Pete Hoekstra says the congressman has a conflict of interest on the contentious cross-lake ferry issue because he received campaign contributions from the operators of the Ludington ferry. Robert Shrauger, of Pentwater, said Hoekstra should have divulged the contributions when he met with competing Ludington and Muskegon officials last week. Hoekstra called Shrauger’s accusations a “cheap shot” and promised a fair appraisal of the ferry issue. Hoekstra, R-Holland, is considering whether to take a stand on an expected application for a federal loan guarantee for a proposed high-speed, cross-lake ferry service between Muskegon and Milwaukee. Muskegon-area officials support the loan guarantee. Owners of an existing Ludington-to-Manitowoc ferry service are opposed, saying it creates unfair competition with their service, which they say is unsubsidized. Hoekstra’s district includes both communities. During his 1998 re-election campaign, Hoekstra received free use of the Ludington ferry, the SS Badger, for a campaign fund-raising cruise. The “in-kind” contribution, with a value of $9,000, is listed on federal campaign finance reports filed by the candidate. Shrauger, Hoekstra’s 1998 Democratic opponent, said Hoekstra met with competing officials in Muskegon and Ludington last week “under a false pretext of neutrality.” “Hoekstra has received (contributions) from top executives of the Lake Michigan Carferry and their families,” Shrauger stated in a press release Monday. “He is misleading the public with his claims of impartiality when, in fact, he has a very real conflict of interest.” Hoekstra denied the charges of a Democrat who he said is “considering” another run against him in 2000. “This is more than just a campaign contribution,” Hoekstra said in response to the Shrauger charges. “This is an issue about the lives and jobs of the citizens in both communities.” Hoekstra said he handles issues every day that are brought to his office from political friends and foes. He said Muskegon-area residents have also supported his campaign. “Friends and supporters on both sides of issues come to our office every day,” Hoekstra said. “When you can’t talk about issues, you try to destroy a person’s integrity.” In 1998 campaign contribution reports to the Federal Election Commission, Hoekstra’s campaign stated that it received $9,000 of “in-kind” support for a “fund-raiser facility.” A $1,000 contribution – the federal limit for any one individual per election cycle – was given by: Lake Michigan Carferry President Robert Manglitz and three family members; Vice President Don Clingan and his wife; and Vice President Jim Anderson and three family members.
“Lake Michigan Carferry owners and their families have contributed to the election campaign funds of many of our elected representatives in the past, including Rep. Pete Hoekstra,” Clingan said. “Like many of his constituents, we believe Pete Hoekstra isa highly competent man with high standards, sound morals and an economic philosophy we believe in.” Shrauger questions whether all the family members listed as contributors are owners of the ship because only ship owners can make a contribution of the vessel. And if the ship is owned by a corporation and not the individuals, contributions from companies are illegal, Shrauger said. Despite the political broadside, Hoekstra said he will continue to research the issues involving a potential federal loan guarantee for the high-speed ferry company, Hydrolink LLC. “We are going to focus on what is the best solution for the people of West Michigan,” Hoekstra said. “This will be a very fair process.” Hoekstra has been asked by economic development officials in Ludington to oppose the Hydrolink loan guarantee. After meeting with officials from Muskegon and Milwaukee Thursday morning, and from Ludington in the afternoon, he declined to take an immediate position. If Hydrolink applies for a loan guarantee, Hoekstra said he will either oppose it, support it or allow it to proceed without his comment. Shrauger said the Lake Michigan Carferry support is not the problem; it’s Hoekstra’s lack of candor in not divulging it. “As his constituents, we deserve the truth about where his interests lie, and he has an inherent obligation to fully disclose any biased involvement he has in this debate,” Shrauger said. A year and a half after raising a political firestorm over potential “subsidies” for a proposed Muskegon-to-Milwaukee high-speed ferry, the Lake Michigan Carferry Co. in Ludington had its own subsidy request before the Michigan Legislature. That bid was turned down by the full Senate Appropriations Committee last week. And according to Ludington ferry officials, that’s exactly what they wanted. They said the legislative move was not intended to collect $1.2 million for an engine upgrade in the SS Badger. Instead, the funding request was a ruse to “set precedent” against any company or community receiving state assistance, an explanation at least one ferry player found “unbelievable.” Meanwhile, it could not be determined whether Ludington’s state Sen. Bill Schuette, who initiated the budget item, thought he was trying to establish funding or precedent. Lake Michigan Carferry spokesman Thom Hawley said the ferry company would not have accepted the $1.2 million, which was initially approved by the Senate Appropriations Transportation Subcommittee in the current budget debate. “We wanted to set precedent on the subsidy issue by it being defeated,” Hawley said. “This was to reinforce our position that we stand opposed to ferry subsidies.” Bull, said Milwaukee Port Director Ken Szallai. “That is so bizarre as to be unbelievable,” Szallai said of the Ludington explanation. “No politician does something like that. They went after a subsidy and they got shot down. “This is typical Manglitz,” said Szallai of LMC President Robert Manglitz. “He says one thing and does another. That’s why we weren’t able to do a cross-lake ferry deal with him.” Senate staffers say Schuette, R-Midland, requested the $1.2 million at the Appropriations Transportation Subcommittee. Schuette’s 35th Senate District includes Ludington. Schuette aide Phil Ginotti said the senator would prefer not to provide subsides for any private business but that is not realistic in today’s world. “There is economic civil war out there,” Ginotti said. “You disarm or compete. The senator figured this is what we have to do in an imperfect world.” Ginotti distinguished between state assistance for the former Hydrolink project, which was a new company, and the Lake Michigan Carferry, a cross-lake link that has been operated as a railroad ferry for more than 100 years. Schuette fought against a cityof Muskegon state grant for a cross-lake ferry dock for Hydrolink.
Ludington Daily News (MI) December 1, 2001 Section: News Manglitz letter to MARAD warns end of carferry If loan guaranteed Author: PATTI KLEVORN News Editor Article Text: Lake Michigan Carferry Service officials want the U.S. Maritime Administration (MARAD) to consider the issue of competition when deciding the fate of a loan guarantee application from Viking High Speed Ferries. Dr. Thomas Rankin, of Eau Claire, Wis., has applied for a federal loan guarantee in his effort to start a cross-lake ferry service, Viking, between Waukegan, Ill. and St. Joseph. If MARAD grants Rankin’s request, it could spell the end of carferry service from Ludington, LMC officials say. In a letter to the MARAD, LMC President Bob Manglitz wrote, “If Viking were granted a loan guarantee, we believe Viking and Lake Michigan Carferry would both fail.” Rankin had proposed a plan from Muskegon to Milwaukee, Wis., a couple of years ago under the name Hydrolink, and considered requesting a loan guarantee for that project. Manglitz’s letter to MARAD states: “We were opposed to the loan guarantee for Hydrolink because it would have resulted in providing government assistance to a direct competitor serving the same Great Lakes market we serve. We are opposed to the Title 11 guarantee for Viking Fast Ferries for the same reason.” Lake Michigan Carferry considers the Title 11 loan guarantee a subsidy, Manglitz stated, “because the guarantee would: • provide the only means for Viking to obtain financing for the project. • allow Viking to obtain a lower interest rate for borrowed capital. • significantly extend the payback period for Viking. • obligate the American taxpayer for any loan default.” Manglitz letter tells MARAD that the passenger maritime business is risky, and cites a recent failure in the industry, American Classic Voyages, which Manglitz says will cost the American taxpayers millions of dollars by a Title 11 loan guarantee. A loan to Viking could mean another loss of tax dollars and could force Lake Michigan Carferry out of business, he states. There is another company considering a separate venture of cross-lake service, the Lubar family of Wisconsin is working with Muskegon and Milwaukee, Wis. officials to try to work out a deal.
Manglitz’s letter does not refer to this proposal but it does state: “If a competitor has the courage, expertise, and resources necessary to compete with us, without government assistance, we will accept the challenge and the outcome.” And in the meantime, Lake Michigan Carferry is considering sprucing up a second carferry, the S.S. Spartan, to run a second cross-lake route to the south. It’s been a long-term goal of the company since Charles Conrad took over the ailing carferry business in 1991 and restarted the S.S. Badger’s route from Ludington to Manitowoc. Wis. And in recent years, including 2001, Manglitz has offered more details on potential plans for a second route, referring to it a luxury cruise. But LMC officials have said they’re route would complement the Ludington service, allowing both to stay in business. The Ludington carferry business is forwarding copies of the letter to MARAD to U.S. Rep. Pete Hoekstra, R-Holland, U.S. Sen. Carl Levin, D-Mich., Manitowoc Mayor Kevin Crawford, Ludington Economic Development Corp. Director Bill Kratz and U.S. Rep. Thomas Petri, R-Wis. “We are not asking for public support at this time, but if it the application seems to be getting serious consideration we would appreciate community support as we’ve had in the past,” said Don Clingan, vice president in charge of marketing for Lake Michigan Carferry. If the proposedhigh speed ferry is a sound business investment, privatelenders will provide the resources necessary to meet the need.Government should not interfere with the free enterprisesystem to the disadvantage of an existing non-subsidizedbusiness.The Alliance is supportive of the free enterprise system andwe believe that any taxpayer subsidy in the form of grants orloan guarantees creates an uneven playing field and is notconsistent with the principles of the free enterprise system.

On April 16, 2003, Congress appropriated $25 million to the Maritime Administration(MARAD) for new Title XI loan guarantees1. As part of the Appropriation, theOffice of Inspector General (OIG) was required to certify that the recommendationsset forth in our March 27, 2003 report had been implemented before MARAD couldaccess those funds. Although this certification specifically applied to the newlyappropriated funds, the Secretary decided that it would be prudent for MARAD toadhere to the OIG�s recommendations on any new commitments, even those fundedby prior year appropriations.
In December 2002, Lake Express LLC applied for a Title XI loan guarantee to build ahigh-speed ferry to provide service on Lake Michigan between Milwaukee,Wisconsin and Muskegon, Michigan. MARAD had completed its analysis of theapplication in April 2003 and presented it to you for final approval. Before taking thisfinal step, the Secretary suggested that we review both the application and MARAD�sprocessing of it to ensure that our recommendations had been incorporated. We werenot asked to nor did we opine on the merits of the application.
Of the five recommendations set forth in our March report, only two apply to the pre-approval stage of the loan guarantee, and thus the Lake Express application. The firstrecommends a rigorous analysis of the risks from modifying any loan approvalcriteria and the imposition of compensating provisions on the loan guarantee tomitigate those risks. In this instance, there were no material modifications to the loanguarantee approval criteria that would require MARAD to impose any compensatingprovisions on Lake Express.

The second recommendation is for MARAD to formally establish an external reviewprocess as a check on MARAD�s internal loan application review and as assistance incrafting loan conditions and covenants. We are currently working with MARAD tofinalize the procedures for establishing this process which will ultimately allow theindependent reviews to proceed simultaneously with MARAD�s internal reviewprocess.
MARAD retained an independent financial analyst to review Lake Express� businessplan and capitalization. MARAD also engaged a market analyst to review theapplicant�s market research and demand forecast. Given the narrow window inwhich these analyses needed to be performed, their scope was more limited than wewould anticipate from future independent analyses. However, given thecircumstances, we believe that these reviews were consistent with the underlyingintent of the recommendation.
The financial analysis resulted in a finding that Lake Express represents a viablebusiness proposition and that there is a reasonable probability of repayment offinancing according to its terms should MARAD decide to provide a Title XI loanguarantee. The analyst recommended that several steps be taken to further protectthe Government�s interests and MARAD has agreed to implement these changes.
The market analysis raised some concerns about the underlying market research,although it is not clear whether these issues would materially affect the financialprojections of the venture. Given these concerns, however, if MARAD decides toapprove the Lake Express Title XI loan guarantee application, it would be prudentfor MARAD to limit the Government�s risk by establishing a firm limit on theguarantee amount. MARAD will do so by including explicit language to this effectin the commitment letter.
Lake Express has applied for a loan guarantee in the amount of $14.5 million and itsowners have committed to invest $8.5 million in equity. That equity will be usedboth for boat construction ($4.4 million), and initial start-up costs and workingcapital ($4.1 million). If the cost of construction increases beyond the currentlycontemplated total vessel cost of $18.9 million ($14.5 million + $4.4 million), theinvestors in and owners of Lake Express should be required to provide new equityfunds to cover the increases with no decrease in the $4.1 million in pledged start-upfunds/working capital or increase to the $14.5 million loan guarantee. The applicantmust seek sources of funds to cover any shortfalls from sources other than theGovernment.

SEC. 707. SPECIAL CONSIDERATION FOR VESSELS OF HIS-1
TORICAL SIGNIFICANCE. 2
(a) IN GENERAL.—Notwithstanding any other provi-3
sion of this title or the amendments made by this title, 4
a qualified vessel shall operate for the life of the vessel 5
under the terms and conditions of the Vessel General Per-6
mit, as in effect on November 1, 2011, without regard to 7
any expiration dates in such permit. 8
(b) DEFINITIONS.—In this section: 9
(1) QUALIFIED VESSEL.—A vessel is a qualified 10
vessel for purposes of subsection (a) if the vessel is, 11
as of November 1, 2011— 12
(A) on, or nominated for inclusion on, the 13
list of National Historic Landmarks; and 14
(B) subject to part 5.3 of the Vessel Gen-15
eral Permit. 16
