A N O R D I N A N C E TO A M E N D T H E M E R C H A N D I S E M A R K S O R D I N A N C E .

B E IT E N A C T E D by the H i g h Commissioner for Palestine, with the advice of the Advisory Council thereof :—

1. This Ordinance may be cited as the Merchandise Marks S n o r t t i t l e • (Amendment) Ordinance, 1939, and shall be read as one with the Merchandise Marks Ordinance, hereinafter referred to as the pr in- Cap. 91. cipal Ordinance.

2. Subsection (2) of section 2 of the principal Ordinance shall Amendment of be amended by the deletion of the words "or marks " appearing t h e ^ r i n c / a l therein, and the substitution of the following words therefor : — Ordinance^

" , marks, get-up or manner of packing or wrapping" .

O B J E C T S A N D R E A S O N S .

Section 2(2) of the principal Ordinance provides that the provisions of the Or­dinance respecting the application of a false trade description to goods shall extend to the application to goods of any such figures, words or marks as are calculated to lead to the belief that the goods are the manufacture or merchandise of a person other than the person whose manufacture or merchandise they really are. This Ordinance amends section 2(2) so as to include deceptive get-up, packing and wrapping of goods as well as actual "figures, words or marks" . The definitions of "trade description" and "false trade description" under section 2(1) of the pr in­cipal Ordinance are already sufficiently wide to cover get-up, wrapping and packing.

2. The intentionally deceptive getting-up, wrapping or packing of goods, which wi l l become an offence under the amended section 2(2) read in conjunction with section 3(l)(c) of the principal Ordinance, was formerly an offence under section 33(l)(e) of the Trade Marks Ordinance (Chapter 144 in the Revised Edit ion of the Laws) , but section 33(1)(e) was not reproduced in the Trade Marks Ordinance, No. 35 of 1938, which repealed and superseded the former Ordinance, and it is now considered that the Merchandise Marks Ordinance is a more appropriate place for the insertion of such a provision, which is not necessarily concerned with trade marks.

B E IT E N A C T E D by the H i g h Commissioner for Palestine, with the advice of the Advisory Council thereof :— Short, title.

No. 6 of 1935.

Amendment of section 4 of the principal Ordinance.

1. This Ordinance may be cited as the Public Health (Rules as to Food) (Amendment) Ordinance, 1939, and shall be read as one with the Public Heal th (Rules as to Food) Ordinance, 1935, herein­after referred to as the principal Ordinance.

2. Section 4 of the principal Ordinance shall be amended by the insertion of the words "Sanitary Surveyor o r " between the words " a n y " and "inspector" appearing in paragraph (d) thereof.

This Ordinance inserts a specific reference to Sanitary Surveyors, for the purpose of clarity, i n the list of inspectors and officers who are empowered under section 4 of the principal Ordinance to procure samples of food for inspection or analysis.

Greetings Letter Telegrams.

It is notified for information that commenc­ing 1st May, 1939, a greeting letter telegram service wi l l be introduced "v ia Imperial", be­tween Palestine and all countries in the Br i t ­ish Empire except Burma, Canada and India.

The service wil l be available all the year round.

Telegrams must be entirely social messages, and consist solely of greetings, family news or non-commercial personal affairs. They must not relate to trade or business or include com­mercial marks or expressions.

" G L T s " must be written entirely in plain language and must bear an intelligible mean­ing. They must not bear any other meaning and must not include a succession of numbers or words without connected meaning. Subject to the foregoing, " G L T s " may include figures provided that total number of groups of figures does not exceed one third of the chargeable number of words in the text and signature.

The telegrams wil l be delivered on an orna­mental form enclosed in a decorated envelope.

The charge wil l be 250 mils for the first 13 words including the indication " G L T " and 21 mils for each additional word.

Further particulars relating to this service may be obtained from any Post Office or Postal Agency.
