Superintendent/President Issue The decennial census marks the time for certain local government entities to redistrict, including community college districts. The COS District is subject to mandatory redistricting pursuant to Education Code 5019.5. If the COS District does not redistrict before March 1, 2022, the county committee on school re-organization is required to redistrict by April 30, 2022. Background California Community College District governing boards are subject to the federal Voting Rights Act and the one person, one vote principle of the Fourteenth Amendment of the U.S. Constitution. The Voting Rights Act prohibits electoral systems that deny or abridge the voting rights of protected racial and language minority groups. The one person, once vote principle requires that governing board member districts be as equal in population as possible and that election systems that are at-large meet the one person, one vote test. In the COS District, the trustees are required to be residents of a particular ward and their districts must meet the requirements of the Voting Rights Act. The COS District completed the redistricting process in 1991/1992, 2001/2002, and 2011/12 without challenge. Process The COS District is working with legal counsel, Nielsen-Merksamer, and demographers to ensure voting rights to protected racial and language minority groups; and that the five wards in the COS District are as equal in population as possible. When the Board of Trustees are satisfied that the best option has been developed, they will forward their approved redistricting option to the County Committee on School District Re-organization (chaired by the County Superintendent of Schools). Recommended Action At the November 8 board meeting, Nielsen-Merksamer and Lapkoff & Gobalet Demographic Research, will present draft maps and invite public testimony.

Issue The decennial census marks the time for certain local government entities to redistrict, including community college districts. Why Are We Doing This?• Every 10 years the federal government conducts the Census,

and each school district must update its trustee areas to reflect the latest population counts, so that they are equal in population.

• Requirement is both statutory, see Education Code § 5019.5(a), and constitutional, see Reynolds v. Sims, 377 U.S. 533 (1964).

• The current trustee areas were adopted in 2011, using 2010 Census data.

Redistricting Process: Key Upcoming Dates

• February 28, 2022: deadline for completion of redistricting process. (Educ. Code § 5019.5)

• January/February 2022: anticipated completion date (to allow ample time for implementation by Elections Offices in Tulare, Fresno, and Kings Counties)

Purpose of This Hearing No. 4

1. Receive a report concerning the draft map prepared by the District’s demographics consultant (“Plan 1 – Minimal Change”);

2. Open a public hearing and invite members of the public to provide feedback on the draft map presented;

3. Close the public hearing when there is no more input from the public; and

4. Board to then provide specific direction to the District’s demographics consultant about any modifications to the draft district map considered tonight and/or regarding any other map(s) the Board would like the demographics consultant to prepare for review and consideration at the next meeting.

Redistricting Process: Anticipated ScheduleAugust 9, 2021 Presentation at Board meeting re redistricting process, basics of legal criteria

governing adjustment of trustee area boundaries and receive public comment.Sept./Oct. 2021 GIS team completes construction of COS database by year 2020 census block.

October 11, 2021 Initial meeting with Board of Trustees to discuss demographics of current trustee areas under new 2021 Census data and receive public comment re criteria and local goals for the 2021 redistricting process.

October 25, 2021 Second meeting with Board of Trustees to discuss demographics of current trustee areas under new 2021 Census data, receive further public comment re criteria and local goals for the 2021 redistricting process, and adopt criteria for developing maps.

November 1, 2021 Draft maps published on redistricting website.NOTE: Any maps from the public also must be received by this date to be considered at the next meeting; maps must be on redistricting website at least seven days prior. (Elec. Code §§ 21508(d)(1)).

November 8, 2021 Public hearing to review draft maps and invite public testimony.

January 10, 2022 Hold final public hearing and Board votes on a final map for adoption.

February 2022 Submit adopted map to County Registrars of Voters.

February 28, 2022 Statutory Deadline for Completion of Redistricting Process (Ed. Code § 5019.5).

November 8, 2022 First Election of COS Board of Trustees under newly adopted districts.
