-sible situation,” Strome said. “The only alter-native is to propose massive cuts in services and we are not prepared to do that.”

Strome said Albany needs to explore

real pension reform. He proposed making employees pay more into their pensions and no longer allow overtime to be included in pensions. He would also like to see reform done on police and fire disability, which costs municipalities thousands.

“The tax cap was a politically popular piece of legislation,” Strome said. “It makes them look good, but they are setting up people to fail. We have done all the things we can do to comply. We have a hiring freeze, we’ve cut staff, we’ve used too much of our fund balance. There’s nothing left but raising taxes or cutting services.”

Despite the needed reform, Strome is pes-

simistic that Albany will ever pass meaningful mandate relief, especially after hearing Cuomo saying that local governments are on their own.

“I have no confidence,” Strome said. “The best we can do is sink and swim on our own.”

Business groups in Westchester have said that mandate relief is needed if the business community in Westchester is to thrive. Both The Business Council of Westchester and Westchester County Association(WCA) have made mandate relief one of their legislative agendas.

“The cap will be unsustainable other-wise,” Amy Allen, managing director of the WCA said. “A slew of things need to be done or we will live in a community that no one wants to live in. We will have no services.”

Allen said she sees the mandate relief movement gaining momentum.

“It’s bringing together unlikely partners,” Allen said. “You don’t (unusually) see busi-nesses, schools and local governments com-ing together. Hopefully there’s enough noise by constituents that they will pay attention.”

John Ravitz, COO of the Business Council said that the tax cap was a good first step, but that it’s time to get serious about mandate relief.

“Without mandate relief, Albany could cap taxes at 2 percent or 20 percent, it wouldn’t make a difference,” Ravitz said. “We can’t keep waiting on these blue-ribbon panels. We know that mandates are hurting us, we know how we change it and we have to get it done.”

Ravitz said that mandate relief would encourage businesses to come or stay in New York.

Democratic Assemblywoman Sandy Galef is one of the biggest advocates of the tax cap and believes that despite the outcry from municipalities that the tax cap is working.

“It is forcing a more in-depth evaluation of spending,” Galef said. “We can’t continue to have high taxes. It’s causing us to evaluate how we do things. Voters need to speak out and advocate for the programs they believe are important.”

During her time in the Assembly, Galef has been an advocate for sharing services and consolidation. She points to Cortlandt, which has had a self-imposed cap for 20 years by using state and county police and eliminating

the position of highway superintendent.“Their taxes have increased insignificant-

ly over that time,” Galef said. “The cap gives us more of an opportunity to look at doing things together. Without a cap, I don’t know if these things would be considered.”

In Greenburgh, Supervisor Paul Feiner has been living within the cap, though he acknowledged that it is difficult. Greenburgh has reduced employees via attrition and uses the fund balance when necessary.

“It’s always a struggle,” Feiner said. “We are constantly looking for ways to tighten up. Due to pension and health care costs, before you start, you’re close to the cap. It’s really tough.”

Feiner said he doesn’t think the law is successful, since many municipalities have been deferring costs and borrowing to pay for pension costs.

“A lot of these gimmicks will catch up,” Feiner said. “You’re going to have commu-nities charging for sanitation or have more independent libraries. People will end up paying one way or another.”

Galef said the cap is supposed to be tough and hopes it will force municipalities to con-front spending.

“If we let go of the pressure, the urgency to look at sharing services will disappear,” Galef said. “We have to be realistic. A lot of things need to change and this forces the change.”

The corporate merger taking shape this winter between Westchester Medical Center (WMC) in Valhalla and Sound

Shore Health System (SSHS) in New Rochelle represents “the tip of the iceberg” in New York hospital consolidations on the nation’s new health care landscape, a regional hospital executive predicted.

Westchester Medical Center President and CEO Michael Israel said hospital offi-cials should know in about 45 days what structure will best work for the two hospitals, which recently signed a memorandum of understanding to conduct exclusive talks to establish a formal corporate relationship. The hospitals then will apply for a certificate of need from the state Health Department for the consolidation.

The private, nonprofit Sound Shore Health System operates the 252-bed Sound Shore Medical Center and the Schaffer Extended Care Center in New Rochelle, the 196-bed Mount Vernon Hospital and the Hofer School of Nursing at the downtown Mount Vernon hospital. Its operating budget is about $325 million this year, said Sound Shore Health System President and CEO John Spicer.

Spicer said SSHS was “close to break

even” financially in 2011 and will end 2012 with a $3 million to $4 million deficit. The hospital system last spring agreed to pay about $2.3 million to settle the state attorney general’s claims of Medicaid program over-billings at both the New Rochelle and Mount Vernon hospitals, about 60 percent of which has been repaid, said Spicer.

A public benefit corporation, the 643-bed Westchester Medical Center operated on an $871 million budget this year. The advanced care center had close to $5 million in profits in 2011, and expects 2012 to be its sixth con-secutive year of profitability, Israel said. WMC this fall agreed to a $7 million payment to settle claims of Medicaid overbillings for out-patient mental health services brought by the U.S. attorney’s office in Manhattan.

Both the SSHS hospitals, with about 500 physicians, and WMC, with about 900 physicians, are teaching affiliates of New York Medical College, which shares a Grasslands campus with WMC. Spicer and Israel said that is one of several common elements and shared services between the institutions.

“It keeps that continuity in place” for physicians, Spicer said of the shared affili-ation with New York Medical College. “We do a lot of stuff together already,” including neonatal and cardiac catheter services. Both WMC and SSHS use the same emergency

room physician group, he noted.“Our mission of treating everyone who

comes in regardless of ability to pay works well” with the Sound Shore system, which has the same policy, Israel said.

Israel in a joint announcement of the merger talks said the Sound Shore facilities “are critical links to quality care for everyone in southern Westchester, and we are commit-ted to furthering the programs and services that the people of that area have come to expect and rely on.”

Spicer said finding an academic medi-cal center partner has been part of Sound Shore’s strategic planning for about 18 months. Though partnerships with other institutions were explored, “Eventually all roads led to Westchester (Medical Center) for a number of reasons,” he said. “We think it’s very important for this community that it’s a Westchester-based hospital.”

“What you don’t have here is two com-munity hospitals coming together,” said Israel. “This is not a marriage of like entities. This is a very complementary relationship.”

The hospital officials in their joint state-ment said WMC and SSHS will combine their financial resources to “provide a smooth transition toward operational and fiscal sta-bility, consolidated services and necessary infrastructure needs.” Merged operations

later will generate the capital funding to sup-port the combined organizations, they said.

WMC and SSHH are members of the Northern Metropolitan Hospital Association (NorMet). NorMet President and CEO Kevin W. Dahill said the announcement of merger talks was “not a surprise in terms of Sound Shore desiring to get a partnership with someone else.”

“I feel it to be probably the tip of the iceberg,” Dahill said. “I think there’s going to be future consolidations over the course of the next year or two.” With federal health care legislation aimed at lowering costs and improving quality and coordination of care, “Everything that health care is all about points us in that direction.”

Dahill also heads the Nassau-Suffolk Hospital Council on Long Island, where Stony Brook University Hospital, a state facility, is preparing to take over the 168-bed Southampton Hospital. “That’s another example of a large academic center hooking up with another hospital,” he said.

“The day of the standalone hospital, the day of the standalone physician practice, is coming to an end,” said Israel. “They’re becoming more and more scarce.

“The system is changing. What you see going on here is a natural evolution regard-ing two great organizations.”

County cancels gun showAmid protests in the wake of the Sandy Hook Elementary School tragedy, the coun-ty announced it is cancelling a gun and knife show that was set to take place at the Westchester County Center in February.

The Sportsmen Firearm and Knife Show has been running at the Westchester County Center since 2010, when County Executive Robert P. Astorino lifted a ban on gun shows at the County Center that was put in place by former County Executive Andy Spano in 1999 in the wake of Columbine.

“The shows in past years were popu-lar and run in a thoroughly professional manner,” Donna Greene, a spokeswoman for Astorino, said in a statement. “But at this time as the country grieves the loss of life in Newtown, a contract renewal is not appropriate.”

Greenburgh Supervisor Paul Feiner had harshly criticized the county for the gun show, holding a rally in Dobbs Ferry on Sunday.

“Citizens have a right to bear arms and a right to purchase guns from reputable deal-ers,” Feiner said. “But, there is nothing in the constitution that requires governments to allow gun sales at government buildings.”

Greene said that the county plans to review its policies and procedures to see what can be done to prevent more acts of violence.

“The county plans to be fully engaged in the complex and comprehensive conversa-tion of how all Americans can continue to live in an open society while preventing all acts of violence,” Greene said.

sandy sinks factory revenue

New York manufacturers in the metro-politan area estimated a 7 percent decline in normal October revenue and a 5 percent

drop in November revenue from Hurricane Sandy’s disruptions and damage to busi-nesses and supply chains.

The region’s manufacturers, though, expected no effect on net revenue from Sandy in December, the Federal Reserve Bank of New York reported in its monthly Empire Manufacturing Survey.

General business conditions for the state’s manufacturers declined for the fifth consecutive month in December, with a three-point drop on the Federal Reserve index indicating a modest pace of decline.

Of manufacturers surveyed, 15 per-cent said conditions had improved over the month, while 23 percent reported that conditions had worsened.

The Federal Reserve’s new orders index fell seven points to -3.7, indicating a small drop in demand for manufactured goods, federal economists reported. After posting November gains, the shipment index fell six points to 8.8, indicating a slower rise in shipments than the previous month.

Manufacturers again paid moderate price increases in December, while their selling prices were generally flat, the survey found.

Manufacturing employment indexes were negative for the second straight month in a weaker labor market.

Predicting their costs in 2013, manufac-turers surveyed expect an average 7.2 per-cent hike in employee benefits, compared with a 6.4 percent average benefits increase in 2012. They expect their overall costs to increase 4 percent on average, compared with an average 3.7 percent increase in 2012.

Specialty practice, insurer ink network agreement

ENT and Allergy Associates L.L.P. (ENTA), an approximately 130-physician specialty group practice based in Tarrytown, has renewed its health care network agreement with Aetna for a four-year term. The new contract takes effect Jan. 1.

The U.S. News rankings showcase more than 10,000 law firms in 118 practice areas. The White Plains firm, which specializes in elder law and estate planning, was among about 6,000 firms that received first-tier status based on performance ratings from clients and peers.

New York Life Foundation grants nonprofits $300K

The New York Life Foundation gave $300,000 worth of grants to six Westchester nonprofit organizations. The nonprofits are dedicated to young people, specifically in need of educational enhancement.

Since 2004, the Foundation has distrib-uted grants amounting to more than $2 million to Westchester-based nonprofits.

The organizations that received grants include Girls Inc., which received $60,000, and Westhab, which received $85,000 to help fund support STRONG (Students Taking Responsibility & Ownership Now & Graduating). Other recipients received the second installments on multi-year grants include Family Services Center of

Westchester, The Youth Shelter Program of Westchester, The Volunteer Center of the United Way and Today’s Students Tomorrow’s Teachers.

Green nutrient for state’s specialty crops

The U.S. Dept. of Agriculture has awarded $1 million in block grant funds to New York for research, development and promotion to boost the market competitiveness of the state’s specialty crops. They include fruits and vegetables, tree nuts and nursery crops.

Gov. Andrew M. Cuomo in announc-ing the award said $200,000 of the federal funding will help support the growth of the state’s wine, beer, and spirits industry. The governor in October hosted the state’s first wine, beer and spirits industry summit in Albany.

Most of the funds will go to Cornell University in Ithaca and Cornell Cooperative Extension county offices across the state.

Storm’s aftermath may help casino expansion

Hurricane Sandy could help the movement to expand casino gambling in New York state. The economic losses resulting from the storm have opened the door, according to proponents who claim gambling could give the state a much needed economic boost.

New York lawmakers are poised to con-sider an amendment to the state constitu-tion on gambling in the new year. The state has appealed to Congress to get a $42 billion relief package to help recovery efforts. Also, New York has continued to feel the lingering effects of the down economy.

All that sets a tone, according to Sen. John J. Bonacic, chairman of the Senate Committee on Racing, Wagering and Gaming. Bonacic reportedly said he thinks lawmakers may now be willing to approve an amendment next year, although there is some uncertainty over how New Yorkers will vote.

The re-election of President Barack Obama could have significant impacts on energy and environment

regulations. Experts discussed the potential effects

at “Energy and the Environment: Likely Winners and Losers in the Second Obama Administration,” a Dec. 14 event hosted by the Association for Capital Growth at Castle on the Hudson in Tarrytown.

Norman Bernstein, a member of law firm N.W. Bernstein and Associates L.L.C. in Rye Brook, said the Obama adminis-tration postponed environmental regula-tory actions, such as tightening the National Ambient Air Quality Standards (NAAQS), until after the election.

The NAAQS regulations may be expen-sive, with projected costs of $19 billion. In July 2011, the Environmental Protection Agency (EPA) proposed an 8-hour primary ozone standard at .07 parts per million as well a seasonal standard to protect veg-etation and ecosystems. The Clean Air Act requires the EPA to set NAAQS for ozone and other pollutants considered harmful

to public health and the environment, and requires the EPA to periodically review the standards and update them as necessary.

“The Clean Air Act has been construed by the courts to require establishing NAQQS based only on health considerations, without regard to cost or feasibility,” Bernstein said.

Bernstein said he expects the regulations to be adopted by the end of 2014.

New regulations under the Clean Water Act limiting how many fish can be killed might also be put in place during Obama’s second term. The regulation will affect 1,260 existing facilities, including the paper, chemicals and steel industries. Facilities that withdraw at least 125 million gal-lons of water per day would be required to conduct studies on controls required to reduce aquatic organisms sucked into cool-ing water systems.

Bernstein estimates the rule would cost $181 million for manufacturers. Violating the Clean Water Act could cost $37,500 per day.

Thomas Fogarty, an energy restructur-ing and investment consultant, said while big companies have been here before, this could have a negative impact on smaller companies trying to comply. Many smaller

companies are being bought out and shut down.

Hydrofracking has become another hot-button issue, particularly in New York state, where natural gas companies are anxious to drill the Marcellus Shale formation despite public opposition.

The EPA’s Office of Research and Development is conducting a study on hydrofracking and its potential impacts, with a final draft for public comment and peer review expected in 2014.

In October 2012, an EPA law went into effect regulating air pollution from hydro-fracking operations. The panelists said that debating hydofracking is often difficult due to the emotion involved.

“It completely dominates the discus-

sion,” said Andrew Revkin, a former New York Times environmental reporter. “I was almost booed off the stage at Cornell. People like Sean Lennon and Yoko Ono don’t want their Catskills views ruined by trucks. How do you sustain energy independence? When it is in abundance.”

Other panelists defended fracking and said it would benefit an impoverished area like upstate New York, noting how well central Pennsylvania is doing since fracking was allowed.

“Is fracking completely safe? No,” Bernstein said. “Is coal safe? There is no completely safe way to get all the energy you need. The risk is irrational, it’s people with not in my backyard fear. It was the War on Coal and now it’s the War on Fracking.”

ted not only the lowest price for the pro-posed project but also the best value, Thruway officials said. Of three competing bidders, the consortium proposed the shortest project completion time – 5 years, 2 1/2 months – and the least environmental impact on the Hudson River, with approximately 951,000 cubic yards of dredging.

With state officials estimating an additional $500 million to $800 million in project costs on top of the base construction contact, the bridge replacement could cost $1 billion to $1.5 billion less than the state’s previous $5.2 billion estimate. Thruway Authority Executive Director Thomas Madison said he hoped to realize $2 billion in project savings compared with initial estimates.

The winning consortium outbid Tappan Zee Bridge Partners, a joint venture of Bechtel Infrastructure Corp. and Tutor Perini Corp., which proposed a $3.99 billion project, and Kiewit-Skanska-Weeks Joint Venture, with a high bid of $4.059 billion.

Tappan Zee Constructors is a consortium of Fluor Enterprises Inc., American Bridge Co., Granite Construction Northeast Inc., and Traylor Brothers Inc. An industry source said state offi-cials between now and February will negotiate final terms with the consortium and a contract could be signed by February or early March.

Leading the design-build team is Fluor Corp, a publicly traded international con-struction company headquartered in Irving, Texas that reported $23.4 billion in revenue in 2011. The company has a 30 percent owner-ship stake in the Tappan Zee joint venture.

Fluor spokesman Keith Stephens called the Thruway Authority award “an important and huge step ahead, and we’re excited to get started with our team that has a great heritage of building bridges in this country and is look-ing forward to tackling this project.”

Milstein joined business and political leaders in praising Gov. Andrew Cuomo as the prime mover behind the challenging bridge project after what the Thruway chairman called “12 years of dysfunctional inaction” in Albany. Cuomo one year ago persuad-ed state lawmakers to adopt his New York Works Infrastructure Fund Act, which permits

design-build contracts on bridge and other infrastructure projects for the first time in state history, bundling design and construction ser-vices in one contract and shifting most project cost overruns from the state to developers. He also has led the state’s effort to obtain a federal loan to finance the project.

The Tappan Zee design-build “is seen as a model for how mega-projects should be run,” said Milstein. “This is such a wonderful expression of what government, using private sector dollars, can do rapidly.”

The state still does not have project financ-ing in place, which is needed before Tappan Zee Constructors can start work next year. The 3.1-mile, twin-span bridge is scheduled to open in 2018, replacing a 57-year-old Tappan Zee span crossed by about 138,000 vehicles daily.

Ross J. Pepe, president of the Construction Industry Council of Westchester and Hudson Valley Inc. in Tarrytown, said 3,000 to 4,000 con-struction jobs will be at the Hudson River cross-ing and two landing sites over the five years of the project. “There will be many hundreds, if not thousands more in the region that will be provid-ing services and materials to the project,” he said.

Pepe said the region’s building trades unions “across the board” are down about 45 percent in work hours and employment num-bers from peak years. “It’s been much longer than the previous downturns that we’ve experi-enced in the past two or three decades,” he said.

The Tappan Zee project “is a real boost to the economy and the industry,” said Pepe, whose trade organization represents about 500 companies in the region. “We’re looking for this to be a real opportunity for turning around the economy in a whole new direction from the past five years.”

The Business Council of Westchester President and CEO Marsha Gordon said the organization will be “a bridge” between the Tappan Zee contracting team and Business Council members and plans to host meetings where members can explore business oppor-tunities with bridge contractors.

Design subcontractors for Tappan Zee Constructors include Savin Engineers P.C., an approximately 130-employee engineer-ing firm in Pleasantville, and Hudson Valley Engineering Associates P.C., a Beacon consult-ing company that focuses on federally aided state and municipal construction projects.

Office provider passes leasing milestone

Stark Office Suites has signed a 10-year lease extension at its White Plains head-quarters while passing the 100,000-square-foot mark in its rapid metropolitan expan-sion.

Founded in 2004 by President Adam J. Stark, the provider of turnkey executive offices and virtual office services also has leased a third floor for its 3-year-old opera-tion in One Grand Central Place at 62 E. 42nd St. in Manhattan. Occupying 38,914 square feet of space in the midtown tower, Stark Office Suites will offer 24 offices, four conference rooms and several workstations to professionals and entrepreneurs in its new 40th-floor space.

At its company’s 445 Hamilton Ave. headquarters in downtown White Plains, Stark added 1,700 square feet when extend-ing its lease to 2022 with landlord Heyman Properties L.L.C.

The company has more than 500 cli-ents, who have use of conference space in all Stark Office Suites locations in New York City, Westchester County and Stamford, Conn.

The company’s other Westchester offic-es are at 100 S. Bedford Road in Mount Kisco and at 2 Overhill Road in Scarsdale. The Stamford office is at 243 Tresser Blvd.

“Surpassing the 100,000-square-foot mark is a big milestone for us and we are extremely excited about our continued growth,” Stark said in a press release. “The most gratifying portion of our growth has been our ability to retain and grow so many of our client relationships over the years.”

Apartments to rise where school razed

Demolition work has begun at the site of a $58 million development to replace a long-vacant Yonkers public school with a 121-unit mixed-income apartment complex for families and senior citizens.

Yonkers Mayor Mike Spano and state officials recently joined officials from The Community Builders Inc. (TCB), the proj-ect’s nonprofit developer, and the Yonkers Municipal Housing Authority for the start of demolition of Public School 6 at 33 Ashburton Ave. The deteriorated school will be replaced by Schoolhouse Terrace at Croton Heights.

The project, to be built according to environmental sustainability standards, will include a 70-unit building for fami-lies earning under 30 percent of the area median income (AMI) to under 60 percent of AMI. A 50-unit building will house senior citizens earning less than 50 percent of AMI. The new buildings will sit atop two underground garages with 134 park-ing spaces.

Jan Brodie, Northeast regional direc-tor for TCB, said the developer “is commit-ted to creating mixed-income housing as a platform for opportunity in Yonkers.” The project, financed in part by TCB’s neigh-borhood stabilization program funds, is scheduled for completion in 2014.

Also financing the project are state and federal agencies and their funding pro-grams and banks that include RBC Capital, The Bank of New York, M&T Bank and Federal Home Loan Bank of New York.

The project has been awarded two state grants totaling about $2.5 million for demolition at the brownfield site and $600,000 in low-income housing tax cred-its from the state Homes and Community Renewal (HCR) agency.

Darryl C. Towns, HCR commissioner and CEO credited the governor-appoint-ed Mid-Hudson Regional Economic Development Council for its award of “criti-cal financing” for the Yonkers redevelopment.

I keep getting into cash crunches. I’ve been

paying off loans. Sales look good. But now it

looks like I might have spent too much on improvements and I’m wondering if my contracts are as profitable as I thought they

were. What should I do?ThouGhTS oF ThE DAy: Know you’re not alone. Cash is king. Figure out the dif-ference between invoicing, cash coming in, expenses and cash going out. Get an accurate picture and keep a lid on the extras.

Most business owners have a hard time predicting and managing cash flow. There are things you can do to see things more clearly. First and foremost, prioritize cash reserves.

Don’t pay off loans too quickly. I know interest on deposits is close to zero and inter-est charged for credit card debt and bank loans is much higher. Keep the company safe if things go wrong by having extra cash on

hand. Until then, think of loan interest as a cost of doing business. Putting $1 toward cash reserves as you put $1 toward paying down debts allows you to accomplish a little bit of both.

Keeping track of cash flow is very differ-ent from looking at what’s on a profit and loss (P&L) statement. The P&L might show your company has a great net income, when the actual cash picture is much less rosy. Changes to accounts receivable and accounts payable, bank account and loan principal balances can all impact cash without showing up on the P&L.

Look for cash flow shortfalls. List imme-diate and upcoming expenses. Realistically plan out customer payments. Add up old bills waiting to be paid. Compare money coming in and going out.

If you see shortfalls coming, you can do a few things. If you have extra capacity, sell into it. Cut back on unneeded expenses. Ask employees to use vacation when you’re slow. If you have to invest in equipment and materials well in advance of getting paid by clients, talk to your vendors about spreading

out payments. Term out credit lines. Make sure every contract is profitable by including the cost of financing.

Many times owners accelerate spending at year end in order to save on taxes. Forget it. There’s no telling what might happen in the first quarter. And you’re not going to save that much on taxes by tying up precious funds paying for expenses you didn’t need to make. If you’re tight on cash already, trying to save a few tax dollars by spending three or four times what you’re going to save makes no sense.

Make sure you have a good handle on accounts receivable. When you’re tight on cash it’s possible your clients might be in the same boat. That means they’re juggling who to pay and who to delay. Make sure your company gets paid sooner rather than later.

Have a good accounts receivable system. As soon as invoices go out, call the cli-ent’s accounting department to verify they received the bill. Find out how long they take to process checks and hold them to it. Focus on collecting accounts that are over 45 days past due.

If someone needs to authorize payments, email invoices directly to that person. Agree on how long they’ll take to approve the bill. Better yet, set terms in your contract that define approval and payment timing. That gives you something to go by when it comes time to collect.

Be willing to be pushy and demanding. Don’t relax with existing customers. They can hold back funds just like new custom-ers do.

The Senate vote that would ulti-mately end the Transaction Account Guarantee (TAG) program came as

a bit of a surprise to those who lobbied for the program to be extended. Despite a major push from bankers and bank associations, the Senate voted Dec. 13 against preserving the program that has provided unlimited insur-ance for noninterest-bearing bank accounts.

The issue over whether to keep the TAG program, which covered accounts over $250,000, or let it lapse had been a debate within the banking industry for some time. The program was enacted in October 2008 during the financial cri-sis that drove the nation into the Great Recession. It was extended and revised in 2010 as the economic recovery that fol-lowed the recession lagged.

Some in the banking industry believe the economy is still trying to recover and for that reason many banks and banking associations lobbied for a second exten-sion. “We debated and discussed this issue last summer,” said Michael Smith, presi-dent of the New York Bankers Association. Smith had hoped a decision to extend the program would have been made then. “We

recognized at the time that it was always designed to be temporary, but that during this time of recovery and rebuilding it was appropriate to extend the program.” Not everyone was on the same page.

One of the obstacles proponents of the TAG program faced in gaining enough support was the Congressional Budget Committee’s determination that the price for the program was too high. Republicans argued against the extension safety net because the legislation would in turn violate constraints on spending for financial services legislation. Conservative opponents also associated the program with the federal bailouts handed out in 2008 and 2009, further insisting the bank-ing industry had weathered that storm.

The cost issue raised by the Budget Committee has been divisive, with some arguing the committee didn’t really estab-lish who was paying for it. “The TAG program has been funded by the banks by increased premiums to the FDIC so it’s unclear certainly to the banking industry,” said John Tolomer, president and CEO of The Westchester Bank. “I think perception may be in the marketplace that it is a gov-ernment program and that it’s a handout to banks but in fact it’s a program that the banks paid for.” Tolomer added that

for many banks, like his, the premium increase was worth it. But their battle would remain uphill.

Some bankers couldn’t understand the FDIC’s lack of involvement in the debate. Smith said the federal bank insurer did an “objective study on the program” and inevitably left the fate of the TAG program in the hands of Congress. In a statement released by the FDIC, Andrew Gray, deputy to the chairman for communications, said “TAG was extended by statute through the Dodd-Frank Act and the FDIC has tradi-tionally deferred to Congress in deciding appropriate deposit insurance limits.”

Looking ahead, the industry is hoping for minimal impact once the TAG pro-gram officially ends Dec. 31. On that day, the Independent Community Bankers of America, which represents approximately 5,000 small- and mid-sized financial insti-tutions, notes that more than $1 trillion in TAG deposits will become uninsured. Tolomer said many customers with large sums in their accounts may pull their money and distribute their funds to a variety of FDIC-insured banks. For his clients, he insisted “The Westchester Bank is well positioned” so there is essentially “no reason for anyone to take any money out of our bank.”

Smith said despite that missing layer of protection for accounts, “The indus-try is well capitalized right now and it’s strong in New York particularly,” adding

“people should feel very safe with their money in the bank and I think that’ll be the message you’ll hear going forward.”

More than a decade ago, chef and restaurateur Rafael Palomino came to Port Chester. He’d

established a boast-worthy reputation in Manhattan in the late 1990s after opening the original Sonora there, but he recog-nized the expense of the city as a challenge.

Palomino wanted to look at places closer to his new home in Bedford. “When I start-ed there, I was nothing there,” Palomino recalled. “I was coming from New York City and (Port Chester) was dead, not appealing at all.”

Palomino couldn’t afford Greenwich, but wanted a more affordable location that welcomed diversity. “Port Chester had at the time 25 to 30 restaurants – there was a small number (and) no dynamic. I took a chance.” It paid off: Today, Sonora is one of the cornerstones of Port Chester that recognizes itself as “The Restaurant Capital of Westchester County.”

Port Chester is home to 140 restau-rants, according to Mayor Dennis Pilla’s office. The diversity of eateries is also a calling card. Sonora offers Latin fusion din-ing; Tandoori: Taste of India has authentic Indian cuisine; there are several Mexican restaurants, including El Tio and Coyote

Flaco; and Italian cuisine is well repre-sented.

“All kinds of restaurants started coming to Port Chester about 10 years ago,” said Ken Manning, executive director of Port Chester-Rye Brook-Rye Town Chamber of Commerce. “It’s all thriving; everyone is thriving from what we hear. You can’t get through Main Street and that means busi-ness is good.”

Business has been good for the Italian eatery Tarry Lodge as well. The restau-rant has been a mainstay in the village of Port Chester since 1906. In 2008, partners, including famed chef, author and television personality Mario Batali, award-winning chef Andy Nusser, wine-maker and restau-rateur Joe Bastianich, and award-winning wine steward Nancy Selzer, bought Tarry Lodge.

“We are a restaurant group that is based in New York, and most of our restaurants are in Manhattan with a few exceptions,” said Selzer. “One of our main partners, Joe Bastianich, lives in Greenwich (Conn.) and was drawn to this building because of its historical significance. It’s always func-tioned as some sort of restaurant. It was a speakeasy at one point in time.”

Selzer said expanding to Port Chester proved to be a good move. It’s in a con-venient spot for Westchester residents,

patrons in New York City and those across the border in Connecticut. Tarry Lodge also benefits from the restaurant culture that feeds the larger community atmosphere, Selzer said.

Palomino agrees the dynamic that

exists among eateries in Port Chester also embraces those outside the industry. When he came to the village, Palomino began not only to build his business but also relation-ships. He’s been a board member of Don Bosco, a community center established in the village in 1928. Just last year, Palomino

helped promote the center’s annual Fusion of Flavor, a fundraiser that highlights area restaurants and in turn raises money for Don Bosco, focusing on helping youth and embracing the immigrant population in Port Chester.

According to Father Richard Alejunas, executive director of the center, 28 res-taurants participated last year. This year, that number went up to 48, including Palomino’s Sonora and the Tarry Lodge. The restaurant culture has not only helped the center but provided inspiration.

“We are doing a building expansion, which will include a culinary school,” said Alejunas. “It has been a part of the fund-raising.” The cost of the building project is estimated to be $2 million and recently the center received a $1 million gift from a private donor. Alejunas said a quarter of the building facility will be dedicated to the new culinary school and Palomino is going to help outfit its kitchen. The center is expecting to break ground for the expan-sion in April 2013.

Both men say the building expansion and culinary program is important to the culture of Port Chester and its identity as a food-lovers destination. Palomino said it’s something to be proud of. “I think we have everything going on. That makes Port Chester dynamic.”

The Hudson Valley region won big this year with $92 million in economic devel-opment funds for 84 projects.

Some of the top award winners in the region are:

1. $1.2 million for the construc-tion of a mile-long Hudson Landing Promenade straddling the Kingston and Ulster munici-pal boundary on an old industrial site.

2. $3 million to Marist College in Poughkeepsie to establish the New York State Cloud Computing and Analytics Center that will facilitate operations for technology-based firms by providing workforce training and reducing overhead.

3. $2 million to develop the closed Harlem Valley Psychiatric Center in Dover, including upgrading the Harlem Valley-Wingdale train sta-tion, retail, a golf course, commu-nity center and 200 housing units.

4. $775,000 to Newburgh-based Hudson Valley Pattern for Progress to create the Hudson Valley Food Hub. The organization will pro-vide processing and marketing opportunities to farmers and other food producers. The state said this will help retain and stimulate the farming community.

5. $500,000 to Matrix Distribution Park in Newburgh, a manufactur-ing/distribution facility. The goal is to attract a Fortune 500 compa-ny to the park, at the intersection of I-84 and I-87.

6. $1 million to Touro College to use the vacant Horton Hospital in Middletown to house an osteo-pathic medicine school. The state said this will bolster medical pro-fessionals in the Mid-Hudson.

7. $1 million to New York Medical College, in Valhalla, to build an iBio Incubator that will provide office and laboratory space for entrepreneurs and start up bio-tech companies and provide spe-cialized workforce training for established biotechnology com-panies in the region.

8. $1 million to the develop-ers behind the preservation and development of the 1904 Glenwood Power Plant in Yonkers to develop the closed plant as a mixed-use development.

9. $1.5 million for the Echo Bay mixed-use development on the Sound Shore waterfront in New Rochelle.
