Mission Statement Is There Such a Thing as a Stupid Question? First of all WELCOME BACK! That’s kind of a misnomer since most of us never left. However, people still ask, “How did you like your summer off?” Then in your way you explain to that person that you are a School Business Official and that you don’t get your summers off. You feel compelled to explain all that goes on during the summer in order for a successful start of a new school year. Then the person states, “Wow, I really didn’t realize the complexity.” It’s not a stupid question but rather an opportunity to share and educate. In our careers we come across a lot of so called stupid questions. But when we really think about it, are they really that bad? All the questions really come from a lack of understanding, lack of information or igno- rance. Lately, with all the legislative changes dealing with teacher evalu- ations, new compensation models, teacher contracts, reporting unused buildings, the Healthy Hunger Free Kids Act, Indoor Air Quality, Internet Safety Policies and so much more; we are the ones finding ourselves ask- ing the questions. Where do you turn to get answers to your questions, without feeling like an idiot? I hope you answered IASBO. I frequently answer and ask questions from many of my IASBO colleagues. I am always put at ease and never feel uncomfortable asking a question because I know that IASBO members are always eager to help a fellow member. At times an answer to a question may not seem readily available, however, in the end the depth of IASBO’s networking framework and experience comes through with a solution. I encourage all members to ask and get your questions answered by taking advantage of your IASBO membership. Is There Such a Thing as a Stupid Question?

First of all WELCOME BACK! That’s kind of a misnomer since most of us never left. However, people still ask, “How did you like your summer off?” Then in your way you explain to that person that you are a School Business Official and that you don’t get your summers off. You feel compelled to explain all that goes on during the summer in order for a successful start of a new school year. Then the person states, “Wow, I really didn’t realize the complexity.” It’s not a stupid question but rather an opportunity to share and educate.

In our careers we come across a lot of so called stupid questions. But when we really think about it, are they really that bad? All the questions really come from a lack of understanding, lack of information or igno-rance. Lately, with all the legislative changes dealing with teacher evalu-ations, new compensation models, teacher contracts, reporting unused buildings, the Healthy Hunger Free Kids Act, Indoor Air Quality, Internet Safety Policies and so much more; we are the ones finding ourselves ask-ing the questions. Where do you turn to get answers to your questions, without feeling like an idiot? I hope you answered IASBO. I frequently answer and ask questions from many of my IASBO colleagues. in all areas of school business from food service, transportation, facilities, human resources, payroll, accounting, technology, budgeting and much more that will be happy to collaborate. In addition, IASBO always has informative professional development seminars on current topics in order to keep the membership up to date.

I did have one question this year that I really had to think about and maybe you could help me with. A parent of a kindergarten student called me quite upset and asked, “Why didn’t someone tell me that there were no seatbelts on the school buses?” I thought to myself, what a stu-pid question. Then after a short reflection, I then explained to the parent that most school buses in Indiana didn’t have seat belts and that they are designed in a compartmentalized way as to prevent student injuries in case of an accident. I also tried explaining that school buses are one of the safest forms of transportation in the country. I thought to myself this really wasn’t a stupid question; obviously this was a person new to public education that wasn’t familiar with school buses. I hoped I had shared information with the parent to answer their question and make them feel more at ease.

Of course you know there is more to the story, because this is public education. Well even though I knew the answer, people don’t always want to listen nor do they always get the answer they want to hear. That is a different topic to probably come in a future newsletter. In this case, of course, the parent wasn’t satisfied and wanted to know who else they could call to complain to that the buses didn’t have seat belts? I explained that they were delving into a National debate and I politely referred them to the Indiana Department of Education.

You would think the story was over at this point. Of course not, this is public education. They decided to call the police department and get their take on why our school buses didn’t have seat belts. The reason I know this is because the police called to ask why our buses didn’t have seat belts, yet another opportunity to share and educate. So you might think the story was now over at this point. Well think again, of course not, this is public education. The parent went on to call the local news media. How do I know this, because the local news station also called wanting to know why our school buses didn’t have seat belts. I saw this as yet another opportunity to inform and educate. Thankfully, they didn’t deem it newsworthy after the explanation.

You can probably guess, I contend there are no stupid questions. I encourage everyone to ask away. Oh, what I didn’t mention earlier or to the parent is that our Director of Transportation chairs the Indiana School Bus Safety Committee. I guess some things are best left unsaid.

As I refl ect on the beginning of a new school year, I know that it is also the beginning of a new season of professional development activities for Indiana ASBO. For years, IASBO has prided itself for providing the best opportunities possible for the members to accomplish the myriad of tasks that face a school business offi cial. Our Professional Development Committee, the fi ve Research Com-mittees and Mark Miller have created an excellent program of seminars for the upcoming year. The full calendar of IASBO events is included with this edition of the InterCom. And, when you add the Certifi cation Program courses, IASBO presents a multitude of activities to keep the membership current and knowledgeable. Having said that, there are some things that you can do personally to make yourself a better leader and co-worker. It is impera-tive that you recognize that you are leaders in your school corporation and in your community. Here are a few areas that will enhance your leadership skills:

*Self Promote

Promote your strengths and accomplishments. Promote your school corporation.

*Do the Right ThingAlways strive to simply do the right thing, rather than to do things right. Never compromise your-self or your school corporation. Your integrity and good judgement are vital to success.

*Take PrideYou must respect your corporation staff, associ-ates, students and business partners. Show respect by taking pride in your work and giving extraordinary effort.

*Develop a Positive AttitudeDevelop an attitude of “If it is to be, it is up to me”. Become involved and take responsibility.

*Be a ReaderYou can learn by reading, whether it is a book or a report on your IPad or smart phone. It gives you access to how experts think and act.

*Stop Making ExcusesExcuses are reasons you did not want to do something. We all do the things we like to do. As professionals, we’ve also got to do the things we don’t like to do. Leaders don’t make excuses; they make things happen.

*Get OrganizedThis automatically helps you become more pro-ductive. Organize your time, fi les, projects and tasks.

*Be Team-OrientedYou need to develop the skills to successfully work with others. Become interdependent. In-terdependence means others will rely on you and you on them. Understand the concept Together Everyone Achieves More.

*Be ConsistentStress the importance of being consistent. Your staff members need to rely on you. If you are inconsistent, you are unreliable.

*Come PreparedYou need to ensure you are fully prepared at meetings/events to answer questions. This means you will automatically be prepared when an op-portunity arises.

*Gain New Skills with TrainingWe must understand that the school business is changing very rapidly. It is imperative that we consistently train our team members and our-selves on the various aspects of school business management. Training must be considered a priority for all staff. As IASBO members move forward to meet

the demands of new legislation and rules, always remember that the staff of Indiana ASBO is ready to assist you as we venture down the new paths for public education.

SEVENTH ANNUAL IASBO FOUNDATION GOLF OUTINGOn Wednesday, September 7, the 7th Annual IASBO Foundation Golf Outing was held at Eagle Creek Golf Club in Indianapolis. Even though is was chilly, windy, misty and a little rainy, all players fi nished and a good time was had by all. Mark Miller referred to the day as a British Open experience with the unusal weather for early September. The most important aspect of the event is that the proceeds from the outing will go to a great cause - scholarships to high school seniors that will be given at the 2012 Annual Meeting. IASBO would like to thank the Foundation Golf Outing Committee for planning another great day and all of the IASBO members who volunteered to help on Wednesday. Thanks to Mark Miller for his leadership as

chair of the golf committee and to Ella Adamson for getting all of the registra-tion materials prepared. As always, a special thanks to Steve Sonntag and Karen Canary for organizing the golf and raffl e prizes.

OCTOBER 6 SEMINAR REGARDING SEA 1 AND SEA 575Indiana ASBO will sponsor a seminar on October 6 at Primo West in Plainfi eld that will provide information on SEA 1, teacher evaluation, and SEA 575, teacher collective bargaining. The title of the seminar is “Evalu-ation Models, Complensation Models, and Collective Bargaining Strategies”. The IASBO Human Resources Research Committee has created a seminar that addresses the major elements of these signifi cant measures from the 2011 General Assembly. Seventh Circuit Court of Appeals DecisionsTitle IX is not an exclusive remedy for gender discrimination in schools and therefore does not preclude suit under 20 U.S.C. §1983.

Following the decision of the U.S. Supreme Court in Fitzgerald v. Barnstable School Committee, the Seventh Circuit Court of Appeals held that a plaintiff could proceed with her gender discrimination claim pursuant to 20 U.S.C. § 1983. Trentadue v. Redmon, 619 F.3d 648 (7th Cir. 2010).

A male instructor in the Junior Reserve Officer Training Corps (JROTC) program at a high school sex-ually abused a female student enrolled in the program. She reported the abuse to her mother, and then to the high school guidance counselor the very next day. The guidance counselor immediately contacted the superin-tendent. When confronted by the superintendent about the allegations, the instructor admitted to the miscon-duct and resigned from the school district.

The victim filed a lawsuit pursuant to 20 U.S.C. § 1983 against the instructor and his supervisor and a claim under Title IX against the school district. She eventually dropped her § 1983 claim against the in-structor. The district court dismissed the claim against the supervisor based on circuit caselaw holding that Title IX displaces § 1983 as a remedy against school officials for sex discrimination in schools. The district court then granted summary judgment in favor of the school district after finding no evidence that school officials knew of the instructor’s misconduct and/or failed to stop it. The victim appealed to the Seventh Circuit Court of Appeals.

Shortly after the appeal was filed, the U.S. Su-preme Court concluded, in Fitzgerald v. Barnstable School Committee, that Title IX did not displace § 1983 claims against school officials because it was not intended to be the exclusive remedy for address-ing gender discrimination in schools. In the opinion of the Court, § 1983 suits based on the Equal Protection Clause remained available to plaintiffs alleging uncon-stitutional gender discrimination in schools. Based on this conclusion, the Seventh Circuit reversed the dis-trict court’s decision with respect to the § 1983 claim. Additionally, in light of the fact that the evidentiary record had been fully developed and that both claims hinged on the same facts, the court proceeded to deter-

mine whether there were any material factual disputes for trial on either of the victim’s claims.

The appellate court first noted that liability under § 1983 required some evidence that the instructor’s supervisor had knowledge of the sexual misconduct and facilitated, approved, condoned, or turned a blind eye to it. Likewise, for the school district to be liable under Title IX for the instructor’s sexual harassment of the student, a school official with authority to institute corrective measures had to have actual knowledge of the misconduct and be deliberately indifferent to it. According to the court, it was undisputed that no administrator or other school official knew about the instructor’s sexual abuse of the student prior to her dis-closure of the inappropriate behavior. Therefore, there could be no liability under either § 1983 or Title IX. The court thus determined summary judgment on both claims was appropriate.

Federal District Court DecisionsSchool corporation that allowed a swim club to use its facilities was not liable for instructor’s clandes-tine filming of female swimmers.

Because a swim club instructor was not acting as an agent of the school corporation when he videotaped female swimmers undressing, the school corporation was not liable for alleged violations of a swimmer’s Fourth Amendment rights or gender discrimination under Title IX. Taflinger v. Hindson, 2011 WL 304699 (S.D.Ind. 2011).

Brian Hindson organized a swim club under the auspices of U.S. Swimming, a nonprofit corporation comprised of coaches and swimmers across the coun-try. The swim club used the pool at Westfield-Wash-ington Schools for practices. As the swim club instruc-tor, Hindson had unrestricted access to the school’s pool and facilities. Unbeknownst to anyone, he had placed a videocamera in a locker that recorded footage of female swimmers changing in the coaches’ office. After the FBI received a report that Hindson had sold a computer on eBay that contained pornographic images, the FBI obtained a search warrant and discovered the video footage of the swimmers changing. One of the swimmers, Traflinger, filed suit against U.S. Swim-

ming and Westfield-Washington Schools. Taflinger specifically alleged that the school corporation violated her Fourth Amendment rights by ignoring the sub-stantial risk that Hindson would exploit his privileges at the school to satisfy his sexual appetite for young women and that the school corporation was liable un-der Title IX for gender discrimination.

The district court dismissed the Fourth Amendment claim after finding that Hindson was not an employee of the school corporation, but instead was a private actor. Since the Fourth Amendment does not apply to searches or seizures performed by private individuals, the court granted summary judgment for the school corporation on this claim.

With respect to the swimmer’s discrimination claim, the court found there was no reasonable evi-dence that the school had actual knowledge of the instructor’s videotaping. In absence of any such knowledge, the school corporation could not be held liable under Title IX. Therefore, the court granted sum-mary judgment in favor of the school corporation on this claim as well.

Indiana Court of Appeals DecisionsSchool corporation was not required to transport nonpublic schools on special routes for the sole benefit of the nonpublic school students.

Finding that Indiana’s law requires a public school corporation to accommodate nonpublic school students on its regular routes and not create special routes or spe-cial buses for their exclusive benefit, the court upheld the school board’s decision to stop transporting non-public school students to the nonpublic school. Roman Catholic Archdiocese of Indianapolis, Inc. v. Metropoli-tan School District of Lawrence Township. 945 N.E.2nd 757 (Ind.App. 2011).

For over 10 years, the M.S.D. of Lawrence Town-ship picked up nonpublic school students from their residences on bus routes ridden by public school stu-dents and transported them to one of three middle schools within the district. From the middle schools, the nonpublic students were transported on shuttle buses directly to one of two nonpublic schools located within the boundaries of the public school district. In 2010, due to a deficit in the transportation budget, the school board initially voted to assess a fee for the transportation

service to the nonpublic schools. The Archdiocese of In-dianapolis filed a petition for injunctive and declaratory relief. The trial court judge determined that the school district had met its statutory obligation to transport nonpublic students on regular routes established by the school district, that the school district had not exceeded its legal authority, and that the school district had not levied a fine or penalty against the nonpublic school students. Therefore, the trial court concluded that, if nonpublic school students wanted the school district to transport them from the district’s middle schools to the nonpublic schools, the students had to pay for the actual transportation costs incurred by the school district. After the court’s decision, the school board voted to termi-nate the shuttle bus service from the middle schools to the nonpublic schools. The school district continued to transport the nonpublic school students from their resi-dence to the three middle schools.

Shortly after the board’s decision to terminate the shuttle service, several parents filed a complaint for declaratory judgment and injunctive relief. A trial court judge determined that the parents’ claims were almost identical to those of the Archdiocese it its lawsuit and therefore concluded they were barred by the doctrine of res judicata. Despite making this determination, the judge went on to address the merits of the parents’ claim and ultimately ruled in favor of the school district. After this decision, the Archdiocese moved to consolidate its appeal of its claim with that of the parents.

The Court of Appeals first noted that there was no dispute between the parties as to the school district’s obligation under IC 20-27-22-1(a) to provide transporta-tion to nonpublic school students who reside on or near its regular school bus routes. The parties’ disagreement was to the nature and extent of the school district’s obli-gations under IC 20-27-11-1(b) to transport the nonpub-lic school students “to and from the nonpublic school or to and from the point on the regular route that is nearest or most easily accessible to the nonpublic school.” In the opinion of the court, this statutory language autho-rized the school district to drop off nonpublic school students at either the nonpublic school or the point on the regular route nearest or most easily accessible to the nonpublic school. “Because the statute expressly con-templates an alternative drop-off point to the nonpublic school, it cannot reasonably be construed as mandat-

ing the school district to deliver the nonpublic school students to the nonpublic schools.”

In support of this conclusion, the Court of Appeals noted its decision in Frame v. South Bend Community School Corporation and two official opinions of the Attorney General. Specifically, the court cited a 1936 opinion wherein the Attorney General concluded that school trustees were only obligated to furnish transpor-tation to nonpublic school students when they could be “accommodated in the school bus already in operation over the regularly established school route in question.” The court also referenced a 1980 opinion wherein the Attorney General concluded that a school corporation is not required to revise a bus route to accommodate parochial school children. According to the Court of Ap-peals, these precedents “reflect Indiana’s goal of ensur-ing public safety and efficient allocation of public funds such that where a school district has already expended transportation resources that can benefit both nonpublic and public school students, nonpublic school students should certainly benefit from the outlay; however, the school district is not required to undertake additional expenses, to revise its existing bus routes, or to other-wise devote its funds such that they accommodate only nonpublic school students in the manner they desire.” The court thus concluded that the statute did not man-date Lawrence Township to provide special school bus routes and free shuttle bus services not already in effect, for the sole benefit of the nonpublic school students.

Public Access Counselor OpinionsSchool board did not violate the Open Door Law by separating into small groups for the purpose of receiving public input.

Because the public does not have the right to speak at public meetings, the Public Access Counselor concluded the school board did not violate the Open Door Law. Formal Complaint 11-FC-75, Public Access Counselor, April 18, 2011.

The East Allen County School Board adopted a policy whereby it receives public input by dividing into three groups that meet in different rooms. An administrator is present with each of the groups and is responsible for taking notes so that the board mem-bers can listen and dialogue with the members of the community. A patron filed a complaint with the Public

Access Counselor (PAC), alleging that this practice violated the Open Door Law (ODL).

The PAC first noted that Indiana law does not re-quire that the public be given the opportunity to speak at school board meetings. The law only requires that meetings of public agencies be open to the public. Thus, the PAC concluded the school board did not violate the ODL by failing to allow public commentary at its regular meetings.

Secondly, the PAC noted that the ODL applies only to meetings wherein a majority of the governing body is gathered for the purpose of taking official action upon public business. In this case, since the small group sessions only included two or three members of the seven board members, the board did not hold a meeting subject to the ODL. However, the PAC cau-tioned the school board to be aware of the serial meet-ings provision of the ODL when having gatherings of less than a majority of the board.

School corporation violated the Access to Public Records Act by refusing to release the superinten-dent’s contract addendum on the basis that it has not been signed by the board president.

Opining that draft or incomplete records are disclos-able records, the Public Access Counselor concluded the school corporation violated the Access to Public Records Act by not releasing the superintendent’s contract addendum because it had not yet been signed by the board president. Formal Complaint 11-FC-87, Public Access Counselor, April 8, 2011.

A patron filed a request with the school corporation for salary information for certain school officials and personnel reports. When the patron did not receive the records, she filed a complaint with the Public Access Counselor (PAC). The superintendent responded to the complaint, maintaining that records responsive to the request had been mailed, with the exception of the superintendent’s contract addendum. That record had not been mailed since it had not yet been signed by the school board president. The PAC noted that this was not a basis for withholding a record since draft or incomplete records are still disclosable. Therefore, the PAC concluded that the school corporation violated the Access to Public Records Act by failing to release the contract addendum.
