S E C T I O N –A (INTRODUCTION)

At the outset, Shri C.K.Kutty, Dy.CPO/IR welcomed all the members of the SWRMU for the 24th PNM. He mentioned that this is the second meeting of the current year and the administration is looking forward cordial and result oriented discussions in this meeting. Then, he requested Shri K.Harikrishnan, CPO/SWR to address the forum.

CPO in his opening address welcomed Shri W.A.Yadwad, Zonal President, Shri A.M.D’Cruz, General Secretary and other office bearers of SWRMU and Officers and Officials present and mentioned that this is the 2nd

PNM during the current year. Last year only one PNM was conducted because half of the period had gone due to secret ballot elections and other reasons, but this year, administration is able to conduct 2nd PNM within a span of 6 months and wished that the discussion will be fruitful and to the satisfaction of both administration and Union.

Then, CPO requested Shri A.M.D’Cruz, GS/SWRMU to address the forum.

2.0 Shri A.M. D’Cruz, General Secretary, SWRMU welcoming the Office Bearers of SWRMU & the Officers present for the 24th PNM meeting, has agreed with CPO that the schedule of PNM could not be adhered to during the last year because of Secret Ballot Elections and other reasons. He also mentioned that SWRMU emerged as Single Union in SWR among the 5 Unions contested elections. He thanked the administration for smooth conduct of elections without any problems and also thanked 33,000 employees of SWR for electing SWRMU as Single Union over SWR.

2.1 GS, with profound grief intimated to all that their beloved leader, Com. Umraomal Purohit, President, All India Railwaymen’s Federation, the father of the Indian Trade Union Movement and an International level leader breathed last on 27th February, 2014 in Mumbai.

2.2 He mentioned that as per the Law and Constitution of AIRF, AIRF has conducted a special convention in Chennai on 3rd & 4th of July-2014 wherein Com. Rakhal Das Gupta has been elected unanimously by the delegates of the Union as new President of AIRF and Shri N.Kannaiah, General Secretary of SRMU and Assistant General Secretary of AIRF has been elected as Working President.

2.3 In spite of difference of opinion between the administration and the Union, SWRMU is extending full co-operation to the administration to run Railway system smoothly and reciprocally expect the same from officers also.

2.4. General Manager is kind enough to give the audience to the Union whenever they want to meet him to discuss the issues. He also mentioned that all P/HODs are extending full cooperation to the Union and there is absolutely no problem with them.

3.0 The General Manager came to address the PNM meeting on the second day i.e. on 10th July, 2014.

4.0 Welcoming him CPO mentioned that, this was the 2nd PNM after our respected General Manager has taken over charge and that too within a short span of about 6 months. This shows the kind of efforts both the administration and recognized Union are taking to solve the problems.

4.1 In between PNMs also, whenever a problem is brought to our notice by the recognized Union sincere attempts have been made to solve them. He also indicated that the administration is getting very good cooperation from the recognized Union in running the Railways smoothly. CPO also mentioned that our performance in many areas has been good.

4.2 CPO mentioned that, after the last PNM with SWRMU, Shri.Umraomal Purohit, who was the President of AIRF is no more with us and requested all to observe one minute silence as a mark of respect to Shri.Umraomal Purohit. One minute silence was observed by all.

4.3 He then mentioned to the General Manager that many new and old subjects have been placed in the present PNM and a number of subjects have already been discussed with the PHODs and HODs and among them a few subjects will be coming for the kind attention of GM, and afterwards he requested respected General Manager to address the forum.

5.0 Addressing the forum, GM stated that he is happy that with active cooperation of Union, SWR’s performance is commendable in increasing in loading and passenger earnings. He also stated that SWR was able to run many Holiday Specials to clear extra rush, which contributed to overall increase in the earnings.

5.1 Day before yesterday Railway Budget was presented and everybody might have seen the directions of Budget announcements, which are of course for better betterment of the Railways. He informed that though financial crunch continues, adequate funds have been given for the new lines and doublings, etc.,

5.2 With regard to allotment of funds towards Staff welfare and staff amenities, he mentioned that the money given in the present budget is almost at the same level as we got last year. But, he assured that no stone will be left unturned to get the revenue demands.

5.3 Though financial crunch continues on the Railways, still position is not that much bad so as to cause any panic. He asked the executive departments to prioritize the most critical items.

5.4 GM assured that Unions will be taken into confidence while planning for the improvements in the colonies. Instructions have been given to DRMs to select priority items. Hygiene will not be neglected at any cost in the colonies.

5.5 We may not able to construct new quarters and repairs also cannot be undertaken for the quarters which are 75 years old, since they can be demolished at any time. But, improvements will be undertaken for the quarters which are 30 to 50 years old. But, he assured that over all maintenance of colonies will be taken care.

5.6 As far as hospital conditions are concerned, GM mentioned that he had interacted with Shri D’Cruz regarding some issues. He mentioned that earlier the situation was bad, now with the active involvement of our present CMD, FA&CAO has also agreed to release more funds. Medical care is the one area where he assured that paucity of funds will not be allowed to come in the way.

5.7 During the current year, medical indents have already been placed for procurement of medicines.

5.8 Extension of contract for referral hospitals at Hubli and Bangalore has been taken care. 16 Health Inspectors were appointed on contract basis and a notification has appeared in today’s news papers about the proposed engagement of 8 or 9 CMPs, for which walk-in-interview is proposed on 1st August.

5.09 Departmental selections will be expedited. Notifications have been issued against 10% and 40% intake quota from Group-D categories for Inter departmental transfers.

5.10 More than 900 applications have been forwarded for inter railway transfers.

5.11 GM stated that he is confident that selections are going on and candidates will be reporting through RRB/Bangalore. RRB has already given the panels for ALPs, ASMs and Guards, which enabled us to forward around 200 transfer applications of ALPs.

6.0 Speech of Shri A.M.D’Cruz, GS/SWRMU:

6.1 At the beginning of his address GS, with profound grief intimated that their beloved leader, Com. He briefed about the life time achievements of Com. Umraomal Purohit.

6.2 AIRF has conducted a special convention in Chennai on 3rd & 4th of July-2014 wherein Com.Rakhal Das Gupta has been elected unanimously by the delegates of the Union as new President of AIRF and Shri N.Kannaiah, General Secretary of SRMU and Assistant General Secretary of AIRF has been elected as Working President.

6.3 AIRF has congratulated the newly elected Government at the centre especially Shri Narendra Modi, Hon’ble Prime Minister of India and Shri D.Sadananda Gowda, Hon’ble Minister for Railways, who is hailing from Karnataka and also worked as Chief Minister of Karnataka and he expected that more funds will be released for the benefit of Karnataka and especially to SW Railway.

6.4 Officials of AIRF have met Hon’ble MR and discussed about the 36 charter of demands and MR assured to look into the issues.

6.5 Union is getting full cooperation from the administration in all angles and assured that SWRMU will continue its full support to the management in future also on reciprocal basis.

6.6 He described about the bad incident that took place at Mysore workshop on 21st March, 2014 and felt that it should not have happened. He mentioned that Union Members went to meet the General Manager only on the advice of the administration and in turn administration has filed an FIR against the 24 Union Members including the General Secretary of SWRMU, which is not at all correct. The incident has happened only on the provocation of RPF staff. He requested the General Manager to withdraw the FIR. He also added that promotion has been denied to one employee at Mysore Workshops stating that criminal case is pending against him.

6.7 He has written a DO letter to General Manager regarding the denial of audience by CSC and the reply is still awaited from the administration. He mentioned that being a single recognized union on SWR, they are following the democratic way of deliberations.

6.8 Cadre restructuring is yet to be implemented in many of the important cadres like Ticket Checking staff, Welfare Inspectors, which was supposed to be implemented from 01.11.2013. He requested General Manager to look into this aspect.

6.9 He is happy that he is getting the appointment with General Manager, whenever there is a need and also thanked the General Manager for taking a stand that on each death, one CGA needs to be offered as per rules.

6.10 A uniform policy should be adopted through out SWR with regard to appointment on compassionate grounds. He pointed out about a committee formed by UBL division to screen the CGA candidates, which is against the rules.

6.11 Steps should be taken to fill up the vacancies of Welfare Inspectors at the earliest, being an important category especially dealing with CGA cases.

6.12 The replies for 11 preamble subjects of last PNM meeting are yet to be received.

6.13 He has strongly objected to the retention of women employees beyond office hours and appealed General Manager to see that no women employee should be retained beyond office hours especially at the New Building, Gadag Road where transportation facilities are not available. GM has informed that no women employees will be needlessly asked to stay back beyond office hours and he also stated that he expects those employees should finish their assigned job within the stipulated time especially during Parliament Session.

6.14 GS also mentioned that even after repeatedly pointing out in every PNM, SDGM is not attending the PNM for discussion. He also mentioned that at Railway Board’s level, Director (Vigilance) is participating in the negotiations. GS requested General Manager to advise SDGM to attend PNM meeting to sort the issues.

6.15 Vigilance Department is not following rules especially with regard to Commercial circulars. He mentioned a recent incident at Hubli Station where One Vigilance Inspector has insisted the Reservation Supervisor to declare his private cash, though it has not been stated in any of the rules and moreover that particular inspector has seized the private cash of Commercial Supervisor. He demanded that the amount seized should be returned to the employee immediately. GS also pointed out that though Vigilance Seminars are conducted by Vigilance Branch, Organized labour were not invited to participate and to give their suggestions, if any.

S E C T I O N –B (PREAMBLE SUBJECTS)

All the following 25 items tabled as preamble subjects had been sent to respective P/CHODs for detailed examination and remarks. All these issues will be replied in writing to GS/ SWRMU separately. Preliminary discussions however were held on each item with the respective HOD.

(1) I - Item no.1 of Last Preamble subject: Cadre Restructuring of Group-C & D - Matching surrender (RB’s lr.no.PCIII/203/CRC/4 (RBE no.102/2013) dt.08.10.2013 --- This Union strongly opposes the matching surrender of posts for implementing cadre restructuring as per Board’s orders. In the recent PNM held with Railway Board on Jan 16th & 17th, 2014, the Union through the Federation has opposed the matching surrender of posts in various grades. As higher grade posts are being proposed for surrendering for the money value, the Union is urging that the posts in the lowest grade may be surrendered for the purpose.

In this connection, it is pointed out that as per instructions contained in RBO 91/2011 and Board’s lr.no.E(MPP)/2005/1/54/III of 06.03.2007 higher grade posts should not be surrendered while implementing restructuring.

As per Sr.DPO/UBL lr.no.H/P-135/V/Restructuring cadre/2013 dt. 29.01.2014 it is noticed that higher grade posts are being surrendered for matching surrender. This is highly objectionable. Hence the Union urges to issue necessary instructions to all concerned not to surrender higher grade vacancies.

No action has been taken till date and no remarks furnished till date. FA&CAO, CPO

Revised memorandum has been issued by Hubli division. This has been informed to GS/SWRMU vide lr. No. SWR/P.694/ SWRMU/ Genl.Corres/Vol.I dated 03.04.2014 A copy was given in the meeting.

(2) II -. Item no.7 of Last Preamble subject: Railway Colonies – The railway colony roads are in a very bad shape. The drainages are not proper. Also, the quarters which are condemned are not fully demolished, the structures are left as it is, giving room for anti-element activities. The Union urged that all the structures of condemned quarters should be demolished and levelled properly.

This subject is so serious, the railwaymen are facing hell lot of problems, the roads are not proper, no street lights, not at all taken any care and we have not received any replies also till date.

(3) III - Item no.8 of Last Preamble subject: Smt. Shantha, CDMS/SBC has sought transfer to MYSS/Stores but the same is not considered for the last more than a year. Recently she lost her father also. Her request may therefore be considered on priority. The same is not considered for last more than a year. Recently GM also mentioned during my discussion and after that COS replied that she will be relieved within one month. After GM’s speaking with COS two months passed and not yet relieved, no office order issued, no information received by this union.

(4) IV - Item no.11 of Last Preamble subject:Sri. Arun, TTE/BJP has requested for transfer to Chennai and even after pursuing by the SWRMU, the application is still pending in CPO’s Office. (Union’s letter dated 16.9.2013 to CCM/UBL with copy CPO/UBL)

The applications still pending with CPO office and this case also GM personally talked to CCM and it was agreed, but being it a medical ground, his father was taking treatment at PER hospital, recently he was also admitted, there is no humanitarian consideration even after GM’s intervention also. This is the fate of Railwaymen.

CCM, CPOR E M A R K S:

CCM has mentioned that Shri Arun, TTE stands at priority number 15, out of a total applications of 25 at present. His application cannot be forwarded at present due to shortage of manpower and around 200 coaches are being unmanned on an average per day.

GS mentioned forwarding of applications should not be stopped on the plea of shortage of manpower and demanded that all the pending applications should be forwarded as the acceptance may take its own time. He also mentioned that the responsibility in filling up the vacancies lies with the administration and staff should not be made to suffer on that account.RRB papers is expected to supply TC papers by end of August 2014. It was agreed to take positive action on receipt of RRB papers.

(5) V - Item no.13 of Last Preamble subject: Zonal PNM item no.03/08 – Promotion channel to Khalasis working in RCD and Lobby of Hubli division - It was minuted in the Zonal PNM held with GM/SWR on 17.12.2008 that a joint meeting with recognized unions was held on 4.12.2008 by UBL division and the next joint meeting was fixed on 16.1.2009 to finalise the avenue of promotions to Loco Khalasis in RCD and Lobby. The subject was CLOSED but till date nothing has been done in regard to providing the avenue of promotions to Loco Khalasis in RCD & Lobby. In this connection, letter has been addressed to CPO/SWR on 23.12.2013. It was also mentioned in the last preamble subject, it was also an earlier Zonal PNM subject, but no remarks given and till date no position given to the Union.

(6) VI - Item no.14 of Last Preamble subject: Balance Shoes not supplied to C&W staff Hubli - Indents placed for supply of 390 shoes but supplied only 290 and the balance 100 is yet to be supplied. The remaining staff bitterly complaining

Whereas till date not supplied. No reply received to this union. C M E

(7) VII -. Item no.31 of Last Preamble subject: Promotion for Khalasi to Tech.III after completion of 2 years in Workshops, Hubli & Mysore --- In the V-CPC, the residential period for promotion from Group-D to Group-C ie. From Khalasi to Tech.III was 3 years and within Group-C it was 2 years. In VI-CPC, Group-D is abolished and all staff are elevated as Group-C with GP 1800/- Hence, all Khalasis appointed in Workshops Hubli & Mysore may be promoted against vacancies after completion of 2 years services.

No remarks given and not implemented till date. CME, CPO

This is under process

(8) Relieving staff Gr.D still pending in all the departments, particularly in Mechanical C&W SBC to MYSS. Whereas in this case there is no 10% or 40% intake to workshops whereas the Kh.Helpers on bottom seniority requesting in the same Mechanical department from one unit to other ie. From C&W to MYSS but till date the file is kept in cold storage. No action has been taken. After the Union discussing also, nothing result is coming.

(9) There are so many items which are not at all taken care in the last preamble subjects. Other items of agenda also no action has been taken on many issues that are pending, like Restructuring orders till date totally not completed, there are lot of complaints receiving from employees, one category given but other category not given till date

For instance, the small cadre of S&WIs having a meager total strength of 60 staff, controlled by Headquarters, the implementation of Cadre Restructuring has not yet been finalized even after offering matching surrender money value by all divisions

The process of restructuring of the cadres are at various stages of completion. This will be expedited

(10) Compassionate ground appointments also badly delaying has been brought to notice of GM in last PNM agenda. Still the cases are delayed.

CGA case will be regularly monitored for early disposal.

(11) This Union, in all the Divisions done on 18th last month, demonstrations against removing from service and making compulsory retirements, cases not proved / proved also in the name of SPAD cases. The Loco Running staff are in a very agitated mood since without conducting proper enquiries, who is conducting the prima facie enquiry in the beginning the same officer is coming as Disciplinary authority to prove the cases and whatever points in the Defence Plea we raise is not taken into consideration since it is already informed to Rly Board, the Union urges why without completing inquiry why the Board has to be informed. Then there is no meaning in conducting enquiry. So the union the lead demonstration but till date the administration kept quite. Never asked the union what is the problems?

(13) Procurement & supply of CUG SIM for AC staff. - This union has received representations from AC staff regarding non-supply of CUG SIM to the escorting staffs as per boards’ instruction. The last CUG supply was made during 2010 from then onwards many new services have introduced and staffs have been promoted to Tech from helper. As on date nearly about 150 staffs need to have supply of CUG SIM. Hence this union urges to procure & supply CUG SIM to AC staffs.

(14) Change of classification of Pointsmen’s rosters of TK section from EI to ‘C’. The factual job analysis conducted during 2010 justified the change of classification of Pointsmen’s working at TK station from EI to ‘C’. The proposal was sent to CPO/UBL vide Sr.DPO/UBL Letter No.B/P.347/JA/PMs/TK dated: 03.06.2010, after keeping the proposal in cold storage for almost two years now the proposal have been returned vide CPO/UBL Letter No.SWR/B/P.347/HOER/SBC Division dated: 13.02.2012 stating that the proposal was not agreed since the goods shed activities is likely to shift to Kyathasandra. It is very pertinent to mention that the job analysis conducted during 2010 based on the workload at that time and further the workload have been increased at TK and justifies reclassification. If at all future date any activities in the workload gets reduced again by the way of job analysis classification may be revised. Till such a time the justified JA report should be considered and classification is changed from EI to ‘C’ from the dated of FJA.

The above subject was discussed vide subject No.03/2/2012 and a commitment was given by the administration that activities are likely to be shifted to Kyathasandra. Hence, it cannot be agreed. Since last 4 years, day by day Train Services are getting increased and workload have increased in manifold. Hence, this union urges to change the classification Pointmen’s of TK Section from EI to ‘C’.

(15) Supply of Printers to PRS & Booking Office on DS-8. Time & again this union has been demanding for procurement & supply of Printers to Booking Office as well as PRS on condemnation replacement it is learnt that necessary indents have been placed to Headquarters for procurement Hence, this union urges for procurement & supply of printers to PRS & Booking Office.

(16) Creation of Posts of Guards under cadre review. A proposal have been sent vide Sr.DOM/SBC, Letter No.B/P.172/Guards dated: 01.07.2014 for creation of total 39 posts in the Guards Category in the cadre review the Competent Authority Approval is awaited for Headquarters for creation of the post. Hence, this union urges to communicate the approval of the post.

(17) Change of Classification of Commercial Clerks of RMGM. FJA was Conducted on 08.01.2013 for change of classification and to the Competent Authority approval has been forwarded on 06.12.2013 to Headquarters for approval. This union urges to communicate the Headquarters approval at the

(18) Conducting of General Department Competitive Exam (GDCE) for filling up of vacancies in graduate quota - The GDCE exam to fill up graduate quota has not been held from quite long time to fill up the vacancies of ECRC, ASMs & TCs and other categories from serving graduates, whereas one such selection was held during erstwhile Southern Railway days when SBC division was part of Southern Railway. Since then no such selections have been held ever. As the administration is aware that the new RRC candidates are well educated and having graduation qualification even in some of them are master graduates and they are working as group ‘D’ employees If the administration conducts GDCE selections, it is a golden opportunity for serving graduate employees to excel themselves in the competitive exam to seek better career progression for them. This was one of DRM/PNM agenda in 33rd PNM of SBC division and the remarks furnished were that the matter has been referred to HQ. Hence this union urges to conduct GDCE selections to facilitate promotional opportunity to serving Group-D graduates.

This will be taken care of when indent is processed for direct recruitment quota in future.

(19) Harassment to Track Machine Staff in UBL division - The representation received from the staff of TMO to this union stating that UBL division does not permit line clear towards “Track Machine” for going back to stabled in the adjacent station after completion of work of Track Machine, even after station master informing to clear the line even when train movements are not there. The Track Machine staff have to cook food in the evening hours after going back to adjacent station where the track machine coach is stabled, and then they have to take rest and they should ready for next day duty. This shows that Section Controller giving harassment to track machine staff. This Union urges to administration, this kind of attitude should be stopped by the Section Controller towards Track Machine Staff working in out stations very immediately.

(20) Inter Railway request transfer - Sri Sheo Shankar Prasad, JAA working in Accounts dept., applied for request transfer to S.E.Rly due to his both the parents sickness and he was going every month to his native place to take care of them, unfortunately his father has been expired on 19.06.2014 and no one available to do the final formalities of his father, finally he went by flight to his native place for his father death. Now his old age mother 77 years she is staying lonely in her native place. Now it is come to notice of this union that more than 14 staffs have been relieved and transferred from accounts dept to other railways recently. In view of above fact, this union request to relieve above staff to S.E.Rly on sympathetic ground as a special case to take care of his old age widow mother who is staying lonely without any assistants.

FA&CAOR E M A R K S:

FA&CAO has mentioned that he has formulated a policy for relieving the employees based on the merit and hence requested SWRMU to cooperate in the matter. However, on the request of GS/SWRMU, FA&CAO has agreed to consider the case when the cadre position improves. This issue has also been discussed with General Manager on 10.07.2014.

(21) Distribution of Toilet soap (PL no.81050914) to Sr.Tech with GP 4200 In MYSS – Based on COS letter no.04/81/12/1072 dt. 13.12.12 toilet soaps are being issued instead of soap laundry for those staff below GP 4200 at the rate of 8 nos per year. Since Sr.Technicians are with GP 4200 it is limited to only 4 nos as par with JE and SSE. Unlike JE or SSE, Sr.Technicians are physically working and they also eligible to get 8 nos per year even though they are in GP 4200. Hence the above COS letter may be modified and new letter should be issued to concerned to distribute 8 nos of toilet soap to all Sr.Technicians with GP 4200

(22) Not granted 1800 GP for Substitute in Hubli division – Nearly 60 people are working at Hubli division as Substitute from quite long time in GP 1300. These staff are acquired requisite qualification ie. Passed SSLC. As per Rly Board lr.no.E(NG)-II/2011/RR-1/11 of 9/12/13 Substitutes those who has passed SSLC to be absorbed in 1800 GP. But it is not understood how UBL division is not considered them for GP 1800 even though they have passed SSLC and still they are in GP 1300.

(23) Repatriation of Sri. Edakundalu, E&RS/HPT – Sri. Edakundalu has been transferred to UBL division on vigilance case from Bangalore. Now his case is withdrawn and he is free from all the charges. Hence he may be repatriated back to Bangalore division. His presence at UBL division is depriving the promotion of UBL staff as he is also considered as one among the existing vacancy.

(24) Problems of Loco Inspectors of UBL division – The division LIs asked for protocol duties to PHODs for all the times like NDLS-HYB-ALD-SC for long duration. They are attending trouble shooting daily some problems to the Locos (sanders repair, adding of water, minor Loco repairs). Even after night foot plate duties, LIs are not spared to avail proper rest. Allow LIs to take FR/Rest as per their eligibility. Sanctioning of leave to LIs by Sr.DME/P/UBL is not liberal. Whenever LP/ALP not having LRS between LWR-AVA-LWR administration forcing LIs to take crew with train which incorrect. Every now and then CMPE/SWR is asking division LIs movement to CPRC/PRC. As if LIs are not performing their foot plate duties. CMPE/SWR harassment to prepare sectional directory which is impossible to do by keeping so much work. Due to the above problems Loco Inspectors are unable to monitor/counsel to NLPs /ALPs /Shunters properly and DAR enquiries, punctuality drives, running room inspections, crew lobby inspections, safety drives are delayed / affected. Therefore, HQ LI should be nominated for protocol duties, RCD and sand witnessing. Trouble staff to provide at UBL station. Specific rest to be given as per eligibility and leave/rest to be granted.

(25) Medical decategorized running staff to alternative job – Sri. S. Kumar who was Goods Pilot in SBC division was medically decategorized while giving alternative appointment they have given as CRC/SBC in GP 4200. After that there is no further promotion as it is kept in as CRC. Instead of CRC he requested administration to give in Commercial Department where he can go further promotion still he is having about 20 yrs service without any promotion. So this union urge the administration again he should be given for re-screening for the medical decategorized and give the Commercial as GP 4600 which is available. Further his service can be utilized properly otherwise there is no avenue for medical decategorized staff. Hence union request that his case can be considered for re-screening for giving alternative job

CLASSIFYING `RNN' STATION UNDER URBAN AGGLOMERATION FOR GRANT OF HRA AT `X’ RATES (30%).

The staff working between YNK and RNN Station have represented to this Union that the up to RNN Station comes within 6 KMs radius from the BBMP limits in this connection they have obtained Dependency Certificate from Dy. Commissioner Bangalore Rural District vide letter dated 27.03.2008 and represented to administration also duly enclosing the copies of dependency certificate issued by DC Bangalore Rural requesting for grant of `X’ rates of HRA (i.e. 30%) to the staff working between YNK and RNN.

It is also very pertinent to mention that it has been confirmed from the sister Central Government organization employees i.e. BSNL staff working at Rajanukunte, are being paid 30% HRA at X rates but same is deprived for the Railway men’s.

Hence, this Union urges for classifying up to RNN Station Urban Agglomeration and grant HRA to the staff retrospectively i.e. w.e.f. 30.08.2008 that is the date of issual of dependency certificate by Dy. Commissioner.

This Union have been persistently complaining about the pathetic condition and poor maintenance of Ticket Checking Staff Rest Room in pursuant to the demand raised by AIRF in Boards PNM as well as JCM Meeting Railway Board have issued orders vide Letter No.2010/TG/V/10/3 dated: 02.03.2010 issued orders to provide infrastructure, including catering facilities to TTE’s Rest Room on the analogy of Drivers & Guards. But unfortunately in SWR this facility is not extended to Ticket Checking staff.

Hence, this Union urges for provision of infrastructure including catering facilities to at TTE’s Rest Room.

As per Railway Board guidelines, a committee has been formed consisting of HQ(SAG) level and (JAG) Divisional level to monitor adequate facilities at TTE’s rest room.

GS/SWRMU has mentioned that facilities as per the instructions of Railway Board are yet to be provided, especially at stations like Hubli, Shimoga. At Hubli itself, which is headquarters of SWR, 25 beds are required at peak hours whereas only 19 beds are available. Water Geysers, Coolers etc. should be repaired immediately. The problems faced by the TTEs of SWR in Rest Rooms at Tirupati, Chennai, etc. of neighbouring Railways are yet to be solved.

It was mentioned to the Union that as per the Railway Board guidelines, a committee has been formed consisting of HQ(SAG) level and (JAG) Divisional level to monitor provision of adequate facilities at TTEs rest rooms. In addition to above, divisions were also instructed to take immediate action to sort out the deficiencies at TTEs rest rooms and to maintain zero deficiency vide letter dated 12.06.2014. The Divisions have been given a target date for the deficiencies reported to be made good by 31.08.2014.

CCM has informed that the issue has already been taken up with South Central Railway in respect of TTEs rest room at TPTY.

GS/SWRMU has raised the pathetic condition of TTEs at Tirupathi where TTEs are hiring rooms on payment as the existing rest room for TTEs is very bad. He also mentioned that this issue has been brought to the notice of DRM/SBC on several occasions. GS demanded that till such time improvements are made in the existing rest room at Tirupathi, reimbursement for hiring the retiring room has to be arranged. GS also demanded that few retiring rooms should be earmarked for the occupation of TTEs of Bangalore Division till such time the existing rest room is made fit for occupation.

During the discussions, the problems being faced at Chennai has also been highlighted by GS. GS mentioned that even at Hubli, being the Headquarters of SWR, sufficient beds are not being provided.

CCM mentioned that with regard to lack of facilities including paucity of beds, it was decided that the matter will be vigorously taken up with other Railways and an acceptable solution will be found within a couple of months.

GS has discussed this issue with General Manager on 10.07.2014 also and GM assured that necessary steps will be taken shortly to improve the conditions at the rest rooms of TTEs and GM advised CCM to earmark a few Retiring Rooms for the use of TTEs, which will give some relief.

GS specifically mentioned that cooking facilities should also be extended to the TTEs on par with the Loco running staff in terms of Railway Board’s instructions issued during 2010. GM mentioned that the instructions of Railway Board will be followed.

APPOINTMENT OF CANDIDATES HAVING ITI QUALIFICATION IN REFRIGERATION & AIR CONDITIONING MECHANIC AS TECH GR-III ON COMPASSIONATE GROUND AT CWS/AP.

Two candidates, Shri Arun kumar S/o Siddalingappa and Shri Sreejit S/o K.Kandan were appointed as Khalasi on Compassionate ground at CWS/AP though they possess ITI qualification in Refrigeration and Air Conditioning and same trade is available at CWS/AP under Mechanical department. Hence, their appointment should be modified as Tech-III with 06 months training period.

M I N U T E S (10/11-07-2013):Refrigeration and Air conditioning trade is not a relevant trade for workshops. Both the candidates were subjected to suitability test and Shri Sreejit, who was found suitable and appointed as App.Tech.Gr.III and Shri.Arun Kumar was found suitable for only Group-D post.

SWRMU stated that Shri Arun Kumar, who is having the qualification of ITI in Refrigeration and air conditioning should also be considered for the post of App.Tech.Gr.III as his qualification is within the ambit of RBE No.196/2006. Further, SWRMU mentioned that in the recent notification of Centralized Employment Notice, the same qualifications were prescribed.

It was mentioned to the Union that the matter has been examined further. It is true that RBE No.196/2006 quoted, gives the list of trades under the Craftsmen Training Scheme but Refrigeration and Air Conditioning trade is not a relevant trade for the Mysore Workshops and hence the case of Sri.Arun kumar cannot be considered for Compassionate Ground Appointment directly as Technician based on his ITI in Refrigeration and Air Conditioning. Since he has not passed the suitability test for Technician, he was offered Group D post.

This subject was deliberated at length and GS/SWRMU has not been convinced with the above remarks and contended that ITI in Refrigeration and Air Conditioning is very much eligible for appointment as AC fitter and the candidate need not be trained for three years. He also handed over a copy of RRB notification in support of his contention wherein this trade has been indicated as eligible for the post of AC fitter.

The matter will be examined further by CEE and CPO and put up to General Manager.

AC cadre is yet to be formed in MYS Shops. ITI qualification in Refrigeration and Air Conditioning was not relevant trade in MYS shops at present. As already mentioned since he has not passed the suitability test for Technician, he was offered Group D post. He joined Gr.D post and there after he was promoted to Tech.Gr.III. The position was also put up to GM as decided in the PNM.

However, GS/SWRMU has stated that since AC cadre is formed in Mysore Shops, instructions should be given to Workshop that in future CGA cases should not be rejected, if any of the candidates is having the above referred qualifications.

MAINTENANCE OF CHALUKYA INSTITUTE AT HUBLI.Chalukya Institute is constructed in promising all the facilities required to perform the functions. But it is noticed that the following facilities are not available as a result functions are not successful without taking much strain.

(a) Generator is not provided to overcome electric failure. (b) Drinking water is not supplied. (c) Drainage system is not functioning. Water is stagnated inside the compound wall

as there Is no outlet. This is causing much difficulties to the marriage parties. Hence it is requested to provide the proper outlet flow of water.

(d) Separate shed for Non-Veg cooking is not provided. At present one common kitchen is available in Chalukya Hall, whenever functions/ marriages take place in the above hall which requires preparation of Veg/Non-veg food it is not possible to cook the same in the available kitchen. The veg food can be cooked on LPG stove whereas Non-veg food (Chicken, Mutton, Biryani etc) has to be cooked on firewood stove only. As such, Non-veg. food is being prepared in the open space on the east side of the Hall within the compound wall which is causing the difficulty during rainy season. Hence, it is requested to provide cover for cooking the Non-veg food.

the same is supplied along with colony supply on alternate days. Now SSE/W/WW/UBL and care taker of Chalukya Institute has been entrusted to co-ordinate in drinking water supply on other days also.

(c) Drainage system inside the Chalukya Institute compound has already been repaired and there is no water stagnation.

(d) Separate shed for cooking of non-veg food has already been provided. During the discussions, GS/SWRMU has requested to provide the tables in the dining hall as the employees have to bring the same again on rental basis.

ERRONEOUS PAY FIXATION FOR TOWER WAGON DRIVER (TOWER CAR DRIVER) AS PER 6TH CPC INSTRUCTIONS.As per the instructions contained in Railway Board Letter No.PC/IV/2005/CC/SR dated: 02.03.2005, the Tower Wagon Drivers who were in erstwhile pay scales in 5th PC Rs.4500-7000 their pay have to be fixed in GP 2800. The fixation have been done correctly in adjoining Railway’s except SWR/SBC Division wherein their pay have been fixed in GP Rs.2400 causing grouse anomaly amongst Tower Wagon driver working in SBC Division.

The above subject has been discussed at Divisional level in the last PNM vide agenda No.08/06/2012 and administration have replied that the matter has been referred to Hqs vide their letter No. B/P.535/III/TRS/TWD dated: 27.08.2012 for issue of clarification/guidance in the matter

Hence, this Union urges to advise SBC Division to revise and re-fix the pay of Tower Car Drivers in light of the above Board’s instructions with1 retrospective effect.

SBC Division is not a respondent in O.A.115/2010 and hence Hon’ble CATs order referred to above has not been implemented by this division.

The contention of the SWRMU is that the post should be operated in scale Rs.4500-7000 in 5th CPC and correspondence Grade Pay should be implemented as per 6th CPC with further avenue for promotion.

During the discussions, the union reiterated their demand.

Prior to formation of South Western Railway, CPO/MAS has issued certain guidelines in the matter of conducting selection for the post of Tower Wagon Drivers in scale Rs.4000-6000 and instructed all Divisions to follow instructions uniformly. After prolonged discussions, it was agreed to examine the case again, in the light of the disposal orders passed by AM/Staff in the O.A.

PROVISION OF LIEN TO AC TRIP SHED STAFF.

This Union had raised a demand in the Zonal PNM vide sub.No.49/09 for provision of lien for the TRD staff working at AC Trip Shed/SBC. In the minutes recorded against the item it has been agreed to review the entire case afresh. This was also an agenda in the Divisional PNM. In pursuant to the demand raised by this Union, P. Branch/SBC have to call for options from the employees to give their option / willingness to work at AC trip shed with bottom seniority. Accordingly three Khalasis have submitted their willingness to continue in the Trip Shed. In this connection Divisional Administration vide Sr.DPO/SBC, Letter No.B/P.535/V/Dsl/PNM dated: 31.07.2011 have communicated to Headquarters decision for providing lien to three helpers working in TRS who are having lien in TRD.

Hence, this Union urges to convey the Headquarters decision in the subject matter to enable the Division to provide the lien and for regular absorption at AC Trip Shed.

It was explained to the union that the lien of AC Trip Shed staff has to be decided by DRM/SBC since TRS and TRD are both separate cadre and are having separate seniority unit which is fully controlled by Bangalore division.

The demand of SWRMU for interpolating the seniority of five Helper/TRDs who were being utilized in TRS depot from 03.11.97 was regretted by DRM during August-2008 and these employees were given opportunity to exercise option to join the cadre of Helper/TRS vide letter dated 13.08.2008 on bottom seniority. However, none of the five employees exercised option for joining TRS unit on bottom seniority till May 2011.

It was pointed out by SWRMU that in the earlier PNM it was agreed to review the entire issue and however review has not been done so far. SWRMU reiterated their demand that the staff, who are presently in TRS should be given lien in their seniority unit from the date of joining in TRS wing. It was also mentioned that the staff when got promotion, they were not relieved to TRD.

CREATION OF 248 POSTS IN S&T DEPARTMENT SIGNAL SIDE.The demand of this Union for creation of post for maintaining the new assets in S&T department Signal wing at SBC has been under discussion at zonal PNM as regular agenda and further review in the subsequent PNM. However this Union has been replied that no proposal has been received from the Division to create the new posts. RESTORATION OF HIGHER GRADE POST SURRENDERED IN BRI UNIT SBC DIVISION.

Time & again this subject is coming for discussion and further review at Headquarter Zonal/PNM this issue was discussed under item No. 16/09 and approved in subsequent PNM meeting preamble agenda although PCE had given a commitment to immediately restore the higher grade post surrendered at BRI unit SBC no tangible action could be seen for the restoring the post the staff who are aspiring for the promotion at the virtue of at their retirement.

During each one of the zonal PNM in the opening address by GS/SWRMU it has been urged to restore the higher grade posts surrendered since the promotional prospects has been very badly affected to serving employees particularly who are virtue of retirement. Despite of our hue & cry administration has did nothing other than giving a vague reply by assuring this Union 52 posts are being created. The BRI staffs are totally lost their faith due to administration delay in creation of posts.

Hence, it is urged to immediately restore the higher grade posts in light of Board’s instructions.

The proposal for creation of 14 posts, which were surrendered in Bridge Unit, Bangalore Division, was initially proposed to mitigate the difficulty of staff due to surrender of posts in higher grade as per Railway Board`s letter No. E(MPP) 2009/6/8 dt23.03.2012, to restore the higher grade posts by surrendering the lowest recruitment grade without seeking money value from the vacancy Bank. The proposal is under process for concurrence from the finance.

PCE also explained to the Union that Finance has raised the objection to create the posts as the same were surrendered prior to 06.01.2007 and the current proposal of creation of posts will not come in the ambit of Railway Board letter issued during 2012, which advises to restore the higher grade posts immediately duly surrendering the lowest level posts.

GS/SWMU has stated that the letter regarding restoration of higher grade posts was issued during 2012 only, whereas this issue is being discussed since 2009 and earlier PCEs have assured that the higher grade posts will be restored back.

SWRMU was not satisfied with the above position and this issue was discussed in the presence of GM again. GM assured that the matter will be looked into.

M I N U T E S(4/5-02-2014):

As per RBE 39/2012 dated 23.03.2012, only the higher grade posts surrendered after 06.03.2007 can be restored surrendering the posts in the lowest recruitment grade from the cadre. In the above case, the posts were surrendered on 29.03.2006. Hence restoration of these posts could not be done. However a proposal has been sent to Sr.DFM/SBC on 03.01.2014 for concurrence for creation of 28 work-charged posts (MCM-1, Revitter Gr.I-3, Revitter Gr.II-2, Revitter Gr.III-1, Welder GR.I–2, Welder Gr.II–1, Welder Gr.III-1 and Helper-17 posts. Total – 28 posts).

GS/SWRMU has not agreed for creation of work-charged posts, since Bridge cadre is permanent and this subject was referred to the General Manager. General Manager has assured that action will be taken to create some of the revenue posts, which are considered essential after identifying equivalent matching surrender.

It was mentioned that proposal for creation of 16 number of ex.cadre posts is under process in SBC Division, but Accounts has not agreed for the same as the Bridge cadre is a permanent one and work charged posts cannot be created.

This issue has been deliberated in the presence of General Manager also on 10.07.2014. General Manager advised FA&CAO and PCE to look into the matter once again within the frame work of rules.

GS has pointed out that in case the posts are not being created at Zonal level, a letter may be given to the Union so that they can take up the matter at Federation level, since the higher grade posts were surrendered against the instructions of Railway Board, which is hampering the promotional prospects of existing employees.

Hence, this Union urges the management for immediate Annual Cadre Review of the categories in Engineering Department at HQ level. M I N U T E S (10/11-07-2013):BLACKSMITH: After implementation of cadre restructuring w.e.f. 01.11.2003 under RBE No.177/2003, in the Artisan category of Blacksmith in Engineering Department of MYS Division, no fresh creation/surrender has been made. Therefore, the posts available based on the revised percentage w.e.f. 01.11.2003 will remain unchanged

WELDER: The posts of Welder in Engineering Department is maintained as “Ex-Cadre Post”. The lien of the incumbents detailed in the above table are being maintained in respective P.Way Units.

In terms of RBE No.177/2003 (Para 2.1), the restructuring is not applicable to “Ex-Cadre Post”. Therefore, there will be no cadre review of these Welders (Ex-Cadre Post). Union requested to form a cadre duly clubbing all the ancilinary cadres for the promotional benefits to the employees.

SANCTION OF MACP IN 4800, 5400 & 6600 FOR ENGINEERING GRADUATES APPOINTED AS APPRENTICE CHARGEMAN ‘A’ BEFORE 1986.The induction of supervisors to Railways was being done through RRBs from the Diploma holders as Apprentice Mechanics with two years and the graduates as Apprentice Charge man ‘A’ with one year training.

These Apprentice Mechanics became Chargeman ‘B’ and Apprentice Chargeman ‘A’ became Chargeman ‘A’ after their satisfactory completion of training up to the year 1986 in the mechanical cadre After 1986, the diploma holders were inducted as Junior Engineer Gr.II trainees and Graduates were inducted as Section Engineer Trainees (Dy.SS). The hierarchy of technical supervisors in mechanical cadre was as under up to the 5th CPC:

JE-II JE-I SE SSE From 6th CPC, the hierarchy has been revised as: JE SSE.

While implementing the recommendations of 6th CPC, the two grades viz: JE-I & JE-II have been merged as JE with GP 4200 in PB-2 and SE & SSE have been merged as SSE with GP 4600 in PB-2. This merging has been done without visualizing the fate of technical graduates inducted during the 3rd CPC.

During the implementation of MACP, the financial upgradation for technical graduates appointed as Apprentice Chargeman ‘A’ should have been started from GP 4800 for first MACP, 5400 for second MACP and finally 6600 for third MACP.

Because of not going into the details of the qualification of engineers during merging, it has resulted in some of the graduate engineers recruited as JE-I to loose one financial up gradation their career.

M I N U T E S (10/11-07-2013):Chargemen ‘A’ were inducted in Rs.550-750 Scale in the 3rd PC, which was revised to Rs.5500-9000 in Vth PC and replaced by GP of Rs.4200 in the 6th PC. The MACP entitlement will be regulated accordingly. SWRMU mentioned that only 2 MACPs have been accorded instead of 3 MACPs. Relevant details will be submitted by the Union and it will be examined further.

Union mentioned that direct recruitment of Chargemen ‘A’ was in Rs.550-750 Scale in the 3rd PC. Subsequently the direct recruitment quota was upgraded to 6500-10500 in V PC equivalent to GP 4600 in VI PC. Thus those who were appointed in Rs.550-750 Scale in the 3rd PC should get MACP to GP 4800, 5400 and 6600. DS/Workshop has agreed to furnish details of such cases. On receipt of the same, it will be examined further.

DEPLOYING OF AEN TO HUBLI WORKSHOPThis Hubli workshop is having several engineering problems between the four walls as and when these subjects pertaining to engineering discussed with the SSE available he is unable to make any kind of decision effectively and he has to again depend upon the Division.

And whenever the branch is conducting the PNM in branch level no DEN or AEN is attending as and when the subjects pertaining to engineering are available. Hence this Union urges the administration to deploy one AEN to Hubli workshop.

MEDICAL HEALTH UNIT TO HQ OFFICE (NEW GM OFFICE)

The S.W.Rly zone started functioning since 2003 onwards. The HQ Office New GM Office building located at Gadag Road, Hubli. Offices: CPO, CCM, CSTE, Raja Bhasha Office, CEE, Statistical, CSO, CSC, FA&CAO & COS have been already functioning and shortly CME & COM Offices are going to come to New GM Office building. This HQ Office located centre of GSD and EMD Shed. HQ staff strength is nearly 500 employees, EMD shed Staff strength is nearly 600 employees and GSD staff strength is nearly 300 employees. All together total strength is coming nearly to 1500 employees in this location. Whereas no any health unit is available in these work place. There is a very difficulty in emergency to take first aid in duty hours if anything’s happened and Railway colony also available at same place. The Central Railway Hospital is away for more than 3 kilometers from these three offices and no any frequent bus facilities or Auto Rickshaws facilities.

In view of the above circumstance, the Union urges to take immediate step to open a Health Unit at New GM office building to overcome the problems in the office hours as well as railway family & children’s.

CMD mentioned that CMS/UBL (Division) has been advised to look into the matter and put up a proposal as per the needs.

During the discussions, CMD was of the opinion to close the Health Unit at MTS colony and shift the same to HQ building, for which SWRMU has not agreed, since around 100 families are visiting the MTS Health unit daily. CMD suggested that the feasibility of working of Health Unit at GM’s office and MTS colony for three days each in a week will be looked into. CMD mentioned that the Health Unit at Hubli Divisional Office was opened without the approval of CMD.

CMD suggested that the feasibility of working of Health Unit at GM’s office and MTS colony for three days each in a week will be looked into by CMS/UBL, since all the Health Units are under the Control of CMS.

CMD has further mentioned that the suggestion of GS will be examined and accordingly a decision will be taken.

The S.W.Rly started functioning since 2003 onwards. The HQ Office New GM Office building located at Gadag Road, Hubli. Offices: CPO, CCM, CSTE, Raja Bhasha Office, CEE, Statistical, CSO, CSC, FA&CAO & COS have been already functioning and shortly CME & COM Offices are going to come to New GM Office building. HQ staff strength is nearly 500 employees. No permanent Railway Canteen in New GM Office building. The staffs working in these offices are going outside the office premises to take Tea & Snacks. This is creating more problems to staffs as well as officers harassment to staff.

In this situation, the Union urges to take immediate step to open a permanent Railway Canteen in New GM Office building to overcome the problems.

EXTENSION OF ENHANCED CRITERIA OF 1900 GP CATEGORIES UNDER LARSGESS TO TECH.III LARSGESS FOR SPECIFIED SAFETY CATEGORIES OF STAFF CARRYING GP 1800/1900 HAS BEEN ISSUED BY BOARD VIDE RBE NO.99/2011 & RBE NO.04/2012.

When the scheme was expanded by enhancing the criteria of GP 1800 to 1900, it was clearly stated that the list of safety categories covered under the scheme in GP 1900 shall be the same as already circulated vide Board’s letter dated 11.09.2010. As per this, the Helpers in GP 1900 assisting the Technician is eligible for benefit under LARSGESS. The Technician Gr.III are also coming under GP 1900 and they are not independent of duty but assisting the Tech.I/Sr.Techs. Whereas on this SWRly the same is not extended to the Tech.III in GP 1900 & coming under safety category for LARSGESS. Therefore, the Union urges to extend the enhanced criteria of GP 1900 to Tech.III under LARSGESS.

The list of categories indicated in Boards letter dated 11.09.2010 covers only categories operated in GP of Rs 1800/-. Vide letter dated 28.06.2011, the categories finding mention in this list, operated in GP Rs. 1900/-, were also made eligible for benefit under LARSGESS scheme.

Among the categories mentioned in this list only Points Man category in SWR is operated in GP Rs. 1900/-. The category of Traffic Porter is operated in GP Rs 1800/-. The category of Technicians does not find a place in this list. Hence, Technician Gr. III, are not coming under LARSGESS. After prolonged discussion and on the request of SWRMU, it has been agreed to refer the matter to Railway Board.

GS/SWRMU has stated that the award has been given based on the amount collected, which is not correct, since the difference of fare for long distance trains will naturally be more and it does not mean that the other staff have not discharged their duties efficiently. He requested to grant cash award for all the ticket checking staff irrespective of amount collected.

Thereupon CCM has agreed to refer the matter again to the Committee for re-examination.

GS once again brought to the notice of CCM that the award has been given based on the amount collected, which is not correct, since the difference of fare for long distance trains will naturally be more and it does not mean that the other staff have not discharged their duties efficiently. He requested to grant cash award for all the ticket checking staff irrespective of amount collected.

GS has questioned the methodology being followed in awarding the limited staff. CCM has mentioned that a detailed reply will be given to SWRMU within 15 days on the criteria on which the particular TTEs were awarded.

However for smooth maintenance of assets at least the existing vacancies in the power depot may be filled up to avoid burden to existing staff and to maintain assets smoothly.

Time and again this union has been raising a demand for posting of required no of staff to meet prudential/maintenance of AC Trip Shed.

The prescribed requirement of staff for the maintenance of a MEMU rake as per railway board manpower planning letter No.2001/EL/G/138/3 dated: 05.11.2002 is 7.26 staff per unit i.e. 1 MC + 3 TC accordingly the total requirement for 2 units i.e. 2 MC + 6 TC works out to 7.26x2=14.52 say 15. Overall staff distribution on Sundays during trip inspection/1A schedule of MEMU:

Apart from the Normal Manpower Distribution in AC Loco Trip Shed during Week Days, Staffs are deputed for the following activities. Daily inspection/Rolling in, Driver Booking attention during evening shift 01 Technician is deputed at BWT.

For Daily Night Stabling attention of MEMU 01 Technician + 01 Helper is deputed at BWT.

Once the New MEMU 150002/150003 is inducted in to service, Trip inspection has to be carried out after six days. At present it is not feasible to maintain the new MEMU rake of SWR 150002/150003 with the existing staff strength. For the Maintenance of New MEMU Rake a minimum the additional staffs of 05 Technicians + 07 Helpers are required.

Further any newly appointed staff from RRC requires time to acquire the skill for maintaining MEMU/AC Loco, if existing Senior Helpers with experience are promoted as Technicians, then acute shortage of Technicians can be dealt with when they take additional responsibility and can be deputed to work with new Helpers where in transfer of skills takes place in a smooth manner.

Hence it is urged that the required no of additional staff may be posted at the earliest at AC Loco Trip Shed/SBC and existing vacancy may be filled up, So that both the MEMU rake is maintained to the expected level without compromising the safety and can run in good fettle without any disruption to traffic.

Time & again this union has been making persistent demand for procurement & supply of branded walky talkie for better communication to the staff involved in train operation and its maintenance duties. Although administrations have given the reply about the procurement of new walky talkie, even till date problem remains same. On account of this, the staffs involved in train maintenance, i.e. TL, Mechanical Running staff’s operating etc are being put into hardship due to non-availability of working condition walky talkie,

Since most of the walky talkies are in condemned condition. This union urges to procure new walky talkie under DS-8.

As per the current regulations of Ministry of Communication, license has to be obtained for each and every new Walkie Talkie to put into use. They will be put into use as soon as license from Ministry of Communications is received.

It was also explained to the SWRMU that for obtaining each license for every Walkie talkie set, an amount of Rs.14,000/- to 16,000/- is required. Hence, Walkie-talkie sets will be provided on need basis. But, GS/SWRMU has demanded that all the Walkie Talkie sets to be replaced with new one without compromising financial implications as the same is being used on safety point of view.

Railway Board vide their letter No. 2002/Sign./PI/I dated: 14.03.2007, a joint circular issued by MT & ML directing all zonal Railway GM’s to provide additional SM’s for those stations having double line sanction with central panel to oversee and check through trains and to exchange right signals for this activities board have instructed to post one additional SM for each shift in addition to regular rostered SM. Since the BWT station meets the above stipulated condition, this union urges to post additional SM as per the above board’s instructions.

PIN-POINTING OF H & MI POSTS ACCORDING TO SANCTIONED STRENGTH AND EQUAL DISTRIBUTION OF GR.I POST TO ALL DIVISIONS WITH OUT ANY DISPARITY.

The sanctioned strength of H & MI posts over the zone is 55 .The previous pinpointing was done without the knowledge of this elected organized labor and distributed these posts to divisions on vested interest of administration. According to CRC report ,the 47% i.e.26 will be in GR.I( GP4600) and remaining 53% i.e.29 in GR.II (GP.4200) . As per CPO/UBL letter No. SWR(P) HQ/535/Medical/H.I. dated 28.12.2010, these posts of GR.I are distributed as follows, 10 posts to each UBL and SBC , 03 posts to MYS and 01 post RWF/YNK, a total of 24 posts distributed like this without any mentioning of 02 remaining posts .As there is anomaly in previous pinpointing which was done without knowledge of this UNION, it is once again demanded to conduct a pin pointing with a discussion with this ORGANIZATION and distribute the posts to all division without any disparity by allotting at least 05 GR.I( in GP of 4600) posts to MYS division i.e.47% of sanctioned 11 posts of MYS division . MYS division is having six major colonies and 120 stations and distance more than 500 KMs and geographically it is very difficult to reach all parts of the division due to which more number of HI Gr.I posts are required for up keep of this vast division

CMD mentioned that the restructuring of H & MI posts is under process and pinpointing of posts will be carried out after restructuring.

GS/SWRMU has stated that the orders of Railway Board on restructuring of the cadre issued in 2008 have not been implemented so far and pinpointing was not done as per the workload, causing much hardship to the employees. There is less number of higher grade posts in Mysore. Further, he has demanded that the present orders of cadre restructuring should be implemented only after completion of the exercise of restructuring orders issued during 2008.

CMD has agreed to look into both the above aspects.

After discussions, GS has made it clear that the issue is pertaining to the cadre restructuring of 2008 and not of 2011. It was agreed that a joint meeting will be convened with CMD and Union shortly and GS has agreed to give further details, if any required in the meeting to sort out the issue.

Further, GS has also demanded that the present orders of cadre restructuring should be implemented only after completion of the exercise of restructuring orders issued during 2008.

RECOGNITION OF GROUP OF HOSPITALS AS REFERRAL HOSPITAL AT HQ LEVEL FOR ENTIRE ZONE.

At present recognition of individual hospital as referral hospitals are being done at divisional level. Because of this, if a particular facility is not available at a hospital recognized by a division, the sanction has to come from CMD to approach another referral hospital of the other division where the particular facility available. This will cause undue delay and create problems to critical patients. Instead of this, if this recognition is done with a group of hospitals as referral hospitals at Zonal level for entire zone, this difficulty can overcome and patients can be referred by CMS of the division as per the needs of patients and save valuable life.

CMD has stated that presently for availing a particular service of a referral hospital available in another division, approval by CMD is given by fax without any delay. MD & all CMSs have also been further advised to refer a patient in emergency immediately, and obtain post–facto sanction of CMD later-on.

GS/SWRMU has explained the difficulties being faced by the relatives of employee in taking the patient to the referral hospital after completing all the formalities especially in case of referral from Hubli Division and requested CMD that the referral to Bangalore area hospital should be made directly without routing through CMS/Bangalore again.

CMD has agreed to advise Mysore and Hubli divisions to initiate proposal to have tie up directly with the referral hospitals.

This subject was deliberated at length. CMD mentioned that the approval of Railway Board is necessary for the 1st and 6th renewal of contract of referral hospitals. Hence, he has agreed that the proposals for renewal of contracts will be initiated two months in advance of expiry of contract, in case the approval is to be given by General Manager and six months in advance of expiry of contract, in case the approval has to be obtained from Railway Board to avoid hardship to the employees.

STOPPAGE OF TRAIN AT ARBT & OTHER STATIONS OF SKLR-SBHR GHAT SECTIONS.

All staff headquartered between DOGL & SVGL of SKLR-SBHR Ghat section does not have any means of access to their head quarters as well as from headquarters to the nearest town of SKLR or SBHR except the train service. ARBT station is yet to be commissioned and there is doubt about opening this station. 15 gang staffs are at present staying at this station, out of which only 3 men are locals who are habituated to come to this place by walking through the forest from their houses. The other 13 men were recruited through RRB during 2012 &2013, native of different places in Karnataka, Tamil Nadu and Rajasthan. All the 5 men from Tamil Nadu and Rajasthan already absconded from this place, due to the above isolation of this place.

ARBT is the heart of Ghat section and treated as the most vulnerable and sensitive spot of the SKLR-SBHR Ghat section. Many landslides were taken place adjacent to ARBT in the past and the recent major land slide on 04.7.2013 was happened just 3 km from ARBT and also detected by the trackmen who was headquartered at ARBT. Being the landslide prone area, presence of sufficient No. of trackmen as well as contractors labors are kept at this place to meet with any emergency, but the administration not thought of providing the minimum facilities for the men who are risking their life to stay here. It is very strange to note that the first and foremost problem of the conveyance to reach at ARBT is yet to be thought by the administration. Since it is not a block station or a halt station, no train is stopping here. There is no road approach to this station and at this circumstance the trackmen and the contractor’s labours are forced to follow any of the following ways to reach as well as to get out of there.

Walk with luggage by head load through track, which have dark tunnels, very deep viaducts, narrow cuttings, poisonous snakes etc. for a distance of 8 KM in the 1 in 50 up gradient to YDK station or 10 km down direction towards SVGL. Their luggage includes rations; clothes etc and it will be very difficult task for a normal healthy person to do so regularly. After reaching SVGL or YDK again they have to request the station master to stop the train and there is no guarantee for that.

Try their luck to draw the attention of the Crew of the train to slow down and jump into the moving train which risks their life!

Wait at SBHR and watch for the movement of Motor Trolley towards YDK and if the trolley is having free space they will be accommodated. Most of the times, the trolley will not be permitted beyond SVGL due to the train services as well as the mood of the section controller and they have to come back to SBHR and again to try their luck in the next day.

To solve the problem, a decision to be made to stop all the up and down train to stop invariably at ARBT as well as all the stations of Ghat section so that the track men can have the facility to go to their home in rest and also to move out from ARBT in case of any sort of emergency.

It was explained that ARBT was a break halt station during MG period and closed for gauge conversion. The station is ready for commissioning. The papers for sanction are submitted to CRS/SBC and are awaiting sanction for opening the station. Hence, stoppage of train at ARBT can be examined only after commissioning of ARBT station.

GS/SWRMU has brought out the difficulties being faced by the employees in the SLR-SBHR Ghat Section of Mysore Division and mentioned that since there is no road access to any of the stations, steps may be taken to stop at least one Express Train during day time for at least one minute in all the stations. CTPM has explained that the stoppage of Express train should have the approval of Railway Board.

On the request of GS/SWRMU, CTPM has agreed to refer the matter to Railway Board.

PROVISION OF LIFT FACILITY AT THE NEW ZONAL OFFICE BUILDING

Maximum number of Head quarters offices have started functioning in the New Zonal office building located at Gadag Road. Both the East wing and West wing are full of offices. There are some group ‘C’ & ‘D’ staffs who are handicapped. They are facing very much hardship in claiming the stairs. The plight of those who have to go to 2nd floor is still miserable. Hence, this union urges the administration to provide lift facility to both the sides of the building very immediately.

M I N U T E S(4/5-02-2014):CEE has mentioned that the provision of lifts to the new Zonal office building will be provided after the construction of third floor as machine rooms to these lifts need to be constructed above third floor by construction organization.

GS/SWRMU has requested that till such time lift is provided, action may be taken to see that Physically Handicapped employees of offices in second floor work from first floor to avoid hardship to them.

Staffs are made to stand in the scorching sun or heavy rains awaiting bus. Since the opening of New Zonal office, the matter has been discussed several times with the administration to provide Bus shelter whereas no fruitful action taken by the administration regarding bus stop shelter near New Zonal office. Hence this union urges the administration to provide bus stop shelter near New GM office at Gadag Road, very immediately.

There is no office available for conducting branch level meetings and to conduct other organizational activities. Now this union is facing much hardship being Single Union as more and more staff grievances are to be attended. Hence, this Union demands the administration to provide Headquarters’ branch office in new Zonal Office premises very immediately.

a) Sr.EDPM is the Head of Computerization of SWR and he should be assisted by Hardware/Software Engineers. No such Engineers are available in SWR since formation and Sr.EDPM is working whose duties are unknown.

b) Parent Railways of SWR viz: SCR & SR had transferred money value of Sr.EDPM/Engineers; those posts are not yet created / manned as on date ie even after ten years of formation of SWR.

In absence of the above, there are delays & irregularities in the Bills. For instance, Hubli division had difficulties in processing the Bills for payment of PL Bonus and DA arrears recently.

The Union therefore, urges for an immediate necessary action on top priority, to create the required posts and establish EDPM centre for SWR at Hubli,

PROVISION OF RESERVATION COUNTER AT PREMISES OF HUBLI WORKSHOP

Hubli workshop is having more than 3000 employees working which is not provided with reservation counter whereas the Head qrts and division do not have more than 1000 employees working where they are provided with separate reservation counters.

Hence this Union urges the administration to provide separate reservation counter at Hubli Workshop premises.

It was stated that Railway Board vide letter No.2006/C&IS/PRS/Non-Cash/28 dated 22.11.2010 and 12.01.2011 has permitted for opening only one PRS non-cash/enquiry terminal at each Zonal Headquarters. However, one non-cash PRS counter at New Zonal Headquarters building at Gadag Road and one more PRS counter at DRM’s building have been provided for the exclusive use of staff. Staff may make best use of these existing two counters which are located within a distance of 2 KMs. In addition, the main PRS at Station is also less than a kilometre from Railway Workshop.

During the discussions, GS/SWRMU highlighted the benefits in opening the PRS counter at Hubli Workshop, for which CCM has stated that we may not be able to operate the counter due to shortage of manpower even if it is opened. GS/SWRMU has informed that the manpower will be provided to operate the counter from Hubli Workshop, if CCM provides the basic infrastructure for which CCM has agreed.

After lengthy discussions, CCM has mentioned that the staff of Workshop may not be able to perform the duties at Reservation Counter though they are qualified technically as it requires not only technical knowledge, but also the knowledge about the commercial rules and circulars. Seniority of the employees of South Western Railway may be uploaded in the internet for their clarification and transparency as the neighbouring railway i.e. Southern Railway which is having more than one lakh employees are being provided with this facility.

Hence this union urges the administration to make it possible to upload the employees seniority in the internet.

PROVISION OF ADDITIONAL CUG SIM CARDS – 254 NOS.FOR VARIOUS DEPARTMENTS OF HUBLI DIVISION.

The requirement of additional 254 CUG SIM Cards for Supervisory & other staff of various departments of Hubli division is a long pending issue which is only under correspondence and not materializing to provide the same.

The Hubli Division with various departments caters to the administrative needs of more than 12000 employees working at various stations over Hubli division. The need of the day is faster communication for immediate necessary action and therefore, in order to ensure faster dissemination of information and to get the work done continuously, it is imperative that each one of the Supervisory & other Staff are provided with CUG SIM cards which will certainly result in overall improvement of functioning as there will be no communication impediments or lack of accessibility in dealing with official matters.

Therefore, the Union urges to provide the 254 additional CUG SIM cards immediately to the Hubli division.

CSTE has informed that the proposal for S&T and Finance for 32 Nos. of CUG SIMs has been vetted by Associate Finance. He further stated that the process will be initiated as and when the proposal is received from individual departments.

To avoid revenue loss and for Quarters maintenance these vacant Quarters at Gadag (Mechanical Pool) may be allotted to needy Railway employees.

As far as possible, Railway Quarters are being allotted to the needy employees on priority and also on out of turn (as the case may be) for the employees who are headquartered at Gadag. There are no instances of any individual cases pending.

Hence it is suggested to consider these BE/Diploma candidates who are referred to HQ also to be considered at Division level also for Group C appointment and two chances should be given as per Rly Board orders till such time selection is taken at HQ to avoid loss of financial benefit of grieved family as done in S.C.Railway.

All the three divisions and two workshops of SWR are conducting children’s women’s and employees camp every year, plus two camps by HQ. To conduct 17 such camps every year, SWR is having only one camp coach which is aged and about to condemn during 2014.

Further, the camps being organized by divisions/workshops are many times getting over-lapped and therefore are one of them are forced to postpone and due to so many other official works, difficulties are experienced to conduct the camp once it is postponed. Especially, the Children’s camps are to be invariably conducted during Summer/Winter Holidays only in view of school vacations.

Hence, this union request the administration to convert two AC coaches (3 Tier) into CAMP coach on priority since all employees are eligible for 3AC and having two camp coaches will ease the situation

DENIAL OF THIRD MACP FOR SMS WORKING IN MYS DIVISION(SWRMU’s letter dated 17.10.2013 to CPO/UBL)

There are lot of complaints received from MYS division SMs category, Pro-ASMs batch no.173 appointed in Railway in 1984, some of the people working in Hubli got third MACP whereas same batch people Sri. H.W.Fernandes, now working as SM/Ammasandra, MYS division also eligible to get third MACP in grade of 4600 whereas since these employees went request transfer to MYS division from UBL division but MYS division is denying MACP as they have gone on their own request transfer the total service will not be counted and the MACP is rejected.

There is a Railway Board order No.PC-V/2009/ACP/2 dated 10.6.2009 (RBE No.101/2009) circulated vide no.SWR/P/R/529/MACPS/Policy, dated 29.3.2010 as per which the total service to be counted and accordingly Hubli division has issued orders for the due staff. But MYS division is denying the same.

There are lot of other SMs denied of this MACPS viz: M.S.Sharma, SM/DVG, T.P.Ranganath, SM/GBB, M.S.Srinivasa Rao, SM/TTR, H.T.Puttaswamy, SM/SPGR, Vijayendra Rao.C., SM/NTR, T.Thippeswamy, SM/NTR & others of Pro-ASM batch no.173/1984.

It is therefore requested to issue necessary directions to the MYS division to extend third MACPS to the above said employees & others without any further delay.

As could be seen from the statement, all the employees were granted 2nd Financial Upgradation under MACPS w.e.f. 01.09.2008 and they are due for 3rd Financial Upgradation under MACPS in October-2014 only.

GS/SWRMU stated that they were absorbed to working posts curtailing the training period. Hence if the service is counted from the day they are placed on working posts, they are eligible for MACP from earlier date than that mentioned above. It was agreed to examine this aspect.

APPOINTMENT ON SPORTS GROUNDS (SWRMU’s letter dated 20.08.2013 to GM/SWR/UBL)

The Railway Board has allotted for 2012-13, 55 posts can be appointed on sports grounds, whereas only 6 are appointed and for 2013-14 also allotted 55 posts but so far no process for filling up of the same. Because of new candidates not appointing in sports quota, our Railway is not getting good places in sports since the old people only available. If the quota is not filled in the same year, it will lapse.

Sports people are also complaining that they are having 15.00 hours relief for practice but in some areas they are not at all relieving them to go for practice in the evening at 1500 hours for which Board’s instructions already available. Some remote places like CLR, the sportspersons are forcing because there is no any facility available in such a gnat places.

One or Two sportspersons (body building) have got award in the International Body Building event, such people should be encouraged by giving some award.

Divisions recruitment also, in all the divisions the quotas are not filled up including Workshops.

So, the union urges to help the poor sportsmen for serving to the Railways, if they are qualifying. Suitable instructions be given to the concerned officers in this regard to fill up the quota fully

It was stated that all concerned are advised for relief of sports persons for practice. Railway Board’s policy of giving increments to sports persons for excellence in sports is being followed. For filling up the sports quota, necessary process is initiated.

During the discussions, GS/SWRMU has highlighted that 55 posts allotted under Sports quota to SW Railway has not been filled and moreover there is no provision to carry forward these posts for the ensuing year. Hence, he requested to initiate action within the stipulated time every year so that vacancies under Sports Quota can be filled up. Further, the sports persons should not be posted in shift duties especially in Commercial and Operating Departments as they are not able to go to practice.

CME mentioned that efforts will be made to fill up the quota. Posting of sports persons will be kept on watch. SWRMU is welcome to bring out any specific case for needful action.

It was mentioned that the notification will be issued shortly. Game-wise distribution has already been made. This year quota will be filled up and old quota for the previous years has to be treated as lapsed.

In this connection, President/SWRMU has pointed out that on earlier occasions, Vigilance Department have interfered in the selections and could not complete the selections in time and the quota allotted has been lapsed. Hence, he suggested that time limit has to be prescribed for completion of investigations by Vigilance Department in any selections.

In pursuant to the demand made by this union in one of the DRM/PNM during 2009 the ancillary cadres of S&T like cable jointer, painter, blacksmith, tinker, Diesel Mech trades, etc have been merged with one cadre it, ancillary fitters with one seniority vide CPO/UBL Letter No.SWR/P/HQ/621/GN/S&T, dated 24.06.2010. very recently vide Sr.DPO/SBC Memorandum Ltr No. B/P.694/V/PNM/FNM/2009 Dt: 20.07.2012, the ancillary fitter cadre of Mechanical C&W wing of SBC division have been merged with regular stream of C&W with HQ approval to facilitate better promotional opportunity to the incumbents who are over staying in the above ancillary cadre over decades without any promotions. Hence this union urges to communicate the approval for merger of ancillary fitter cadre to the regular stream of technicians in the Signal wing.

CCM has mentioned that a meeting was held with Southern Railway officials on 24.06.2014 to sort the issue and a copy of the minutes was handed over to GS/SWRMU. After going through the minutes, GS has expressed his displeasure as few trains were going to be handed over to Southern Railway.

In the presence of General Manager, this issue was raised on 10.07.2014 once again and after prolonged discussions it was agreed to keep the proposal in abeyance.

PROCUREMENT OF AMBULANCE VAN TO HU/YPR.

The YPR have become the 2nd terminus station in SBC division. about 800 staffs are working at YPR area. A part from this YPR colonies having 800 Qtrs wherein a total of around 3000 peoples including Railwaymen and their wards are availing medical facilities at HU/YPR. The Railwaymen’s are finding serious hardship and inconvenience during emergency particularly accident/ IOD while on duty to get them shifted to RH-SBC/ other referral hospitals due to non-availability of Ambulance van. This issue has been discussed at Division and it has been replied to us that necessary proposal has been send to HQ.

In view of the above this union urges to communicate the approval for procurement of ambulance van.

GS highlighted the recent death of one AC Mechanic in the absence of doctor and ambulance. CMD has mentioned that the proposal is being initiated at Divisional level and assured that the ambulance will be made available within six months. CMD also made it clear that till such time ambulance is made available, Imprest can be utilized to hire the ambulance in case of emergency.

Item No.4/2014 CHANGE OF CLASSIFICATIONS OF SMs OF NRYP & BSPL.This union has demanded to change the rosters SM’s of NRYP & BSPL at par with SSPN. During 2011 the actual job analysis has been conducted and based on the jurisdiction the roster’s of SM’s was changed to upgraded classification from EI to C . since then onwards this union has been persistently requesting the administration to implement the changed classification to NRYP & BSPL on the lines of DPJ station wherein FJA was conducted only at DPJ the justified change of classification has been implemented for entire section from BAND to OMLR. However, this has not been done in case of NRYP & BSPL. Once again this union urges to communicate the HQ approval to change the rosters of SM’s of above station from EI to C.

VIOLATION OF POLICY IN RESPECT OF TRAFFIC INSPECTORS IN OPERATING DEPARTMENT:

This union had tabled an agenda in one of the Divisional PNM held during 2007 & again during 2013 duly highlighting the violation of policy in respect of selection of TI’s of operating department vide agenda No.85/07 & 01/07/2013. In terms of instructions contained in CPO memorandum No.SWR/P/694/II optg dated: 28.09.2005 appended below for ready reference.

A. The post of Traffic Inspectors Operating shall be filled up by calling volunteers from the SM’s in the respective grade and their suitability to be adjudge through Viva Voce by a committee comprising of Sr.DOM, Sr.DSO & Sr.DPO/DPO at the Divisional level and by a JAG or above Officers to be nominated by COM at HQrs level.

B. The tenure Traffic Inspectors Operating shall be 3+1+1 years at the Divisional level and 5+2+2 at Zonal Hqrs level.

C. The Traffic Inspector Operating also shall be objected for periodical transfer.

D. Traffic Inspector Operating deployed to Station working rules and planning sections as far as possible may be imported adequate training at ZRTI’s.

The final minutes drawn as follows: “Notification shall be issued as per Railway Board/Hqrs instructions”. Although selection was held during 2013 only 8 candidates have been selected and 3 incumbents who are long staying have been retained beyond their completion of their tenure. In some of the cases TI’s who have got selected during decades before are still working as TI’s in other jurisdiction/areas. It is very crystal clear from the above letter that the divisional selection post of TI shall hold the post for the period of three years tenure plus one year with the approval of DRM. All the existing TI’s baring 2 or 3 individuals, majority of the TI’s are over continuing in the post beyond permissible period without going back to their cadre to satisfy the condition of cooling period from one tenure post of another tenure post. This is serious violation of the instructions of Railway Board/Hqrs. On account of this, the interested volunteers from SM’s cadre are frustrated due to non-repatriation of tenure completed TI’s.

Hence this union urges to repatriate tenure completed TI’s as per the above instructions.

It may be noted that less number of Station Master are volunteering for TIs job, and the competent persons are not volunteering. It has become inevitable to retain the existing TIs to manage important day to day activities. However, a shift is being done within office to ensure that TIs are not kept in the same post more than the tenure.

However, GS pointed out that minimum cooling off period should be observed before allowing the employee to continue on the ex.cadre post as per the extant instructions of Railway Board.

MANNING OF TRAIN BY TICKET CHECKING STAFF CONSEQUENT ON NON DETACH OF AC & SLEEPER COACHES OF T.NO. 16221/22 AT SBC.

The partial manning of trains is under discussion from quite a long time at various forums up to Zonal PNM to finalize the manning of coaches by one division/one railway instead of bifurcating two railway & two different divisions.

So this union had tabled an agenda in 18th GM PNM held with SWRMU held on 12.07.2011 to 13.07.2011 urging the administration to finalize the partial manning by the Ticket Checking staff. In pursuant to our demand CCM had made a reference vide D.O.Letter no.C.568/Tkt.Chg/Manning of Trains/11 dated 21.07.2011 communicating to CCM/Southern Railway to follow the uniform pattern of manning train by Ticket Checking Staff of one zone/division.

Hence, this Union urges to convene joint meeting between SR & SWR to finalize the sharing of trains.

REPLACEMENT OF EXISTING OBSOLETE TYPE LIFT BY DOUBLE DOOR NEW TYPE AT DIVISIONAL OFFICE/MYS

The existing lift at Divisional office building being old and has served more than 15 years. Due to its long year of service the lift is getting frequently failed and the agency which is holding AMC of the lift is facing difficult for replacement of defective components being the model of the existing lift has become obsolete. The differently abled employees and heart patients working at 1st and 2nd floor are facing much problem during the frequent failure of the obsolete lift. Hence this subject was placed in divisional PNM and discussed with the concerned several time but nothing has come out. Based on that division has sent the proposal for replacing the existing obsolete type by double door new type lift and CEE/SWR/UBL approved this with a remark “APPROVED BUT THE PROPOSAL TO BE PROCESSED UNDER THE PLAN HEAD 64 - OTHER SPECIFIED WORK (OSW)” and in turn Sr.DEE/MYS has complied for this remark by up loading the work in IRPSM under PH-“OSW”. Hence this UNION demands to take up the above work under the power of GM out of turn for the year 2014-15 .

UTILIZATION OF KRCL CREWS TO WORK AT MYS DIVISION AND FORCING MYS CREWS TO WORK AT UBLDIVISION.

(A) Crew of ASK /SKLR are working goods train working up to PNMB which is exceeding normally duty hours while returning back keeping ASK /SKLR crew over lap at PNMB ,KRCL CREWS are utilized to work up to SBHR in MYS division over lapping the rest cleared MYS division crew. Hence this UNION urges the administration to stop KRCL crew working in MYS division.

(B) At present the crews of MYS division of JRU-BAY section are working more than 12-15 hrs and 220 KMs and now the administration is forcing these crews to take LR at TNGL SIDING(Which belongs to UBL division) but this will exceeds their duty hours and thus infringe HOER. Within a span of 5 days i.e. from 25.12.13 to 29.12.13, SIX trains were exceeds the working hours. After reaching TNGL, crews are being detained more than the permissible rest and in some cases whenever EDP to crew to return HQ, convenient trains won’t be available and due to which staff are put over burdened. Hence this UNION urges the administration to avoid MYS division crews working up to TNGL siding.

M I N U T E S:

COM has mentioned that crew utilization is based on availability and traffic pattern. Fluctuations of traffic flows have to be met with by utilization of crews to optimum extent. He mentioned that KRCL crew will not be allowed to work, if rest cleared staff of SWR is available.

GS/SWRMU has mentioned that only in case of emergency, crew of KRCL have to be utilized to work over the jurisdiction of SWR and not by keeping the rest cleared crew of SWR.

Item No. 9/2014 ABNORMAL DELAY IN PAYMENT OF EX-GRATIA TO FAMILIES OF RAILWAY EMPLOYEE WHO DIE-EN-HARNESS WHILE ON DUTY IN MYS DIVISION:-

This UNION was continuously raising the subject of payment of ex-gratia lump-sum compensation to families of railway employees who die-in-harness while on duty. The following three cases were placed in our FNM during 2010 and for that a reply was given by the division that it has been sent for HQ for necessary approval but nothing has come as yet. 1.Smt. Mayamma. w/o late Nanjegowde, ex-gangman in gang No. 8/SSE/PW/MYS 2.Smt. Kamalamma, w/o late Bhadrachari, ex-keyman/SSE/[W/O/CTA & 3. Smt. Anjamma, w/o late Venkitesh, ex-khalasi/SSE/BRIDGES/O/MYS Hence this union urges the administration to payment of the ex-gratia lump sum to the families of railway employee who die-in-harness while on duty without any delay.

Though MYS division is having a route KMs of 1160, there is an only three control board which is putting lot of hardship and strenuous work for the existing controllers, while the other 2 divisions are having 4 control boards. Hence this UNION urges to arrange to open one more control board at MYS division.

ERRONEOUS MEDICAL EXAMINATION AT MYS DIVISION.

A number of re-medical cases of this division are getting a report UNFIT even though the referral hospitals are certifying that there is no health problems to the person sent for medical examination. For example, recently Shri Luhit Kumar was selected as ALP and in initial medical examination at RH/MYS he has been declared UNFIT in A-1. Consequent to this he submitted a request for re-medical examination and was underwent re-medical examination at RH/SBC and from there also he was found to fail in binocular vision and further he was referred to Shankara netralaya , Chennai , for further evaluation in detail for binocular vision. From Sankara Netrala it was certified that he had no specific complaints .Even after this he has been declared as UNFIT for the post. Hence this UNION urges the administration to reconsider all such cases and to arrange a remedial examination in a candid way.

It was mentioned to the Union that initially the candidate was medically examined at RH/MYS and found unfit. CMD has considered appeal for re-medical examination of the said candidate with a Medical Board at RH/SBC, where he is found “UNFIT IN CLASS AYE-ONE”. The proceedings of the said Medical Board was accepted by CMD as per the extant rules.

This subjected was deliberated again with CMD at length and CMD has agreed to review the case once again in terms of extant instructions.

ENHANCING THE GENERAL IMPREST & MEDICINE IMPRESTAT RH/MYS.

At present the general Imprest amount at RH/MYS is Rs.15000/ which is used to meet the expense like Quality test of medicines, Food sample analysis, minor repair of instrument/machinery/equipment, purchase of surgical items X-RAY items, Laboratory items, blood bank charges, miscellaneous items in which includes Xerox charges, computer peripheral consultation charges to honorary visiting consultants, chemical examination of blood samples and the MEDICINE IMPREST of Rs.20,000/- is used for Local purchase of medicines. These amount were fixed during the year of 2008, from that period the all the market value of the above items have been increased 5 to 6 fold but the amount of Imprest remained unchanged. Because of this meagre amount of Imprest, the bills are getting undue delay for further recouping fresh amount and due to which patients are suffering in emergency situation for the want of medicines/machinery. Hence this UNION urges the administration to enhance the general Imprest and medicine Imprest to Rs.50,000/- for ensuring timely medicines to needy patients of the division.

It was mentioned that CMS/Mysore has been asked to send the revised proposal as per the present requirement considering the availability of the referral services, with proper justification.

Item No. 13/2014 CONSTRUCTION OF NEW RAILWAY QUARTERS AT CWS/AP

A total of 1900 staff are working at CWS/AP. Only 300 quarters are available which are aged more than 50 years. Half of these quarters are not fit for safe living. In addition to this, around 200 new RRC/RRB candidates have been appointed at CWS/AP in last two years. 80% of new appointees are from different states/places away from Mysore. In the seniority list for new quarters, more than 150 applications are pending. Hence, it is high time to construct new quarters. Hence, this union request the administration to construct a minimum of 200 new quarters (Type-II & III) at CWS/AP.

(A) The following common medicines are not issued from HU/AP and it is understood that these medicines supply is not regular. Imprest cash is being used for purchasing these medicines through local purchase. Due to this, purchase of medicines on emergency through local purchase got affected.

(B) Supply of medicines prescribed by Super Specialist on Referral Cases – Present practice is that substitute medicines which are available in Railway Pharmacy is being given against the medicines prescribed by a super specialist on referral cases, namely cardiology, nephrology, neurology etc. Due to this, the expected rate of recovery to patient can’t be ensured and many times when this was discussed with such specialists, they opined against this. (A) – Stepping up of pay of senior employee who got promotion in the V CPC at par with his junior who got promotion in VI CPC --- Pay of senior employee in the same cadre having identical pay and scale of pay in the V CPC should be stepped upto pay equal to his junior’s pay when junior gets promotion in VI CPC. In this regard, a clarification should be issued from CPO to implement the same in the field offices. (B) – Stepping up of pay of senior employee at par with his junior while granting one increment to those whose increment was due between Feb to June 2006 in the V CPC – Cases are reported that senior employees are drawing less pay compared to their juniors when junior’s pay was fixed while granting one increment to those whose increment was due between Feb to Jun 2006 in the V CPC (RBE 40/2012) based on Rly Board letter dated 23.2.12. Hence, it may be clarified to all concerned about the stepping up of pay of such senior employees at par with juniors while implementing RBE 40/2012.

STAFF SANCTION FOR 182 LOCOS AT EMD DIESEL SHED, HUBLI

EMD Diesel shed Hubli has staff sanction for only 150 locos till date. But as of now this shed is maintaining more than 182 locos. So it is injustice on the part of the employees in less number and working for more number of locomotives. So it is a right of the staff of EMD Diesel shed to place a requisition to sanction staff for 182 locos. Hence, this Union urges to sanction staff for 182 locos.

Item No. 18/2014 PROVIDING CHANGING ROOM AND WATER FACILITIES NEAR THE GANG BOX.

Most of the Trackman are coming from far away places after reporting for duty near the Gang box for Muster, they have to changed the dress and they don’t have any privacy for changing dress. This union urges to provide one small room near the gangbox with water facilities as the gangboxes are provided near the station vicinity, so that they can change the dress and use water facilities.

At present there is no policy guide lines for providing dress changing room at the Gang Box. Water facilities are provided at stations and at few manned level crossing gates in the mid section through tap connection and bore wells and the same is being utilised by the Gang Staff.

ISSUING OF DUPLICATE SLIP FOR MEDICINES AT CH/UBL

In Hubli Central Hospital while issuing medicines a duplicate slip from the doctor is issued and the pharmacist after issuing the medicines has to procure the slip whenever the Audit comes they have to show the slip. The medicines costing more than one rupee has to be procured and now a days all the medicines are costing more than one rupee and it is very difficult to procure the slip in large quantities. Whereas South Central Railway has already circulated notice vide MD No. 69/P of 30-11-2011, that any drug costing above Rs.5 the duplicate slip to be procured. It is requested to follow par with S.C. Rly.

ATTENDING OF FAILURES IN WAY SIDE STATION OF S&T DEPARTMENT

Whenever there is a failure message is given to ESM on duty and the ESM moves from the Head quarters by the first available train passenger/goods train to the station where the failure is. After attending the failures there will be no means of transport for the ESM to come back to Head quarters. Especially during night times the ESM has to wait on the platform. So it is requested, after attending the failure first available train towards the ESM HQ’s Pass/Goods can be stopped for a minute. So that the ESM can go back to his Head quarters.

Legislation of procedure is not desirable as stopping of express/passenger trains out of course is not within the competency of the zone. However this will be sorted out by inter-departmental co-ordination with control.

In the Statistical Branch, Headquarters office all the furniture ie, chairs & tables are very old and broken condition, the staffs are using the same, it is very much difficult to set and work In the duty hours. This union discussed the matter with the administration, the administration told that new furniture’s will be provided in new GM office building in gadag road, now almost all the office located in new GM office, but till date no new furniture’s are provided. this union urges the administration to provide new furniture’s to statistical branch duly changing the old very immediately.

Further, as per the information obtained that the Golden rock workshop of Southern Railway is also not debited with LAP on account of Unpaid holidays to the supervisory and ministerial staff. Hence, this Union urges the administration to stop debiting the LAP from the supervisory and ministerial staff of Hubli workshop on account of unpaid holidays.

Sri. Raghu Prasad.S., Jr.Trackman working under SSE/PW/HPT of Hubli division has submitted application for inter divisional transfer on bottom seniority in January 2012, but so far the same has not been forwarded for further necessary action. The above named was appointed in the year 2005 and since then he has been working at HPT. Being native of Mysore and his aged parents are residing at Mysore. His mother is frequently falling sick and he is the only bread winner in his family. He is facing lot of hardship with two establishments and since as he is unable to take care of his parents at their old age As the position of Trackmen vacancies have been considerably improved, it is requested to consider his application for transfer to CWS/AP/MYS as a special case in view of his domestic difficulties and that he has been working at HPT since 2005 onwards. Hope, the above request will be considered sympathetically for needful action in the matter.

FILLING UP OF THE POST OF DESIGNATED OFFICER UNDER FSS ACT, 2006.

As per the RB’s lr.no.2012/H-1/9/2/1 dt.29.10.2012 the work charge post of “Designated Officer” (Gr.B post) has been created in S.W.Railway in the month of Oct-2013 itself in view of implementing the ‘Food Safety and Standard Act, 2006’ in our Railway. Two Food Safety Officers drawn from the Health Inspector category are functioning full time. Dr. Mane, Dy.CMD/SWR has been nominated for the post of “Designated Officer” and looking after the duties as additional charge.

In this connection this is to bring to your kind notice that as per the Rule no.2.1.2 of FSS Act, 2006 the “Designated Officer” shall be a “whole time officer” with minimum of Bachelor’s Degree in Science with Chemistry as one of the subjects and also person having been appointed as Food Inspector having qualification prescribed under PFA Rules 1955 or as local health Authority shall be eligible for the post of “Designated Officer”

Moreover as per the Rule 2.1.2 (iii)b, if the post of Designated officer held by any other officer as additional charge basis the Officer shall continue to hold such additional charge till such a time a whole time Designated Officer is appointed or for a period of one year from 28.3.2008 whichever is earlier. So the nomination of Dr.Mane, Dy.CMD as Designated Officer is not valid as per the provision of Act.

It is regretted to inform your goodself that our administration has violated rules of FSS Act 2006 by not taking any initiative to fill up the whole time Designated Officer in spite of the availability of eligible candidates in Health Inspector category.

Hence, it is requested to your goodself to kindly look into the matter for necessary action to fill up the “Designated Officer” post from the eligible candidates as per the norms of FSS Act, 2006.

It was mentioned that Shri T. Penchalaiah, Health Officer/HQRS/ UBL was notified by FSSAI vide order no. 1(42)2011/Railway/FSSAI dated 19/06/2013, to work as a “Designated Officer”. After his retirement as there was no health officer available in SWR, Dr. Ramakrishna Mane, Dy. CMD/SWR was notified as “Designated Officer” by FSSAI vide Order no. 1(42)2011/ Railway/FSSAI dated 24/10/2013.Selection of the one post of “Health Officer” is in the pipeline. Nomination of the Designated Officer will be done after the finalization of the above selection

GS/SWRMU has mentioned that the subject was misunderstood. In this connection he has clarified that the subject was with regard to creation of Food Safety Officer in terms of Railway Board’s Letter No.2012/H-1/9/2/1, dated 29.10.2012, a copy of which was handed over to CPO in the forum. CPO has stated that the issue will be examined once again in terms of the letter given by GS/SWRMU.

GS also mentioned that the above post to be filled up by calling volunteers on full time basis and not on nomination basis.

Item No. 28/2014 SELECTION FOR THE POST OF STAFF & WELFARE INSPECTOR IN PB 9300-34800+GP 4200 (35% QUOTA) OPEN TO ALL GR-C & GR-D EMPLOYEES (Ref: DRM/P/UBL LR.NO.H/P.608/I/S&WI/STREAM-I&II DATED 09.10.2012)

Notification was issued for conducting selection for the post of S&WI for total of 07 vacancies (UR=5, SC=2). Written examination also held and results also declared vide H/P.608/1/I/S&WI/Stream I & II dated 01.04.2013 in which 7 employees were qualified. Before panel could be released, the SDGM Office has seized the records and till now nothing has been done. In view of this the Hubli division is facing shortage of Welfare Inspectors and the compassionate appointment reports are delayed badly. The available staff are overburdened with work. Because of the delay in finalizing the matter, the vacancies could not be filled and no further selections could be held. This subject I have also discussed with your goodself.

DELAY/REGRET CLAIMS WITHOUT PROPER REASONS IN REIMBURSEMENT OF MEDICAL EXPENSES. There are many cases coming up for the medical reimbursement rejected by Railway Hospital, Hubli.

Example: the following some of the cases are furnished below for necessary action.

(a) Sri.D.Panneer, Rtd.SMR/MRB

The claims of reimbursement of medical expenses incurred for his self treatment during 2011 & 2012 at Vellore in view of emergency, is still pending. The employee has retired from service and facing lot of financial crisis. His health suddenly became worse and got admitted in the CMC/Vellor on 4.8.2011 when he proceeded to his native place since received death message of his sister. He was diagnosed as chronic kidney disease stage-5 and initiated dialysis as an emergency basis and further advised homo dialysis every alternative days. He was admitted from 20.9.2011 to 27.9.2011 for AV Fistula and 29.9.2011 to 4.10.2011 for coronary angiogram for pre-transplant warm u. His brother has voluntarily donated his kidney for him. He got admitted for renal transplant from 14.1.2012 to 28.1.2012 and underwent renal transplant on 19.1.2012 and follow-up transplant OPD for 6 months and has to continue immune suppressive medication lifelong. There are no Govt.institutions nearby to take renal transplant. His wife and minor daughter were along with him to take care of him and they could not move anywhere leaving him alone. His representations dated 23.8.2011, 12.11.2011, 22.2.2012 and 17.6.2012 have not received any attention.

In view of the above, the union urges to reimburse the medical expenses incurred by the above named at CMC Hospital, Vellore immediately.

(b) Shri Noel Pillai OS/Sr.DME/O/UBL. Ref: Representation dated 01/12/2009, 19/12/2009 & 24/3/2010.

CMS/RH/UBL No. H/MD-34/4/10 dated: 03/03/2010.

The claims of reimbursement of medical expenses incurred for his self treatment during 2009. His health suddenly became worse and got admitted in Yelamalli Hospital Hubli. He experienced severe pain in abdomen unable to bear the pain or pass urine. His wife and children rushed to private hospital Yelamalli near to his daughter’s house and Hospital authorities immediately started the treatment, due to the severe abdomen pain it was suspected to be appendices and decided that an operation was needed, after all the necessary tests were conducted as I am a diabetic patient on 17/09/2009 at 9.30 hrs the operation commenced, during the course of operation it was confirmed that the case was of Explorative Luparateum for which a major abdomen surgery was conducted. His wife and children are not aware of the rules and regulations prevailing In the railways, nor do they know the procedure to be followed by approaching the Railway hospital authorities. As he discharged from the Yelamalli Nursing Home, he reported and was placed on sick list from 06/10/2009 to 30/10/2009 vide AMC/DMC No. 055725 dated 06/10/2009- 30/10/2009.

In view of the above, the union urges to reimburse the medical expenses incurred by the above named at Yelamalli Hospital, Hubli immediately.

(c) Shri Prabhu Shankar Kademani MCM in Engg dept. SE/W/O/Qrs/UBL in Hubli division.

On 5th April, 2013 Sri. Prabhu Shankar Kademani consulted doctor at Railway hospital for swelling in his both legs and also inability to walk& stand for long time. From 5th to 9th April he attended Railway hospital and he was treated with some medications but his problem was not resolved. In the evening of 09.04.13 he suddenly developed chest pain at home and it was a medical emergency so he could not go to Railway hospital and consulted the Spandana hospital, Saptapur, Dharwad which is nearer to his house. At Spandana hospital they advised for certain investigations and directed to consult Dr.Vivekanand Gajapati a Heart specialist (cardiologist) and gave some medication to relieve his chest pain. Further he consulted the Doctor and he had to undergo Angiography test at SDM Narayana Hurudalaya Dharwad on 23.04.2013 and had to undergo surgery as early as possible Further he was advised not to undertake travelling. Therefore, he underwent heart surgery and coronary artery bypass graft and was put in ICU. He became normal and was discharged on 31.05.2013.

In view of the above circumstances, the union urges to reimburse the expenses incurred by him immediately.

As the claims are genuine cases since they have they have gone due to the emergency, the claims can be paid to the employees without further delay. As Railway Board advised to see the reimbursement cases liberally and it is also discussed in the Railway board PNM with AIRF.

(b) The reimbursement of Shri. Noel Pillai. OS/Sr.DME/O/UBL was regretted by CMS/UBL vide letter no. H/MD.34/4/10 dated 03/03/2010 as per the Railway Board Policy.

APPOINTMENT ON COMPASSIONATE GROUNDS:

Some of the appointments on CG are regretted/delayed due to which the widow/wards of the deceased employee are suffering. Some of the cases are submitted for speedy disposal and justice:

(a) Sri. Mohammed Ghouse Adoni, S/o.Late.Mohammed Subhani, Khalasi/C&W dept/KOP expired on 10-3-1996 and Shri Mohammed Ghouse Adhoni was called for suitability test on 25-2-2008 and had passed for the post of Tech Gr.III in C&W Mechanical department, and was offered an appointment in fitter Tech Gr.III/C&W department vide letter no. H/P 268/IV/CA/C&W/Vol. IV/ dated: 5-5-2008. As there is a provision for appearing the examination two times Mohammed Ghouse Adoni requested for second chance. So that he can fare better in the second chance and accordingly the second chance was given by DRM/UBL vide Ltr No. H/P268/IV/10/07/110/MS dated: 24-2-2010. Examination/suitability test was held on 16-3-2010. After this there was no communication about the result of the second chance and Mohammed Ghouse Adhoni whenever approached the office he was advised that the result will be advised to you by postal address. So the party after the lapse of the year 2012 requested the administration to comply the old orders dated: 5/5/2008 as a Tech Gr.III in C&W dept, but the administration issued a letter that your appointment order No. dt: 5/5/2008 is not agreed by the competent authority vide Ltr No. H/P268/IV/C&W/Vol. 6/ dated 15-3-2013.

So this union urges to consider compassionate ground appointment with compassion.

(b) Late Sri. Chandrappa M. Potdar Pointsman A/SS/LIM expired on 21-4-2009 and his son Sri. Ravichandra C. graduated in B.Sc Electronics with first class applied for CG appointment and CPO/SWR considered his request of offer and advised him to appear for JE selection Vide Ltr No. SWR/P.268/05/12/UBL/RC/465 of 24-8-2012 and the examination was conducted 26-9-2012 and the results were declared on 8-10-2012 that has not qualified for the exam and Sri. Ravichandra C. applied for NTPC examination in the division on 22-10-2012 and the administration sent a call letter vide Ltr No. H/P 268/CS/CGA/Vol. VII/ of dated: 31-1-2013 and the examination was held on 20-2-2013 and results was declared that he had passed for Tech Gr.III, but to the sup rise a memorandum was issued on 15-4-2013 for the post of Safaiwala vide ltr No. Safaiwala/H/P564/VIII/Medical/Vol.IV of 15-5-2013. And the party approached the administration he was informed. Since he has passed Medical examination in C1 category. Even though he has passed for Group C he will be allotted Group D only.

As such this union urges to offer Ravichandra in Group c category.

Butler Loco Pilot/UBL was sent for PME on 31-5-2005 after conducting all the required Medical investigation it was detected that he had problem in his heart and the Central Hospital/UBL directed him to Rly Hospital/Perambur in Southern Railway .and the report was positive and he is not fit for Loco pilot post and the doctors at CH/UBL decided to make him unfit for drivers post on 26-4-2005. However unfit certificate was issued on 20-7-2005 no obvious reasons and after Medically decategorized Mohammed H. Butler had

voluntarily retired seeking CG appointment to his son Mohammed Sharif but the administration did not consider his request taking that 5 years left over service should be there from the date of decategorization. Hence this union would like to highlight that the medical board had already taken a decision that the employee is unfit for driver’s post on 26.4-2005 but the unfit certificate was issued on 20-7-2005. The party is eligible for CG as he is having 5 years service from the date of decision taken that he is not taken to duty ie, 26-4-2005 and in this connection CMS has given a clear letter No. M/MD/84/Md. HB/12 dated : 2-8-2012 .

So this union urges to consider the Compassionate ground appointment.

The family is finding it difficult to maintain with no other sources of income.

(p) Case of Mr. T.J.Nithin Sagar, S/o T.S.Jayappa, ex.Hd.TE/CTI/O/DVG MYS divn, expired on 30.10.2008. The employee left behind a daughter and a son who were minors. The widow Smt. K.P.Rajamma was informed to apply for appointment of her son Mr. T.J.Nithin Sagar on attaining majority ie. On or after 26.7.2012. Accordingly, when the widow has sought for appointment on compassionate grounds vide her appln dt. 30.7.2012, ie immediately on attaining majority by her son and without sending him for further education, in view of financial difficulties she was facing. But, her request has been rejected stating

that her financial condition is satisfactory since she was working as Teacher in the Govt.Primary School. Her earnings as school teacher is not sufficing her needs to look after the education of her daughter and she has incurred loans for treatment of cancer. She herself is suffering from perennial health problems and spending nearly 2000/- per month for treatment. She has incurred loans to the tune of 11 lakhs for treatment and most of the settlement amounts has been used for clearing the same and now left with no cash on hand. She has also taken loan from SBI 12.5 lakhs for constructing a small house with one floor in outskirts of the city and being lone woman with 2 minor children, she has asked her cousin to stay in the first floor for her protection. She is not getting any income ( rent) from the house. Further there is no income from the ancestral property of uncultivated land.

As the widow is also aged and suffering from perennial health problems and the teacher job is not of permanent nature and the children are too young, there will be none to look after them in case of her death. Hence, the case is genuine since the finance condition is not satisfactory. Therefore the union urges to offer appointment on compassionate grounds immediately to Mr. Nithin Sagar, S/o Late Sri. T.S.Jayappa, ex.Hd.TE/CTI/O/DVG MYS divn.
