upontheAttorneyGeneralonly,nottheStateofHawaii.

conflictwiththeImmigrationandNationalityAct,inthatUnitedStates

Conceivably,aparentcouldhavegivenbirthoutsideoftheU.S.,andclaimed

thatitwasanunattendedbirth(nowitnesses)inHonolulu.

146. Localregistrartopreparebirthcertificate,authorizedbyHawaii

RevisedLaw§57‐8isbristlingwiththefraudulentpotentialbycompellingthe

localregistrartoprepareabirthcertificateforanallegedunattendedbirth

basedsolelyuncorroboratedtestimonyfromanyoneclaimingtohavehad

knowledgeofthebirthtakingplace.

189. In1961,theHawaiiDepartmentofHealthappearstohaveusedlocal

areaofficesoutsideHonoluluasreportingcenterswhereparentsandother

familymemberscouldrepresentchildrenborntothefamilyasHawaiian

births,withoutsubmittinganyproofthechildwasactuallyborninHawaii.

Thispracticewasalsostatutorilypermitted.
