As reported today in the Capitol Weekly, an impatient and feisty Gov. Jerry Brown unveiled an extraordinary plan to bore two tunnels beneath the vast delta just south of Sacramento to shift millions of acre-feet of water from northern California south to the state’s farm belt and the thirsty population of southern California. “I want to get shit done,” Brown declared Wednesday to his surprised listeners at a news briefing. Brown, flanked by ranking state and federal officials, denounced the “analysis paralysis” which he said has led to inaction on California’s longest policy dispute – the equitable distribution of water across a state in which most of the rain falls in the north and most of the people live in the south.Even as he spoke, environmentalists and their allies gathered outside Resources Building and state Capitol to protest the governor’s plan. The $23 billion project -- $14 billion for the pipes and $9 billion for environmental protections -- is the culmination of nearly seven decades of formal study by federal and state agencies to get northern water to the south. Thirty years ago, voters rejected the construction of the Peripheral Canal that would have tapped the Sacramento River near Hood and transferred the water in a concrete-lined ditch some 42 miles to pumps at the delta’s southern edge. The crux of the dispute is the Sacramento-San Joaquin River Delta, the source of about half the state’s drinking water. The delta, a confluence of rivers, is a fragile, farm-rich, marshy, slough-laced landscape crisscrossed by aging 19th century levees. Taking large amounts of water directly from the delta has harmed wildlife, so the dream of engineers and water contractors has been to devise a method of transferring northern water from above the delta southward without endangering the environment. In the latest plan, the twin pipes will carry water, gravity fed, to the southbound aqueducts and channels near Tracy – including the 700-mile-long California aqueduct – and thence to the water wholesalers, who are picking up the bulk of the tab of the project. While the governor desperately wants to leave an infrastructure legacy like his father (who built the existing state water project and many other important projects), it will likely be easier said than done. Indeed, as one of my colleagues suggested tongue in cheek “maybe they can carry the pieces of the pipeline up to the Delta using the high speed bullet
train!” In other words just like the bullet train, chances are great that between lawsuits from farmers, environmentalists and others who are vehemently opposed, the project will never get off the ground. It will be interesting to see how this, and the train, play out.
Are There Other Options? As a matter of fact, there may be. First and foremost, each and every sewage treatment plant in California should be mandated to recycle 100% of their water to potable standards, just like the treatment plant in Huntington Beach has done successfully. Then there’s a considerable amount of water conservation that still can be achieved. Finally, desalinization holds a very bright future towards meeting our future water needs. Certainly it’s expensive, but the costs are dropping quickly. The environmentalists don’t like it, because they say that it produces too much brine and also sucks in too many fish and their eggs into their intakes. However, I happened to have lunch with an old friend of mine yesterday who is the executive director of the desalinization association. He informed me that both of these arguments are non-issues with today’s technology and that the real reason environmentalists don’t like desalinization is because of the population growth it would induce if the projects came to fruition. Interestingly, there is one desalinization project that is close to becoming a reality, the Poseidon Desalinization project in Carlsbad in San Diego County. Despite being strongly opposed by the environmental community, it has received all of its necessary permits (and beaten back myriad lawsuits) and will start construction soon, I’m told. This project will produce 56,000 acre feet of water per year, which is enough water to support 300,000 people. So that “in a nutshell” is the latest news from Sacramento. By the way, the Legislature is due back from their summer recess on August 6th. My colleagues and I will then experience “hell month” as everyone tries to “ram” their legislation through the legislative process before the final gong of the bell on August 31st. Gee, I can’t wait!
Executive Summary of Changes to California Lien Law, with Links to New Forms, Effective July 1, 2012New lien laws brought into existence by the 2009-2010 Legislative Session's SB189, and the 2011-2012 Legislative Session's SB190 and SB293, impact how construction participants must go about protecting their rights to be paid, from the start of a project to well beyond its end. This brief summary identifies overarching changes that apply generally to the lien laws. It then walks chronologically and identifies law changes that apply typically at different project stages. It also provides links to editable Word document forms (marked with bullet points) updated to comply with the new laws.
Overview And Changes That Apply Generally
SB 189 is a comprehensive recasting of the law relating to liens and prompt payment requirements. It was 10 years in the making by the California Law Review Commission and consists of 235 pages. Substantive changes are generally not intended, except in thirty-six specified sections (most of which are referenced in this summary). The legislature stated its intent that the new sections be applied the same as the old sections unless substantively changed. Thus, existing case law should still apply to most sections.Old lien laws have been repealed and recast into three new Civil Code sections:• Sections 8000 to 8154 – Works of improvement generally• Sections 8160 to 8848 – Private works of improvement• Sections 9000 to 9566 – Public works of improvementConstruction terms have new definitions:“contractor” includes “subcontractor” depending on context“original contract” or “prime contract” is now “direct contract” “original contractor” or “prime contractor” is now “direct contractor” “materialman” is now “material supplier” “20-day preliminary notice” is now “preliminary notice”. “stop notice” is now “stop payment notice”Notices to parties related to a construction project now have standardized requirements. Here is a new proof of notice with blanks for standard, required information:• Proof of Notice Declaration – GeneralDesign professional liens have been modestly enhanced and are now better integrated in the mechanics lien laws. Also, land-scape architects are included in the definition of design professionals entitled to lien rights.
Changes That Apply Early In Construction
New preliminary notice forms. Failure to serve these forms as required invalidates lien and stop notice rights, and may invalidate payment bond claims.• Preliminary Notice – Private• Preliminary Notice – PublicConstruction lenders must be specifically identified in both direct contracts (contracts directly between the owner and a contractor)
and subcontracts.Law is clarified that all contractors, including direct contractors, must give a preliminary notice to construction lenders (in addi-tion to others).
Changes That Apply During Construction
Owner must give notice of the name and address of the lender if a construction loan is obtained during the project.New lien waiver and release forms. These must be used start-ing 7.1.12, including for projects that started before 7.1.12.• Conditional Waiver and Release Upon Progress Pay-

Changes That Apply Late In And After Construction
On private construction, "completion" no longer includes "ac-ceptance” by an owner as a trigger starting the time for record-ing a lien or filing a stop notice.Completion by cessation of work on a public works project requires cessation of work for 60 days, which is increased from 30 days. However, public works owners may still record notice of cessation after 30 days' cessation of labor, thus triggering the
time for serving a stop payment notice.New notice of cessation forms:• NoticeofCessation–Private• NoticeofCessation–PublicOwners’ time is extended from 10 days to 15 days after com-pletion in which to record notice of completion and reduce the amount of time in which claimants may record liens and serve stop payment notices and payment bond claims.Owners may record separate notices of completion on projects governed by separate direct contracts.New notice of completion form:• NoticeofCompletionFailure by a lien claimant timely to sue to enforce a recorded lien renders the lien ineffective to give constructive notice of the lien claim to lenders. This means that the claimant's lien will lose priority to deeds of trust obtained by lenders recorded after the start of construction. Amount of lien release bonds has been reduced from 150 per-cent to 125 percent of amount of lien. The former cap of $2000 has been removed, leaving no cap on the amount of attorney fees recoverable by owner successfully removing a stale lien.For $10 on public works paid to the public entity along with the preliminary notice, lower tier subs and suppliers must be informed by entity of time for serving stop notice (sec. 9362, up from $2 in sec. 3185). Claimants are cautioned, however, to do their own research and not to rely on public entities to provide this notice.Service of Lis Pendens (notice of pendency of action) is no lon-ger optional to give lien priority over later purchaser or lender.New payment bond claim and related forms:• PaymentBondClaim–Private• PaymentBondClaim–Public• PaymentBondClaimRelease–Private• PaymentBondClaimRelease–PublicThe so called “second bite of the apple” is limited by the new law. Always wearing safety goggles or glasses may seem like a pain, but the alternative could be much worse. There are so many eye hazards on a construction site that leaving your eyes unprotected even for a short time is extremely risky.

Eye Injuries Are a Serious Threat Protect your eyes on the job
There are countless eye hazards on a construction site, including particles (wood chips, dust, cement chips, metal shavings, etc.) that have been ejected from a tool or blown by the wind. Chemical splashes and swinging objects can also be eye hazards on a worksite. However, most eye injuries are preventable if you follow simple safety precautions, and always wear your safety goggles! Use Protective Eyewear It’s a proven fact that the best thing you can do to protect your vision on the job is to wear safety glasses or goggles. Even if you do have your safety glasses on, keep in mind that there are a variety of ways you can get debris in your eyes. Some accidents happen by simply taking off your safety glasses or goggles and wiping your face; particles can easily fall out of eyebrows or hair and into your eyes. Safety glasses should rest firmly on top of the nose and close to – but not against – the face. If they are uncomfortable, foggy or sight-restrictive, then find a different pair. Don’t let excuses get in the way of protecting your eyes. They may not always be convenient to wear, but the right eyewear will ensure your eyes and vision are safe while doing your job. Find a Good Fit You can find many ways to make safety glasses or goggles work for you, such as:
• If you find safety glasses uncomfortable, experiment with different sizes or styles.
• Make sure glasses are fit well while you are also wearing your hard hat and other protective equipment.
• Wear glasses or goggles that are properly ventilated for the work you are performing. Unless you are working near splash hazards, use goggles that have plenty of side ventilation.
• If you wear prescription glasses, wear goggles designed to fit over your glasses or safety glasses made with your prescription.
• If your goggles fog up, try a model with more ventilation or coat them with an anti-fog liquid.
• Wear a sweatband or handkerchief around your head to keep sweat off your goggles.
• Always keep your safety glasses clean. Scratched and dirty glasses or goggles can reduce vision, cause glare and may contribute to accidents.
Safety First It takes only one accident to cause partial or complete blindness. Even tasks that you don’t consider dangerous may present a risk for eye injury. Take a moment to think about possible eye hazards around each job site, and then take the necessary precautions to help prevent potential accidents and injuries.
