In May, the Tacoma Daily Index was first to re- port an initiative is under way at City Hall designed to bolster the City of Tacoma's enforcement codes in order to prevent instances of so-called "demoli- tion by neglect," the process by which buildings en- dure crippling, long-term issues such as deferred maintenance, vandalism, or even foreclosure and eventually become too expensive to save in the eyes of building owners (see "Tacoma considers plan to save neglected historic buildings from demolition," TDI, 05/31/13). In Tacoma, the Luzon Building, which was designed by famed Chicago architects John Wellborn Root and Daniel Hudson Burnham during the 1890s, was demolished in 2009 after city inspectors deemed the historically significant build- ing a safety hazard for fear it would collapse after decades of neglect. Similarly, 120-year-old Old City Hall has experienced foreclosure, fire damage at the hands of a transient, a 'derelict' designation by city inspectors, and an 'endangered' designation by a lo- cal historic preservation group. Finally, the 88-year- old Winthrop Hotel is in need of nearly $16 million in deferred maintenance, according to a report pre- pared four years ago. In June, Tacoma City Council's Neighborhoods and Housing Committee met with city staff to dis- cuss the proposal (see "Can legislation save Taco- ma's neglected historic buildings?" TDI, 06/06/13). Although it's still in its development stages, city staff highlighted some of the strongest elements of a new ordinance, which would define neglect as a pub- lic nuisance. For one, it would likely apply only to properties listed on the Tacoma Register of Historic Places, National Register of Historic Places, and to properties within designated historic districts. The new law would provide incentives to encourage own- ers of neglected properties to find new owners with the means and interest to save the historic struc- ture. It would also afford the City of Tacoma the au- thority to address conditions that threaten historic buildings before they are deemed 'dangerous' and, ultimately, demolished. Finally, the ordinance would allow the city to create an "emergency preservation fund" to tackle deferred maintenance issues that threaten Tacoma's historic buildings. "We want to have the ability to proactively ad- dress these issues and create the ability to inter- vene," Tacoma Historic Preservation Officer Reuben McKnight told councilmembers during the meeting in June. He added that the goal is to have the ordi- nance operational and online before the end of this year. In an e-mail Friday, McKnight added the new ordinance, titled "Preventing Neglect of Historic Properties," would be added to Title 8 of the Tacoma Municipal Code as a new chapter. "The proposed or- dinance would allow the city to act, where appropri- ate, to prevent neglect of commercial and multifam- ily historically designated buildings earlier in the process of a building's decline through its authority to abate public nuisances before a building becomes 'dangerous' or unfit for human habitation," wrote McKnight. "Existing minimum buildings standards, already in place, will remain unchanged. Historic single family residences will not be affected by this code change." An informational session about the proposed or- dinance is scheduled to take place on on Thurs., Aug. 8 at 5:30 p.m. at Tacoma Municipal Building North, 733 Market St., Room 16. The beneficial inter- est is now held by 2010-1 RADC/ CADC Venture, LLC, a Delaware limit- ed liability company (the “Beneficiary”), successor in interest to Federal De- posit Insurance Corporation (“FDIC”) in its capacity as Receiver for West- sound Bank by that certain Assign- ment of Real Estate Deed of Trust re- corded December 1, 2010 and re-re- corded April 28, 2011 to correct the legal description, under recording nos. 2 0 1 0 1 2 0 1 0 3 9 1 a n d 201104280370, respect ive ly, records of Pierce County.The Deed of Trust secures the total principal amount of the Secured Debt (as defined in the Deed of Trust), in the maximum amount of $100,000.00, plus interest, loan charges, commit- ment fees, brokerage commissions, attorney’s fees and other charges made pursuant to the Deed of Trust, which Secured Debt is evidenced by that certain Universal Note dated Feb- ruary 6, 2007, in the principal amount of $763,750.00 (the “Note”), execut- ed by Reid-Dallas, LLC (“Borrower”) as maker in favor of Westsound Bank as payee. The Beneficiary is the owner and holder of the Note and the other obligations secured by the Deed of Trust.Reference is made to Section 19 of the Deed of Trust ent i t led “Environmental Laws and Hazardous
Substances”. XNOTICE TO OCCUPANTS OR
TENANTSThe purchaser at the Trustee’s sale is entitled to possession of the Property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not ten- ants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chap- ter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accord- ance with RCW 61.24.060.
XINOTICE TO GUARANTORS
(1) The Guarantors may be liable for a deficiency judgment to the extent the sale price obtained at the Trustee’s sale is less than the debt secured by the Deed of Trust; (2) the Guarantors have the same rights to cure the de- fault and repay the debt as is given to the Grantor in order to avoid the Trus- tee’s sale; (3) the Guarantors will have no right to redeem the Property after the Trustee’s sale; (4) subject to such longer periods as are provided in the Washington Deed of Trust Act, chapter 61.24 RCW, any action brought to en-
force a guaranty must be commenced within one year after the Trustee’s sale, or the last Trustee’s sale under any deed of trust granted to secure the same debt; and (5) in any action for a deficiency, the Guarantors will have the right to establish the fair val- ue of the Property as of the date of the Trustee’s sale, less prior liens and en- cumbrances, and to limit its liability for a deficiency to the difference between the debt and the greater of such fair value or the sale price paid at the Trus- tee’s sale, plus interest and costs.
