ICT Policy Evolution in Kenya

1st Telecom Policy was Released in Feb. 1997, Revised in April 1999 & Dec. 2001. It mainly provided for;

The Sector Restructuring, Liberalization & Privatization and New Regulatory Framework

The Current ICT Policy was Established in 2006

New ICT Policy, 2006:

Recognized the potential & challenges in the use of ICTsAddressed issues of privacy, e-security, cyber crimes, ethical and moral conduct, copyrights, intellectual property rights, piracy, etcRecognized the need for adequate legislation, stakeholder participation and international cooperation



Kenya Communications Amendment Act, 2009

The new Act was geared to address the 2006 policy objectives.It expanded the facilitative role of the regulatory authority (CCK) to encompass ICT & Electronic Commerce by way of;

Removal of barriers to e-transactions; Ensuring integrity of electronic records & e-transaction;Cyber crimes;

CCK is to promote public confidence in the integrity and reliability of electronic records and e-transactions;CCK is to develop sound frameworks to minimize the incidence of forged electronic records and fraud in e-commerce and other e-transactions.




The following acts are proscribed:Unauthorized access to computer dataAccess with intent to commit offencesUnauthorized access to and interception of computer serviceUnauthorized modification of computer materialDamaging or denying access to computer system




Unauthorized disclosure of passwordUnlawful possession of devices and dataElectronic fraudTampering with computer source documentsPublishing obscene information in electronic formPublication for fraudulent purpose




Unauthorized access to protected systemsRe-programming of mobile telephonePossession or supply of anything for re-programming mobile telephoneBona fide reprogramming or possession is not an offence.



Regional & International Cooperation Initiatives

East African Regulatory, Post and Telecommunications Organization (EARPTO) established a cyber security Taskforce with a view to:

Building confidence and security in the use of cyberspace in the East African (EA) regionEnhance security of the cyberspace in the East Africa (EA) region through collaboration amongst all the stakeholders
