and a hard place.’ Sometimes vague
statutes written into law can be subject to
misinterpretation or implications never
intended. Time has run out for another
contractor, so don’t let this happen to you…
Q: We have several Home Improvement
Salespeople (HIS) registered on our license.
I am the Responsible Managing Employee
(RME) on the license and my boss recently
suggested that I should register as a Home
Improvement Salesperson since I sell and
negotiate products as well. Is this required even
though I’m the RME on the license?
A: No, you are not required to register as a
Home Improvement Salesperson. The official
personnel listed in the CSLB’s records for
the contractor’s license are exempt from the
requirement to be registered. This includes
individual contractors, Qualifying individuals,
Partners, Officers of a corporation, and
Responsible Managing Employees (RME’s).
Q: You helped us get our Arizona license last
year and I received a renewal form from the
AZ Department of Revenue for our Transaction
Privilege Tax (TPT) number and noticed that
there is a new rule for contractors effective
1/1/15. It states:
“If you are a contractor whose only business
is to enter into contracts with the owner of
real property for the maintenance, repair,
replacement or alteration of existing property,
beginning January 1, 2015, you do not need to
have a TPT license.”
We only do solar sales and installation, so does
that mean that we do not need to renew?
A: While the notice certainly implies that you
do not need to renew your TPT license, that
notice is misleading. The Arizona Registrar of
Contractors (ROC) still has a statute in place
that requires all applicants and licensees to
provide them with a TPT to obtain or renew a
contractor’s license. According to the ROC’s
website “the ROC has asked the legislature to
make these laws more consistent by removing
this TPT requirement. Until this change is
made, contractors should maintain their state
TPT license.”
Q: Our Qualifier left the company some time
ago and just recently notified the CSLB by
disassociating from the license. Because he left
over 90 days ago, our license was automatically
suspended.
We have an application in progress with a new
Qualifier but he hasn’t even been scheduled
for an exam yet. Is there any way to get
an extension? If yes, how do we go about
requesting that?
A: In many cases the CSLB will grant you
a one-time 90-day extension to replace your
Qualifier. However, it is unlikely that you
will be approved for this request due to the
fact that your license is already suspended. If,
for instance, you were within your initial 90
days and you submitted your new Qualifier
application along with a request for a 90-day
extension, the CSLB would likely approve it.
Q: We are making a company banner and
want to know if there is a size violation if the
contractor number is too small on the banner?
A: While the CSLB does have regulations
about font size when displaying your name and
license number on company vehicles, I am not
aware of any regulation for font size on banners.

Carbon Monoxide
Carbon monoxide is a deadly poison.
Carbon monoxide (CO) is a colorless, odorless gas produced whenever carbon burns. When breathed, CO takes oxygen from the bloodstream. Oxygen-deprivation is damaging to vital organs and often fatal. CO can build up enough in an enclosed space to kill a person within minutes. Victims of CO poisoning can survive if the symptoms are recognized early and immediate action is taken. If not detected promptly, irreversible damage can occur to the heart or brain; death is not an unlikely outcome if CO poisoning is not dealt with and treated promptly.
In order to protect yourself and others from poisoning, learn the risks for CO buildup and take preventative measures. Sources of CO:
Substances containing carbon give off CO when burned, such as:
• Gasoline • Natural gas • Oil • Propane • Coal • Wood A common source for CO is the exhaust of an internal combustion engine. Other sources that can generate CO include generators, stoves and lanterns. Workers who use gas-powered tools are at risk. Symptoms of poisoning: High levels of CO inhalation can cause loss of consciousness and death. Unless suspected, CO poisoning can be difficult to diagnose because the symptoms mimic symptoms of other illnesses.

Preventative measures:
• Check your workplace and home for CO sources and potential sources.
• Monitor the air. − Conduct regular tests. − Use personal CO monitors when CO is a risk. These must be equipped with an
alarm to warn when CO levels have risen too high. − Levels must stay at or below 50 parts per million.
• Educate workers about CO poisoning. They should be alert for symptoms and know to immediately report them. They should also know the common sources, and the safe use of any CO-producing equipment.
• Do not operate internal combustion engines indoors. For example, do not leave your car running in a garage.
• If internal combustion engines are required indoors due to an emergency situation, everyone indoors must wear respirators.
• If you need to use a fuel-burning tool indoors: − Use equipment that can separate the CO producing unit from the tool. Put the
engine outdoors, away from any sources of ventilation into the building, and use the exhaust-free part of the tool indoors.
− If it is possible and safe for the task, substitute electric-powered tools for gas-powered tools.
• Ventilate the area. This requires more than simply opening windows or using a fan. Ventilation should be professionally installed.
• Any equipment producing CO should be well maintained. If poisoning is suspected:
• Turn off the equipment. • Move the affected people into fresh air. • Keep them warm. • Call 911. • If they are not breathing, administer
cardiopulmonary resuscitation (CPR). • No one with symptoms of CO poisoning should
drive. • If CO poisoning occurs inside a building, have the
CO levels checked before anyone returns. • Rescuers may be exposed to fatal levels of CO,
and should be fully trained and prepared for the situation.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

THE SITE SUPERINTENDENT/FOREMAN WILL:- Direct, supervise and teach other crew members- Perform any construction tasks needed to meet deadlines - Determine labor requirements and recruit talent to meet demands- Create supplies and materials lists and timelines- Review materials and subcontractors invoices against forecasts- Review job costs, budgets and weekly field time cards- Communicate with clients throughout the project to guarantee customer satisfactionRequirements:- Relevant industry experience.- Must utilize smart phone from the field for emailing and text messaging- Must be able to read and interpret plans- Knowledgeable in all trades- Excellent written and verbal communication skills, with an ability to speak professionally with clients, architects, subcontractors, etc.- Ability to identify and problem-solve various issues- Able to run projects with minimal supervision- Must have a truck in good working condition, insurance, valid driver’s license and own tools

DUTRA IS SEEKING ESTIMATING ADMINISTRATOR
Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
