In the CSLB’s current winter edition of their newsletter is an article about the responsibilities of a qualifier. Take heed that there are companies in California who ‘mine’ the CSLB’s data files looking for recently retired or disas-sociated contractors who might be interested in ‘making a few dollars’ in exchange for serving as a qualifier. For anyone thinking of becoming a qualifier, please be aware that there are responsibilities and direct consequences IF you serve in a ‘name only’ capacity. To wit:
CSLB has zeroed in on licensees who rent their services as Responsible Managing Officers (RMOs) for companies over which they have little or no control. Due to the work of a special CSLB task force that targets suspected RMO abuses, those who act as little more than paid license qualifier for companies are being identified and disci-plined for violating state contractor law.
Contractors who serve as qualifiers for a company’s construction operations must exercise direct control and supervision, and, by law, maintain at least a 20 percent ownership stake in each firm for which the person acts as a qualifier. Business and Professions Code (BPC) section 7068.1 authorizes CSLB to discipline the licensed entity when the qualifier is not actively involved in the construc-tion activities of the license they are representing. In addition to administrative penalties, the individual falsely serving as a qualifier on the license can be charged with a misdemeanor and be sentenced to serve up to six months in jail, and required to pay a fine of up to $5,000, or both.

RMOs-for-Hire Better Know What They’re Getting Into
CSLB’s effort to uncover straw men RMOs has yielded big dividends. There have been a total of 304 complaints filed against those suspected of misusing their qualifier status (many still under investigation), 31 accusations filed to revoke or suspend a license, 12 citations issued for viola-tions of contractor law, 11 criminal cases filed by local district attorney’s offices, and $215,000 in restitution ordered for wronged consumers.
CSLB has strong words of caution for those who would enter these arrangements: If you act as an RMO and do not have active and financial involvement in the construc-tion and business operations, you risk CSLB administrative penalties against your license(s) as well as criminal pros-ecution, regardless of whether you’re aware of substan-dard work being performed by unqualified individuals.The task force also is watching for exam waiver requests from applicants suspected of only seeking to rent their name for a fee. CSLB also will seek to revoke qualifier status previously granted to anyone whose actions dem-onstrate they do not have an ownership stake or are not active decision makers listed on a license.A review of BPC section 7065 will provide further expla-nation of examination waiver laws.

NEW HOME SALES LEAP 10.8% Census Bureau data showed new home buying at its hottest pace in 10 months in December – a seasonally adjusted annual rate of 544,000 sales. New home sales were up 14.5% for 2015. In other housing news, the National Association of Realtors said pending home sales rose 0.1% in December after a 1.1% November dip.1,3

A typical construction site includes many different trades, competing priorities, and pressing deadlines. Good teamwork makes the workplace more efficient and safer for everyone on the jobsite. Teamwork includes open communication and everyone contributing to improve the workplace to safely and successfully achieve the construction goal.
Teamwork starts with pre-planning and organization. Setting clear expec-tations guides everyone to work toward the common goal of a successful, safely built project. It is important for workers on the jobsite to know:•The project’s priorities of safety, teamwork, and quality.•The required safe work practices so everyone follows the same rules on the job site.•Every person’s role and responsibilities so that workers can identify their resources and contacts.•The location of emergency equipment and the ability to operate it.
Good communication means that everyone can voice their opinion. Build-ing trust ensures that workers are comfortable sharing their suggestions and concerns. Workers on successful teams are empowered to:•Participate in safety training, site inspections, and hazard identification.•Foster a sense of sharing and learning to improve the team and the work product.•Speak up and make suggestions to improve the worksite, equipment, or job processes.
•Ask for training or guidance if there are questions or concerns about how to do a job safely.•Correct hazards immediately when it is safe to do so.•Remove defective tools and equipment out of service.•Call a “timeout” for safety when it’s necessary.
Complicated construction work tasks are simplified when people work together. Workers that watch out for each other can complete more work safely and efficiently. Worksite teamwork includes:•Asking for help instead of taking shortcuts, unnecessary risks, or “wing-ing” it.•Offering help when more hands or a better method can make the job safer.•Offering constructive suggestions when workers see unsafe behaviors in others.•Maintaining good housekeeping at all times, even when it’s someone else’s mess.•Cleaning the worksite and setting up equipment and supplies for the next shift’s success.
Good teams are built by sharing information and building trust. When individual workers make the commitment to each other to be a team, inju-ries are reduced, and productivity and quality are improved. Construction teamwork builds safety into every job to achieve successful projects.
