Passengers in a Siyaya taxi all escapedunharmed from the the flames as thevehicle caught alight next to the petrolpump at the Excel filling station next toAutozone in Burgersfort last weekSaturday.

In their struggle to escape the burningvehicle, some cooking oil from grocery bagsspilled on the driveway, also caughtingalight, following the panicked passengers.No one was injured, but evereone had aterrible fright.

Pump attentands were quickly at hand

with fire extinguishers to put out theflames, but it proved to be overwhelming.Mr Hennie Howard of Protea Towing sawthe smoke and burning vehicle from therobot, rushed to the scene on the wrongside of the wall, quickly hooked theburning vehicle and pulled it away fromthe petrol pump.

No fire hoses were immediately at handand he called the Fire Brigade who alsorushed to the scene to quench the flames.

When Platinum Gazette arrived, mostof the danger was over.

The Bengwenyama community near Burgersfort are anxiously awaiting thejudgement of the Constitutional Court after they took Genorah Resources, NkwePlatinum’s controlling shareholder, and the Minister of Minerals and Energy andothers to task over prospecting rights on their communal land.

The case is one of many legal battles, in different courts, involving miningcompanies and rural communities living on top of potentially lucrative mines. Thisis a landmark as it is the first court case to have reached the Constitutional Court.

The community has lived on the land for more than a century and the LandClaims Commission recognised its ownership after it was dispossessed of the landduring apartheid and to make room for another mine. Genorah, has twice beeninterdicted from continuing with prospecting. In court papers community membersdescribed how, because of the prospecting, their grave sites were under threat,they had lost access to fresh drinking water and could not sleep due to the noiseand dust from 24-hour drilling.

The Community resides on communal land known as Eerstegeluk andNooitverwacht. The first respondent, Genorah was awarded prospecting rights onthe communal land as well as on three other properties under the provisions of theAct. The Community challenged the award on review in the North Gauteng HighCourt on various grounds but the application for review was dismissed. An appealto the Supreme Court of Appeal was also dismissed on the grounds that theCommunity had failed to bring the application for review timeously in terms of theprovisions of the Promotion of Administrative Justice Act 3 of 2000. The SupremeCourt of Appeal accordingly did not adjudicate on the substantive merits of theCommunity’s grounds of review. The Community contends that the Supreme Courtof Appeal erred in this approach and that the application was brought in time. Itargues that the review should succeed because the Community should have beenawarded a preferent right to prospect in terms of s 104 of the Act; that the awardto Genorah was defective because of irregularities in the required consultationprocess, lack of compliance with environmental requirements and unfairprocedures.

Genorah contends that the Community never applied for a prospecting right interms of s 104 of the Act and that it now seeks to clothe its application in thoseterms in order to gain an advantage it is not entitled to. Genorah also disputes thatthere was anything irregular or untoward in the process and award to it of theprospecting right under the Act.

Counsel for the community, Gilbert Marcus SC, said that, in terms of theMineral and Petroleum Resources Development Act, Genorah had to consult withthe community before a right was granted. He said this meant “real andmeaningful” interaction. Instead, the consultation by Genorah was a “caricature”.Genorah argued that the requirement of consultation did not mean the communityhad to agree and insisted there was interaction between the two.

The company’s counsel, Bruce Leech, said that there “was never going to beagreement” because the community had set up its own company, BengwenyamaMinerals, whose shareholding comprised 35% of the community and which alsointended to apply for prospecting rights. He said the community was not objectingto the harmful effects of the prospecting, but to who did it.

Mr Leech said that, in law, Bengwenyama Minerals was just another company.When both applied for a prospecting licence the principle in the act was first come,first served. Genorah got there first, Mr Leech said.

Genorah’s main argument was that the community was too late to go to court, apoint the high court and Supreme Court of Appeal had agreed with. In terms of thePromotion of Administrative Justice Act, an objection had to be lodged within 180days. Bengwenyama Minerals waited more than a year and as a result lost theircase in that court. Mr Marcus said the delay was due to the community trying toargue its case internally, by appealing first to the Minister.

Road chaos: slipthrough the wallRoadworks on Kastania Street disruptedtraffic on a large scale on Thursday morning.The road between the Ohrigstad turn-off up toBurgersfort Toyota was closed.This was done to finish cable work for therobots that will be installed at the new roadleading towards the new civic centre. Withoutwarning to take an alternative road the streetwas closed forcing many drivers to drivethrough the Twin City parking area.

Many motorists who were previously angered byvehicles taking a shortcut through the pedestriancrossings through the wall, were now forced to takethe same route to avoid a major traffic jam.Vehicles were using one lane of the one-way of theR37 to get past the road blocks. Traffic was alsoheavy and slow in Morone Street and Kruis Street.While this chaos was unfolding the traffic officerswas standing further down the road trappingmotorists for speed.

A stretch of EddieSedibe Street wasalso closed forrepairs on the roadsurface.

Going through thehole in the wall...motorists weretaking this route toget through thechaos caused byroadworks.

The roadworks on Kastania Streetcaused more disruption to Burgersfort’straffic flow than the attempted townclosure by the PAC on 27 August 2010.On Monday people were greeted withburning tyres as they tried to leave townon their way to work.Days before businesses were notifiedwith a memo addressed to “All Resi-dents, Villages, Townships, sub-barbs(sic), Scholars, Workers, First classcitizens and managers in all theirdisciplines within their various institu-tions” that the PAC in the TubatseRegion will attempt the ‘PermanentClosure of Burgersfort Town/City’.

Town closure quickly ‘put out’The memo explained that they will try toadvance the struggle of the communitieswho have been waiting for years forservice delivery. They also expressedtheir dissatisfaction with the waybusinesses and large companies deliveron their social responsibility obligations.The burning tyres was relatively quicklyput out by the Fire Department.Damage to the tar surface of the road canstill be seen in places. The remains of theburnt tyres are also visible next to theroad.The rest of the day and week continuedwithout any further attempt to disrupttraffic or normal business.

Stolen property recovered,suspect arrested

On Thursday 23 September the LeboengSAPS arrested a 38-year old suspect atCloser Settlement (new stands).The SAPS received a tip-off that the manwas involved in housebreakings at RDPhouses in the area.When they approached his house, he fledtowards the mountain. Communitymembers assisted the police who chasedafter him and arrested him.The SAPS searched the man’s house andfound various stolen items includingclothing, bedding, cosmetics, groceries,cellphones and home appliances. It issuspected that the goods were taken from

houses in the same area.The man was charged with housebreakingand theft, possession of stolen property andresisting arrest.He appeared in the Leboeng Magistrate’sCourt but was not granted bail. He willappear in court again on 5 October 2010.The SAPS has asked community membersto come and identify the recovered items.“We also appeal to members of thecommunity to report a case whensomething happens and not to wait for theproperty to be recovered first before layinga charge” said Const. Hlungwane of theLeboeng SAPS.

Ferrochrome producerSamancor Chrome wasevaluating potentiallygenerating 45 MWh ofelectricity from its threesmelting operations, groupenvironment managerHeather Booysen saidrecently.

She told delegates at acogeneration conference inJohannesburg that theproducer was looking atgenerating power from thewaste gas emitted by closedfurnaces at its Ferrometalsoperation, in Emalahleni(Witbank), the MiddelburgFerrochrome operation andthe Tubatse ferrochromesmelter, in Steelpoort.

It had two closedfurnaces at the Ferrometalsoperation and three closedfurnaces at the MiddelburgFerrochrome operation. Thegroup was also planning toput one closed furnace inplace at the Tubatse smelterat a later stage.

The power would be fedback into the group’ssmelters to reduceSamancor’s overall energyuse and the future impact ofrising electricity tariffs.

Further, with possiblefuture carbon taxes, whichcould be implemented assoon as February next year,she said she expected theproject to assist the group inreducing its carbon dioxide(CO2) emissions.

She said that indicationswere that these carbon taxescould start at about R100/tof CO2 and eventually rampup to as much as R750/t ofCO2.

Booysen said thatfeasibility studies for theproposed project havealready been completed, butenvironmental impactassessments still had to beundertaken, which could bea lengthy process.

Samancorstudies co-generationat smelters

Nkwe Platinum, currently listed inAustralia, which plans to also list on theJSE early next year, expects diversifiedminer Xstrata to make an investmentdecision on the Garatau project nearBurgersfort later this year.

Speaking at the last day of the AfricaDownunder conference in Perth recently,Nkwe Mananging Director, MarediMphahlele also said that it would bereleasing the results of the Garataufeasibility study within the next month.

Mphahlele said that Xstrata held theoption to acquire a 50% equity in the 14-million platinum group metals (PGM)ounce Garatau project by fully funding thedevelopment cost of the project.

The current capital expenditure on theGaratau development is estimated atbetween R6-billion and R8-billion. IfXstrata decided to exercise its option to

earn a 50% stake in Garatau, it would alsobe entitled to fund up to 50% of the largerTubatse project (see article on page two ofthis week’s newspaper).

However, Mphahlele said that ifXstrata decided against the developmentof the Garatau project, Nkwe would lookfor alternative strategic partners.

“In case they don’t make a positivedecision, the prospect is very large andvery robust,” he told delegates.

Once an investment decision has beenmade, the mine development would takebetween 18 and 24 months, with the firstproduction expected either in the fourthquarter of 2012, or the first quarter of2013.The mine would produce aroundthree-million tons of ore a year, deliveringaround 400 000 oz of PGMs. Mphahleleadded that the feasibility study on theTubatse project would also start in 2011.

Nkwe saysXstrata to decideon Garatau soon

Integrated iron-ore and vanadiumminer and steelmaker EvrazHighveld is working with theDepartment of Mineral Resources(DMR) to convert its old-ordermining right to a new-order right.

“We’re working closely with theDMR at the moment to try andconclude that. We think we’ve doneall the groundwork,” EvrazHighveld CEO Scott MacDonaldsaid recently.

Evraz Highveld – which has aR540-million black economicempowerment (BEE) transactionwith BEE investment holdingcompany Umnotho weSizwe, as wellas the local community linkedMapochs Mine Community Trust –owns and operates the Mapochsmine, which produces lumpytitaniferous vanadium-bearingmagnetite iron-ore that is suppliedexclusively to the company’ssteelworks; and fines ore that isused for the production of a varietyof vanadium products.

Mapochs Mine Pty Limited,which was created as a specialpurpose vehicle, is the empoweredcomponent.

Umnotho weSizwe, which alsohas interests in platinum, diamond,coal, chrome and the oil and gassectors, has 23% of Mapochs MinePty Limited, and Mapochs MineCommunity Trust the remaining3%.

A transfer in terms of Section 11of the Mineral and PetroleumResources Development Act iswaited.

“We first have to get the miningright converted and approved, andthen the Section 11 transfer willfollow,” Evraz Highveld executiveCathie Lewis said. The company,which is currently carrying out adetailed mine plan on Mapochs,believes that the mine has sufficientiron-ore for 30 years, 14 years ofwhich will be on surface. The seamextends for 200 km.

“Mining is a key part of thebusiness because, in effect, we’revertically integrated, and having aniron-ore mine is a major advantage,”said MacDonald. In addition to thelong-life Mapoch, exploration is alsounder way at the Uitvlug iron-oreprospect in the area, where thereare also several other iron-oreprospects.

Evrazworkingon rights

Hawkers in Burgersfort say they are on track with the Gtreater Municipality’s plans to havethem registered and to have permits issued to hawkers to do business. According to theBurgersfort Hawkers Cluster, the committee will meet with the municipality next week,while a mass meeting for all hawkers is planned for 13 October, whereafter the permits willprobably be issued. Meanwhile, Mr Jackson Tjatji, who is not a member of this structure,but addressed a large group of hawkers a few weeks ago, said everything is quiet at themoment, and as far as he could determine, corrupt individuals who sold the right to hawkin Burgersfort, stopped their activities.

Survivingthe fire

A fire at two-year old EmmanuelMmola’s home at Mokutung Village nearEcho Caves left him with variousinjuries. The fire happened on 17 August2010.The fire came at a time when health careworkers were on strike. He was firsttreated at Matibidi Hospital, but waslater transfered to Dilokong hospital.There he remains while doctors arestruggling to the internal damage hesuffered to a level where he can be caredfor at home.The fire destroyed everything in theroom Emmanuel was sleeping in exceptthe Bible (photo) that was with him inthe room.

Are the GTM staff now betterVarious departments of the GreaterTubatse Municipality (GTM) has alreadymoved into the new civic centre at the backof the Morone Shopping Centre.This building, situated in Kastania Street(which is still under construction) will behome to departments that was previouslyscattered all over town.The building will be the first in Burgersfortwith a lift and was designed to be disabilityfriendly. The public will next week also beable to get a first hand view of the newcouncil chambers when council will have ameeting there on 5 October.The building was fitted with state of theart furniture and other equipment.Currently the datalines are still beinginstalled and by the time of going to pressthe telephone lines was being sorted out.This means that all payments must still bedone at the old buildings on the corner ofKort and Eddie Sedibe Streets.We asked readers if they think that theofficials who will occupy this building willnow be better equipped to do their workand make good on governments promise ofservice delivery? Ms Muriel Mohlala said: “I do think they willimprove on service delivery. They aremoving to a bigger building and will bebetter equipped. Water is important. Theymust start there and then electricity”

Ms Sina Nare said: “Ja, they are gonnadeliver a good service. Maybe noweveryone will have his own office. Waterand electricity to the communities is stilla problem and they have to provide RDPhouses to the needy. The road toPraktiseer is also full of potholes. Theymust fix it”.

Ms Gladys Mokansi said: “They willchange because the place is nice. Wewant water first then electricity”.

Mr Kuziva Nyamurowa said: “Of course itwill be better. Now it will not only be filesand papers. Very good service will nowbe given. Water is life, the rest will comeafter that”.

Maatlopo’spride atstakeMaatlopo United Football Club faced Real Touch on 24September at Ntoampe Sports Ground. This clash was thefirst of various rounds played on the day in the NedbankCup.Maatlopo United FC won this game 2-1 and went on toplay against Tubatse United FC in the afternoon. Althoughthe game started late, the players’ enthusiasm did notwane. This was a tough game, but it ended in favour ifMaatlopo United FC with a 4-3 score.The team will now play against Material Black Chiefs FCon a still undetermined date to decide which team willrepresent the Sekhukhune district in the regional play-offsfor Limpopo province.On 26 September Maatlopo United FC played a leaguegame at Ntoampe Stadium, Moroke. They beat Real Touch3-2 to collect maximum points on the log.Barecho Tsokolibana was the star of the game.The next league game is against Tubatse United atPraktiseer on Saturday 2 October. The game is scheduledto start at 15:00.“We want to prove to Tubatse United that we are theChamps of the Sekhukhune region by beating them intheir own backyard,’ said Mr Jimmy Makola, spokespersonof the Maatlopo United team. He also encouraged all theirsupporters to come to the game and cheer them on. Theyare organising transport to the game from Moroke toPraktiseer. The cost will be R40 per person. Riders of Kitima Arab Stud participated in the 80km CapricornEndurance Race 2010. The competition was held at Polokwaneand stretched over two days. This year it was from 24 to 25September.During such an endurance race both rider and animal is testedto the limit, but good care is always taken that the animalsremain in a healthy condition.Along the way veterinarians give the animals a check-up toensure that they are fit to continue on the next stretch. Theriders have to cool their animals down and their temperaturehave to be at a certain level before they get the green light tocontinue. Especially in the heat both rider and animal are testedand all the participants are monitored closely. This means that arider may arrive first at the finishing point, but if he or she failsto cool their animal down to a target point or if the animal is notgiven a green light by the veterinarian, they may not be first inthe competition.The riders participate in various categories according to weight.The children are in a separate category.Alta Kriegler, owner of Kitima Arab Stud came second in thelightweight category. Stephanie Spray was third in the standardweight category and Micaela van der Merwe was first in thechildren’s category. She was also the children’s rider with thebest time. She and her horse came in with a time of 4 hours and40 minutes over the two days. She also received a prize for thebest prepared horse in the competition.Kitima Arab Stud is outside Burgersfort on the R555 towardsSteelpoort.
