Slugfest On November 4, candidate for
the incredibly coveted DistrictClerk post, Kristen Hoyt,received 88% of the vote,with her write-in opponent,Rene Brimmage, pulling downthe other 12. This, despite the factthat Hoyt was declared ineligible forthe position because she didnt meet the one-year, pre-application residency requirement.According to Hoyts campaign paperwork,she had only lived here eight months insteadof the requisite 12.
The County GOP Chair resigned over theissue, as he shouldnt have allowed her to runin the rst place. Hoyt, however, has adopteda Never say die philosophy about the wholething, issuing vague statements about theapplication and her residency, saying therewas confusion on her part, but never outrightstating that she did indeed live here for a fullyear before the primary, or providing proofof any such residency to the Republican Partyas of the nal election. Her attorney has notreturned our call requesting clarication.
So heres the deal. The District Judges willget together and appoint someone to the job.Could be Cherie Perez, the current District ClerksOfce Manager and Hoyts primary opponent,or Brimmage, or Hoyt herself. Or someone
else entirely. Whomever the Judges select, itstheir right and obligation to choose the personthey see best t for the job- its out of the votershands now. The Houston-owned Herald-Zeitung,however, has issued a call for Hoyt to be namedto the post for a rather weak reason that webelieve should be addressed. So address we will.
In an op-ed that ran November 9, theHZs editorial staff published a columnwith the headline Judges should mind willof the electorate. Thats the rst problem.If judges minded the will of the electorate,wed still have a disposable container banand Jim Crow laws. Judges, in many cases,are called upon to override the electorate,state legislatures, and even the United StatesCongress on a regular basis, in the eventthat we the voters, or our representatives,commit or approve an illegal act. One should
never ask the courts to Mind the will of theelectorate. Take our word for it, you wontlike how that turns out in the long run.
Should the will of the electoratebe invoked, several things need
to be kept in mind:1) Many voters, both
Republican and Democrat,simply vote a straight ticket -
that is, they dont look at whosrunning for anything, they simply
say I want all elephants/donkeysand let it go at that. That single click forelephants would have automatically includedHoyt. That isnt will. Those voters dont care
one way or the other. That is partisan laziness.2) A great deal of voters had no idea
that Hoyt was ineligible for the ofce, let alonethat there was a write-in candidate. The factthat people that ill-informed actually vote isdismaying. Nonetheless, they had one choiceon the ballot and just clicked it. This isnt willeither. Its just ignorance.
3) Brimmage got 12% of the vote. Thatsa ipping miracle. What we can say for sureis that 12% of voters paid attention to theelection. We cant really draw anything elsefrom that number.
4) Only State law prevented Hoyt frombeing removed from the ballot. Had it beenwrite-in against write-in, which we would havefully supported, the race would have beenmuch, much closer, with far fewer votes castin the race.
There are a few things we can say forsure about Hoyt:A) She won a primary that she shouldnt
have been allowed to run in.B) She won a general election despite
being ineligible to run. Got lucky by being lefton the ballot.
C) According to her statement to theHZ that On the application where it asksfor Continuous Residence, I wrote eight
months What the application appears to askfor and what the law pertaining to residencerequires are two very different things, shecannot properly ll out an incredibly simplelegal form. Or ask for help.
D) She wants to work in the Countys legalsystem, but has decided that certain laws justdont matter. The legal system is constructedof technicalities and details. The Clerk shouldrespect that.

The fact that she retained anattorney who has threatened legal actionagainst the County should she not be giventhe job is a big deal. Now its a ght. Couldhave just been an issue to be worked out.And even if she didnt get the position thistime, it goes up for grabs again in two years.Now shes got a personality/integrity issue
she didnt need. As of press time, shes only25 years old, so I blame whoever is advisingher. Especially that lawyer.
One more thing. The HZ op-ed statesHoyt has since maintained she had lledout the form incorrectly and indeed had therequired 12 months residency.
Not so fast. Lets a have a good close lookat her statement to the HZ from September18, by which time she had already livedhere for over a year. Assuming a victory inthe general election in November, she said, Ican assure you I will be eligible to serve asdistrict clerk as I meet, and have always met,all of the residency requirements to do so.Lets take that one apart. It doesnt mean whateverybody thinks it means.
HZ: Assuming a victory Hoyt:Iwill be eligible What she actually said thereis that by the time November rolls around, shewill have lived here for a year or more. Shealready did at the time of the statement, but therule was to be here for a year or more at thetime of application to run, which, of course,she is ignoring. Tricky.
Weve got to ask, why is a technical joban elected position to begin with, why was it sohotly contested at the primary level, and whyis Hoyt ghting so ercely for it? What the Hellis going on at the District Clerks ofce? Whatkind of juice does this gig come with, and whydoes it come with any to begin with? Wed putthose questions to Hoyts attorney should heever call us back. Perhaps the clerks ofce is a
good place to establish a positive relationshipwith judges for future, you know, stuff thatmight cross their desks. That would make
sense. In any case, i t s a good bet that there sa power struggle going on in that ofce, anda hot one at that.
In other news, it looks like the City mightbe having second thoughts about the way thePospisil Administration pushed that litigation-spawning towing contract through last year,as Council has decided to go back to the
drawing board on the issue. Well have moreon the ramications of that decision in nextweeks Due Process column.

the decision.
Policing the RiverPolice Chief Tom Wibert announced recentlythat the New Braunfels Police will place an
aircraft carrier on the Comal River.The plan is to get the carrier on the waterby summer. The vessel is expected to be calledthe NBS Pospisil, after former Mayor GailPospisil, the much beloved City leader whowas known for her critical thinking skills andloathing of tourists.
I was thinking, what could we do tobetter get a police presence on the river? thePolice Chief said. There are a great number of
people oating around on tubes out there whoare out of reach of harassment. Then, like aash, it came to me: an aircraft carrier.
Were looking for drunkenness, disposablecontainers and fornication, Wibert said.
When it was pointed out that, by courtorder, the police could no longer enforce thedisposable container ban, Wibert simply said,Whatever. Ill have an aircraft carrier.
The Chief explained how the aircraft carrierwould work: The planes go voom, while theguns go tatatata and the bombs go boom!
However, the United States governmentsaid that New Braunfels could not have an
aircraft carrier because not only is it too big fora river, it is illegal.
New Braunfels appealed the decision,claiming that as a home-rule city, it has the rightand duty to use an aircraft carrier.
Theres no appeal. Its illegal, a Pentagonspokesman said, obviously not understandingwho he was dealing with.
Fighting City HallSteve Morsett is demanding that City Council passan ordinance that would give him a girlfriend.
The City owes me a girlfriend, Morsett
said. Im a taxpayer.Every time I turn around, theresanother restraining order, he bemoaned.How am I supposed to make them love meif I cant see them?
Morsett said that the United StatesConstitution demands the government providehim a girlfriend. When it was pointed out thatthe Constitution allows no such thing, Morsettresponded that youre just like them.
After Morsett presented his case to Council,an unnamed City Attorney said the City couldprocure Morsett a girlfriend, but it couldnt be aNew Braunfels resident. We could capture atourist, the attorney said.
One Councilmember asked if that wouldamount to the City participating in the illegalact of kidnapping.
Yes, the City Attorney answered.OK, the Councilmember said.The unnamed City Attorney said she only
recommended the plan to keep the City fromgetting sued.

Lets face it, we dont want to go into a barthat has nothing to do. Such places aresinister affairs constructed out of plywood orcinderblocks. They usually dont have windowsbecause the outside world gets in the way ofserious drinking.
When there is nothing to do in a bar butdrink, the seriously inebriated get bored. Thisis when the knives come out.
This is what makes the Watering HoleSaloon a great place: There is a lot do, so
you wont get cut.I call it a Chuck E. Cheese for adults,
said manager Holly Oveturf. We have allkinds of games: pool tables, darts, foosball,shufeboard, video golf and more.
Besides the games, the WateringHole also provides a wide variety ofentertainment for its clientele.
We have a large air conditioned dance
oor, Holly said. We have DJ music onSaturday nights and we get a lot of peoplewho come in for that. This Friday, well startoffering live music.
When Hollys parents, Bob and ShirleySaulle, opened the place in 1986, it wasintended to be live music venue.
We used to have a lot great liveacts coming from Austin, Holly said.Unfortunately, at that time the town wasntready for live music and didnt want to pay a
few extra bucks at the door. Then we went toa DJ and thats worked for us for more than 20
years. Now, live music is what this town is allabout. You could say that the Watering Hole isreturning to its roots.
In fact, one of Hollys favorite memoriesfrom the saloon was when the 1950s Doo-Wop act the Drifters performed in 1992.
That was a fun night. I was just 22 and itwas a blast, she said.
On Tuesdays, the saloon has long offered
acoustic performances. On Thursdays,theres karaoke, which often requires a greatdeal of bravery.
We have some talented singers and, letssay, some persistent singers, Holly said. As forme, I will sing behind the bar all night, but youcould never get me up there to sing karaoke.
Besides the games and entertainment, theWatering Hole Saloon is a visually fascinating
place, one in which you could gander foreverand still not see everything.
One of the rst things you notice when youwalk in is the beautiful wooden serving bar.
The bar was handcrafted by TerryBoquist, a chainsaw artist from Minnesota,Holly said. The myriad of animal carvingson the bar show a deft hand and a greatdeal of depth. Boquist also carved, with achainsaw, an enormous and intimidating7 ft.-tall bear.
Besides the bar, the Watering Holes wallare chocked full with an array of stuff thatruns from autographed sports memorabilia(including an autographed Brett Favre Packersjersey and a football signed by Jim Brown),music posters (with an autographed photo ofElvis manager, Col. Tom Parker), and snazzyAmericana metal advertising signs.
A patron could truly walk around thesaloon for hours and never be bored, thuskeeping him from pulling out a knife.
There is even a horse trailer in there. No,seriously. The trailer is actually a full-servicebar that is used when the joint gets crowded.
And the Watering Hole can getcrowded. The saloon can comfortably t atleast 300 people.
Our biggest night was when, several years ago, the Cowboys were playing thePackers, Holly said. They were playing on a
Thursday night on the NFL Network, which alot of people did not have. The place was lledwall to wall, standing room only. As soon asthe game was over, the place was deserted.
I was not prepared for such a big crowdon a Thursday night, she said. We only hadthree bartenders on staff and me. It was themost money we ever made in one night.
Of course, as with any place, returningcustomers offer the greatest testament tothat business quality.
I have regulars that have been coming ihere since 1986, Holly said, explaining thathe continual success of the Water Hole is ilaid-back atmosphere.
Everybody in here is really friendlyshe said. I would call it a working manbar, a blue collar bar.
But the Watering Hole continues to puin new crowds, both local and tourists. Holalso said they also have many northern SnowBirds who return to New Braunfels and thWatering Hole every winter.
To keep people returning, however, agood business has to offer more than ambiancand a shankless environment. You have to givthem goodies. Get this, on Sunday you canwatch any football game, pay happy hourprices and if you ready for it eat for FR(while the food lasts, anyway).
The Watering Hole offers more tha50 avors of beer along with several typeof cocktails and shot drinks. Of course, thprimary beer of choice is Bud Lite.
They work hard at the saloon, which iopen seven days a week, 364 days a year(they only close on Christmas).
The Hole is located just minutes frodowntown at 1390 McQueeney Rd, just ofElliot Knox Boulevard.
So, grab your boots, leave your knife andgo see the Good Ole Boys play some TexaCountry fare this Friday night.

The Religions of the FoundersTwo weeks ago, in my column on fear, I warnedagainst the argument that the United States is aChristian Nation. The point I was trying tomake was that the United States was designedto be inclusive to everyone, not just Christians.In doing this I said that the Founders came froma wide variety of religious beliefs. To me, thiswas a minor statement of fact, requiring nofurther explanation, but when comments beganto come in, I found that this was a major point ofcontention. Sometimes, its the smallest factorsthat need the most explanation, and withoutthat explanation, the larger point can be lost.Because of this, Ive decided to dedicate thiscolumn to defending the statement I madesimply in passing. I hope that by explainingwhat I meant, I can help people come to gripswith the point that the Founders would not havewanted us to base our government on anyspecic set of religious ideals.
To start, let me support the basic critiqueof my contention that the Founders had a widevariety of religious beliefs. Any respectableresearch into the subject will nd that most(if not all) of the Founders could nominallybe called Christian in that they came fromsome background that was founded on theNew Testament teachings of Christ. Amongthe Founders, one will not nd Jews, Muslims,
Hindus, or Buddhists. I assumed that mostpeople would take this as a given. That said,not all Christians share the same religiousbeliefs, and some of the founders had personalbeliefs with regards to God that could not besaid to fall into any traditional structure of faith.
If we look specically at the signers ofthe Declaration of Independence, the vastmajority of the signers would be consideredAnglican. This isnt surprising; the AnglicanChurch is the Church of England and wouldhave been the primary religious afliation ofmost Englishmen. That said, Anglican wouldalso be a catchall for many regardless of theircommitment to faith. We know that a goodnumber of the Founders were quite pious, butmany of those who were not would have beenraised as Anglicans and would, no doubt,have been referred to as such.
There was certainly a political differencebetween Anglicans and Roman Catholics (theAnglicans were founded originally in response
to the Popes refusal to sanction Henry the VIIIsdivorce), but the differences dont end there.There are several fundamental differencesbetween Anglicans and Catholics in matters offaith. Anglicans believe in salvation based onfaith alone, where Catholics require both faithand good works. The primacy of the Pope asthe head of the Christian faith is also disputed.And, Anglicans accept only the Bible as asource and basis for their religious faith. Thesedifferences may not sound extreme, but theyare substantial when it comes to the way each
faith is practiced, and even though Anglicansare considered a relative midpoint betweenCatholicism and Protestantism, the two are notremotely interchangeable.
The next most common group would havebeen Congregationalists. Congregationalistswere the Revolutionary eras version of thePuritans. The Puritans, of course, left Englandspecically looking for religious freedom.
Those they sought freedom from were theAnglicans. (It cant be made clear enough thatthese two sects of Protestantism would not haveseen themselves as holding the same religiousbeliefs.) The major difference between themwas that the Congregationalists were dedicatedto individual salvation. The Anglicans hadreplaced the Pope with the King as the headof the Church. Congregationalists recognizedno authority in such matters, and took theleadership of the Church upon themselves,usually in small community-based groups.
Presbyterians come next. Aside from thepolitical differences dened by the English CivilWar (16421651), Presbyterians differ fromAnglicans in that they believe in predestination.Both groups believe that only through Godsgrace is man saved, but the PresbyterianChurch believes that God has preordained
that some will be saved and others will not.Again we have a major theological differencethat prevents compatibility between the faiths.
Quakers were also among the signersof the Declaration of Independence. Thisis a bit surprising because Quakers arepacists and the Declaration of Independencewas tantamount to a declaration of war,but Quakers were heavily represented in
the Pennsylvania citizenry, and as suchhad a large stake in the nations pursuit ofindependence. The Quakers are a subset of
the Puritans (Congregationalists), and justas the Puritans had been persecuted by theAnglicans, the Quakers were persecuted bythe Puritans. Quakers were so dedicated toindividual salvation that they rejected even thenominal, community based, authority set upby the Puritans. Quakers did not believe thatone need be educated as a clergyman, theyrejected the idea that a church was the centerof worship (often meeting in private homes toworship), they were abolitionists, and evenallowed women to participate, more or less,
equally within the church.Unitarians were also present. Unitarians
are the most different of these Protestant sects.Unitarians do not accept the Trinity, the divinityof Jesus, that man is born tainted with OriginalSin, or even the idea of eternal damnation.With all these differences, the Unitariansopened their doors to many different non-traditional groups and welcomed agnostics,
polytheists, and even atheists into their midst.Because of this, just as Anglicans might havebeen a catchall for people of nominal faith,Unitarians likely would be the catchall term forpeople of non-traditional faith. Such peoplewho followed their own course would probablynot have had any other church to call home.
When we hear people profess thatmany of the Founders were not religious orwere deists, they are generally referring to anon-traditional viewpoint of the type that theUnitarians would have tolerated. Indications ofthis can be found in the writings and actionsof many of the more famous of the Founders.
Thomas Paine wrote of his unwillingnessto accept any common denomination ofChristianity inThe Age of Reason saying, I donot believe in the creed professed by the Jewishchurch, by the Roman church, by the Greek
church, by the Turkish church, by the Protestantchurch, nor by any church that I know of...Eachof those churches accuse the other of unbelief;and for my own part, I disbelieve them all.Other statements made by Paine make it clearthat he believed in God though he implied hehad little concern for the afterlife, so it can beassumed that his belief differed somewhatsignicantly from all of the groups above.
Though George Washington hasbeen identied as an Anglican, his attitudeswere more Unitarian than anything else. He
supported religious freedom in all areasFurthermore, in none of Washingtoncorrespondence does he declare himself aChristian, nor was he attended by any clergyupon his death. Though there is no direcproof that Washington was either an atheisor agnostic one could be forgiven if theassumed as much. His religious convictiowere conspicuously absent.
Thomas Jefferson is well documentedas something other than a traditionaChristian. Jefferson has often been referre
to as a deist. He seemed to believe in Godand was very interested in the teachingof Jesus, but clearly questioned much oconventional Christian doctrine. Jeffersoprofessed an afnity for the Unitarian Churcthough he doesnt seem to have belonged toit. Perhaps the most common tale of Jeffersin this vein is his construction, in later lifof a version of the New Testament tha
removed everything but the direct teachinof Jesus. Amongst the redacted material waanything that indicated a supernatural or divinnature for Jesus.
Space constraints prevent any otheexamples, but there are many of them. JohAdams, James Madison, Ethan Allen, anBen Franklin are all popularly known for thnon-traditional beliefs extrapolated from thhistories. If this is true of many of the mstudied Founders, it seems likely that many of tother less well-known Founders might have hpeculiar beliefs. The debates and documentthat led to the formation of our country includa level of tolerance for religious freedom thwas unheard of at the time. Lets not forgthat one of the signers of the Declaration oIndependence was even (gasp!) a Catholic. Wescoff at some of these differences today. Ove
time Protestantism has become more inclusivand old rivalries are now mostly forgotten, buthat would not have been the case during theFounders time. These differences were, ndoubt, the basis for their concern over inordinatcoordination between Church and State. Weneed to respect this; its one of the things thmakes our country so great.
