SUMMARY City staff has completed its efforts to obtain easements in the project area. Staff is recommending continuing moving the project forward to 100% design to stay on the timeline to remain eligible for funding and for final completion this year. Upon completion of 100% design, staff is recommending the submittal of plans to MnDOT to remain eligible for funding and for final completion this year. PURPOSE/ACTION REQUESTED Staff recommends that City Council approve staff to continue to 100% design and submittal of plans to MnDOT.

Subject: 2019 Sidewalk Project City of Le Sueur, MN In cooperation with City staff, Bolton and Menk is preparing the final construction plans and specifications for the 2019 Sidewalk Project. The scope of the project is to upgrade sidewalk and pedestrian ramps along 4th, 5th and Bridge Street. The project was successfully awarded a grant through MnDOT’s Transportation Alternatives Program (TAP) as part of a 2015 City led application for the amount of $383,090 in federal funds. The project was awarded additional federal funding in the amount of $137,048 in 2018. The total estimated construction cost is $650,172 with a total federal funding amount of $520,138. The project final design was started in 2016 and was discovered the need for extensive temporary construction and permanent sidewalk easements. The project design was placed on hold in order to allow time for these acquisitions and we are able to conclude that at this time, the easement acquisition process has been completed to the furthest extent practical. City staff was unable to secure six permanent and two temporary easements within the project area. The inability to secure the easements is attributed to the lack of participation on behalf of the property owners. The proposal is to advance the project design to 100% and remove any improvements that fall outside of the easement at these locations. The goal would be to continue these easement discussions into construction in order to hopefully gain approval and allow for a continuous completion of the proposed improvements at that time. Based on the federal funding we are required to have the project out for bid by June 30, 2019 or risk forfeiture of the funds. Additionally, the project will require review and approval by MNDOT prior to the bid letting. We are working towards the final submittal to MnDOT and are planning on having this submittal completed on or before April 25th. As follows is the anticipated schedule for final delivery:
• May 2019 – MnDOT Plan Review and Authorization to Bid • June 2019 – Bid Advertising and Opening • July 2019 – Award Contract and Preconstruction Meeting • July 2019 – Start Construction • October 2019 – Substantial Completion • December 2019 – Final Completion

Dear Ms. Bigham,
I am writing to respectfully inform you that, per recommendation from Ms. Yates, the 100% DCP 02 for
the above mentioned project is necessary to be submitted for district review after the April 1st deadline.
The project was successfully awarded a TAP grant in 2015 for pedestrian walk and ramp improvements
along 4th, 5th and Bridge Street in the City of Le Sueur. The project final design was started in 2016 and
was placed on hold in order to allow time for acquisition of required temporary and permanent sidewalk
easements.
The easement acquisition process has been completed to the furthest extent practical, resulting in the
inability to secure six permanent and two temporary easements within the project area. The inability to
secure the easements is attributed to a lack of participation on behalf of the property owners. Based on
the necessity to secure the awarded federal funds in 2019, the proposal is to advance the project design to
100% and remove any improvements that fall outside of the easements at these locations. All of these
properties have existing sidewalk and proposal is to leave the existing sidewalk in place in order to
maintain continuity.
The project memorandum was approved on 10/31/16 and addendum #1 was approved on 11/5/18. The
100% submittal is planned to be consistent with these previously approved documents. The following is
proposed to be submitted for review and approval on or before April 25, 2019.

Hello Rylan,
Per our recent phone conversation, I am providing information regarding the 2016 Sidewalk Improvements project in
the City of Le Sueur. According to the MnDOT Project Memorandum template, construction projects that fall within the
“area of influence” of an airport must be reviewed by the MnDOT Office of Aeronautics. At this time I do not have an
SAP/SP # for project reference.
The 2016 Sidewalk Improvements project entails construction of new sidewalk and reconstruction of sidewalk in poor
condition within the City of Le Sueur. The proposed locations include: North 4th Street (Davis Street to Ferry Street and
Bridge Street to just north of Grove Street), South 5th Street and North 5th Street (from Risedorph Street to North 4th
Street), and Bridge Street from North 4th Street to South 5th Street. The project limit will extend in each direction from
the intersections to tie into existing facilities and provide ADA compliant pedestrian ramps. The southern project limit
extends approximately 750 feet into the Le Sueur Municipal Airport “Area of Influence.”

Dear Ms. Aulwes,
We have reviewed the above-referenced undertaking pursuant to our FHWA-
delegated responsibilities for compliance with Section 106 of the National Historic
Preservation Act, as amended (36 CFR 800), and as per the terms of the 2005 Section
106 Programmatic Agreement between the FHWA and the Minnesota State Historic
Preservation Office (SHPO). The Section 106 review fulfills MnDOT’s responsibilities
under the Minnesota Historic Sites Act (MS 138.665-.666), the Field Archaeology Act of
Minnesota (MS 138.40); and the Private Cemeteries Act (MS 307.08, Subd. 9 and 10).
This project will construct new sidewalk and reconstruct sidewalk in poor condition
within the city of Le Sueur. The proposed locations include North 4th Street from Davis
Street to Ferry Street and from Bridge Street to just north of Grove Street, South 5th
Street and North 5th Street from Risedorph Street to North 4th Street, and Bridge Street
from North 4th Street to South 5th Street. The project limits will extend in each direction
from the intersections to tie into existing facilities sand provide ADA-compliant
pedestrian ramps.
Based on our existing programmatic agreements with various tribal groups, there are
no tribes that want to be consulted on projects in this area of the state and/or projects
with the proposed scope of work.
The area of potential effects (APE) for the project consists of the proposed
construction area and the first tier of properties along those segments of the project
receiving new sidewalks. Because all work will occur within areas previously disturbed
by road and associated construction within the existing right of way, it is unlikely that
the APE contains intact, significant archaeological resources. No historic structures
are located within the APE.
The finding of this office is that there will be no historic properties affected by the
project as currently proposed. If the project scope changes, please provide our office
with the revised information and we will conduct an additional review.

No Effect Determination S.P. 040-637-002, North 4th Street and South and North 5th Street Sidewalk Construction City of Le Sueur, Le Sueur County In response to your request, the above referenced action has been reviewed for potential effect to federally-listed threatened, endangered, proposed, candidate species and listed critical habitat. As a result of this review, a determination of no effect has been made. Federally-Listed Species/Designated Critical Habitat in the Action Area Section 7 of Endangered Species Act of 1973, as amended (Act), requires each Federal agency to review any action that it funds, authorizes or carries out to determine whether it may affect threatened, endangered, proposed species or listed critical habitat. Federal agencies (or their designated representatives) must consult with the U.S. Fish and Wildlife Service (Service) if any such effects may occur as a result of their actions. Consultation with the Service is not necessary if the proposed action will not directly or indirectly affect listed species or critical habitat. If a federal agency finds that an action will have no effect on listed species or critical habitat, it should maintain a written record of that finding that includes the supporting rationale. According to the official County Distribution of Minnesota’s Federally-Listed Threatened, Endangered, Proposed, and Candidate Species list (revised in June 2015), maintained by the Service, the project county is within the distribution range of the following:
Le Sueur
Northern long-eared bat Myotis septentrionalis
Threatened Hibernates in caves and mines - swarming in surrounding wooded areas in autumn. Roosts and forages in upland forests during spring and summer.
Potential Impacts to Northern Long-Eared Bat Habitat

Based on the information that you provided and the nature of the activities proposed, it has been determined that no further action under Section 7 of the Act is required.
