The purpose of this Program Instruction is to provide information related to the 1990-91 HEAP program and to address some of the changes in the program ·for this year.

Background:

The Federal Government has been providing funding for various low income home energy assistance programs since 1977. Through the 1990 federal fiscal year, the Low Income Home Energy Assistance Act of 1981 funded HEAP (called the Home Energy Assistance Program or HEAP in New York state). The Federal LIHEAP program is expected to be reauthorized with minor changes in 1990.

HEAP is a state supervised, locally administered, direct benefit program. The Department of Social Services is the lead agency for the program. The State Office for the Aging contracts with the NYS Department of Social Services to administer the Non-public Assistance component of HEAP for New York State residents aged 60 and older or disabled, through 57 Area Agencies on Aging.

Funding:

Federal funding for the program has been declining for the past few years. From a high of $260 ni11ion in HEAP funds allocated to NYS in 1985, the program was reduced to $175 million in 1989-90. HEAP may suffer additional federal funding cuts in the 1990-91 program, but it is difficult to predict what impact the current Middle East and deficit situation may have on the program. Therefore, we do not have allocation figures for 1990-91 as yet. This will depend on Congressional action on the reauthorization and the Federal bUdget, and on NYS allocations to each component of the HEAP program.

In earlier years of SOFA's involvement in the HEAP program, over 200,000 applications were approved, resulting in over $42,000,000 in benefits for the elderly. However, funding cuts have resulted in changes in eligibility and benefit levels. In 1989-90, over

148,000 applications were processed by AMs, resulting in over 110,000 elderly or disabled New Yorkers being approved for approximately $23 million in HEAP benefits. Applications approved for NPA elderly were down by about 6% during the last program year due to policy changes, restrictions on eligibility of subsidized housing residents, and a two year freeze on maximum income allowable. In the past three years, Federal cuts have hurt the Non­Public Assistance and weatherization components of the HEAP bUdget the most. The rationale for Federal cuts was that the energy crisis was over, and oil overcharge money could be used for energy needs. However, oil overcharge money is not intended to supplant other federal funding, and the energy crisis is back again. We will keep you informed on the progress of the reauthorization and any changes in the program which result. As soon as final allocations are available, we will inform you of them.

It is expected that the HEAP program will be reauthorized and funded this Fall, and until October 19, HEAP is subj ect to a continuing resolution of Congress. In preparation for the 1990-91 HEAP Program, the New York State Plan for HEAP and State Department of Social Services HEAP regulations contain the following requirements:

start Up, staggered mailings, and shut down:

Staggered mailings of HEAP applications may begin as early as November 1, though the official start of the program is planned for November 15. Shut down is planned for March 29, 1991. No applications may be released before November 1. Applications returned before November 15 should be date stamped no earlier than November 15, the official start-up date. Official notice from SDSS is necessary to start up the program. If there are program changes due to funding, SDSS will notify all certifiers. .

Local Meetings:

AM management and certification staff should meet with LDSS before the end of October to negotiate staggered mailing schedules and other cooperative procedures. In counties where no AM staff attends the SDSS regional training, local DSS is responsible for training and updating AM HEAP staff on their return from SDSS training.

Food Stamp Households Over 60:

A~l households containing Food Stamp recipients - including m1xed households - are now categorically eligible for HEAP Tier I benefits. These households must apply through LDSS.

AAAs that choose to may negotiate with LOSS to handle certification of the Food Stamp population over 60, however, they will not receive any additional administrative funding to cover the cost of so doing. This is a local option. Cover Letters:

SOSS cover letter language must be used on cover letters which accompany AAA outreach mailings. If any language is added or removed, a formal request for a waiver must be made. (See attached sample cover letter.)

Income Eligibility:

Income eligibility ceilings were raised slightly to allow some households which had been eliminated to apply. Tier I eligibility has also been raised to 130% of federal poverty levels, which means many more of the lowest income households will receive Tier I benefits.

Benefit levels for Tier I have gone down because more NPAs are in Tier I in the new matrix.

certifier Responsibilities:

Manuals:

Each certifying AAA is responsible for its errors or omissions in following the HEAP procedures. If an AAA certifies a client in error because procedures were not followed - or if proper procedure is not documented - the OFA will be held responsible by SOSS. We therefore strongly advise that all HEAP staff stUdy the manual carefully before the program starts up and consult the manual, LOSS liaison, and/or their ASR in all unusual circumstances which require interpretation of regulations. Manuals will be available as soon as they are printed. Any changes in the manual will be sent out as insert page updates. Certifiers are responsible for keeping their manuals updated and training staff on any changes.

Date stamps:

All applications must be date stamped as manuals require ­when received, when pended, when certified. Date stamping should begin November 15, on the official start-up day. Application Register logs and monthly reports:

HEAP regulations require that logs are kept listing the case name, date of receipt, type of application, and listing requests for applications from new clients. SOFA's application register log or an approved equivalent should be used for this purpose. These should be accurate, as they may be referred to in legal cases. They are also useful for CAARS reporting purposes. CAARS report imbalances in the past may be due to errors in record keeping which these logs are designed to avoid. CAARS reports for HEAP must begin with the month of November 1990, and are due by the eighth day of each following month (or if the eighth falls on a weekend, due by the following Monday) starting December 10, 1990. Send these reports to the Bureau of operational standards and Systems Development, attention Nancy Gisotti. Use the same forms as last year. (Sample attached~

Letters of Verification:

A letter requesting verification - using the SDSS format ­must go out to pended applicants, and a copy must be on file in the AAA client file. (Sample attached - Attachment II)

Subsidized Housing Residents:

Subsidized housing residents' vendor relationships must be verified. This means AAA certifiers must document that they checked to be sure that each subsidized housing applicant pays for heat - not just electricity or cooking gas. A system must be set up to do so in cooperation with the utility companies if not already in place.

Documentation Retention:

Copies of all documentation sent to LOSS with applications should be kept on file at the AAA. Documentation and other HEAP files are required to be retained for a period of six years under State requirements. (The Federal requirement is for three years, but we are also sUbject to State fiscal and aUditing requirements.)

Low Income form:

Guidelines for when this form is required have been relaxed and the form has been revised. This form indicating that a verification contact was made is required when household members have income below SSI level or have expenses which are more than $100 per month above income. SSI Code A income levels are: 1 person - $472 2 people -$681.50.

Emerqency Grants:

Requirements for emerqency benefit applicants reqardinq neqotiatinq deferred payment aqreements with the utilities have been chanqed. Assets must be spent down to zero to be e1iqib1e for Emerqency HEAP qrants. This does not include burial funds, which are allowable under specific conditions­- see the manual for details. There is no HEAP emerqency money available between October 1 and November 15. Emerqency money is likely to be spent quickly this year due to chanqes in application requirements.

REMINDER: AAA staff ARE NOT TO APPROVE EMERGENCY APPLICATIONS EVER NOR ARE THEY TO SIGN BIDS OR AGREEMENTS FOR INSTALLATIONS OR REPAIRS OF FURNACES, ETC. LOCAL DSS IS THE ONLY CERTIFIER FOR HEAP EMERGENCY APPLICATIONS.

Fuel Funds:

AAAs should assist clients to access any available Fuel Fund monies from utility companies which sponsor them to help out in emergency cases. HEAP coordinators should check with their utilities to determine amounts available and procedures for applying this year.

Senior 10:

Remember that seniors who are at risk should be encouraqed to· identify themselves to their utility companies to assure receipt of senior protections aqainst shut off, etc. There are other associated benefits for seniors throuqh some utility companies which may be attractive.

Training:

Because of funding constraints and space availability, the state Department of Social Services is not inviting all AAA HEAP staff to attend its training meetings this year. However, an AAA staff person can be invited by LDSS to be one of the three allowed to attend trom each county. We recommend that AAA directors contact SDSS Commissioners or HEAP Liaisons to request inclusion in that training. If they are not invited, arrangements should be made for a special training or HEAP update from those who do attend immediately after the SDSS regional training is held. For your information, this year there will be three DSS upstate regional trainings in Albany, Batavia, and syracuse, and individual county training in New York city, Nassau and Suffolk. SDSS informed SOFA that local training of AAA HEAP staff will be the responsibility of the local Departments of Social Services. If you have concerns or questions Which cannot be resolved by review of this program instruction coupled with AAAA, or SDSS, or LDSS training, and supplemented by technical assistance to your HEAP staff from your LDSS HEAP Liaison, contact your Aging services Representative at SOFA.

SOFA staff will be available to present a brief update on the HEAP program to AAA representatives at the AAAA meeting in Albany on November 8. Kathryn Leitch, HEAP/Energy Task Force Chair will notify AAAs about this training.

Under 60 Mail-ins:

For your information, mail-ins may be used for under 60s who applied last year. LDSS will handle this process which is a major change in their certification system.

SS! Code A's - No questionnaire:

S5I Code As who are living at the same address as last year and who previously received HEAP will automatically get a HEAP check mailed to them this year. They do not have to fill out the SSI questionnaire used in the past. Only new SSI Code As will be required to do so. We do not yet know when their checks will go out.

Household composition:

The definition of "household" has changed. Roomer boarders can be distantly related. See the manual for the exact definition.

A specially pUblicized HOTLINE day is planned for November 15 wi th energy as the theme. AAAs may receive more HEAP and weatherization referrals than usual on that day as a result.
