1 SMC 23.47A.032 Parking garage entry from Dexter Avenue N instead of alley.
The site slope makes entry form the alley a true hardship. A curb cut currently exists on Dexter. Our proposal would move it from the center of the site (facing Hayes Street) to the north. From approved MUP #3008741:From the "In responding to this issue, the [original] applicant relied on their traffic engineer’s estimation (Transpo Report, July 28, 2008) that a single-lane in-and-out driveway would pose serious safety issues and was not a viable solution...[T]he Board was agreed that taking access for all the parking from the alley was impracticable given the steep topography between street and alley (see Guideline A-1) and given the size, scope and innovative (using modular, pre-fabricated units) nature of the project. The proposed MUP Revisions do not change the parking access or size, scope and proposed construction methods (modular pre-fabricated units) from the original MUP.

2 SMC 23.54.030G.2.: For two way driveways 22 feet wide or more, a sight triangle on the side of the driveway used as an exit shall be provided, and shall be kept clear of any obstruction for a distance of 10 feet from the intersection of the driveway with sidewalk. The entrance and exit lanes shall be clearly identified.
Allow concrete structural support to obstruct 2 SF of required sight triangle on the right turn side.
The concrete column is structural and defines the edge between live-work zone and the parking access. The column is part of a series of columns that creates a human scale rhythm at the streetscape and contributes to the consistency of building design. The garage door has been setback an additional 1' from the original MUP. Given that the amount of obstruction is minimal and there is good visual access on both sides of the column, the applicant feels the proposed design allows safety for pedestrians while also better defining separation between the live-work and parking areas and reinforcing the overall design. Justification: The concrete column is structural and defines the edge between live-work zone and the parkingaccess. The column is part of a series of columns that creates a human scale rhythm at the streetscape andcontributes to the consistency of building design. The garage door has been setback an additional 1' from theoriginal MUP. Given that the amount of obstruction is minimal and there is good visual access on both sides of thecolumn, the applicant feels the proposed design allows safety for pedestrians while also better defining separationbetween the live-work and parking areas and reinforcing the overall design.

SBC 506 Building Area Increase 506.3: Where building is equipped by automatic sprinkler per 903.3.1.1, allowable building area is permitted to be increased by 200%. Therefore allowable R-2 building area is 24,000 SF not including frontage increase.
Building area per floor does not exceed allowable R-2 areas with sprinkler increase.
SBC 508.3 Non-Separated Occupancies Buildings or portions thereof that comply with the provisions of this Section shall be considered nonseparated occupancies.
All occupancies in Type 1A and 5A portions of the building meet height and area limits of Table 503. No separation between occupancies is required in Type 1A or Type 5A portions of the building except as required between dwelling units per SBC 420.
SBC 508.3.1 Occupancy classification Nonseparated occupancies shall be individually classified in accordance with SBC 302.1. The requirements shall apply to each portion of the building based on the occupancy classification of that space except that the most restrictive provisions of Chapter 9 shall apply to the building.
SBC 508.3.2 Allowable building area and height The allowable height and area shall be based on the most restrictive allowances for the groups under consideration for the type of construction per SBC 503.1.

SBC 705.2 Projections Exterior balconies and similar projections extending beyond the building area shall conform to the requirements of this Section and 1406. Exterior egress balconies and exterior exit stairways shall also comply with 1019 and 1026. Projections may not extend any closer to the line used to determine fire separation distance than shown in Table 705.2.Exception: Buildings on the same lot and considered as portions of one building in accordance with Section 705.3 are not required to comply with this Section.
Projections may extend up to 40" from the line that determines fire separation distance.
SBC 705.3 Buildings on the Same Lot For the purposes of determining the required wall and opening protection, projections and roof-covering requirements, buildings on the same lot shall be assumed to have an imaginary line between them.Exception: Two or more buildings on the same lot shall be considered portions of one building if the aggregate area of such buildings is within limits specified in Chapter 5 for a single building.
SBC 705.5 Fire-resistance ratings. The fire-resistance rating of exterior walls with a fire separation distance of greater than 10' shall be rated for exposure to fire from the inside. The fire-resistance rating of exterior walls with a fire separation distance of less than 10' shall be rated for exposure to fire from both sides.

SBC 1021.3.1 Access to exits at adjacent levels Access to exits at other levels shall be by stairways or ramps. Where access to exits occurs from adjacent building levels, horizontal and vertical exit access travel distance to the closest exit shall not exceed that specified in 1016.1. The path of egress travel to an exit shall not pass through more than on adjacent story.
SBC 1026.2 Exterior Exit Stairways For occupancies other than I-2, exterior exit stairways and ramps shall be permitted as an element of a required means of egress for buildings not exceeding six stories above grade plane or which are not high rise buildings.

SBC 1026.6 Exterior stairway protection Exterior exit stairways shall be separated from the interior of the building as required by 1022.2. Openings shall be limited to those necessary for egress from normally occupied spaces.Exception 2: separation from the interior of the building is not required where the exterior stairway is served by an exterior balcony that connects two remote exterior stairways with a perimeter that is not less than 50% open. To be considered open, the opening shall be a minimum of 50% of the height to the enclosing wall with the opt of the openings no less than 7' above the top of the balcony.
