(a) The Government of Canada launched an online public
consultation from February 17 to March 17, 2014, and held an
in-persan consultation on March 3, 2014, to inform the Govemment's
response to the Supreme Court of Canada's decision in Bedford v.
Attorney General of Canada, which found three prostitution-related
Crimjnal Code offences unconstitutional (bawdy house (section 210),
living on the avails of prostitution (paragraph 212(1 )(j)) and
publicly communicating for the purposes of prostitution (paragraph
213(1 )(c)).
(b) As noted in response to (a), public consultations were held
to inform the Government's response to the Supreme Court of
Canada's decision in Bedford.
(c) The Govemment sought the input of Canadians; the online
consultation was open to the general public.
(d) and (k) The discussion paper and consultation questions.
which were available online, were developed by the Department of
Justice, Crimirial Law Policy Section experts in criminal law,
including cri minai laws related to prostitution, together with the
Department of Justice, Research and Statistics Division experts in
research and survey methodology.
(e) to (h) and(/) to (o) As noted in response to (d), the
Department of Justice, Criminal Law Policy Section experts in
criminallaw, including criminal laws related to prostitution,
participated in the development of the discussion paper and in the
development of the on li ne consultation questions.

(t), (J), (p) and (q) As noted in respon~e to (d), the
Department of Justice, Research and Statistics Division experts in
research and survey methodology participated in the development of
the discussion paper and in the development of the online
consultation questions.
(r) Responses to the online consultation were received in the
[email protected] inbox. A total of 30,072
forms were sent to the inbox.
(s) A total of 856 email responses were sent to the
[email protected] inbox.
(t) Bath email addresses, i.e.,
[email protected] and
[email protected], used the same email inbox
and a total of 856 email responses were sent to the same email
inbox.
(u) and (v) If a response in a language other than English or
French was identified, it was reviewed separately to assess whether
it contained information intended for the prostitution
consultation.
(w) Online responses were limited to 500 words to facilitate
their review. (x) The re was no limit to the length of submissions
sent directly to [email protected] or
[email protected]. Ali respondents had the
option to submit the online form, which was received in the
above-noted email in box, or send their submission directly to
it.
(y) The Government issued a national news release on February
17, 2014 to invite Canadians to participate in an online
consultation on prostitution laws in Canada. The online
consultation received high media coverage in the week th at
followed this announcement. The Department of Justice a Iso posted
notices of the online consultation on its Facebook and Twitter
accounts. These social media messages were shared widely by media
outlets, including sorne posting the link to the on li ne
consultation to their website directly.
On March 3, 2014, the Government issued another news release to
announce to the public that the Department of Justice was holding
an in-person consultation on prostitution with representatives from
a broad cross-section of interest groups. The ongoing online
consultation was again highlighted in this news release.
ln addition, the Minister of Justice posted tweets to remi nd
Canadians of the ongoing consultation w~en there were 1 0 da ys
remaining in the consultation, and aga in on the last day of the
consultation .
. The online consultation on prostitution was also publicized on
the "Consulting With Canadians" website address.
(z) and (a a) to (cc) The on li ne consultation on prostitution
was publicized through traditional and social media outlets only.
The re was no advertising of this consultation, paid or
otherwise.
(dd) to (gg) and (oo) Ali responses were read by Department of
Justice officiais from the Criminal Law Po licy Section and/or the
Research and Statistics Division.
(hh), (il) and (sss) to (www) The individual responses to the
online consultation will not be made available to the public.
UJ) to (nn) Sorne responses were reviewed by members of the
Minister of Justice's office.

(pp) to (xx) The Department's Research and Statisti.cs Division
compiled and analyzed responses to the online consultation. Input
submitted to the on li ne consultation was transferred to a
database for analysis and coding. Analysis was ongoing over the
course of the consultation period using Excel and a statistical
analysis program (SAS}. Th focus of analysis was on the proportions
of yes and no responses (or agreementtdisagreement) to questions 1
, 2 and 4, as weil as the corn mon themes that emerged from
question 3 and any other qualitative re.sponses. A combination of
manual review and qualitative coding using SAS was used to compile
results.
Responses from those who identified themselves as part of
particular groups (NGOs, municipalities, police organizations, sex
trade workers, etc.) were compiled and indexed with roll-ups of key
statistics/themes by group.

included discernible input/feedback on the tapie of prostitution
were analyzed.

considered.
(nnn) The Department of Justice had filters in place that
prevented spam from entering the consultation in box.
(ooo) Respondents cou Id only be identified if they answered
consultation question number 6, which asked respondents to identify
if they were responding on behalf of an organization and to
identify the organization and their role (many individuals not
speaking on behalf of an organization a Iso chose to identify them
selves in this question).
(ppp) and (qqq) Any responses discovered from those who
identified themselves as from outside of Canada were removed from
the sample for analysis, but remained available for
use/reference.

ongoing basis and analysis concluded on April17, 2014.

conducted the prostitution-related consultations that took place in
February and March of 2014.

Territorial criminal justice fora.
Uih) The Government has undertaken the following two studies:
2014 National Justice Survey -The Department of Justice
periodically conducts the National Justice Survey, a national
public opinion research survey th at helps the Department of
Justice gain an understanding of the views, concerns and priorities
of Canadians on important justice-related issues. Tapies for this
year's survey included prostitution and marijuana. As with ali
public opinion research, results are available within 180 da ys of
the last day in the field. .
Review of Research Evaluating Legislative Approaches to
Prostitution - The purpose of this project is to compile an
inventory of the research, including evidence of the benefits and
challenges of the different legislative approaches, specifically
decriminalization, legalization, abolition and prohibition, to
dealing with prostitution, across the globe. The project is being
conducted by a contracter.
(kkkk) The Govemment does not intend to undertake any further
studies at this time.
(/Ill) The Government has consulted numerous studies, including
Canadian Parliamentary reports, Parliamentary reports conducted by
other like-minded jurisdictions, Canadian and international
research reports, evaluations of legal frameworks in other
countries, Canadian and international academie articles and
Canadian and international jurisprudence interpreting prostitution
laws. Mary of these were submitted to the courts as part of the
Bedford case.
(mmmm) The Government will continue to consult studies and
reports listed in response to (1//1) as they become available.

(nnnn) The issue of prostitution and how the criminallaw should
address it raises diverse views. Public consultations were launched
to seek tho se views in order to inform the development of the
Govemment's response to the Supreme Court of Canada's decision in
Bedford.
(oooo) For privacy reasons, it is not Govemment policy to record
IP addresses, although it has the technical capacity to do so.
(pppp) (i) to (v) The IP addresses of each submission were not
gathered, recorded or stored via the online consultation submission
function.
(qqqq) and (rrrr) No submissions were rejected on the basis of
IP address.

en ligne du 17 fvrier au 17 mars 2014, et il a tenu une
consultation en personne le 3 mars 2014, afin d'orienter la rponse
du gouvernement l'arrt Bedford c. Canada (Procureur gnral) de la
Cour suprme du Canada, dans lequel la Cour a dclar
inconstitutionnelles trois infractions relatives la prostitution
prvues au Code criminel (maison de dbauche (article 210), vivre des

public dans le but de se livrer la prostitution (alina 213(1
)c)).
b) Tel qu'indiqu en rponse a), des consultations publiques ont t
tenues pour orienter la rponse du gouvernement l'arrt Bedford de la
Cour suprme du Canada.
c) Le gouvernement a cherch recueillir les observations des
Canadiennes et des Canadiens; la consultation en ligne tait ouverte
au gran,d public.

le cadre de la consultation, qui taient disponibles en ligne, ont t

dans la bote de rception susmentionne, ou d'y envoyer directement

y) Le gouvernement a mis un communiqu de presse national le 17
fvrier 2014 pour inviter les Canadiennes et les Canadiens prendre
part une consultation en ligne sur les lois relatives la
prostitution au Canada. La consultation en ligne a reu une bonne
couverture mdiatique au cours de la semaine qui a suivi cette
annonce. Le ministre de la Justice a galement affich des avis de la
consultation en ligne sur sa page Facebook et dans son compte
Twitter. Ces messages mdiatiques sociaux ont t largement diffuss
par diffrents mdias; notamment, certains d'entre eux ont affich
directement sur leur site Web le lien conduisant la consultation en
ligne.
Le 3 mars 2014, le gouvernement a mis un autre communiqu de
presse pour annoncer la population que le ministre de la Justice
tenait une consultation en personne sur la prostitution avec des
reprsentants d'un large ventail reprsentatif de diffrents groupes
d'intrt. La consultation en ligne alors en cours a encore t
souligne dans un communiqu de presse. En outre, le ministre a
affich des gazouillis pour rappeler aux Canadiennes et aux
Canadiens la consultation en cours alors qu'il restait 10 jours la
priode de consultation, et il a refait la mme chose le dernier jour
de la consultation.
La consultation en ligne sur la prostitution a galement t
annonce sur le site Web Consultations auprs des Canadiens.

prostitution a t faite uniquement par le truchement des mdias
traditionnels et sociaux seulement. Aucune publicit, paye ou non,
n'a t faite de cette consultation.

fonctionnaires de la Section de la politique en matire de droit
pnal et/ou par la Division de la recherche et de la statistique du

Les observations communiques dans Je cadre de la consultation en
ligne ont t transfres une base de donnes aux fins d'analyse et de
codage. L'analyse a t faite tout au long de la priode de
consultation au moyen d'Excel et d'un programme d'analyse
statistique (SAS). L'analyse portait .sur les proportions de
rponses par oui ou par non (ou par en accord 1 en dsaccord ) aux
questions 1, 2 et 4 ainsi que sur les thmes courants qui se
dgageaient de la question 3 et sur toute autre rponse qualitative.
Une combinaison d'examen manuel et de codage qualitatif a t
utilise, au moyen de SAS, pour compiler les rsultats.
Les rponses des personnes qui se sont identifies comme
appartenant des groupes en particulier (ONG, municipalits,
organisations de police, travailleuses ou travailleurs du sexe,
etc.) ont t compiles et indexes au moyen de synthses de
statistiques ou de thmes cls par groupe.

des commentaires ou de la rtro-_information discernables au sujet
de la prostitution ont t analyses.

Le Sondage national sur la justice de 2014- Le ministre de la
Justice mne priodiquement le Sondage national sur la justice, un
sondage de l'opinion publique men l'chelle nationale des fins de
recherche qui aide le ministre comprendre les points de vue, les
proccupations et les priorits des Canadiennes et des Canadiens en
rapport avec des questions relies la justice. Le sondage de cette
anne portait notamment sur la prostitution et sur la marijuana.
Comme dans le cadre de toute recherche sur l'opinion publique, les
rsultats sont disponibles dans les 180 jours suivant la dernire
journe de travail sur le terrain.

Examen de rsultats de recherches valuant diffrentes approches
lgislatives en matire de prostitution -Ce projet vise recenser et
inventorier les.rsultats de recherches, notamment les preuves
d'avantages et : de dfis lis diffrentes approches lgislatives, plus
prcisment la dcriminalisation, la lgalisation, l'abolition et la
prohibition de la prostitution dans diffrents pays dans le monde.
Le projet est ralis par un entrepreneur.
kkkk) Le gouvernement n'a pas l'intention de commander d'autres
tudes ce stade-ci.
Ill!) Le gouvernement a consult de nombreuses tudes, notamment
des rapports parlementaires canadiens, des rapports parlementaires
tablis dans d'autres pays par des gouvernements aux vues
similaires, des rapports de recherche produits au Canada et
l'tranger, des valuations des cadres juridiques dans d'autres pays,
des articles scientifiques canadiens et trangers et des dcisions
judiciaires canadiennes et trangres interprtant les lois sur la
prostitution. Bon nombre de ces documents ont t prsents aux
tribunaux dans l'affaire Bedford.
mmmm) Le gouvernement continuera de consulter les tudes et
rapports numrs en rponse /Ill) mesure qu'ils deviennent
disponibles.
nnnn) La question de la prostitution et de la manire dont le
droit pnal devrait traiter la prostitution suscite des points de
vue divers. Des consultations publiques ont t menes pour recueillir
ces points de vue afin d'orienter l'laboration de la rponse du
gouvernement l'arrt Bedford de la Cour suprme du Canada.
oooo) Pour des raisons lies la protection de la vie prive, le
gouvernement n'a pas pour politique d'enregistrer les adresses IP,
bien qu'il ait la capacit technique de le faire.
pppp) i) v) Les adresses IP de chaque soumission n'ont pas t
recueillies, enregistres ou conserves au moyen de la fonction de
soumission la consultation en ligne.
qqqq) et rrrr) Aucune soumission n'a t rejete sur le fondement
