FINDINGS OF FACT
1. On or about January 28, 2016, Complainant Patrick Dorais, in his official capacity as
the Chief of the Bureau of Automotive Repair, Department of Consumer Affairs, filed Accusation
No. 79/16-45 against Nguyen Hoang Nguyen as an individual and doing business as King Smog
Test Only, Binh-An Trinh, Nguyen and Trung Minh Truong (collectively Respondents) before
the Director of Consumer Affairs. Accusation No. 79/16-45 is attached as Exhibit A.
1. On or about January 5, 2012, the Bureau issued Automotive Repair Dealer
Registration Number ARD 267623 ("registration") to Nguyen Hoang Nguyen ("Respondent
Nguyen Nguyen") doing business as King Smog Test Only. The registration was due to expire on
January 31, 2016, however was cancelled on January 4,2016. The registration is subject to
reinstatement until January 31, 2019. The license was suspended, however the suspension was
stayed on January 25, 2016.
2. On or about March 16, 201 2, the Bureau issued Smog Check Test Only Station
License Number TC 267623 ("station license") to Respondent Nguyen Nguyen The license was
due to expire on January 31, 2016, however was cancelled on January 4,2016. The license is
subject to reinstatement until January 31, 2019. The license was suspended on January 25, 2016.
3. In or about 2003, the Director issued Advanced Emission Specialist Technician
License Number EA 146234 to Respondent Nguyen Nguyen. Respondent Nguyen Nguyen '5
advanced emission specialist technician license was due to expire on June 30, 2013 however was
cancelled on June 17, 2013. Pursuant to California Code of Regulations, title 16, section 3340.28,
subdivision (e), the license was renewed, pursuant to Respondent's election, as Smog Check
Inspector License EO 146234 and Smog Check Repair Technician License El 146234.
Respondent Nguyen Nguyen's Smog Check Inspector License and Smog Check Repair
Technician License expired on June 30, 2017, and have not been renewed. The licenses were
also suspended on January 25, 2016.
Effective August 1, 2012, California Code of Regulations, title 16, section 3340.28, 3340.29 and 3340.30 were amended to implement a license restructure from the Advanced Emission Specialist Technician (EA) license and Basic Area (EB) Technician license to Smog Check Inspector (EO) license and and/or Smog Check Repair Technician (El) license.

4. In or about 2006, the Director issued Advanced Emission Specialist Technician
License Number EA 152659 to Binh-An Trinh Nguyen (Respondent Binh-An Nguyen).
Respondent Binh-An Nguyen's advanced emission specialist technician license was due to expire
on June 30, 2014. however was cancelled on June 12, 2014. Pursuant to California Code of
Regulations, title 16, section 3340.28, subdivision (e), the license was renewed, pursuant to
Respondent's election, as Smog Check Inspector License EO 152659 and Smog Check Repair
Technician License El 152659. Respondent Binh-An Nguyen's Smog Check Inspector License
and Smog Check Repair Technician License expired on June 30, 2016, and have not been
renewed. The licenses were also suspended on January 25, 2016.
5. On or about May 16, 2012, the Director issued Advanced Emission Specialist
Technician License Number EA 634269 to Trung Minh Truong (Respondent Truong).
Respondent Truong's advanced emission specialist technician license was due to expire on
December 31, 2013, however was cancelled on December 19, 2013. Pursuant to California Code
of Regulations, title 16, section 3340.28, subdivision (e), the license was renewed, pursuant to
Respondent's election, as Smog Check Inspector License EO 634269 and Smog Check Repair
Technician License El 634269. Respondent Truong's Smog Check Inspector License and Smog
Check Repair Technician License expired on December 31, 2015. The licenses were also
suspended on January 25, 2016.
6. A lapse or cancellation in registration or licensure, pursuant to Business and Professions
Code section 118(b), Business and Professions Code section 9884.13, and Health and Safety
Code section 44072.6 does not deprive the Bureau of its authority to institute or continue this
disciplinary proceeding.
7. On or about January 28, 2016, Respondents were served by Certified and First Class
Mail copies Accusation No. 79/16-45, Statement to Respondent, Notice of Defense, and Request
for Discovery at each of Respondents' addresses of record which, pursuant to Business and
Professions Code section 136, is required to be reported and maintained with the Bureau.

8. Service ol' the Accusation was effective as a matter of' law under the proviSionS of
Government Code section 11505, sulxjjvision (c) and/or l3usincss & Professions Code section
124.
Government Code section 11506 states. in pertinent part:
(c) The respondent shall he entitled to a hearing on the merits if the respondent flies a notice of defense, and the notice shall he deemed a specific denial of all parts oithe accusation not expressly admitted. Failure to file a notice of defense shall constitute a waiver of respondents right to a hearing, but the agency in its discretion may nevertheless grant a hearing.

of the Accusation, and therefu rewaived iheir rights to a hearing on the merits olAceusation

II . Caiilbniia Government Code section 11520 states, in pertinent i.rt:
(a) If the respondent either fails to file a notice of defense or to appear at the hearing, the agency may take action based upon the respondents express admissions or upon other evidence and aflidavits may be used as evidence without any notice to respondent.
I 2. Pursuant to its authority under Govemnnient Code section ii 520, the Director after
having reviewed the proof of service dated January 28, 2016. signed by l3eihsaida Rico, finds
Respondent is in default. 'l'he Director will take action without further hearing and, based on
Accusation No. 79/I 6-45. prool of service and on the A 'lidavit of 13ureau Representative Martin
Sexton, linds that the allegations in the Accusation are true.

DETERMINATION OF ISSUES
13. Based on the foregoing findings of fact, Respondent Nguyen Nguyen has subjected
his Automotive Repair Dealer Registration No. ARD 267623, Smog Check Test Only Station
License No. TC 267623, Smog Check Inspector (EO) License No. 146234, and Smog Check
Repair Technician (El) License No. 146234 to discipline.
14. Based on the foregoing findings of fact, Respondent Binh-An Nguyen has subjected
his Smog Check Inspector (EO) License No. 152659 and Smog Check Repair Technician (El)
License No. 152659 to discipline.
15. Based on the foregoing findings of fact, Respondent Truong has subjected his Smog
Check Inspector (EO) License No. 634269 and Smog Check Repair Technician (El) License No.
634269 to discipline.
16. The agency has jurisdiction to adjudicate this case by default.
17. The Director of Consumer Affairs is authorized to revoke Respondent's Automotive
Repair Dealer Registration based upon the following violations alleged in the Accusation which
are supported by the evidence contained in the affidavit of Bureau Representative Martin Sexton
in this case:
18. Respondent Nguyen Nguyen has subjected his registration to discipline under
Business and Professions Code ("Code") section 9884.7, subdivision (a)(l), in that he made
statements which he knew or which by exercise of reasonable care he should have known were
untrue or misleading.
19. Respondent Nguyen Nguyen has subjected his registration to discipline under Code
section 9884.7, subdivision (a)(4), in that he committed acts which constitute fraud.
20. Respondent Nguyen Nguyen has subjected his station license to discipline under
Health and Safety Code section 44072.2, subdivisions (a) and (c), in that he violated Health and
Safety Code section 44012 and California Code of Regulations, Title 16, sections 3340.24(c),
3340.35(c), and 3340.42.

21. Respondent Nguyen Nguyen subjected his station license to discipline under Health
and Safety Code section 44072.2, subdivision (d), in that he committed acts involving dishonesty,
fraud or deceit, whereby another was injured.
22. Respondent Nguyen Nguyen has subjected his Smog Check Inspector License and
Smog Check Repair Technician Licenses to discipline under Health and Safety Code section
44072.2, subdivisions (a) and (c), in that he violated Health and Safety Code section 44012 and
California Code of Regulations, Title 16, sections 3340.24(c), 3340.35(c), and 3340.42.
23. Respondent Nguyen Nguyen subjected his Smog Check Inspector and Smog Check
Repair Technician Licenses to discipline under Health and Safety Code section 44072.2,
subdivision (d), in that he committed acts involving dishonesty, fraud or deceit, whereby another
was injured.
24. Respondent Binh-An Nguyen has subjected his Smog Check licenses to discipline
under Health and Safety Code section 44072.2, subdivisions (a) and (c), in that he violated Health
and Safety Code Sections 44012, 44032 44059 as well as California Code of Regulations title 16,
sections 3340.24 (c), 3340.30(a), 3340.35(c) and 3340.42.
25. Respondent Binh-An Nguyen subjected his Smog Check Licenses to discipline under
Health and Safety Code section 44072.2, subdivision (d), in that he committed acts involving
dishonesty, fraud or deceit, whereby another was injured.
26. Respondent Truong has subjected his Smog Check licenses to discipline under Health
and Safety Code section 44072.2, subdivisions (a) and (c), in that he violated Health and Safety
Code Sections 44012, 44032 44059 as well as California Code of Regulations title 16, sections
3340.24 (c), 3340.30(a), 3340.35(c) and 3340.42.
27. Respondent Truong subjected his Smog Check Licenses to discipline under Health
and Safety Code section 44072.2, subdivision (d), in that he committed acts involving dishonesty,
fraud or deceit, whereby another was injured.
ORDER
IT IS SO ORDERED that Automotive Repair Dealer Registration No. ARD 267623,
heretofore issued to Respondent Nguyen Hoang Nguyen, is revoked.

written motion requesting that the Decision be vacated and stating the grounds relied on within
seven (7) days after service of the Decision on Respondent. The motion should be sent to the

Cordova, CA 95670. The agency in its discretion may vacate the Decision and grant a hearing
on a showing of good cause, as defined in the statute. -

Check Repair Technician License expired on December 31, 2015.
7. Respondents Nguyen Nguyen. Bihn-An Nguyen. and Iroung shall be collectively
referred to as "Respondents.'

8. '[his Accusation is brought helbre the Director of the Department of Consumer
A flairs (Di rector) lbr the l3ureau of' Automotive Repair. under the authority of' the following laws.
STATIJTORY ANt) RE(;tJLATORY PROVISIONS
9. Section 9884.7 of' the Nusiness and Professions ('ode ("Code") states. in pertinent
lrt:
(a) The di rector. where the automotive repair dealer cannot show there was a bona Ode
error. may deny, suspend. revoke, or place on probation the registration of an automotive repair
dealer for any of the following acts or omissions related to the conduct of the business of' the
automotive repair dealer, which are clone liv the automotive repair dealer or any automotive

technician, employee. partner. officer, or member ol the automotive repair dealer.
(1) Making or authorizing in any manner or by an means whatever any statement written or
oral which is untrue or misleadi n. and which is known, or which by the exercise of reasonable
care should be known. to be untrue or niisleadine.
(4) Any other condLict that constitutes fraud.
(6) Fail lure in any materia] respect to comply with the provisiotis of this chapter or
regulations adopted pursrlallt to it.
(e) Notwithstanding subdivision (l), the director may suspend. revoke, or place on
probation the registration !br all places of' business operated in this state by an automotive repair
dealer upon a finding that the automotive repair dealer has. or is, engaged in a course of' repeated
and vi II l'ul violations of' this chapter, or regulations adopted pursuant to it.
10. Code section 9884.13 provides, in pertinent part, that the expiration of a valid
registration shall not deprive the director or chief oij urisdiction to proceed with a disciplinary
proceeding against an automotive repair dealer or to render a decision invalidating a registration
temporarily or pernianentl y.
11 Section 44002 of the 1-lealth and Safety Code provides, in pertinent part, that the
Director has all the powers and authority granted under the Automotive Repair Act for enforcing
the Motor Vehicle inspection Program.
12. Section 44012 of the Health and Sahtv Code requires that tests at smog check
stations be performed in accordance with procedures prescribed by the department.
I]. Section 44059 of the Health and Safutv (_'ode states, in pert lent part:
"The willful making of any ftilsc statement or entry with regard to a material matter in any
oath. affidavit, certificate of compliance or nonconipl lance. or app] cation form which is required
by this chapter or Chapter 20.3 (commencing with Section 9880) of l)ivision 3 of' the Business
and Professions Code. constitutes perjury and is punshaihlc as provided in the Penal Code."

14. Section 44072.2 of' the I iealth and Sahtv Code states, in pertinent part:
1'he director nay suspend. revoke, or take other disciplinary action against a license as
provided in this article I the licensee, or any partner. o f'flcer. or director thereof', does any of the
following:
(a) Violates any section of this chapter and the regulations adopted pursuant to it. which
related to the licensed activities.
(c) Violates any of' the regulations adopted by the director pursuant to this chapter.
(d) Commits any act involvme dishonesty, lI'aud, or deceit whereby another is inj ured.
h) Violates or attempts to violate the provisions of' this chapter relating to the particular
activity for which he or she is I icensecl.
15. Section 44072.6 of' the 1-lealth and Safety Code provides, in perti 'tent part, that the
expiration or suspension of'a license by operation of' law, or by order or decision of the Director
of' Consumer Affairs, or a court, of law, or the voluntary surrender of the license shall not deprive
the Director of jurischction to proceed with disciplinary action.
I 6. Section 44072.8 o the Health and Safety Code states:
When a license has been revoked or suspended following a hearing under this article, any
additional license issued under this chapter in the name ol' the licensee may be likewise revoked
or suspended by the director.
I 7. California Code of Regulations. title 16, section 3340.30, states, in pertinent part:
A licensed smog check Inspector and/or repair technician shall comply with the following
requirements at all times while licensed:
(a) Inspect, test and repair vehicles, as applicable, in accordance with section 44012 of the
I-lealth and Safety Code. section 44035 of the 1-lenith and Saf'etv Code. and section 3340.42 of this
article.
10. California Code of Regulations. title I 6. section 3340.35(c), states, in pertinent Part:

''(c ) -\ licensed station shall issue a certificate of conipl iance or noncompi lance to the
OWOCF 01 Operator of any vehicle that has been inspected in accordance with the procedures
spec! lied in section 3340.42 of this article and has al the required emiSSion control equipment
and devices installed and functioning eorreCtl\.
I 9. California Code of Regulations. title 1 6. section 3340.41 (c), states:
"No persii shall enter into the emissions inspection system any vehicle identification
in formation or emission control system identi Peat ion data for any vehicle other than the one being
tested. Nor shall any person knowingly enter into the emiSsiOnS inspection system an [ilse
in formation about the vehicle being tested.''
20. Califiarnia Code of' Regulations, title 1 6, section 3340.42, states, in pert 'ent part that
"Smog check inspection methods are prescribed in the Smog Check Manual, referenced by
section 3340.45."

2 1 . Section 125.3 of the Code provides. in pertinent part. that the Board may request the
administrative law judge to direct a licentiate found to have committed a violation or violations of'
the licensing act to pay a sum not to exceed the reasonable ccsts of' the investigation and
enforcement of' the case. with foilure of' the licentiate to comply subjecting the license to not being
renewed or reinstated. If a case settles. recovery of investigation and enl'orcement costs may be
included in a stipulated settlement.
FACTUAL SUMMARY
-y) On March 9. 2015. the Bureau implemented a statewide regulatory change requiring
the use of the On Board Diagnostic Inspection System (BA R-OlS ) instead of the [mission

used to input technician in formation, the vehicle denti fication number (V iN). and DM V renewal
information. 1'hc printer is used to llri nt Vehicle Inspection Reports.
24. Ihe VIN that is physical lv pi-eselit on all vehicles is also rcriuired to be progranimed
into the vehicles 013 I) II computer oii 2005 and newer vehicles, and on man occasions was
programmed ink) the 0131) 11 computer in earl icr model-years. This electronically programmed
VIN is re6irreci to as the "eVIN' and is captured during a Smog Check. The eV IN must match the
physical V IN on the vehicle.
25. The OBL) 11 conhmiiunicatioii protocol describes tile slleci lied collllllullieati011
language' used by the OBD Ii computer to communicate with the scan tools and other devices
such as the BAR-OIS. l'he conlnlunication protocol is programmed into the OBI) II computer
during manufacture of the vehicle and does Ilot change.
26. Parameter identifications (PIDs) are data poi its reported b a veli id 's OB 1) II
system. Each make and model of vehicle reports a specific number of PIDs when it is being
tested by the BAR-OIS. File PIDs Count is the number of data points reported by tile OBD II
system. Ihe PIDs and PIDs Count are programmed during tile manufacture oia vehicle and does
not change.
27. Data retrieved and recorded during a BAR-ON smog inspectioll include tile eVIN, the
conlmnunication protocol, and the PIDs Count. This mlornlation is transnlitteCl to tile vehicle
inlormation data base during a smog inspection.
28. On or about July 7. 2015. the Bureau initiated an investigation of Respondent Nguyen
Nguyen's shop. King Smog Test Only. Beginning on or about April 30. 201 5. and continuing
until about August 30, 2015. Respondents were iouiid to have perlOriiledl 14 fraudulent smog
i aspect ions using clean-pl uggi ig methods. ('lenin-Ill Liggi ig is the practice of' testing one OBD II
systenl (a system that would piss the smog ifispeet ion). for tile purpose of fraudulently issui ig a
smog certificate of compliance to another vehicle that would not pa55 tile 5IllO InSpeetioll and/or
Respondent Binh-An Nguycmi and Respuiident 1 ruong perloniiied tile snlog tests on behalf of Respondent Nguyen Nguyen

4 Nguyen and Respondent Iruong and cert fled by Respondent Nguyen Nguyen. The data revealed
fiat the 14 vehicles that were purportedly tested bY Respondents were not atid could tint have
been connected to the DAD when they were being certified because the (JBD-11 data purportedly
transni itted by those vehicles could not have been transmitted by those vehicles.
30. The PIDs Counts for the 14 vehicles purportedly being tested did not match the
expected PIDs counts ft)r those vehicles. 'Ihe eVINs were not present on any of the 14 vehicles
and the communication protocols where not what they should have been.
31 Respondent Binh-An Nguyen cleaned plugged len (1(i) vchicles resulting in the
issuance of 10 fraudulent Smog Check Certificates of Compliance. Respondent lruong cleaned
plugged fliur (4) vehicles, resulting in the issuance of 4 li'auclulent Smog Check Certificates of'
Compliance. The Vehicles were clean plugged as ftllows:
is 1101 present for testing. The vehicle receiving the certificate of compliance is not actually tested
by the DAD during the smog inspection.

vehicles without performing bona Ode inspections of the emisSion control devices and systems on
the vehicles, thereby depriving the People of' the State of California of the protection afforded by

42. Pursuant to Code section 98847. subdivision (c). the Director may suspend. revoke.
or place on probation the registration ibr all places of business operated in this state by'
Respondent Nguyen Nguyen. upon a Onding that Respondent Nguyen Nguyen has. or is, engaged
in a course of repeated and willful violations of the laws and regulations pertaining to an
automotive repair dealer.
43 Pursuant to l-lealth & Safety Code section 44072.8. I Respondent Nguyen Nguyen's
Station License is revoked or suspended, any additional license issued under this chapter in the
name of said licensee may be likewise revoked or suspended by the director.
44. Pursi.iant to Health & Safety Code section 44072.8, if Respondent Binh-An Nguyen's
Smog Check Inspector License or Smog Check Repair Technician License is revoked or
suspended, any additional license issued under this chapter in the name of said licer)see may be
likewise revoked or suspended by the director.
45. Pursuant to Health & Safety Code section 44072.8, if Respondent Truong's Smog
Check Inspector License or Smog Check Repair Technician License is revoked or suspended, any
additional license issued under this chapter in the name of said licensee may be likewise revoked
