People Before Profit Councillor Gino Kenny has called on all parties to resolve the situation with abandoned horses in Clonburris after seven horses were found dead in the last week. All of the horses that were found were on privately owned land which is commonly known as ‘Clonburris Little’. The lands have been used over the past twenty years to graze horses. Councillor Kenny who is working closely with the newly formed Clondalkin Equine Club said," The situation at this present time is completely unacceptable and unsustainable in terms of the welfare of the horses.There are horses there that have to fend for themselves with very little food, water and practicably no shelter. This has led to these poor horses either starving to death or been so desperate to escape that they have died in trying to do so. In one incident on St Patrick's Day Dublin Fire Brigade were called to help a stranded pregnant mare which was stuck in a ditch. Local people and myself helped to free the animal, but unfortunately the animal later died that night. Local people and horse owners done all they could to save the animal. It is truly a pitiful situation for the animals. This problem stems from the lack of equine education and irresponsible horse owners abandoning their horses in the fields and not taking care for them. This in turn gives all responsible horse owners a bad name in Clondalkin". "The short term solution is to access the health of the remaining horses that are in the fields . The long term solution is that all parties come up with an equine management plan for horse owners in Clondalkin and work with the newly formed Clondalkin Equine Club. Otherwise we will facing the same situation next year. Dublin South Westrepresentative SeánCrowe TD has said thatSt Vincent de Paul (SVP)has trebled its financialaid to familiesstruggling to payhousehold fuel bills,that an estimated that1200 people are dyingevery year from the

cold and at the sametime the wealthiest 300have seen theiirfortunes rise by 3.9billion to a net worth of66 billion.Deputy Seán Crowesaid: "The St Vincent DePaul charity confirmedat a conference at theweekend that their

outlay on fuelassistance rose from€3.79m in 2008 to€10.37m in 2011."In spite of SVP’s help,it is estimated that1,200 people are dyingas a direct result of fuelpoverty every year.That is 1200 people,mostly elderly dying of

the cold orhyperthermia everyyear"In 2012, 16% of all callsto the four largest SVPoffices were for helpwith meeting fuel bills.Only actual requests forfood were higher at23%."This increased need for

SVP’s support withheating bills is in spiteof the fact theDepartment of SocialProtection spent €215mon fuel allowances to400,000 people in 2012."SVP and other frontlineorganisations say therehas been also asignificant increase in

and are directly leadingto deaths in thecommunity.

I agree with SeánMoynihan, the ChiefExecutive of the charityAlone, who has urgedpeople to check onelderly neighboursduring this bout of coldweather but these cutsare a direct attack onthose same elderly,those with specialneeds, the poor andvulnerable in ourcommunities.

Minister Burton willclaim that there is nomoney available intaxes to pay for thisbut the reality is quitedifferent.

"The day before theconference a specialsuppement in onenewspaper on Ireland’swealthiest 300,reported that the 300wealthiest Irish peoplesaw their wealth growalmost 6.3% (3.9bn) lastyear, to a net worth ofmore than 66bn.

"It's a matter ofGovernment choice butsurely it wouldnt beunreasonable to asksome of these wealthyindividuals to carry alarger part of theburden during thesedifficult days."

Sinn Féin Clondalkin Councillor Matthew McDonaghhas described as ‘shocking’ the revelation thatreported incidents of illegal dumping haveincreased eight fold since 2010.

Cllr McDonagh said: “In recent months I havenoticed a dramatic increase in illegal dumping inClondalkin. However even I am shocked by thereport delivered by Council management atMarch’s Area Committee meeting.

“Since 2010 reports of illegal dumping have riseneight fold from 21 in 2010 to 171 in the first threemonths of 2013. This is a truly staggering figure.

“During this time South Dublin County Council havehad substantial cuts in funding from both FiannaFail and Fine Gael led governments. Vital servicesare being cuts as a result.

“It is my firm view that the increase in illegaldumping is directly linked to the decision byGreyhound to end the waiver for low incomefamilies.

“There is an urgent need to review this problem. Iwill be raising this matter with officials in thecoming period. In the mean time I would onceagain urge people not to illegal dump theirrubbish.”

Speaking in the Dáil Sinn Féin TD for Dublin South CentralAengus Ó Snodaigh TD called on the Government toapologise Thalidomide survivors and introduce a statutoryhealthcare package and compensation package to meettheir needs.

Deputy Ó Snodaigh said; “In the Programme forGovernment produced over two years ago, a commitmentwas made to compensate Thalidomide survivors inIreland. Over two years later they are still awaiting, infact they have been waiting over 50 years for a properand full acceptance of the State’s responsibility inallowing the administration of a poison to pregnantwomen in Ireland.

“In 1959, thalidomide began being sold and issued as a“safe and non-toxic drug without side-effects” andsuitable as an effective treatment to prevent morningsickness nausea and sleeplessness during pregnancy andit was allowed remain on sale in 1961 when the Stateknew of the dangers which resulted in horrificconsequences of this drug such as deformed limbs;malformation of hearts, bowels, uterus and gallbladder,short life spans, deafness, weakened facial muscles, andother countries had withdrawn that.“The 32 survivors of Thalidomide are entitled to justicefor what they have to go through daily. The State has arole in this. Indeed, the State due to their lack of actionin 1961 when they were first aware of dangers, arepartially responsible for the injuries sustained. I amcalling on the government to issue the apology that isowed, alongside a statutory healthcare package to meetthe needs of those with thalidomide disabilities and astructured compensation package should also beintroduced.”

The Minister for SocialProtection, Joan Burton T.D.has launched theDepartment’s redesignedwebsite, www.welfare.ie,and published theDepartment’s CustomerCharter and Action Plan.Visits to the welfare.iewebsite have risen from 2.7million in 2009 to almost 5million in 2012. Currently,the website receives 85,000

visits a week. The websitehas been redesigned to moreproperly reflect the fullrange of services theDepartment now delivers,including Intreo, the new“one-stop shop” service forjobseekers. under Intreo,jobseekers receive theirincome supports andindividually-tailoredemployment supports in theone place for the first time.

Features of the redesignedwebsite include:- Improved navigationfeatures for all users;- Comprehensiveinformation on the full rangeof supports and servicesprovided by the Departmentof Social Protection- A dedicated Intreoarea - www.intreo.ie -through which employers andjobseekers can accessinformation and services onsupports, training andentitlements;- A new Find a Jobservice, integrated with theJobs Ireland site, whichallows jobseekers to searchfor jobs, training andinternships in every county;- Links to many of thecountry’s recruitmentagencies; and- Application forms forschemes.The website also allows forthe reporting of suspectedsocial welfare fraud. Lastyear, of the total of 28,000anonymous and confidentialreports received by theDepartment, 19,000 weresubmitted online. Thiscompares to a total of 16,900in 2011, of which 10,600were submitted online. Allreports are examined and

where relevant, are referredfor follow-up action.The Customer Charter andAction Plan 2013-2015 setsout the Department’scommitment to improving itscustomer service over thenext three years. Each week,nearly 1.5 million peoplereceive a social welfarepayment, and when qualifiedadults and children areincluded, almost 2.3 millionpeople benefit from weeklypayments. The CustomerCharter and Action Planoutlines both theDepartment’s commitmentto the highest quality ofservice, and the rights andresponsibilities of SocialProtection customers.

The Customer Charter andAction Plan was developedfollowing extensiveconsultation with customersthrough surveys, customerpanels and representativegroups. It sets out how theDepartment will measure itsperformance against theservice standards in the planand commits to reporting onprogress through its AnnualReport. It also includes thecontact channels forcustomers who wish to makea complaint.

InTREO is alreadydelivering - clients canaccess employmentsupports in InTREOoffices within a week ortwo of registration asopposed to a minimumof three monthspreviously. Similarly, decisions onwelfare claims aremade within daysinstead of weeks, andclient attendance atthe engagementsessions with caseworkers has increasedsignificantly.

There are a number ofkey elements whichmake up the InTREOservice. They include:

Activation measuresincluding clientprofiling, early group

engagement andone-to-one meetingsfocused on personalisedemployment supportsand on-goingmonitoring of theclient’s progress.An integrateddecision-makingprocess leading toreduced bureaucracyand delivering fasterdecisions.An integrated receptionproviding aone-stop-shop. Insteadof engaging separatelywith three differentservices in differentlocations, jobseekerscan now register for allservices in the onelocation. A ‘social contract’between theDepartment and theclient which sets outthe servicecommitments of theDepartment but alsothe responsibilities ofthe client. Tailoredguidance andemployment supportswill be provided tojobseekers. In return,jobseekers areexpected to accept thatcontinued incomesupport will becontingent on their fullengagement withemployment supportsand activation

measures.Enhanced employerengagement at nationaland local level tomaximise access to jobsopportunities andpotential employees

Any plans to expandBritain's nuclear facilitiesshould be made known toIreland, as both countrieswould be vulnerable in theevent of an accident orterrorist attack, an IrishMEP said this week. FineGael's Gay Mitchell askedthe British government togive a comprehensiveupdate on their nuclearenergy programme to theIrish-British parliamentarybody.Speaking to mark the 2ndanniversary of theFukishima nuclear disasterin Japan earlier this month,Mr Mitchell said it was clearthe uK seeks to reduce itsdependency on fossil fuelsand secure future suppliesby developing its nuclearcapacity. “A forthcomingreport by three of the uKgovernment's most seniorscientific advisers isexpected to encourage thedevelopment of nuclear

generation technologies notcurrently used commerciallyanywhere. The dossier isexpected to suggest thatthese new technologiescould provide as much astwo-thirds of uK electricityby 2050, implying a hugeexpansion of facilities,” hesaid.

But Mr Mitchell stressedthat Ireland must beinvolved in monitoring thegrowth of Britain's nuclearplants. “If an accident orattack took place at one ofBritain's nuclear facilities, itwould have detrimentalconsequences for Ireland.The Irish-BritishParliamentary Assemblywould provide a suitableplatform for considering thisissue and could host aspecial meeting on thefuture of nuclear energysafety,” he added.Britain's west coast isalready home to fouroperational nuclear sites,including five nuclearreactors, as well as the

reprocessing plant atSellafield in Cumbria. It isunderstood that EDF Energy,which has operated eightout of the uK's 10 nuclearplants, plans to expand twosites at Hinkley Point inSomerset and Sizewell inthe South-East.

EU rules will helpdisgruntled shoppers

new rules agreed this weekwill help European shopperssettle disputes with traderswithout having to undergowhat can often turn intolengthy court proceedings.The legislation provides forthe setting up of AlternativeDispute Resolution schemes- known as ADRs - a fast,cheap and informal way toresolve consumerdissatisfaction. Althoughmost countries already haveADR measures in place, theyare often consideredunusable and not consumerfriendly. The new directivewill require every Eumember state to ensure

that ADR bodies exist for allbusiness sectors.Labour MEP Phil Prendergastsaid shoppers will be able touse the new rules to getout-of-court remedies forcomplaints about any goodsor services, whether boughtin a shop domestically,across borders or online. “Ithas huge cost savingbenefits for consumers,with an estimated potentialto save consumers about€22.5 billion in courtproceedings a year,” shesaid.ADR procedures will eitherbe free of charge or at anominal fee and runaccording to fixeddeadlines. The ADRprocedure must reach anoutcome within 90 calendardays.

MEPs vote to tacklematch-fixing in sport

Protection forwhistle-blowers who lift thelid on match-fixing was justone of the measures put

forward by MEPs this weekas a method of rooting outfraudulent practices insport.A report approved by theEuropean Parliament calledfor a range of laws to crackdown on corruption,including common penaltiesfor match-fixing and a codeof conduct amongstakeholders in the sportingworld. It follows a recentInterpol report into illegalbetting which revealed that380 football matches inEurope had beeninvestigated formatch-fixing, includingtop-flight domestic leaguematches and qualifiers inthe European Championshipand World Cup.

Speaking from Brussels, IrishMEP and former GAAPresident Sean Kelly saidthe Interpol findings wereonly the “tip of the iceberg”and that it was clear majorcriminal gangs werebenefiting. “Profits ofmatch-fixing are ultimately

funding the criminalunderworld, the drugs tradeand human trafficking.We're talking aboutprofessional fraudsters whooperate under the cover ofmassive global networks,”he warned.The Fine Gael MEP appealedto the European Commissionto cooperate with thirdcountries by taking part inthe negotiations for aninternational convention ofthe Council of Europe tocombat the manipulation ofsports results. “The Eucould use its influence toput pressure on duringnegotiations on Asian'betting havens' like HongKong and Singapore,” headded.Fianna Fáil MEP LiamAylward also warned thatmatch-fixing was“threatening the integrityof sport” and called for a“zero tolerance” approachon corruption to be agreedbetween member states,police, gambling operatorsand sporting bodies.

I presume you are talking aboutyour personal Credit Rating, which refersto your credit worthiness as an individual.This is an evaluation made by CreditBureaus of your overall credit history andis used to evaluate a potential Borrower’sability to repay debts. In Ireland, theCentral Agency that stores informationabout Borrowers, and their repayments,is the IRISH CREDIT BUREAU (ICB). Theinformation is sent in by the Lendersthemselves and held on a centralised DataBase, that can be consulted each time youmake an application for credit from aMember. Most Lenders in Ireland aremembers of the ICB. The information onBorrowers, that is held by the ICB is keptfor a five year period after each loan isclosed. This means, that if you have aloan or mortgage, either currentlyoutstanding or paid off within the last fiveyears, it is likely that the ICB holds anindividual credit ‘Report’ for you. Thisreport includes the following details:

• Your name, date of birth,address or addresses used by you inrelation to financial transactions.• The names of Lenders andAccount numbers of Loans you currentlyhold, or that were active within the lastfive years.• Repayments made, or missed,for each month, on each loan.• The failure to clean off any loan.• Loans that were settled for lessthan you owed, and

• Legal Actions that your Lender(s) took against you.When you sign a mortgage or loanapplication, you automatically give theproposed Lender permission to both,send information about your repaymentsto a Credit Reference Agency, such as theICB, and to seek information about yourcredit history. A poor credit Historymakes it very unlikely that you will beapproved for a loan – even if you are insecure employment with a steadyincome. Your Report is not limited todetails about personal loans andmortgages. It may also containinformation on Leasing Agreements,Credit Cards and Hire PurchaseAgreements.

Corresponding with the information heldon your Credit Report is what’s known asthe CBS Credit Bureau Score (CBS). YourCBS is a number which summarises yourCredit Report at a particular point intime. According to the ICB, your CBSmay assist Lenders in the fasterprocessing of a loan application andserves as a more objective indicator ofrisk, as factors such a gender, race ornationality are excluded fromconsideration. It might make for moreconsistent decision-making, since bothpositive and negative information arefactored into calculating the score. It isa good idea to check your Credit Reportevery so often, to make sure that it doesnot contain any errors. under the DataProtection Acts 1988/2003, you areentitled to receive a full copy of yourReport, held on the ICB Data Base. Youcan apply on line at www.icb.ie, or bycontacting the ICB directly. The cost ofeach application is €6.00 It usually takesbetween three to four days to process,after which time your Report will be sentto you by post. It is not uncommon for aReport to contain mistakes or incorrectinformation. This could be caused by aconsumer not completing a Direct Debitform correctly, and missing a LoanRepayment as a result. An error in yourCredit Report might also be caused byyour Lender agreeing to postponepayments for a period, but thenforgetting to notify the ICB. This type oferror may be more likely in today’seconomic environment, where thenumber of borrowers re-negotiatingrepayment terms with their Lenders hasincreased.

The ICB cannot change your CreditReport unless the Lender requests it todo so in writing. If you find a mistake inyour Report therefore, you should askyour Lender to write to the ICB withdetails of the change and request a copyof the letter. A. Parental disputes over therelocation of children are a relativelymodern phenomenon. They are aby-product of travel, technology, andthe world becoming increasinglysmaller. Recession is also a factor andCourts across all jurisdictions areseeing increasing numbers ofapplications being brought beforethem in relation to relocation issues,as a result of families ‘job seeking’ inother Jurisdictions. Judges andchild-custody Evaluators often look onrelocation issues as the most difficultto resolve.

The starting point for anyconsideration of an application for arelocation to change the residence ofchildren must be done pursuant toSection 11 (1) of the Guardianship ofInfants Act 1964, and in particularSection 3, which provides, ‘where inany proceedings before the Court thecustody, guardianship or upbringing ofa child is in question, the Court indeciding that question, shall regardthe welfare of that child as the firstand paramount consideration’. Inconsidering the welfare of the child,consideration by the Court must begiven to a variety of factors. A Judgewould have to consider, in anyapplication, to remove a child toanother jurisdiction, which of the twooutcomes would provide the greaterstability of lifestyle for the child, orchildren. Consideration would alsobe given to the availability orcapacity for and frequency of accessby the non-custodial parent, the pastrecord of each parent in therelationship with the child, insofar asit impinges on the welfare of the

child, and the contribution to suchstability for the child, which would beprovided by the new environment in whichthe child might reside, with particularregard to the influence of the extendedfamily. In your favour, against any removal of thechildren outside of the jurisdiction, yourchildren are of an age when they havealready established links, not only withtheir school, but also with their extendedfamily here in Ireland. There is noabsolute guarantee that your husband’snew job in the united States will bepermanent and it may indeed be hisintention to return to Ireland as soon ascircumstances allow. It is a difficultquestion and one which would have to begone into at great length with your LegalTeam, in the event that you do findyourself at the receiving end of anapplication to remove the children fromthe jurisdiction. From what I can gatherhowever, your husband is an Irish nationaland as such, there should be noimmediate threat of any urgentapplication and you will have plenty oftime to deal with any such application andanswer any case made in favour ofremoving the children from thejurisdiction.
