The U18 Coca-Cola Craven Week (8-14 July) is widely recognised as the most iconic school rugby tournament in the world, and also a passage into professional and representative rugby. “The Craven Week is a huge stepping stone for many play- ers and we regard this youth week as the corner stone of rugby. It is also fit- ting to have this tournament here in the true rugby heartland of South Africa,” Khaya Mayedwa from the South African Rug- by Union (SARU) said. Statistics show that 40% of current South African rug- by players playing in the Super Rug- by series this year hail from the East- ern Cape. For the second consecutive year a rugby player from THS Daniel Pien- aar will captain the U18 Craven Week team. Aid- on Davis will lead the Craven Week team – he also captains the Daniel Pienaar 1st rugby team. Justin Benn, also from Daniel Pienaar, last year captained the U18 Craven Week team. After 12 years, the Nelson Mandela Metro will again play host to this an- nual schoolboy rugby showcase – this time in the Nelson Mandela Bay Stadi- um. The tournament was last held in Port Elizabeth back in 2000 at the former Telkom Park. A new mini library or “minilib” forthe blind and visually impaired hasopened its doors at the Elukhanyiswe-ni Public Library in KwaNobuhle.
“This will open up new avenues forblind people,” says Xolisa Yekani,chairperson of the South AfricanCouncil of the Blind who attended thelaunch of the minilib.
It is part of a project which has seen11 public libraries throughout theEastern Cape being provided with fur-niture, equipment and training to en-hance accessibility to the visually im-paired. Another seven are plannedfirst in the province and then the restof the country.
These libraries include a text read-er, a computer for access to online re-sources, and material supplied by theSA Library for the Blind.
According to project coordinator,Pumla Mahanjana, the Minilib projectwas initiated as a result of the need forvisually impaired individuals to haveaccess to library and informationservices.
“The visually impaired have a con-stitutional right to access these servic-es. The pilot project in the Eastern
Cape has been so successful that weare hoping it will eventually be rolledout across the country.”
Each of the identified libraries hasbeen provided with furniture andequipment to aid visually impaired in-dividuals.
“Equipment includes audio read-ers, document readers, computer soft-ware, Braille books and other servic-es,” says Mahanjana.
“Not only does this open up opportu-nities for the visually impaired, it alsoassists those that are illiterate to bene-fit from the service.”
Staff at each library are trained toassist users of the equipment, and toidentify individuals who could benefitfrom the equipment.
Public library workshops are alsoheld for members of the local commu-nities in order to train them on theequipment, as well as to raise aware-ness of the facilities available.
“The communities have welcomedthe minilib projects and we have hadgreat feedback from everyone who hasmade use of the facilities.
“We are very excited about the fur-ther rollout of the project throughoutthe rest of the Eastern Cape, and hope-fully into the rest of the country in thenear future,” says Mahanjana.
SThe minilibs is a joint project be-tween the Eastern Cape Provincial De-partment of Sports, Recreation, Artsand Culture: Library Services and theSouth African Library for the Blindand was launched at the HumansdorpPublic Library in 2010.

Two armed criminals were each sentencednine years imprisonment for robbing an elder-ly man from KwaNobuhle of his cell phone,cash and stationery.
The accused, Sakhive Joseph (20 years) andUnathi Goba (21) pleaded guilty at the Uiten-hageMagistrateCourt of robbingaKwanobuh-le man at knife point in January 2011.
According to police spokesperson Lt Col Pr-iscilla Naidu, the elderly man was walking inthe street when at about 17:00, five men sur-
rounded him and robbed him of his cell phone,cash and stationery.
“The man managed to stop a passing policevehicle and reported the incident. Two of thesuspects were arrested,” said Lt Col Naidu.
The accused remained in police custody un-til the finalisation of the case.
“The safety and security of our citizens is apriority and convictions such as this strength-en the community’s faith in the local police,”said Lt Col Naidu.
Armed robbers behind bars
Uitenhage police would like to warn the publicnot to fall prey to a ”Wendy House” scam.
According to police reports people are re-sponding to a pamphlet about the purchase ofWendy Houses. The advert has a contactnumber and name of a person.
“Two cases of fraud are under investigationby police. In both cases, the complainants al-leged that they spoke to a man named ‘Kobus’,as per the advert. He informed them that anamount of R1 200 must be deposited into a mon-ey market account at Shoprite,” said policespokesperson Lt Col Priscilla Naidu.
“Both complainant’s made the deposits and
when the wooden structures were not deliv-ered they contacted ‘Kobus’. He informedthem a that a further R1 200 must be depositedas the first deposit was only for transport.”
One of the complainants offered to fetch theWendy House, but found out that the name “So-lutions Wendy House” does not exist. The com-plainants reside in Rosedale and Kamesh.
Police are warning the public that this is ascam and that no deposits must be made with-out receiving any goods purchased.
“It is believed that this pamphlet has beendistributed in the Uitenhage, Kamesh and Des-patch areas,” said Lt Col Naidu.
Wendy house scam hits town
A stern warning is sent out by the police to allteenagers and young adults to be vigilant offriends they meet on the social networks.
This follows an incident where a Port Eliza-beth teenager alleged that she was raped by aman named “Kobus” whom she met on the so-cial network “Mixit”.
Uitenhage Family Violence, Child Protec-tion and Sexual Offences (FCS) Unit is investi-gating a case of rape.

“Daar is ouer pyporrels in die land, maarhulle is as geheel vanuit die buiteland bestelen ter plaatse opgebou. Dit maak hierdie Lau-terbach ‘n belangrike erfenisobjek,” het Johan
Strydom, mede-eienaar van Shamrock Kapelin Sunland gesê.
In onderskeidelik 1867 en 1871 land tweeDuitse broers, Johann Lauterbach en JohannAdam Lauterbach in Port Natal aan boord vandie Kandaze, ‘n sendingskip uitgestuur deurdie Lutherse Sendingmissie in Hermanns-burg. Hulle vestig hulle aanvanklik inHermannsburgwaarhulle, rondom1871, beginbou aan ‘n pyporrel.
“Na voltooiing van die orrel in ‘n skuur opdie plaas buite Wartburg, word die orrel nameer as 25 jaar aan die Lutherse Kerk in Wart-burg verkoop. Vir 102 jaar is hierdie gemeentedie tuiste van die Lauterbach-orrel,” het Stry-dom gesê.
In 2011 begin die gemeente met onderhande-linge om die orrel met ‘n groter instrument tevervang en word die Lauterbach-orrel aan Jo-han Strydom en Lukas Coetzee, eienaars vanShamrock Kapel, geskenk. Die orrel is verledeNovember in Wartburg afgetakel en na dieOos-Kaap vervoer waar die nodige restoura-siewerk gedoen is.

A record of more than 46 000 people streamedinto the Sundays River Valley this weekend forthe 11th annual Absa Kirkwood Wildsfees.
“It exceeded all expectations,” said Wilds-fees director Jenni Honsbein.
“We know that the economy continues to betough, and in recognition of that we decidednot to increase entrance or stallholder fees thisyear. The public responded in their thousands,and we thank everyone for their support.
“It shows that the Absa Kirkwood Wildsfees,with its unique mix of entertainment, stalls,expos and shows has firmly established itselfas one of the premier festivals in South Afri-ca,” said Honsbein.
The festival is hosted in association withDStv and Carmen Bennett from this multi-channel digital satellite television service said“The annual Absa Kirkwood Wildsfees pro-vides a fantastic platform for tourism, wildlife
and environmental conservation in the East-ern Cape.”
One of the highlights of the festival was theannual Absa Kirkwood Wildlife Auction,which this year turned over more than R11-million. The top price paid was R360 000 for abuffalo bull, while a family of sable antelopewent for R900 000. A white impala ewe was soldfor R260 000.
Absa Kirkwood Wildsfees provides tempo-rary work for over 350 people and generates aturnover of R19 million for the area.
“All profits are subsequently invested incommunity-based projects, making it an eventthat gives back in a very real way,” said Hons-bein.
The festival is the first major festival inSouthAfrica tobewheelchair friendly. It’s alsoone of the first South African festivals to gogreen, according to Honsbein.

The Uitenhage Lions Club winter jer-sey campaign is now in its fifth yearand during this period they havedonated approximately 800 jerseys to25 local schools.
According to Lion Denis Murphy,
all donations have been aimed at “nofees” schools with learners residing inhigh umemployment areas within thecommunity.
Funding for the winter jersey cam-paign is derived from the Lion Rallywhich is now in its 19th year.
“Without the biker and local busi-ness support the project would not
have been possible. The Uitenhage Li-ons Club wishes to thank theseloyal supporters for their continuedparticipation,” said Uitenhage LionsPresident Bomma Woest.

Being a caretaker is not always easy,but John Masipa did an excellent jobat the Allanridge Civic Centre. Tosuch an extent that the local gospelartists in the community are organis-ing a concert honouring him for hisdedication.
“We as gospel artists have decidedto give ‘Oom John’ a benefit concertto say thank you for his 28 years ofexcellent service to our community,”said pastor Georgen Miggels.
Masipa is the first caretaker at theAllanridge Civic Centre and he assist-ed with the first ever gospel concertpresented at the centre, when inter-national artist Waltor Brown visitedthe town. It was organised by ColinAgulhas and the late pastor LevyMiggels.
“Since then the civic centre be-came famous for its acoustic, neat-ness and friendly staff. Artists like
Ricardo, Inspirations, Felicia Mari-on, Venill D and many others haverubbed shoulders with ‘Oom John’.I’m sure they will agree that theyhave never met a caretake like him.
“He will be retiring soon and wewill surely miss him,” said pastorMiggels.

THERE is just a week to go tothe highly anticipated 30thrunning of the annualVolkswagen Rally which
starts in Uitenhage.
The event, round number four onthe 2012 South African national rallycalendar, is shaping up to be an in-tense battle between the top five com-petitors in the S2000 class.
Just ten points separate these firstfive teams which comprise Ford,Toyota and Volkswagen entries mak-
ing it a tough three-way battle thatwill take place in the Eastern Cape.
With nearly 200 km of competitiondistance and 12 stages of rallying thatwill take place over the two days (Fri-day and Saturday, 13 and 14 July) onboth gravel and tar, the rally compet-itors are going to have to keep theirwits about them.
The home team for this event, theBP Volkswagen Rally Team, will beshowcasing their new BP Volkswa-gen Polo S2000 at the VolkswagenRally with a traditional three-car en-
try in the category.It is also the first outing in the
Eastern Cape for the newest mem-bers of the team, Hans Weijs juniorand Björn Degandt.
Despite being new to the SA rallyscene – they have competed exten-sively in Europe – the pair haveproved a formidable combinationand currently hold fifth place overallin the championship standings.
In keeping with the tradition ofmaking the Volkswagen Rally asspectator-friendly as possible, there
are good spectator points identifiedfor the event and these will bemarked in the spectator guide whichwill be available just before the eventtakes place.
Additionally, there are a numberof activities planned for the finalstage at Kings Beach on Saturday.
While the rally action takes placeon the planned stages, those enthusi-asts who cannot travel to follow theroute can visit the stage at the KingsBeach parking lot.
Here there will be static displays
and stalls as well as karting displays,street rods, the Xtreme Veedubzclub, the Dunlop Drifters and eventhe Nelson Mandela MetropolitanUniversity students showing offtheir Formula Student entry. Thesedisplays will include both static and“laps” of the planned rally stage.
The day’s activities at this pointwill reach their highlight when thenational rally field arrives to contestthe final stage in spectacular tarmacfashion and this will be followed bythe event prizegiving.

This week a reader who is leasing a retailshop asks the Property Poser panel wheth-er his landlord can compel him to buy themajority of his stock from the latter’swholesale distribution business.
Because it forms part of his rental agree-ment, the reader would like to know whethersuch a clause could be challenged.
There are two main issues to be consideredhere, says Rian du Toit from DTS Attorneys inNelson Mandela Bay.
“Firstly, whether such a clause is valid inour law and, secondly, whether the tenant canchallenge such a provision in his rental agree-ment.”
Du Toit says South African law subscribesto theprinciple that people are free to enter intoany lawful contract they wish.
“Conversely, any unlawful term cannot be avalid clause of a contract and, as a general prin-ciple, agreements that are contrary to publicpolicy will not be enforced.”
When it comes to public policy, the interestsand considerations of the public are of para-mount importance, says Du Toit.
“The doctrine of freedom of contract is basedon the premise that both parties hold a positionof equal bargaining strength and that they arefree to accept or reject any terms.”
Therefore, says Du Toit, the courts will notinterfere lightly with the contractual provi-sions agreed to, however harsh they may be.
“This means that our reader may now havedifficulty in convincing a court that he mustbe excused from his responsibilities in termsof the contracthe concludedwithhis landlord.”
That being said, if the lease was concluded
on or after April 1 last year, the Consumer Pro-tection Act may affect the decision regardingthe inclusion of the clause, says Du Toit.
The aim of this act is, among other things,to promote fair business practices and protectconsumers from unfair, unreasonable, unjustor improper trade practices, says CharlotteVermaak from Chas Everitt in the metro.
However, says Vermaak, the reader was cer-tainly not forced to enter into the agreement.
“He could have elected to contract with an-other landlord or he could have negotiated oth-er, possibly more favourable, terms to the
agreement.”According to Vermaak, this becomes clear if
one considers the reverse of his current situa-tion. “What if the supply of stock was beneficialto him in that he acquired the goods at belowcost prices?
“What if the landlord wanted to renege fromthis agreement since it was no longer benefi-cial to him? Surely the reader would then haveliked to keep him bound to the terms of the con-tract.”
An aspect for the reader to consider is wheth-er he knowingly agreed to the provision or
whether he was labouring under some misun-derstanding or misinterpretation, says Ver-maak.
“Because this provision carries such impor-tance, it could be argued that it is a materialterm of the contract and that consensus by thetwo parties is absolutely necessary.”
Although it seems irrelevant in this in-stance, Vermaak says the reader could alsoseek legal advice on the circumstances underwhich a contract could be void.

The tariff increases of 13% for refuse removal,sanitation, property rates andwater came into ef-fect on July 1.
Therewasalsoasharpincrease intheelectrici-ty rates. These are based on a sliding scale thatiscalculatedaccordingtoresident’senergyusage.
According toCarléRitter-Erasmus, theMetro’sacting communications manager, the rate in-creases are necessary to deliver services andshould improve service delivery.
KobusGerber, chairmanof theMetroRatepay-ers Association, however, believes that residentsare being exploited at the expense of politics.
He said the metro can save millions if they cutunnecessary internal spending, such as politicalappointments. He gave an example of the chiefwhip who earns a salary of R3,6 million a year.
“The mismanagement of the municipality isplacing the consumer under unnecessary pres-sure. They are already under enough pressure asit is with the condition of the world economy andhigh petrol prices, to name a few,” said Gerber.
Leon de Villiers, DA caucus leader, saidthe party was concerned about the metro’shigh level of debt.
“The rate increase will result in the ratepayernot paying for service delivery, but rather themetro’s debt,” he said.
“The metro cannot borrow any more moneyand it will take them approximately 20 years topay off the debt.”
The metro is also burdened by unpaid ac-counts. According to Ritter-Erasmus, the rate-payers owe the metro approximately R1,2 bil-lion. Domestic debt amounts to R900 million,businesses owe R217 million and the govern-ment owes the Metro R40 million.
De Villiers said the DA was also deeply con-cerned about the fact that the Metro only budget-ed for one month’s cost coverage.
“In thecaseofacrisis, themunicipalitywillon-ly have enough money for 20 days and it is sup-posed to be three months.”
