* RETROFITTER– a person who services equipment currently using an ODS refrigerant enabling it to operate using a non-ODS refrigerant.

According to subsection 3F (1) of the Montreal Protocol (Substances that Deplete the Ozone Layer) [Amendment] Act (10 of 2011) “a person shall not on or after 1st January, 2002 import any equipment requiring a supply of ozone depleting substances prescribed in the Regulations for its continued operation except if the equipment is to be used for approved medical purposes.”

Subsection 3F (2) of the Act (10 of 2011) further states that “the Comptroller shall detain equipment which is imported contrary to subsection (1) and shall, in the prescribed form, order the person who imported that equipment to have the equipment retrofitted by a licensed retrofitter, at the expense of the person who imported it.”

A copy of the Montreal Protocol (Substances that Deplete the Ozone Layer) [Amendment] Act (10 of 2011) and the Montreal Protocol (Substances that Deplete the Ozone Layer) Regulations can be purchased from the National Printing Corporation.
