New law on Housing and Business Regulation:a Welcome Change or further regulation? words | Wendy Lambert, Partner, Head of Property, Mourant Ozannes Jersey

comment:

the draft Control of housing and Work (Jersey) law 201- (the “new law”) is due to be debated by the states in early July. here is my analysis of certain key aspects of this proposed law.

The Welcome ChangesOne Law only: the New Law replaces both the existing Housing (Jersey) Law 1949 and the Regulation of Undertak-ings (Jersey) Law 1973. That is a good thing in my view as the Housing Law has been changed so many times over the years that it is now unwieldy and difficult to understand, while the Regulation of Undertakings Law is so vague, it is often difficult to say whether a business needs a licence, without seeking guidance from the Population Office or searching through a myriad of policy documents. For new business applications the two laws have been merged in practice by the regulatory authorities for many years - you apply to the same office (just different officers) for a Regulation of Undertakings licence for the business and for a J Category Housing consent for your new senior employee.

Essential Employees and Housing: the New Law introduces some welcome changes to the procedures around buy-ing and renting property for essential employees (currently “J category” and “Licensed” under the New Law). Under the current law, an essential employee can’t rent or buy in their own name, they have to rent through their employer and buy in the name of a company they incorporate and continue to own until they gain Housing qualifications after 10 years residence - then the property has to be transferred into their own name. All of this cumbersome procedure is being abolished by the New Law, a Licensed person will be able to buy or rent directly in their own name.

Regulation of Undertakings: the New Law removes the current requirement for businesses to have to apply to the Population Office to employ individuals

with at least 5 years or more continuous residence in the Island. In future consent will only be required to employ individu-als with less than 5 years residence.

Housing consents for Property trans-actions: except for transactions by companies and certain other bodies, the New Law abolishes the need to apply for the consent of the Housing Minister for all purchases and leases. On each property transaction the purchaser will just produce to their lawyer a valid reg-istration card confirming their Housing qualifications (they may need to have it validated by the Population Office in certain circumstances).

Further RegulationEnforcement: the New Law does grant to the regulators strong enforcement powers which don’t currently exist in relation to Business Licences (the New Law term for a Regulation of Undertak-ings Licence). This includes the power to revoke a licence in the event that the business does not operate in the man-ner envisaged in the application for the licence. These powers are no stronger than in place for financial service busi-nesses now under the Financial Services (Jersey) Law 1998 but one could argue that there is an element of duplication of regulation for these businesses because they are already closely regulated by the financial services regulator.

Change of Control: Under current policy, all new businesses established since about 2000 have had a “change of control” restriction on the business, that is to say they must seek the consent of the regulator to any change in ownership. Many businesses which existed before that time, do not have this restriction on their licence. The New Law puts all businesses on an equal footing and cre-ates a specific (and quite complicated) set of rules for change of control. The basic principle behind the rules is that if a business is locally owned, it won’t need consent to sell provided that the local ownership doesn’t fall below 60%. Non-locally owned businesses will need consent for the first onward sale but not

thereafter. The regulators believe that this new system gives businesses more freedom as regards ownership changes, not less.Businesses prior to 1973: A business which operated before 1973 (when the Regulation of Undertakings Law came into force) won’t necessarily have a writ-ten Regulation of Undertakings licence. In 1973 businesses were deemed to have the licence without the need to ob-tain it in writing. That won’t be the case when the New Law comes into force as those businesses will need to apply for a written licence, which will hopefully be issued as a formality.

ConclusionThe proposed New Law does have cer-tain positive aspects both for individuals and businesses alike. There are, however, some cumbersome regulatory aspects being implemented and furthermore busi-nesses will need to be careful on change of control. The devil will be in the detail and how, in practice, the Population Of-fice implements the New Law.

An ideal solution is a property like La Maison Brulée. Set in the St John countryside, it’s an original granite barn that has been renovated and extended over the years to become a well-designed multi-generational home. Property agent, Christine Mauger from Choice Properties says “it’s a substantial residence, set deep in the St John countryside, with plenty of space as well as privacy. It’s ideal for a growing or extended family and could easily accommodate two or three generations”.

Originally part of a larger farm estate, the oldest part of the house dates back to the mid-nineteenth century. After a large fire, the barn was one of the only places left standing, so it was rebuilt as a house and named ‘La Maison Brulée’ (the burnt house) to reflect the area’s history. Today, that original granite barn forms the main reception area, with the newer part of the house extending around a central inner courtyard with a

swimming pool and hot tub. La Maison Brulée is set away from the road with its own private drive that opens out to a large parking area with space for a dozen cars. Walk through the front door into the spacious entrance hall, and the house opens out with access to each of the ‘wings’. Just off the entrance hall is the original part of the house, used as the reception room, and with its granite walls, double height ceiling, minstrel gallery and huge arch-shaped picture window, it’s certainly impressive. There’s a separate ‘snug’ at the end of the living room with cosy sofas and a Victorian fireplace, ideal for retreating to and watching a film.

It’s a house built for entertaining, with a bay-windowed formal dining room next to the kitchen for dinner parties, and a huge recently renovated billiard room and relaxed lounge area to retire to after supper. Folding doors open out from the lounge to the inner courtyard and the pool area, and as well as a fully fitted out

library, there are stairs leading up to two bright guest bedrooms with their own bathroom. It’s an ideal guest suite for a visiting family, and feels independent from the rest of the house, with its own access to the inner courtyard.

The kitchen is literally the centre of the home at La Maison Brulée, with doors opening out onto a conservatory bridging the courtyard and blending the division between the home’s indoor and outdoor courtyard space. It’s a relaxed and bright family area, with a large table for informal family meals set in the centre of the conservatory. Inside, the kitchen is fully equipped for the most extensive of entertaining, with a Neff double oven and a Belling range with gas hob and electric oven. There’s a wine cellar down a few stairs, and plenty of fridges. The kitchen’s been cleverly designed with a slightly set apart additional kitchen area that’s ideal for separate food or drinks preparation.

The kitchen leads to what has been used as the children’s wing with a downstairs playroom or games room and separate shower room. It’s an ideal space for the younger members of the family to relax, with the kitchen next door for mid-game snacks, and as a playroom for younger children, it’s safe and secure and right in the centre of the house. Stairs lead from the playroom up to the three smaller children’s bedrooms with their own house bathroom. The children’s wing can also be accessed from the master bedroom, making it ideal for younger children.

The main bedrooms of the house are accessed from a staircase from the main reception room. There is a guest suite at each end of the minstrel gallery, both featuring large rooms with plenty of light flooding in from roof windows on either side. The guest suites have plenty of storage as well as featuring beautiful spa-style bathrooms with exceptional attention to detail.

The master bedroom is a stunning room, right in the centre of the house and overlooking the inner courtyard. With windows on both sides, this is a light and airy large room, with its own walk-in wardrobe. The ensuite contemporary bathroom is equally well proportioned with a freestanding bath set under the window, a walk-in double shower and double sinks.

Outside is the swimming pool, sheltered in the inner courtyard, and a hot tub. There are a range of garages and workshops in the courtyard, as well as a pool changing room. The gardens run around the property and include landscaped gardens, extensive patio areas - perfect for outside parties, as well as a Victorian-style walled kitchen garden with raised beds planted with fruit trees and vegetables.

Thinking of Buying a New Build?this issue of places is highlighting new build homes, so here are a few pointers when looking to purchase.

There are currently quite a few new build homes available to purchase in Jersey. These range from new build apartments to luxury detached homes.

To a lot of people the benefits of buying new build out weigh wpurchasing a pre–owned home.

To them, there is something appealing about purchasing a home that no one has lived in before, a ‘blank canvas’ that they can decorate easily. They have confidence in knowing they will be ‘operational’ from the day they move in ( no D.I Y jobs or dubious plumbing to rectify). A warm, energy efficient house, together with en suite facilities and all the latest kitchen appliances, are also major buying attractions.

Should a buyer express their interest in a new build at an early stage, often a developer will give a choice of flooring, tiling and in some cases kitchen units.

It is important to buy from a reputable builder or firm. Ask around, check with your agent which other properties the company have built. One should check that the developer will guarantee to complete any ‘snagging’ issues, say, six months after the sale.

If an offer is made and the sale progresses, the surveyor will double check the building work and build quality. The buyer’s lawyer will check that all the necessary building permits have been ‘signed off’ by the building inspector. It is also less likely with a new build, that there are any onerous caveats, restrictions or boundary issues.

So you see, buying new has many advantages.
