Distracted Dad Mama MaloneRichard Hearn on Noddy, Big Ears and tattoos
T he Boy and Youngest™ were in theirnew beds, made that day. (When Isay ‘made’ I mean constructed.)
With The Boy, they were anovernight success (could theybe any other kind?). Youngest™was less sure, but that‘sanother story.
Youngest™ was lying under aNoddy duvet and wanted tohear a Noddy story. “He lovesNoddy,” said The Boy.“Imagine if he was wearinghis Noddy pyjamas,” headded, “and... imagine if hehad Noddy Tattoos.”
Noddy tattoos. Imagineindeed. That’s a tattoo you’regoing to regret. I think most tattoos are potentially regrettable – “atthis moment in my life, whatwould be a great idea is a wolf’shead on my chest” etc – but I’mthinking that the love of Noddy isdefinitely a phase that will pass.
If Youngest™ really wants atattoo, I might persuade him tohave ’love’ and ’hate’ done on his knuckles. At least they’re emotions thatremain relevant through your life, even if the emblazoning of them on yourskin is not the most perfect expression. If he really objects to theirconfrontational nature, I reckon an expert tattooist could alter the word ’hate’to ’hats’. He loves hats. Actually maybe go for ’love’ and ’hats’ now and ’love’and ’hate’ at 21, when he gets a job as a bouncer.
Noddy tattoos. I can’t get the expression out of my head. Obviously theycould take many forms; there are stylistic choices to make. Perhapssomething subtle, a monochrome version of Noddy’s car on your lower back. You could go the whole hog and have the entire cast including Mr Sparks, BigEars, Martha Monkey and the skittles lined up and waving, expertlyinterpreted by a professional artist. Not sure.
It could be discreet, an image taken from a particular episode, so in thefuture, when Youngest™ is in his late twenties in some rugby changing room,a fellow player turns and says ‘I see you’ve got a tattoo there,’ and Youngest™can turn and answer, bold as brass: “Yes, that’s a goblin cheekily stealing oneof Noddy’s presents. From my favourite episode.“
Even going for an ‘artistic’ interpretation – a calligraphic piece of Chinesewriting on his forearm, say – might come back to haunt him, when an earnesttranslator realises it says “Big Ears”.
Overall, I would say I sit on the fence on many topics, but on this one I‘mdefinite. I reckon I can state with some certainty that getting a Noddy tattoowould be a very bad idea.
So Peppa Pig it is then.
Iusually look forward to January more... but this year I'm actually lookingforward to Christmas! I must be excited as I found myself under the bedcovers googling ‘how to cook the perfect roast’ at 7.30am last week. That’s
excited! Or nervous. I’ve got three fussy people to cook for: a ‘know what shelikes’ grandmother, a picky child, and a vegetarian who isn’t fond ofvegetables. I've never cooked a Christmas dinner for more than two people. Myboyfriend asked if we should eat out. I replied that was the female equivalentof emasculating me! Why isn’t there a word for emasculating women? Can wenot have our woman-ess taken away from us? Sure, cooking isn’t just awoman’s job nowadays (ducking the feminist Twitter taunts) but I’ve neverhad a Christmas dinner at my home with a boyfriend whilst being a mum – Iwant to play being a traditional mother of the family at least once!
In the past, we have spent Christmas away from home, (I’ve been singleat Christmas and thought it would be a lonely, long day with just me andmy child). It’s lovely visiting friends, but it's nice to do things your own wayfor once.
So, no turkey, we are not eating turkey. I know it’s Christmas but why eatsomething you wouldn’t eat normally, that tastes like your own tongue (if ithad been removed a week before)? And no, we are not having Christmaspudding either, as we hold a 3-1 majority anti-sultana/currant/raisin alliance. We will have a massive tree, a trillion fairylights, games and turning off the tellyfor most of the day. I want tohear old soul blaring out, thechild will have to playwith new toys and learnto like Otis Reddingand Sam Cooke.Must pass onmusical heritagefrom Father.
Yes, I will set offthe fire alarm at leastthree times, swear at theceiling, wafting a framedcollage of my deceasedfather (it’s the nearestthing) until the damnthing goes off (he’salways there for me attimes of need). Yes, I willmoan “I’m too hot!” as I pull the bird out of the oven, basting for the millionthtime, burn myself and try to blame it on my boyfriend because he didsomething like walk past the kitchen. My boyfriend has suggested I cook thebird the day before, as that’s what his parents do; when I am 75 I will cook thebird the day before. Until then I will just have a massive, sweaty, swearystress about it on the day, exactly like my parents before me. I’m lookingforward to playing Chess (miffed I have to let my daughter win) and fightingover the strawberry cream Quality Streets with her. A friend has suggested toavoid arguments I should include everyone else’s desires for the day. Oh, yes. That's the spirit of Christmas... But that means letting Nana watch EastEnders.

Do you have a question on employment law for Dean Wilson LLP? Send it to Latest Homes at our usualaddress, or by email to [email protected]
2. Pre-termination negotiationsThe Government wants to enableemployers and employees to have a“pre-termination negotiation” whichwould allow either party to putforward a settlement offer safe inthe knowledge that an EmploymentTribunal would not be allowed totake that offer into account in anunfair dismissal claim.
ACAS will develop a statutory codewhich will provide further detailsabout how settlement offers shouldbe used. It will also give examples ofwhen the conduct of the partymaking the offer would be improper. These proposals will help employersby limiting the risk of an employeearguing that they have been unfairlydismissed if an employer makes asettlement offer.
It is worth noting that an employerwill still bear the risk of the employeeclaiming discrimination.
The Government has recently madeannouncements about up andcoming reform in employment law.
1. Compromise agreementsThe Government’s proposals includechanging the name of compromiseagreements to settlementagreements and producing atemplate settlement agreement foremployers to use if they wish. Itwould enable employers to potentiallydispense with the need to engage asolicitor to draft the agreement. Itwas suggested that the Governmentwould remove the requirement for anemployee to seek legal advice inorder to validly waive statutoryemployment claims but this appearsto have been dropped. The employeewill still need to seek legal advice andthe likelihood is that the practice ofemployers making a contribution toemployees' legal fees will continue.
Ian Wilson is senior partner of 13 partner Brighton solicitors Dean Wilson LLP and specialisesin employment law. He was a part-time chairman of theEmployment Tribunals for nineyears. He is also a board memberof The Martlet’s Hospice.
3. Compensation for unfairdismissal claims The Government has made threemain proposals in relation to thecompensatory award for unfairdismissal: to create a second tiercap of one year’s salary for theemployee in question; to reduce themaximum cap (currently £72,300);and to limit the types of loss forwhich an employee can claim forunder the secondary cap.
Under the proposals, the two caps would operate in tandem. The compensatory award would becapped at whichever figure is lower. When calculating one year's salarythe employee will not be able toclaim for benefits such as acompany car, discretionary bonusesor pension. This is good news foremployers as it represents a furtherreduction in the real amount that anemployee can claim.
Ian Wilson of local solicitors Dean Wilson LLP answers questions onemployment law. This week: employment law reform consultation

Ready for ChristmasW ith Christmas rearing its festive head, it feels like the powers that
be are trying to tell us something. You can rebel all you want andbe one sodden shopper traipsing around town with the rest of the
world on a hectic Saturday, or you can succumb to the cosy realm of yourhome and prepare your kitchen for the feast of treats that will be created.
We all know that Christmas isn’t really about presents, Santa Claus orpolar bears drinking coke – it’s about food. However you choose to spendthe holiday season, food is a massive part of that celebration. Whetheryou are the household lumbered with Christmas day dinner this year forall your 20 relatives or you simply fancy cooking up some boozy mincepies for your workmates, the kitchen is a foundation for festive cookery.First of all you might want to check your fridge can hold its ultimatecapacity in cheese or see if you can jam one more Vienetta into that topfreezer drawer. More importantly, you need to make sure that oversizedturkey you purchased is going to fit in your average sized oven.
A carpenter may be able to help you swap your puny cold storage andinstall a larger fridge freezer that will be more than happy to hold all yourwinter treats. Following the larger scale theme, you may not be surprisedwhen skilled professionals tell you you’re going to need a bigger oven.
Now is the perfect time to maybe have an electrician in to check allthose clever appliances you will be using to make festive culinarydelights. Be prepared and confident so that your Christmas cooking willbe perfect no matter the size of the task. See also, Latest Interiors, p13.
