(P&E)/Nodal Officer (PMFBY), Krishi Bhavan, Tonca, Caranzalem-Goa Wherever the yield estimates reported at Insurance Unit (IU) level are abnormally low or high vis-à-vis the general crop condition, the Insurance Company (IC) in consultation with State Government can make use of various products (e.g. Satellite based Vegetation Index, Weather parameters, etc.) or other technologies (including statistical test, crop models etc.) to confirm yield estimates. If Insurance Company witnesses any anomaly/deficiency in the actual yield data (partial/consolidated) received from the State Government, the same shall be brought into the notice of State Department within 7 days from date of receipt of yield data with specific observations/remarks providing intimation to the GoI and anomaly, if any, may be resolved in the next 7 days by the Head of the Nodal Department for State Government. If the dispute is not resolved, the matter may be referred to the State Level Technical Advisory Committee (STAC) for dispute resolution. In case the matter stands unresolved even after examination by STAC, it may be escalated to the Technical Advisory Committee (TAC) (Central Level Committee) along with all relevant documents including minutes of the meetings/records of discussion and report of the STAC and Departmental Head. Reference to TAC can be made thereafter only in conditions specified in SOP . However, data with anomalies which is not reported within 7 days will be treated as accepted to the IC. The protocol of the timelines defined above Note:- There is one Extraordinary issue to the Official Gazette, Series II No. 34 dated 19-11-2020 namely, Extraordinary dated 25-11-2020 from pages 833 to 834 regarding Order from Department of Home.

Wherever the yield estimates reported at

Insurance Unit (IU) level are abnormally low or high

vis-à-vis the general crop condition, the Insurance

Company (IC) in consultation with State Government

can make use of various products (e.g. Satellite

based Vegetation Index, Weather parameters, etc.)

or other technologies (including statistical test, crop

models etc.) to confirm yield estimates. If Insurance

Company witnesses any anomaly/deficiency in the

actual yield data (partial/consolidated) received

from the State Government, the same shall be

brought into the notice of State Department within

7 days from date of receipt of yield data with

specific observations/remarks providing intimation

to the GoI and anomaly, if any, may be resolved in

the next 7 days by the Head of the Nodal

Department for State Government. If the dispute is

not resolved, the matter may be referred to the State

dispute resolution. In case the matter stands

be escalated to the Technical Advisory Committee

(TAC) (Central Level Committee) along with all

relevant documents including minutes of the

meetings/records of discussion and report of the

STAC and Departmental Head. Reference to TAC

can be made thereafter only in conditions specified

in SOP. However, data with anomalies which is not

shall also be applicable to the actual yield databeing provided by the State Department in batches,i.e. Crop-wise-District-wise lots of data and timelinesfor each batch of data shall be counted separately//batch wise. Unnecessary delay in the finalizationof yield data will attract penal interest on due claimamount payable to the farmers as decided by theDepartmental Head in the matter.

TAC/TA/STAC shall deliberate and examine the

subject matter and indicate their views/decisions

based on statistical/technological inputs and other

related scientific and technical parameters as

detailed in the SOP.

The SOP to deal with yield dispute cases is as

under:

When to use this SOP: This SOP will be followedonly when there is a dispute about the crop yieldvalues between the State Government and IC andin the case when it remains unresolved at the Headof the nodal department level and STAC and hasbeen referred to the Central Government TechnicalAdvisory Committee (TAC), which in turn decidesthat the matter needs to be referred to a TechnicalAgency (TA). The dispute can be brought to theTAC, only in the case, where all of the followingconditions are satisfied. All cases not falling inthese criteria shall be decided by the head of NodalDepartment with the approval of competentauthority and their decision shall be final andbinding on all concerned.

a) There is more than 25% difference between the

yield estimated by the State Government and

the IC.

b) There is sufficient documentary evidence that

the CCEs have not been conducted in the

required numbers and as per the standard

protocol, in at least 20% area of the IUs for the

particular crop in the cluster.

c) The matter has been considered by STAC but

could not be resolved at the State level.

d) The IC has already carried out the technicalanalysis of the data in consultation of the StateGovernment or in collaboration with Central//State/Empanelled agencies and has usedsatellite/model/weather data to support its

claim.

The State Level Co-ordination Committee on Crop

Insurance (SLCCCI) of the State is responsible for the

monitoring of the Scheme.

The SLCCCI meeting to be held prior to the

commencement of the first crop season during Kharif

& Rabi Season and well in advance for finalizing the

various terms & conditions, to take decision for

notification of crops and areas, adoption of level of

indemnity, finalize clusters for drafting of tender

documents, calling of bids/issuance of the bid notice

to all empanelled ICs for selection to implement the

Scheme during the risk period etc.

Whereas, the Government of Goa is of the

opinion that an industrial dispute exists between

the management of the Citizen Co-operative Bank

Limited, Lakshdeep, Near Damodar Temple, Vasco-

-da-Gama, Goa, and it’s workmen, represented by

the Citizen Co-operative Bank Officers Association,

in respect of the matter specified in the Schedule

hereto (hereinafter referred to as the “said

dispute”);

And whereas, the Government of Goa considers

it expedient to refer the said dispute for

adjudication.

Now, therefore, in exercise of the powers

conferred by Clause (d) of sub-section (1) of

Section 10 of the Industrial Disputes Act, 1947

(Central Act 14 or 1947) (hereinafter referred to as

the “said Act”), the Government of Goa hereby

refers the said dispute for adjudication to the

Industrial Tribunal of Goa at Panaji-Goa, constituted

under Section 7 A of the said Act.

SCHEDULE

“(1) Whether the members of the Citizen

Co-operative Bank Officers Association

can be construed as “Workmen” as per

Section 2(s) of the Industrial Disputes Act,

1947 (Central Act 14 of 1947)?

(2) If the answer to (1) above is in affirmative,

then, whether the action of the management

of the Citizen Co-operative Bank Limited,

Vasco-da-Gama, Goa, in refusing to concede

the following demands raised by the Citizens

Co-operative Bank Officers Association, is

legal and justified?

CHARTER OF DEMANDS

Demand No. 1: Wage Rise:- The Association

demanded that all their members be granted a

wage rise of 25% of the gross wages with effect

from 01-01-2016.

Demand No. 2: Basic Pay:- The Association

demanded that the existing Basic Pay Scales be

revised by merging Dearness Allowance points upto

4440 points (Base 1960=100 into the existing Basic

Pay and revising the same by 20% to arrive at a

new Basic Pay Scale. Fitment shall be on stage to

stage basis.

Demand No. 3: Dearness Allowance:- The

Association demanded that with effect from

01-01-2016, Dearness Allowance be paid at 100%

neutralization above 4440 points (Base 1960=100)

Dearness Allowance points from 2836 points to 4440

points be merged in Basic Pay.

Demand No. 4: Stagnation Increments:- The

Association demanded that one stagnation

increment be paid once in every two years till

retirement.

Demand No. 5: House Rent Allowance:- The

Association demanded that with effect from

01-01-2016, House Rent Allowance be paid at

the rate of 10% of the Basic Pay and Dearness

Allowance with a minimum of Rs. 1,000/- per

month.

Demand No. 6: Conveyance Allowance:- The

Association demanded that with effect from

01-01-2016, Conveyance Allowance be paid at

the rate of Rs. 1600/- per month for Managers and

Rs. 1500/- per month for Officers.

Demand No. 7: Medical Aid:- The Association

demanded that with effect from 01-01-2016, Medical

Aid be revised to Rs. 10,000/- per annum for those

upto 5 years service and Rs. 15,000/- per annum

for those above 5 years service.

Demand No. 8: Daily Allowance:- The Association

demanded that the daily allowance be revised with

effect from 01-01-2016 to Rs. 500/- per day to

Managers and Rs. 300/- per day to Officers.

Demand No. 9: Leave Travel Concession:- The

Association demanded that with effect from

01-01-2016, LTC be revised to Rs. 25,000/- for

Officers and Rs. 30,000/- for Managers.

Demand No. 10: Leave Encashment:- The

Association demanded that with effect from

01-01-2016, Leave Encashment be permitted once

every two years.

Demand No. 11: Loan Scheme for staff:- The

Association demanded that Loan Scheme shall be

suitably revised in consultation with the

Association.

Demand No. 12: Period of settlement:- The period

of settlement be for three years from 01-01-2016 to

31-12-2018.

Demand No. 13:- The Association demanded that

all provisions of existing settlements and practices

shall continue to be in operation until the same

are changed by subsequent settlements.

entitled?”.

Now therefore, in pursuance of Clause (f) of

Whereas, the Government vide Certificate of

Practice & Notification No. 5-40-2000/LD(Estt.)

dated 11-02-2000, published in the Official Gazette,

Series II No. 49 dated 02-03-2000, appointed

Shri Rajesh Shrishankar Narvekar (herewith called

as the “Applicant”) as a Notary for a period of five

years in Bardez Taluka with effect from 11-02-2000;

And whereas, the Government vide Certificate of

Practice No. 5/40/2000-LD(Estt.) dated 16-08-2000

has extended the jurisdiction of Practice of the

Applicant to entire Goa;

And whereas, the Certificate of Practice issued

to the Applicant has been renewed by the

Government from time to time as required by sub-

section (2) of section 5 of the Notaries Act, 1952

(Central Act 53 of 1952) (herewith called as the

“said Act”) and last such Certificate of Practice

renewed was for a period of five years with effect

from 11-02-2015;

And whereas, the Applicant vide his letter dated

25-08-2015 has informed that he has been appointed

as the President of the Administrative Tribunal, he

shall not practice as Notary Public till he ceases to

occupy the said position;

And whereas, the State Registrar-cum-Head of

Notary Services (herewith called as the “Competent

Authority”) vide letter No. 3/7/15-Registration/2310

dated 05-10-2015 has recommended that the

Certificate of Practice of the Applicant may be kept

in abeyance as he has been appointed as the

President of the Administrative Tribunal;

And whereas, the said matter has been referred

to the Law Department (Legal Affairs) to obtain the

legal opinion as to whether the certificate of

practice as a Notary of the Applicant can be kept

in abeyance in view of his selection as the President,

Administrative Tribunal;

And whereas, the Law Department (Legal

Affairs) has opined that the request of the applicant

vide his letter dated 25-08-2015 is to be treated as

a request made by him for removal of his name from

the register in terms of Section 10 of Notaries Act,

1952, and accordingly, Department may take

necessary action in the matter, since there is no

specific provision under the said Act, and Notaries

Rules, 1956 (herewith called as the “said Rules”), to

keep the Certificate of Practice in abeyance;

And whereas, the Endorsement dated 09-03-2015

to the Certificate of Practice has expired on

10-02-2020.

And whereas, the said matter was placed before

the Government for decision, wherein the

Government has directed to remove the name of the

Applicant from the register maintained by it under

Section 4 of the said Act, thereby treating the

request made by him for removal of his name from

the register in terms of Section 10 of the Notaries

Act, 1952;

Now therefore, in pursuance of Clause (f) of

Section 10 of the said Act, the Government of Goa,

hereby removes the name of Applicant entered as

a Notary, from the Register maintained by it under

Section 4 of the said Act.

Practice & Notification No. 9-18-2004-LD(Estt.)/Part-

II(14)/612 dated 20-05-2009, published in the Official

Gazette, Series II No. 10 dated 04-06-2009, appointed

Shri Ganesh Shiva Kubal, Advocate (hereinafter

referred as the “Applicant”) as a Notary for period

of five years with effect from 20-05-2009 for the area

of Tiswadi Taluka;

And whereas, the Government vide dated

20-05-2009, has certified that the Applicant is

authorized to practice as a Notary for a period of

five years with effect from 20-05-2009 for the area of

Tiswadi Taluka;

And whereas, the Certificate of Practice dated

20-05-2009 issued to the Applicant had expired on

19-05-2014. However, the applicant had been found

practicing as a Notary, in the year 2016, after expiry

of his Certificate of Practice and therefore vide letter

dated 16-01-2017 and 02-03-2017, the State Registrar

was directed to instruct the said applicant to stop

practicing as a Notary, with immediate effect and

conduct an inquiry into the matter. Vide letter dated

14-03-2017, the State Registrar has directed that

applicant to stop practicing as a Notary, with

immediate effect.

And whereas, vide Enquiry Report dated

29-05-2017, the then State Registrar has specifically

recommended that Certificate of Practice as a

Notary of Shri Ganesh Shiva Kubal, may be

cancelled, since the same has been fraudulently

obtained by suppressing material facts amounting

to misconduct and misguiding authorities, without

disclosing the fact of his employment with the

Regional Commissioner of Provident Fund.

And whereas, the Applicant had failed to renew

his Certificate of Practice, as required under

sub-section (2) of Section 5 of the Notaries Act, 1952

(Central Act 53 of 1952) and sub-rule (4) of Rule 8 B

of the Notaries Rules, 1956. He was also found

practicing as a Notary, even after expiry of his
