1 INTRODUCTION
SLR Consulting Pty Ltd (SLR) was engaged by Skylife Properties Pty Ltd to conduct a Phase 1 Preliminary Contaminated Site Investigation (PSI) for a waste recycling facility at 13 Pembury Road, Minto, NSW (the Site).
The assessment was undertaken in accordance with SLR’s offer of services dated 10 February 2016 (ref: Minto Contract Review 20160210.docx).
The Phase 1 Contamination Investigation of the Site is required to address the Secretary’s Environmental Assessment Requirements (SEARs) for the preparation of an Environmental Impact Statement (EIS) for the proposed expansion of the existing Minto Waste Management Facility.
1.1 Objectives
The objectives of this project were to:
Make an assessment of the potential for land contamination to be present at the site, as a result of past and present land use activities.
Identify areas of environmental concern (AEC) and associated contaminants of potential concern (COPC) at the site.
Assess the likelihood of those COPC being present on site.
Provide recommendations for further investigation of the site (if warranted), in the context of the SEARS request.
1.2 Scope of Work
SLR undertook the following scope of work to address the project objectives:
a desktop review;
a site walkover; and
data assessment and reporting.
2 SITE IDENTIFICATION
The Site locality is presented in Figure 1.
The Site is located in an industrial area on a trapezoidal shaped parcel of land, 8957m2 in area and
approximately 160m by 30m in the east and south directions respectively and 190m by 70m in the west and north directions respectively. The Site is legally identified as Lot 1 on DP 1013852, 13 Pembury Road, Minto, New South Wales and falls within the Campbelltown City Council local government area. The Site is located within Zone IN1 General Industrial under the Campbelltown Local Environmental Plan 2015. The Site is owned by Pembury Street Pty Ltd.

3 SITE SETTING
3.1 Topography
The topography of the Site and its surrounds are relatively flat terrain, with a gentle fall towards the north and northwest. The ground elevation has been mildly modified to suit operations on site and is approximately 40 – 50 m Australian Height Datum (AHD).

3.2 Geology
The Geological Survey of NSW Wollongong 1:250 000 Geological Series Sheet 56-9 (Edition 2) 1966 indicates that the site is underlain by the boundary between Quaternary Alluvium comprising gravel deposits and sand dunes and the Triassic Liverpool Sub-Group which comprise shale with some sandstone beds.
3.3 Hydrology
The Minto facility is located within the George River Sub Catchment which is located within the Botany Bay Catchment Area.
There are no surface waterbodies located within the Site boundaries. Bow Bowing Creek runs directly adjacent to the western boundary of the Site. The portion of Bow Bowing Creek that runs along the Site’s western boundary has been converted into a concrete lined channel with a bund to separate the channel from the industrial properties to the east. McBarron Creek (which has also been converted into a concrete lined channel) runs along the southern boundary of the Site with Airds Road separating the Site and McBarron Creek. McBarron Creek flows into Bow Bowing Creek which flows into Georges River approximately 9.5km downstream of the Site. Georges River ultimately discharges into Botany Bay.
Campbelltown City Council advises that all properties within the Campbelltown City local government area may be affected by flooding caused by overland flow or local topography. Council are currently undertaking a flood study of the Bow Bowing / Bunbury Curran Creek Catchments, of which the property is a part. There results of the flood study are not yet available and there is currently no flood mapping for this area, but given the Site’s proximity to Bow Bowing Creek there is high potential for this Site to be affected by flooding.
3.4 Hydrogeology
The Commonwealth of Australia, 1:5 000 000 Hydrogeology Map of Australia, developed in 1987, indicates the Site falls within an area consisting of exposed bedrock aquifers from the Triassic Period of low-moderate productivity and non-saline groundwater.
A search of the NSW Department of Primary Industries real-time groundwater data (www.realtimedata.water.nsw.gov.au) conducted on 18 February 2016 did not reveal any real-time monitoring groundwater bores in the vicinity of the site.
A search of the Australian Government Bureau of Meteorology (www.bom.gov.au/water/groundwater) indicated the groundwater at the site falls under the Sydney Basin Central Management Area and falls in an area that has a bore density of 7 bores per 25km
2.
3.5 Soils
No intrusive investigations were undertaken as part of this study. Therefore, the underlying soils were unable to be characterised.
The facility has an impervious surface (with the exception of landscaped areas) and ground cover will not be disturbed by core operations at the facility (i.e. storing and processing of waste material).
The proposed development includes some small areas of soil excavation for the establishment of the new weighbridge.
Information obtained from Australian Soil Resource Information System (www.asris.csiro.au) indicated that the site has no known occurrence of Acid Sulfate Soils (ASS). Also, due to the topographical height of the site being 40-50m AHD and Acid Sulfate Soils (ASS) predominately being encountered at <20m AHD, ASS are not expected to be encountered on Site.

Based on information provided in the Salinity Potential in Western Sydney – 2002 Map developed by the Department of Infrastructure, Planning and Natural Resources (DIPNR) (Appendix A), the Site is located on land that has a potential for medium to high salinity to occur.
4 SITE HISTORY
A review of a selection of historical aerial photographs was undertaken. Observations made during the review are presented in Table 1.

Bow Bowing Creek appears to have been modified from a natural creek to a formed drainage channel. Construction of buildings and roads in the areas immediately surrounding the site has commenced.
1988 The site is still vacant of buildings but the land area appears to be part of a larger allotment that contains a large warehouse building which may be the same building that is adjacent to the site today.
McBarron Creek has been modified into a drainage channel and further buildings (warehouses) and roads have been established in the areas immediately surrounding the site.
1998 The site is still vacant of buildings and appears to still be part of a larger allotment that contains a large warehouse building.
The majority of the surrounding areas appear as they do today. The block of land that the site is on appears to be still part of one allotment containing a large warehouse building.
2006 (Google Earth) In March 2006 the site is vacant of buildings but there appears to be earthworks being undertaken on the site. It appears as if the large allotment the site was part of has been subdivided. By August 2006 earthworks have ceased and concrete slabs and building footings are being laid.
Commercial/industrial warehouses as they appear today with the exception of the warehouse located directly south of the site, which at this time does not exist.

The site appears as it is today and is being used as a waste depot with evidence of waste being sorted on the uncovered forecourt areas and sediment evident on the forecourt.

4.1 Historical Land Titles
A search of historical land title ownership records was undertaken on 18 February 2016. The search indicated the land was owned by the proprietors set out below:

4.2 Regulatory Authorities
4.2.1 NSW Environmental Protection Agency
A search of the NSW EPA contaminated land public register of records of notices (maintained under Section 58 of the Contaminated Land Act 1997) was undertaken by SLR on the 8 June 2016. With regards to the Site, the search results indicated that there are no:
Orders made under Part 3 of the Contaminated Land Management Act 1997 (CLM Act).
Approved voluntary management proposals under the CLM Act that have not been fully carried out and where the approval of the Environmental Protection Authority has not been revoked.

A search of the NSW EPA Protection of the Environment Operations Act public register of licence, applications and notices (maintained under Section 308 of the Protection of the Environment Operations Act 1997) was undertaken on 8 June 2016. The register contains information on:

The search results identified numerous sites containing Environmental Protection Licences on the neighbouring Pembury and Airds Roads in Minto and identified one Penalty Notice issued to Industrial Galvanizers Corporation Pty Ltd for contravening a condition of their licence (not noise) in December 2011. No further information was available.
A search of the NSW EPA public register of contaminated sites notified to NSW EPA under Section 60 of the Contaminated Land Management Act was undertaken on 8 June 2016. The search did not identify any records for the Site. There were 3 sites listed from the Minto area however none of them were for properties located adjacent to the Site.
A copy of the search records is presented in Appendix C.
4.2.2 SafeWork NSW
A search of the stored chemical information database (SCID) held by SafeWork NSW for the Site was undertaken on 20 May 2016. SafeWork NSW reported they had no records pertaining to the storage of Dangerous Goods at 13 Pembury Road, Minto, NSW.
A copy of the search results is presented in Appendix D.
4.2.3 NSW Office of Environment and Heritage
A search of the NSW Office of Environment and Heritage (OEH) State Heritage Register was undertaken on the 8 June 2016 by SLR for an area of 5km radius surrounding the Site. No Aboriginal Places were encountered however there were numerous buildings that are listed on the State Heritage Register. The location of the surrounding Heritage Listed Buildings is provided in Figure 2.

4.2.4 Council Records
A planning certificate (dated 8 June 2016) issued by Campbelltown City Council under Section 149 (2) of the Environmental Planning and Assessment Act 1979 was reviewed. The planning certificate indicates that the land to which the certificate relates to, in the context of the Contaminated Land Management Act and at the date the certificate was issued:
Is not significantly contaminated land within the meaning of the Act
Is not subject to a management order within the meaning of the Act
Is not the subject of an approved voluntary management proposal within the meaning of the Act
Is not the subject of an ongoing maintenance order within the meaning of the Act
Is not the subject of a site audit statement within the meaning of the Act

4.2.5 Previous Contamination Assessments
There was no previous contamination assessments made available to SLR for this investigation.

5 SITE WALKOVER
Site walkovers were undertaken by a suitably qualified and experienced SLR Consultant on the 27 November 2015 and again on the 15 August 2016. The purpose of the site walkovers was to make observations of the site and adjacent site land uses (relevant to land contamination). The initial site walkover was undertaken while the facility was being operated by the previous site owners, William Filipoppoulos and Thomas Filipoppoulos. The second site walkover was undertaken while the facility was being operated by the current operator, Minto Recycling Pty Ltd.
5.1 Site Drainage
The site gently slopes towards the north and northwest. All surface water is currently conveyed (via an existing pit/pipe network) to a Humeceptor before discharging offsite into the Campbelltown City Council (CCC) stormwater system which flows into Bow Bowing Creek (a modified concrete lined drainage channel) adjacent to the site. In addition to the pit/pipe stormwater system, bunding also exists on either side of the site to ensure that runoff is contained on-site and directed to the stormwater treatment system.
All roof water is currently directed into an underground 100 kl rainwater tank. This rainwater tank currently acts as a roofwater holding tank prior to its discharge to stormwater. No changes in the site drainage were observed between the 2015 and 2016 site walkovers.

5.2 November 2015 Site Walkover (previous site operators)
5.2.1 Site Operations
Operations being undertaken at the site during the 2015 site inspection included resource recovery from inert wastes. Trucks were delivering waste which was being tipped on to the concrete hardstand outside the warehouse. The lighter material was moved into the warehouse for sorting/shredding, leaving the heavier materials which were then removed off-site.
5.2.2 Site Features
The following site features were observed during the 2015 walkover:
Three sheds with concrete slab floors which are used for site operations:
Shed A – Non-ferrous area/hazardous shed;
Shed B – General waste shed; and
Shed C – Processing shed.
The majority of the site is covered with concrete slabs which were observed to be in fair to good condition. The concrete joints are starting to show signs of deterioration. There were also some unsealed landscape areas along the western boundary and unsealed grassed areas along the northern boundary.

Site features observed in 2015 are presented in the site layout plan in Figure 3, while photographic evidence is provided in Appendix F.
5.2.3 Wastes
The site was used to receive, sort and recycle general solid wastes. Numerous empty waste bins and 205L drums used to transport the recycled wastes to site were evident across the site. A front lift skip bin was available on site for collection of general waste generated by the site employees and there were a few used batteries and gas cylinders stored on pallets waiting for removal from site for appropriate disposal. The batteries and gas cylinders are encountered while sorting the received general solid wastes.
5.2.4 Chemical Use and Storage
Chemical usage and storage observed during the site inspection included:
5000L above ground diesel tank, overhead fuel line and associated bowser, which are stored undercover in Shed A. There was no bund around the tank, bower area or at the entrance to the shed however the floor to the shed slopes inwards so in the event of a spill the diesel would flow back into the shed.
1000L portable plastic tank (IBC) containing diesel additive (a urea solution) located next to the above ground diesel tank in Shed A.
1000L portable plastic tank (IBC) containing waste oil in the workshop. Some small drums containing coolant and oil within Shed A.
These chemicals were used for operation of the onsite machinery and stored undercover within Shed A.
5.2.5 Asbestos
Due to the sites’ buildings having been built in 2006-2007 there is unlikely to be asbestos contained in the structures.
No asbestos fragments were observed in the waste being handled on site during the site walkover, although there is potential for additional waste asbestos products to be brought onto the site mixed with the delivery of the inert wastes. The Draft Operational Environmental Management Plan (OEMP) for the site incorporates protocols to enable the appropriate management of nonconforming wastes including asbestos.
It is noted that a hazardous building materials survey was not within the scope of this investigation.
5.2.6 Phytotoxicity
All vegetation on site appeared healthy and showed no signs of phytotoxic impact.
5.2.7 Odours and Staining
There was no olfactory evidence of odours on the site, with the exception of odours generally associated with inert waste. There was no visual evidence of widespread or significant staining on the hardstand during the site walkover.

5.3 August 2016 Site Walkover (current site operators)
5.3.1 Site Operations
Operations being undertaken at the site during the 2016 site inspection included resource recovery from inert wastes within Shed B. Sheds A and C were not being used for waste storage or processing during the site inspection. Trucks were delivering waste which was being tipped on to the concrete hardstand inside Shed B, where it was being sorted for recycling.
5.3.2 Site Features
The following site features were observed during the 2016 walkover:
Three sheds with concrete slab floors which are used for site operations:
Shed A – Currently empty of waste;
Shed B – General waste receiving shed including 5 x 250L drums containing sorted copper, aluminium and other metals; and
Shed C – Currently empty of waste.
The majority of the site is covered with newly laid concrete slabs which were observed to be in excellent condition. There are some areas that are still covered with old concrete, which was observed to be in fair condition, however the joints have deteriorated.
The unsealed landscape areas along the western boundary and unsealed grassed areas along the northern boundary remained.
A renovated weighbridge office.
The above ground 5000L diesel tank, overhead fuel line and a diesel bowser have been removed.
A new double walled, self bunded, 30,280 L diesel tank. Information obtained from the client suggested that a bund wall will be constructed surrounding the tank, which will separate the tank area from the rest of the site area.
Fire water pipeline running along the eastern boundary remained.
100 000L onsite stormwater detention tank remained.
Humeceptor for stormwater treatment remained.
Four external material storage bays previously found on site have been removed.
Car parking area remained. Majority of the car parking area was vacant with some minor storage of inert construction materials.
Site features observed in 2016 under the current operators are presented in the site layout plan in Figure 4 while photographic evidence is provided below.

5.3.3 Wastes
Operations on site include receipt, sorting and recycling of general solid wastes. The wastes brought onto site for sorting were all contained within Shed B.
A front lift skip bin and several small waste bins were available on site for collection of general waste generated by the site employees.
A temporary waste storage area has been established along the southern boundary of the site. Used batteries and empty gas cylinders from Forklifts are stored on pallets in this area.

5.3.4 Chemical Usage and Storage
Chemical usage and storage observed during the 2016 site inspection included:
30280L self bunded, double walled, above ground diesel tank and associated dispenser which is located along the eastern boundary of the site.
1000L portable plastic tank (IBC) containing Adblue (an urea solution diesel additive) located at the southern end of Shed B.
1000L portable plastic tank (IBC) containing waste engine oil located at the southern end of Shed B.
5 x 250L drums containing coolant, hydraulic 08, gear lube and engine oil located at the southern end of Shed B.
These chemicals are used for operation of the onsite machinery.

5.3.5 Asbestos
Due to the sites’ buildings having been built in 2006-2007 there is unlikely to be asbestos contained in the structures.
No asbestos fragments were observed in the waste being handled on site during the site walkover, although there is potential for additional waste asbestos products to be brought onto the site mixed with the delivery of the inert wastes. The Draft Operational Environmental Management Plan (OEMP) for the site incorporates protocols to enable the appropriate management of nonconforming wastes including asbestos.
It is noted that a hazardous building materials survey was not within the scope of this investigation.
5.3.6 Phytotoxicity
All vegetation on site appeared healthy and showed no signs of phytotoxic impact.
5.3.7 Odours and Staining
There was no olfactory evidence of odours on the site, with the exception of odours generally associated with inert waste. There was no visual evidence of widespread or significant staining on the hardstand during the site walkover.
5.3.8 Adjacent Land Uses
The site is located within an established light industrial/commercial area and is surrounded by light industrial warehouses undertaking low risk contaminating activities, including an office equipment supplier, auto repair shops, consulting engineers and freighters. There was no visual or olfactory evidence of migration of contamination from adjacent land users. No significant changes in adjacent land uses were observed between the 2015 and 2016 site inspection.

7 AREAS OF ENVIRONMENTAL CONCERN AND CONTAMINANTS OF POTENTIAL CONCERN
A review of available site history data and observations made during the site walkover indicated a number of areas of environmental concern (AEC) and contaminants of potential concern (COPC) may be present on the site. The AECs and associated COPC are presented in Table 2.

The likelihood of contamination being present from historic activities has been determined as low even though the site was potentially unsealed for a period of time. The potential for the contaminating activities to have actually occurred on the site is deemed as being very low since the site was subdivided from a larger commercial/industrial site with no previous signs of development on the actual site.
It should be noted that the likelihood of contamination being present from current land activities (AEC 01-02) and previous occupiers (AEC 03) has been determined as low-medium due to the majority of the site being covered in fair to good condition hardstand, restricting the pathway for contaminants to enter underlying soils, however there is a higher potential for the contaminating activities to have actually occurred, as the activities were undertaken on the actual site.

9 CONCLUSIONS AND RECOMMENDATIONS
Based on a review of the available desktop search data and observations made during the site walkover with the context of the objectives of this investigation, SLR makes the following conclusions and recommendations:
1. Some AECs have been identified on the site, based on past and current land use activities, including:
Waste Handling
Fuel storage and handling
Use of the site as a Transport Depot (including workshop and decommissioned oil/water separator)
Historic on-site activities including dairy farming, general industrial uses, transport depot and importation of fill
2. No AECs have been identified in association with potential off-site sources of contamination.
3. The qualitative likelihood of soil contamination being present on the site, as a result of the identified AECs, is considered low to medium.
4. An additional investigation in the form of soil sampling would be recommended, to refine the level of certainty around the likelihood of contamination being present at the site, particularly in areas where future soil disturbance is proposed, so an assessment can be made in relation to the safety of the workers who may come into contact with the soil during soil disturbance works.
5. Further contamination investigation work should be undertaken by a suitably experienced environmental consultant.
6. The site in its current state is suitable for commercial/industrial activities.
