Grossbart Abdulaziz, Grossbart & Rudman Business and Professions Code section 7125.2 provides in part that the “failure of a licensee to obtain or maintain workers’ compensation insurance… shall result in the automatic suspension of the license by operation of law…” There are two reported cases that bear on this issue, Wright v. Issak and Loranger v. Jones. The Wright case held that a contractor who grossly and intentionally under reported his employees effectively failed to “obtain” insurance and fell subject to the sanctions in section 7125.2. The court in Loranger disagreed with the Wright holding: “…we neither have been cited to nor have we found any authority for the proposition that a worker found to be an employee of a contractor… will not be covered by the contractors’ existing workers’ compensation insurance policy if there is any discrepancy in the contractors reporting of payroll.” The holdings in the Wright case and Loranger case, although coming up with different results, raise the issue that the failure to have workers compensation insurance or alternatively, even if you had workers’ compensation insurance and fail to report employees puts you, as a contractor, in jeopardy of being determined to be unlicensed. If you are determined to be unlicensed, you will then be precluded from collecting money for any construction project and may very well be required to pay back any money that you receive. This brings us now to the issue of independent contractor or employee. Many contractors on many of their projects use workers which are sometimes referred to as “day laborers” to assist them in their construction endeavors. If this worker is unlicensed, and performs work that requires a license, the worker would be considered under the law to be an employee, which requires that the employer provide workers’ compensation insurance, issue a W-2, take payroll taxes out of the check of the worker, etc. In the Wright case, the contractor had workers’ compensation insurance but since he used workers that he did not report to his workers’ compensation carrier, and those workers were deemed to be employees, the Wright court found that the contractor had violated the law and considered the contractors’ license suspended by operation of law. The moral of the story is that if you perform work with workers that are not deemed to be independent contractors (an independent contractor is a person who possesses his or her own license) and you do not report the payroll for the particular worker to your workers’ compensation carrier or if you do not have workers’ compensation insurance, you will be deemed by operation of law to have a suspended license and therefore, put yourself in jeopardy for not being able to collect for the work you performed and may very well have to return money that has been paid to you. CSLB’s Additional Strategies for Combatting False Workers’ Comp Exemptions
Concluding our discussion of the Enforcement Division’s presentation during the April 6 Contractors State License Board (CSLB) meeting, staff claims that more than 50 percent of contractors’ licenses have an exemption from workers’ compensation (WC) insurance on file with the board. It is commonly known in the construction field that most contractors do employ workers, which raises con-cerns about the high rate of WC exemptions.
The board directed the Enforcement staff to proceed with five workers’ compensation insurance compliance strate-gies. In addition, the board also approved the following strategies to further combat this serious problem:
1. Identify Three Egregious Offenders for each of the 37 district attorney’s offices receiving grants from the California Department of Insurance Workers' Compen-sation Insurance Fraud Grant Program. The California Department of Insurance provides $34.9 million in grants to 37 district attorney offices representing 42 counties in California to combat workers' compensation insur-ance fraud. Many of CSLB’s more egregious complaints include a workers’ compensation insurance violation that may provide for criminal prosecution of the WC viola-tion and other contractors’ license law violations, rather than a CSLB administrative action. a) Identify all workers compensation insurance grant-funded counties and the assigned deputy district attorney and district attorney investigator. b) Assign CSLB Peace Officers to partner with grant funded counties. c) Develop partnerships with dis-trict attorneys that participate in the Workers’ Compensa-tion and Insurance Grant Program. d) Identify and provide each partnering district attorney with completed investi-gations that include an insurance fraud violation for the three most significant CSLB offenders. e) Seek opportuni-ties to secure a criminal, rather than administrative, filing
for all identified unlicensed/uninsured practice.
2. Expand Sting and Sweep Operations to Public Works Projects a) Explore additional partnering opportunities with the Labor Commissioner’s Office to verify work-ers’ compensation insurance compliance at active public works project sites. b) Partner with the Department of In-dustrial Relations to target public works contractors that remain out of WC compliance at a public works sting.
3. Perform Inspection of Construction Sites identified by the Construction Monitor Database a) Partner with deputy district attorney investigators and the Division of Labor Standards Enforcement to inspect active con-struction sites identified using the Construction Moni-tor Database by noting the acquisition of a permit by an uninsured contractor.
Why is it so important to ensure that all contractors with employees have workers’ comp? Besides ‘leveling the playing field’ for the legitimate contractors in the state, it has been estimated that rates could drop by half if the ‘deadbeats’ all started paying their fair share! Now that’s something every legitimate contractor would welcome! Stay tuned for updates in the coming months.

April 18, 2016 HOW WEAK WAS FIRST-QUARTER GROWTH? Economists have reason to wonder given the latest retail sales, industrial output, and inflation figures. Overall retail purchases fell 0.3% in March, though they rose 0.2% minus auto buying; analysts polled by MarketWatch expected a 0.1% gain for the headline number and a 0.5% gain for the core number. Industrial production slipped 0.6% in March, matching the retreat in February. The Consumer Price Index rose only 0.1% last month while the Producer Price Index declined 0.1%.1

Warehouses range from product distribution centers to popular retailers that sell oversize and bulk products. Whether it is an industrial, commercial or retail facility, warehouse workers should follow safety guidelines for loading docks, conveyor systems, forklifts and pallet jacks, material storage and handling, and good housekeeping.
Products enter and exit warehouses through truck and loading dock systems that are usually at a height from the ground. When loading and unloading materials, workers should pay special attention to avoid falls from elevated docks and ramps; yellow striping can draw attention to edges. Trucks delivering goods should be treated cautiously while they are parked at the loading dock. The area between the dock and truck is hazardous because a rolling truck can cause a crush injury; truck wheels should be chocked while unloading.
In some warehouses, products may be placed on conveyor systems that distribute them to different areas in the facility. Workers must avoid placing body parts or hair near conveyors because moving wheels and belts pose a pinch point hazard. Elevated conveyors should have safety nets to avoid dropping products on workers below. Workers need training on the location of on/off buttons and emergency stop buttons for conveyor systems and lock out/tag out procedures are required whenever servicing conveyors.
Forklifts and pallet jacks help move products from the shipping area into and around the warehouse. Forklifts are powered industrial trucks; forklift operators require training and certification while pallet jack operators require training only. Loads should be properly lifted on forks and stabilized, then slowly and deliberately taken to their assigned location. Forklifts and pallet jacks should never be used as rides or man lifts.
When large, awkward, and/or heavy items are warehoused, they become a challenge to store in a safe manner. Storage shelving and rack systems should be sturdy, braced, and spacious enough to allow people and equipment to move freely. When goods are shelved, they require slow and careful placement to avoid disturbing or pushing products off the facing aisle on to coworkers below. Products should be stored flat and inside the shelving units with aisle ways kept clear.
Pallets used for stacking products should be sturdy and in good condition; damaged or unstable pallet items should be restacked on a new one. Where pos-sible, palleted products should be shrink-wrapped or baled for stability.
Workers can protect themselves on the job with personal protective equipment (PPE) such as steel-toed shoes, gloves, and hard hats or bump caps. Proper lift-ing techniques protect backs. Safe lifting also prevents loads from shifting, falling, and crushing fingers, hands and toes.
Good housekeeping in a warehouse requires keeping dirt, oil, and debris off the docks and floors. Floors should be non-slippery and free from pits and dents. Ex-cess garbage, boxes, baling materials, and other recyclables should be removed and stored properly.
Training on the hazards and attention to procedures will make sure warehouse workers stay safe
