Christina Whited thanked Walter O'Brien for putting High Bridge on the cover of the Hunterdon Review, stated how important it is working with the press is. Doug Walker asked for a vote on the water meters this evening, spoke about past profits with the golf course, spoke about present profits with the golf course, and the challenges that lie ahead with managing the system. Michele Lee asked about the previously stated amount of cost for work at the Middle School which Mayor Desire stated was a job to replace wooden beams with steel beams for safety, asked the date the debt statement will be put up on the website, the possibility of moving the seventh and eighth grade students to a Clinton school, the possibility of having a Facebook page for the Environmental Commission, and Council commented about the cost being $500,000 or so for bussing and other logistics. Michele Lee also spoke about the possibility of the Califon school closing. Council spoke about the school choice program and the number of students coming into High Bridge as well as the use of Facebook for the Borough. Dr. Brenden Coughlin spoke about the use of the Annex and the use of placing a distillery on it, the tax implications of placing a for profit entity on Borough property, presented a blank form 990 and blank CBT-100, suggested that no cash be handled at for profit entities, stated that the entity is for profit and this will be an issue, and that property taxes will be due for the operation of the business. Attorney Goodman spoke about the differences in the cases cited by Dr. Coughlin pertaining to operation of for profit and non-profit entities in different locations in New Jersey. WHEREAS, the Borough of High Bridge Borough Planner had prepared the 100 West Main Street Redevelopment Plan, dated February 2018, which was adopted on March 22, 2018; and
WHEREAS, suggestions from the Mayor and Council have been incorporated to include the use of indoor recreation facilities to the redevelopment plan; and
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council that the 100 West Main Street Redevelopment Plan, dated February 2018, be amended with the adoption of the 100 West Main Street Redevelopment Plan, dated April 2018.
SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed as to such inconsistencies.
SECTION 3. If any article, section, subsection, paragraph, phrase, or sentence is for any reasons held to be unconstitutional or invalid, said article, section, subsection, paragraph, phrase or sentence shall be deemed separable.
SECTION 4. This Ordinance shall take effect upon final public as provided by law.
SECTION 5. The Borough Clerk is hereby directed to publish notice of the passage thereof and to file a copy of this Ordinance as finally adopted with the Hunterdon County Planning Board as required by N.J.S.A. 40:55d-16, the Borough Tax Assessor, and Commissioner of the Department of Community Affairs, Sheila Oliver.

WHEREAS, the Borough Code, Chapter 303-7, C, (7) currently reads
Those residents filling a new permanent swimming pool may apply for a deduction from their sewer bill by requesting a reading of the water meter before and after the filling of the pool to determine the deduction. All requests should be made, in writing, to the Borough Administrator, 71 Main Street, High Bridge, NJ 08829. Readings must be performed during normal DPW weekday work hours and a fee of $40 will be charged. The fee will be deposited in the Sewer Utility.
Whereas, the Common Council of the Borough of High Bridge wishes to amend the Borough Code to the following:

CANCEL TAX BALANCE
RESOLUTION 149-2018 ADOPTED: PENDING WHEREAS, NJSA 54:4-67 sets the maximum rate of delinquency for payment of taxes and assessments; and
WHEREAS, Resolution #005-2018, adopted by the High Bridge Borough Council on 01/05/18 established that interest will be charged at the rate of 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00 to be calculated from the date the taxes were due until the date of actual payment. There will be a ten day (10) grace period after which unpaid taxes will be charged interest from the due date; and
WHEREAS, the Tax Collector is bound by NJSA 54:4-67 to collect interest on delinquent properties; and
WHEREAS, taxes due on May 1 and unpaid as of May 11 were charged the established delinquency rates; and
WHEREAS, the owners of 11 Sunset Drive were charged interest on their 2nd quarter taxes which were paid on May 11; and
WHEREAS, said property owners refused to make payment of the full amount owed; and
WHEREAS, the Borough Council would like to offer relief to the owners of 11 Sunset Drive for the outstanding balance of $10.07;
NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of High Bridge in the County of Hunterdon and State of New Jersey that the Tax Collector is hereby directed to delete the delinquent amount of $10.07 from record.

Authorization of Stipend-Summer Recreation Counselor
RESOLUTION: 150-2018 ADOPTED: WHEREAS, Brady Krushinski is to be employed as a third-year counselor at a rate of $8.80 per hour for the 2018 Summer Recreation Program; and WHEREAS, Brady Krushinski will be providing additional support to the Summer Recreation Directors before and after the regular scheduled hours of 9:00 a.m. – 12:00 p.m. including preparation for daily events, gathering supplies, and after program clean up; and WHEREAS, the Borough Council would like to adjust the compensation paid to Brady Krushinski for the additional services to be provided, above the normal Counselor duties with a $200.00 stipend; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of High Bridge, in the County of Hunterdon and the State of New Jersey, that a $200.00 stipend be authorized to Brady Krushinski, Summer Recreation Counselor upon the completion of the 2018 Summer Recreation Program.

DESIGNATION OF MUNICIPAL HUMANE LAW ENFORCEMENT OFFICER
RESOLUTION 151-2018 ADOPTED: PENDING WHEREAS, an application for designation as a municipal humane law enforcement officer shall be submitted by the governing body of a municipality to the chief law enforcement officer of the municipality, Police Chief Brett Bartman, as per P.L. 2017, CHAPTER 331, Section 25 and 26, and WHEREAS, upon receipt of the application, the chief law enforcement officer of the municipality shall examine the character, competency, and fitness of the applicant for the position, including initiating a criminal background check, and WHEREAS, Det. Matthew Lazier will be appointed the Municipal Humane Law Enforcement Officer title subject to successful completion of the background check the approval of the chief law enforcement officer, NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of High Bridge in the County of Hunterdon and State of New Jersey that Det. Matthew Lazier will be appointed the Municipal Humane Law Enforcement Officer subject to successful completion of a background check and approval by the chief law enforcement officer, Police Chief Brett Bartman.

AUTHORIZATION TO MEET IN EXECUTIVE SESSION
RESOLUTION: 152-2018 ADOPTED: WHEREAS, the Mayor and Council of the Borough of High Bridge seek to discuss legal advice for the Town of Clinton arbitration, a personnel issue, and such other issues as are announced during the open session of the Council Meeting on May 24, 2018 that can be discussed in Executive Session; and WHEREAS, pursuant to the provisions of N.J.S.A. 10:4-12b, matters concerning personnel, pending litigation, contracts and land acquisition may be discussed in sessions from which members of the public may be excluded; and WHEREAS, the Mayor and Council are of the opinion that such discussions should, in the best interest of the citizens of the Borough of High Bridge, be held in Executive Session. WHEREAS, the executive session minutes will be released if and as required by law, including as to (1) pending or anticipated contract negotiations in which the Borough is or may become a party, the purchase, lease or acquisition of real property, and the setting of banking rates or investment of public funds, after the contract is signed or it is clear that negotiations will not resume, (2) pending or anticipated litigation, after the conclusion of the lawsuit in which the Borough is or may become a party, including the time for any appeals, or, if no lawsuit is filed, after the statute of limitations has run on the issue or it is otherwise clear that no lawsuit will be filed, (3) tactics and techniques utilized in protecting the safety and property of the public, if the disclosure would not impair such protection, and (4) matters that would impair the right to receive funds from the US Government if and when the impairment no longer exists. The Borough does not anticipate that executive session minutes covered by the following sections of the Open Public Meetings Act will be released: N.J.S.A. 10:4-12b(1)(information rendered confidential by State or Federal statute), b(3)(material constituting an unwarranted invasion of privacy), b(7)(advice falling within the attorney-client privilege), b(8)(certain employment matters, unless the affected employees or appointees request the release in writing) and b(9)(deliberations regarding the imposition of specific civil penalties)." NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of High Bridge, in the County of Hunterdon and State of New Jersey as follows:
1. The general public shall be excluded from the discussions in these matters pursuant to the provisions of N.J.S.A. 10:4-12B.
2. Matters discussed in Executive Session shall, when appropriate, be made public. 3. It is anticipated that formal action may be taken following this Executive Session.
