South East Queensland Water (Restructuring) Act 2007 TRANSFER NOTICE
Transfer of certain of Queensland Bulk Water Supply Authority’s land to Brisbane City Council and related matters
1 Land Pursuant to sections 67(1)(b) and (k) of the South East Queensland Water (Restructuring) Act 2007 (Qld), with effect on and from the Effective Date, I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, transfer from the Transferor to the Transferee the freehold interest in, and all of the rights of the Transferor associated with, the part of the lot set out in schedule 1 of the Transfer Statement, and all of the liabilities of the Transferor in respect of that land arising from and after the Effective Date.
2 Direction
Pursuant to section 68 of the South East Queensland Water (Restructuring) Act 2007(Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, direct and require that:
(a) (further assurance) the Transferor and the Transferee each do all such things (including the execution of instruments) necessary, incidental or ancillary, to give effect to this Transfer Notice; and
(b) (Council and board) the board of the Transferor and the Council of the Transferee each do all such things (including the execution of instruments) necessary, incidental or ancillary, to give effect to this Transfer Notice.
3 Definitions In this Transfer Notice:
Effective Date means the end of the day on which this Transfer Notice is published in the gazette.

Transfer Statement means the document entitled “Queensland Bulk Water Supply Authority Transfer Statement”, a copy of which is signed by me for identification purposes on the same day as this Transfer Notice and shall be kept available for inspection at Queensland Treasury Department, Executive Building, 100 George Street, Brisbane.
Transferee means Brisbane City Council, a Water Entity under the South East Queensland Water (Restructuring) Act 2007 (Qld).
Transferor means Queensland Bulk Water Supply Authority established under section 6 of the South East Queensland Water (Restructuring) Act 2007 (Qld).
Unless the context requires otherwise, capitalised words used in this Transfer Notice but not defined in it have the meaning given to them in the South East Queensland Water (Restructuring) Act 2007 (Qld).

South East Queensland Water (Restructuring) Act 2007 TRANSFER NOTICE
Payment of consideration by LinkWater to Brisbane City Council and Brisbane City Council to Seqwater and related matters
1 Negotiation of outstanding amounts
Pursuant to section 68 of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, direct and require that:
(a) (Mt Crosby Mains Rationalisation Project):
(i) Brisbane City Council and LinkWater negotiate in good faith to endeavour to agree, by 18 January 2011, the outstanding amount payable by LinkWater to Brisbane City Council in connection with the Mt Crosby Mains Rationalisation Project;
(ii) Brisbane City Council and LinkWater each provide to the other any information or documentation the other reasonably requires for the purpose of negotiating the amount pursuant to paragraph 1(a)(i);
(iii) if Brisbane City Council and LinkWater are unable to agree an amount pursuant to paragraph 1(a)(i) by 18 January 2011, Brisbane City Council notify the Under Treasurer, by 21 January 2011, of the failure to agree that amount; and
(iv) if Brisbane City Council and LinkWater agree an amount pursuant to paragraph 1(a)(i) by 18 January 2011, Brisbane City Council notify the Under Treasurer, by 21 January 2011, of the agreed amount; and
(b) (Mt Crosby Weir Augmentation Project and Brisbane Aquifer Project):
(i) Brisbane City Council and Seqwater negotiate in good faith to endeavour to agree, by 18 January 2011, the following amounts:
(A) the outstanding amount payable by Brisbane City Council to Seqwater in connection with the Brisbane Aquifer Project; and
(B) the outstanding amount payable by Seqwater to Brisbane City Council in connection with the Mt Crosby Weir Augmentation Project;
(ii) Brisbane City Council and Seqwater each provide to the other any information or documentation the other reasonably requires for the purpose of negotiating the amounts pursuant to paragraph 1(b)(i);
(iii) if Brisbane City Council and Seqwater are unable to agree the amounts pursuant to paragraph 1(b)(i) by 18 January 2011, Seqwater notify the Under Treasurer, by 21 January 2011, of the failure to agree those amounts; and
(iv) if Brisbane City Council and Seqwater agree the amounts pursuant to paragraph 1(b)(i) by 18 January 2011, Seqwater notify the Under Treasurer, by 21 January 2011, of the agreed amounts.

2 Consideration
Pursuant to sections 67(1)(c) and (k) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, provide that:
(a) (payment by LinkWater) LinkWater pay to Brisbane City Council the amount which is the sum of the Brisbane Consideration Amount and the Brisbane Adjustment Amount on the Effective Date; and
(b) (payment by Brisbane City Council) Brisbane City Council pay to Seqwater the amount which is the Seqwater Consideration Amount less the Seqwater Adjustment Amount on the Effective Date.
3 Definitions In this Transfer Notice:
Brisbane Adjustment Amount means the amount (if any) notified by the Under Treasurer to Brisbane City Council and LinkWater as the “Brisbane Adjustment Amount” prior to the Effective Date.
Brisbane Aquifer Project means the measure described as the “Brisbane Aquifer project” in item 2 of Schedule 10B of the Water Regulation 2002 (Qld).
Brisbane Consideration Amount means:
(a) if Brisbane City Council and LinkWater agree an amount pursuant to paragraph 1(a)(i) by 18 January 2011 – the agreed amount as notified by Brisbane City Council to the Under Treasurer pursuant to paragraph1(a)(iv); or
(b) if Brisbane City Council and LinkWater are unable to agree an amount pursuant to paragraph 1(a)(i) by 18 January 2011 – the amount notified by the Under Treasurer to Brisbane City Council and LinkWater as the “Brisbane Consideration Amount” prior to the Effective Date.
Effective Date means 28 January 2011.
LinkWater means the Queensland Bulk Water Transport Authority established under section 6 of the South East Queensland Water (Restructuring) Act 2007(Qld).
Mt Crosby Mains Rationalisation Project means work completed to allow for the future connection of Southern Region Water Pipelines, and for the abandonment and decommissioning of the Lockbar mains.
Mt Crosby Weir Augmentation Project means the preliminary work on the raising of Mt Crosby Weir.
Seqwater means the Queensland Bulk Water Supply Authority established under section 6 of the South East Queensland Water (Restructuring) Act 2007(Qld).
Seqwater Adjustment Amount means the amount (if any) notified by the Under Treasurer to Brisbane City Council and Seqwater as the “Seqwater Adjustment Amount” prior to the Effective Date.
Seqwater Consideration Amount means:

(a) if Brisbane City Council and Seqwater agree the amounts pursuant to paragraph 1(b)(i) by 18 January 2011 – the amount which is the agreed amount referred to in paragraph 1(b)(i)(A) less the agreed amount referred to in paragraph 1(b)(i)(B), each as notified by Seqwater to the Under Treasurer pursuant to paragraph 1(b)(iv); or
(b) if Brisbane City Council and Seqwater are unable to agree the amounts pursuant to paragraph 1(b)(i) by 18 January 2011 – the amount notified by the Under Treasurer to Brisbane City Council and Seqwater as the “Seqwater Consideration Amount” prior to the Effective Date.
Under Treasurer means the chief executive of the Queensland Treasury Department.
Unless the context requires otherwise, capitalised words used in this Transfer Notice but not defined in it have the meaning given to them in the South East Queensland Water (Restructuring) Act 2007 (Qld).

Transfer of certain of Brisbane City Council’s land and instruments to Queensland Bulk Water Transport Authority and related matters
1 Assets, land and instruments Pursuant to sections 67(1)(b), (g) and (k) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, do each of the following with effect on and from the Effective Date:
(a) (freehold land – part of lot) transfer from the Transferor to the Transferee the freehold interest in, and all of the rights of the Transferor associated with, each of the parts of lots set out in schedule 1 of the Transfer Statement, and all of the liabilities of the Transferor in respect of that land arising from and after the Effective Date;
(b) (easements – created in favour of Transferee) provide that the Transferor (as grantor) will be taken to have granted to the Transferee (as grantee) each easement set out in schedule 2, for the purpose set out in schedule 2, on the terms set out in schedule 2, with effect on and from the Effective Date;
(c) (easements – created in favour of Transferor) provide that the Transferee (as grantor) will be taken to have granted to the Transferor (as grantee) each easement set out in schedule 3, for the purpose set out in schedule 3, on the terms set out in schedule 3, with effect on and from the Effective Date;
(d) (easements in gross – as tenants in common in equal shares - existing)transfer from the Transferor to the Transferor and Transferee as tenants in common in equal shares: (i) the benefit of, and all of the rights of the Transferor associated with, the
easements in gross set out in schedule 4 of the Transfer Statement; and (ii) all of the liabilities of the Transferor in respect of those easements arising
from and after the Effective Date; and (e) (access easements – created in favour of Transferor) provide that the
Transferee (as grantor) will be taken to have granted to the Transferor (as grantee) each access easement set out in schedule 5, for the purpose set out in schedule 5, for the benefit of the dominant tenement on the terms set out in schedule 5, with effect on and from the Effective Date.
2 Co-ownership Agreement
(a) Pursuant to section 67(1)(g) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, provide that a Co-ownership Agreement shall be taken to have been made and entered into between the Transferor and the Transferee in respect of the easements in gross set out in schedule 4 of the Transfer Statement with effect on and from the Effective Date and will apply and be in force without the need for the Transferor and the Transferee to sign that document.
(b) Pursuant to section 68 of the South East Queensland Water (Restructuring) Act 2007 (Qld), and without limiting paragraph 2(a) of this Transfer Notice, I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, direct and require that the Transferor and the Transferee perform their respective obligations under the Co-ownership Agreement in respect of each of the easements in gross set out in schedule 4 of the Transfer Statement.

3 Direction
Pursuant to section 68 of the South East Queensland Water (Restructuring) Act 2007(Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, direct and require that:
(a) (further assurance) the Transferor and the Transferee each do all such things (including the execution of instruments) necessary, incidental or ancillary, to give effect to this Transfer Notice;
(b) (Council and board) the Council of the Transferor and the board of the Transferee each do all such things (including the execution of instruments) necessary, incidental or ancillary, to give effect to this Transfer Notice; and
(c) (Indemnity) the Transferor indemnifies the Transferee against any Loss suffered or incurred by the Transferee which relates to acts or omissions of the Transferor, its officers, employees, agents or contractors on the lots in the schedules to the Transfer Statement in the period before the Effective Date. The Transferee indemnifies the Transferor against any Loss suffered or incurred by the Transferor which relates to acts or omissions of the Transferee, its officers, employees, agents or contractors occurring on the lots in schedule 1 of the Transfer Statement from the Effective Date.
4 Definitions In this Transfer Notice:
Co-ownership Agreement means the document entitled “Brisbane City Council Co-ownership Agreement” between the Transferor and the Transferee, a copy of which is signed by me for identification purposes on the same day as this Transfer Notice and shall be kept available for inspection at Queensland Treasury Department, Executive Building, 100 George Street, Brisbane.
Effective Date means the end of the day of 30 November 2010.
Loss includes all actions, proceedings, claims, demands, costs, losses, damages, liabilities, penalties and expenses whatsoever which may be brought against or made on a person, or which that person may pay, sustain, incur or be put to.
Transfer Statement means the document entitled “Brisbane City Council Transfer Statement (QBWTA)”, a copy of which is signed by me for identification purposes on the same day as this Transfer Notice and shall be kept available for inspection at Queensland Treasury Department, Executive Building, 100 George Street, Brisbane.
Transferee means Queensland Bulk Water Transport Authority established under section 6 of the South East Queensland Water (Restructuring) Act 2007 (Qld).
Transferor means Brisbane City Council, a Water Entity under the South East Queensland Water (Restructuring) Act 2007 (Qld).

Transfer of certain of Moreton Bay Regional Council’s assets, land and instruments to Queensland Bulk Water Supply Authority and related matters
1 Assets, land and instruments Pursuant to sections 67(1)(b), (g) and (k) of the South East Queensland Water (Restructuring) Act 2007 (Qld), I, Andrew Fraser, Treasurer and Minister for Employment and Economic Development, do each of the following with effect on and from the Effective Date:
(a) (bulk water asset) transfer from the Transferor to the Transferee the asset set out in schedule 1 of the Transfer Statement, despite the asset being attached to (and otherwise forming part of) land;
(b) (freehold land – whole of lot) transfer from the Transferor to the Transferee the freehold interest in, and all of the rights of the Transferor associated with, the land set out in schedule 2 of the Transfer Statement, and all of the liabilities of the Transferor in respect of that land arising from and after the Effective Date;
(c) (freehold land – part of lot) transfer from the Transferor to the Transferee the freehold interest in, and all of the rights of the Transferor associated with, each of the parts of lots set out in schedule 3 of the Transfer Statement, and all of the liabilities of the Transferor in respect of that land arising from and after the Effective Date; and
(d) (easement in gross – existing) transfer from the Transferor to the Transferee the benefit of, and all the rights of the Transferor associated with, the easement in gross set out in schedule 4 of the Transfer Statement, and all of the liabilities of the Transferor in respect of that easement arising from and after the Effective Date.

CORPORATION WIDE BAY WATER CORPORATION
Notice is given pursuant to Section 617 of the LocalGovernment Act 1993 , that on 27 January, 2010, the FraserCoast Regional Council adopted the following resolution:-
That:
(a) the assets and liabilities of the business of Fraser CoastWater be transferred to the local government ownedcorporation Wide Bay Water Corporation at 30 June 2009book value of $153,674,131 as per the audited accountsof Fraser Coast Regional Council;
(b) the consideration for the transfer of the assets andliabilities be the issue by Wide Bay Water Corporation toFraser Coast Regional Council of fully paid ordinary sharesto the equivalent value of the net amount of the assets andliabilities being $153,674,131;
(c) Council approve the transfer of 2009/10 Fraser CoastWater Budget funds as outlined in the report; and
(d) Council delegate the Chief Executive Officer to approve thetransfer of any additional assets that may be identified onthe same basis as (a) and (b) above.
The resolution will take effect from 27 January, 2010.

Adoption of Temporary Local Planning Instrument No.1 (Infrastructure Charges and Contributions) 2010
Notice is given under the Sustainable Planning Act 2009 , StatutoryGuideline 02/09 Making or amending a local planning instrumentthat Gold Coast City Council adopted the Temporary Local PlanningInstrument No. 1 (Infrastructure Charges and Contributions) 2010on 8 November 2010. The temporary local planning instrument willhave effect on and from 17 November 2010. It ceases effect at closeof business on 1 March 2011 unless the Department ofInfrastructure and Planning receives an application to amend thecurrent Priority Infrastructure Plan. The purpose and general effectof the instrument are to continue the stimulus effect to the GoldCoast economy and to suspend various sections of the Gold CoastPlanning Scheme, so that infrastructure charges will be calculatedbased on proposed application demand rather than planneddemand for Transport, Stormwater and Recreation Facilitiesnetworks. The suspension applies to various sections of the PriorityInfrastructure Plan, contained in Part 8 of the Planning Scheme.
