Gomez, City Manager BY: Theresa Devoy, CMC, City Clerk SUBJECT: RESOLUTION NO. 19-10 - DESTRUCTION OF OBSOLETE RECORDS Background: State law provides that certain City records, which are not required for legal or legislative purposes, may be destroyed after two years. In addition, in February 2009, City Council adopted Resolution No. 09-05, establishing a records retention schedule for all City records. Attached is a list of obsolete records submitted by the Human Resources and Transportation departments that may be destroyed pursuant to State law and the City’s adopted retention schedule. The City Attorney has reviewed the list and approved destruction. Fiscal Impact: None. Citizens Advised: N/A Strategic Action Plan Implementation: N/A Recommended Action: Staff recommends City Council adopt Resolution No. 19-10, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE HUMAN RESOURCES AND TRANSPORTATION DEPARTMENTS. RESOLUTION NO. 19-10

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORWALK AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE HUMAN RESOURCES AND TRANSPORTATION DEPARTMENTS.

WHEREAS, Section 34090 of the Government Code provides for the destruction of public records more than two years old with the consent of the Department Head and the approval of the City Attorney and legislative body by resolution; and

WHEREAS, the City Council adopted Resolution No. 09-05 on February 17, 2009, establishing a Records Retention Schedule, which identified City records and established their retention.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NORWALK DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

Section 1. In accordance with Government Code §34090, the following identified records are no longer required:

§ Personnel Files – through 2014 § Payroll Leave Requests – through 2016

Section 2. Pursuant to the approval of the City Attorney, the City Council does hereby authorize the destruction of said records from the Human Resources and Transportation departments of the City of Norwalk.

Section 3. The City Council hereby finds and determines that said aforementioned records are more than two years old and/or are no longer required nor are the same required to be kept by statute or law.

Section 4. The City Clerk is hereby directed to cause said records to be destroyed in accordance with the terms and conditions of Section 34090 of the Government Code of the State of California.

Section 5. That upon destruction of the identified records, the City Clerk Department shall make a certification of destruction of such records and file the original of same in the office of the City Clerk.
